An Ordinance Authorizing the Acceptance of a Dedication of a Portion of Lot 22.03, Block 101 on the Official Tax Map of the Township of Randolph, Morris County, New Jersey from Pulte Homes of NJ, Limited Partnership (Widening of Brookside Road)
WHEREAS, N.J.S.A. 40A:12-4 and 40A:12-5 authorize a municipality, by ordinance, to acquire real property by purchase, gift, devise, lease, exchange, condemnation, or installment purchase agreement; and
WHEREAS, Pulte Homes of NJ, Limited Partnership has conveyed title to property known as a portion of Lot 22.03, Block 101 to the Township of Randolph for right of way purpose (widening of Brookside Road), as more particularly described in a Deed dated October 2, 2017; and
WHEREAS, the right of way dedication set forth therein is pursuant to approvals granted by the Randolph Township Planning Board in its Resolution SP12-13 dated April 11, 2014; and
WHEREAS, the Township desires to accept the dedication to the Township of Randolph of a portion of Lot 22.03, Block 101 as more particularly described in the property description attached as Schedule A to the Deed referenced above.
NOW, THEREFORE, BE IT ORDAINED by the Governing Body of t he Township of Randolph, County of Morris, State of New Jersey, as follows:
SECTION 1. The dedication of a portion of Lot 22.03, Block 101 for right of way as described in certain Deed dated October 2, 2017 by and between Pulte Homes of NJ, Limited Partnership and the Township of Randolph is hereby accepted.
SECTION 2. The Mayor, Township Manager and Township Clerk together with all other officers, professionals and employees of the Township are hereby authorized and directed to take any and all steps necessary to effectuate the purposes of this Ordinance.
SECTION 3. The Township Tax Collector and Tax Assessor are hereby authorized and directed to take any action necessary to further the purpose of this Ordinance.
SECTION 4. All ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.
SECTION 5. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portion of this Ordinance.
SECTION 6. This Ordinance shall take effect immediately upon final passage, approval and publications as provided by law.

Notice is hereby given that an ordinance entitled “An Ordinance authorizing the acceptance of a dedication of a portion of Lot 22.03, Block 101 on the Official Tax Map of the Township of Randolph, Morris County, New Jersey from Pulte Homes of NJ, Limited Partnership (widening of Brookside Road)”, was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, held on January 23, 2020, and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on February 6, 2020 at 5 p.m., prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey, 07869, at which time and place a public hearing will be held thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The ordinance introduced above accepts the dedication by the Township of Randolph of a portion of Lot 22.03, Block 101 from Pulte Homes of NJ, Limited Partnership for purposes of right of way dedication and road widening of Brookside Road and is in accordance with a Resolution of Approval granted by the Randolph Township Planning Board on Resolution SP12-13 adopted on April 11, 2014.
A copy of the full ordinance is available to any member of the general public without cost, as the Randolph Township Municipal Building, Office of the Clerk, between the hours of 9:00 a.m. and 4:00 p.m.
