An ordinance amending the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey to rezone Block 18, Lot 16 on the official tax map of the Township of Randolph from the I-1 Industrial District Zone to the B-2 Regional Business District Zone


Zoning Map Revision, Block 18/Lot 16  (232 KB)

WHEREAS, the Municipal Land Use Law (“MLUL”) of the State of New Jersey, N.J.S.A. 40:55D-1 et seq. grants to municipalities the power to adopt a zoning ordinance relating to the nature and extent of the uses of lands, buildings and structures thereon; and

WHEREAS, the Township of Randolph (“Township”) desires to modify its existing Land Development Ordinance by rezoning Block 18, Lot 16 on the Official Tax Map of the Township of Randolph, commonly known as 1046 Route 10 from the I-1 Industrial District Zone to the B-2 Regional Business District Zone to be compatible with the zoning district of property immediately contiguous to it.

NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Randolph, County of Morris, and State of New Jersey as follows:

SECTION 1. The Zoning District for the following properties listed by block, lot and street address shall be changed as follows:

SECTION 2. The Zoning Map of the Township of Randolph, Morris County, New Jersey is hereby amended to reflect the Zoning Map revision set forth in this Ordinance and as set forth in the attached Exhibit A entitled “Zoning Map Revision, Block 18/Lot 16.”

SECTION 3. All ordinances or parts of ordinances in conflict or inconsistent with any part of this Ordinance are hereby repealed to the extent that they are in such conflict or are inconsistent.

SECTION 4. In the event that any section, part or provision of this Ordinance shall be held to be unenforceable or invalid by any court, such holding shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part so held unenforceable or invalid.

SECTION 5. This Ordinance shall take effect 20 days after passage and publication as provided by law.

NOTICE IS HEREBY GIVEN that an Ordinance entitled “An Ordinance Amending the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey to Rezone Block 18, Lot 16 on the Official Tax Map of the Township of Randolph from the I-1 Industrial District Zone to the B-2 Regional Business District Zone” was submitted in writing at a meeting of the Mayor and Township Council of the Township of Randolph, in the County of Morris and State of New Jersey, held on the 3rd day of May, 2007, introduced and read by title and passed on the first reading and that the Governing Body will further consider the same for the second reading and final passage thereof at a meeting to be held on the day of June 7, 2007, at 8:00 p.m. at the Municipal Building, 502 Millbrook Avenue, Randolph New Jersey 07869, at which time and place a public hearing will be held thereon by the Governing Body and all persons and citizens in interest shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to modify the zoning of Block 18, Lot 16 on the Official Tax Map of the Township of the Randolph, commonly known as 1046 Route 10 from the I-1 Industrial District Zone to the B-2 Regional Business District Zone. The request for the zone change was made by the property owner and the modification of the zoning puts this property in the same zone as property contiguous to this property fronting on Route 10.

A copy of the full Ordinance is available to any member of the general public, at no cost, at the Township of Randolph Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
