An Ordinance Making the Provisions of Subtitle One of Title 39 with Various Traffic Regulations Applicable to the Gas Station/Convenience Store (Wawa) on Lots 2 and 5 in Block 137, 358 Route 10 West, and Regulating the Use of Said Roadways, Streets, Driveways and Parking Lots by Motor Vehicles
WHEREAS, municipalities are empowered to make, amend, repeal and enforce ordinances pursuant to N.J.S.A. 40:48-1 et seq; and
WHEREAS, the municipality deems it necessary to regulate traffic within the Wawa site located in the Township of Randolph; and
WHEREAS, Randolph 10 Developers, LLC with offices located at 1195 Route 70, Suite 2000, Lakewood, New Jersey 08701 has filed a written consent with the Township of Randolph that the provisions of Subtitle One of Title 39 of the Revised Statues of New Jersey be made applicable to the semi-public road, streets, driveways and parking lots at Wawa’s located at 358 Route 10 West in the Township of Randolph.
NOW, THEREFORE BE IT ORDAINED by the Township of Council of the Township of Randolph, County of Morris, State of New Jersey that:
SECTION 1: Subtitle One of Title 39 of the revised statues of New Jersey hereby made applicable to the semi-public roads, streets, driveways and parking lots at Wawa site (Block 137, Lots 2 and 5) located at 358 Route 10 West in the Township of Randolph, County of Morris and the following regulations shall be enforceable:
REGULATION(S):
1. General Parking:
All vehicles must park in designated areas and between the lines provided.
2. Handicapped Parking:
All stalls shall be 13 or 16 feet wide as shown on the attached site plan and signed with the R7-8 and R7-8P (Reserved Parking Sign and Penalty Plate), in the designated parking areas for persons who have been issued the Handicapped Parking Permit by the Division of Motor Vehicles.
3. Tow Away Zones:
Any vehicle parked or standing as to obstruct or impede normal flow of traffic, block entrances or exit ways, loading zones, fuel fills, any grassy area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owners or operators expense.
4. Loading Zone(s):
No person shall park a vehicle in the loading zone during the times indicated other than for the loading or unloading of goods and materials.
5. That all signs, posts or other necessary materials shall be installed and paid for by the applicant. All signing shall conform to the current Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
6. Unless another penalty is expressly provided for by New Jersey Statute, every person convicted of a violation of this ordinance or any supplement thereto shall be liable to a penalty of not more than ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.
SECTION 2. All ordinances or parts of ordinances in conflict or inconsistent with any part of this Ordinance are hereby repealed to the extent that they are in such conflict or inconsistent.
SECTION 3. This Ordinance may be renumbered for codification purposes.
SECTION 4. In the event that any section, part or provision of this Ordinance shall be held to be unenforceable or invalid by any court, such holding shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part so held unenforceable or invalid.
SECTION 5: This Ordinance shall take effect immediately upon final passage and publication in accordance to law.

Notice is hereby given that an Ordinance entitled “AN ORDINANCE MAKING THE PROVISIONS OF SUBTITLE ONE OF TITLE 39 WITH VARIOUS TRAFFIC REGULATIONS APPLICABLE TO THE GAS STATION/CONVENIENCE STORE (WAWA) LOCATED AT 358, ROUTE 10 WEST, BLOCK 137, LOTS 2 AND 5 AND REGULATING THE USE OF SAID ROADWAYS, STREETS, DRIVEWAYS AND PARKING LOTS BY MOTOR VEHICLES ” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on February 18, 2021 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on March 4, 2021 at 5 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of the above Ordinance is to regulate traffic within the Wawa site located at 358 Route 10 West on Lots 2 and 5 in Block 137.
A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
