An ordinance amending Sections 31-91 and 31-111 of Chapter 31, Traffic and Vehicles, of the revised ordinances of the Township of Randolph, Morris County, New Jersey


WHEREAS, pursuant to N.J.S.A.40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and

WHEREAS, the approved site plans for the Gateway Apartments complex depict on-street parking spaces on the private streets within the complex; and

WHEREAS, the owner of the Gateway Apartments has advised of his intent to stripe the on-street parking spaces in accordance with the approved site plan; and

WHEREAS, since Section 31-91(b)(2) of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, prohibits parking on the private streets within the Gateway Apartments complex between 2:00 a.m. and 6:00 a.m., the owner has requested that the Township remove the prohibition on nighttime parking within the complex; and

WHEREAS, the Township of Randolph desires to amend Sections 31-91 and 31-111 of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, to delete the prohibition on parking on the private streets within the Gateway Apartments complex between 2:00 a.m. and 6:00 a.m. except during emergencies.

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:

SECTION ONE. Section 31-91 of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey is hereby deleted in its entirety and replaced by the following:

Sec. 31-91. - Parking between 2:00 a.m. and 6:00 a.m.

  1. Except as provided in subsection (b) of this section, no person shall park any vehicle on the streets of the township between 2:00 a.m. and 6:00 a.m. daily, except as posted.
  2. Approval having been granted pursuant to N.J.S.A. 39:5A-1 for the application of N.J.S.A. 39:1-1 - 39:5F-30 to the properties designated in this subsection, parking is prohibited between 2:00 a.m. and 6:00 a.m. daily, except as posted, on all streets, traffic lanes and entrance drives to the parking lots of the following properties:
    1. Center Grove Village Apartments (Hamiltonian Garden Apartment Complex).
    2. Quaker Village Apartments (Billnan Three Incorporated).
    3. Randolph Village Apartments.

SECTION TWO. Section 31-111 of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey is hereby amended and supplemented by the addition of the following:

  1. Approval having been granted pursuant to N.J.S.A. 39:5A-1 for the application of N.J.S.A. 39:1-1-39:5F-30 to the properties designated in this subsection, parking is prohibited during snow emergencies on all streets, traffic lanes and entrance drives to the parking lots of the following properties:
    1. Gateway Apartments (Center Grove Associates).

SECTION THREE. All Ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION FOUR. If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

SECTION FIVE. This Ordinance shall take effect as provided by law.

ORDINANCE NO. 20-16

Notice is hereby given that an Ordinance entitled “An Ordinance Amending Sections 31-91 and 31-111 Of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County New Jersey” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on June 16, 2016 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on July 28, 2016 at 7 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to amend Sections 31-91 and 31-111 of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, to delete the prohibition on parking on the private streets within the Gateway Apartments complex between 2:00 a.m. and 6:00 a.m. except during emergencies.
