An Ordinance Re-Adopting Article XVII, Wildlife Management Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey


WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and

WHEREAS, the Township of Randolph ("Township") adopted Ordinance No. 16-12 on August 2, 2012, which amended the Revised Ordinances of the Township of Randolph by the addition of Article XVII of Chapter 10, Boards, Commissions, Committees and Agencies, which established the Wildlife Management Advisory Committee; and

WHEREAS, the Wildlife Management Advisory Committee serves as the advisory board to the Township Council on deer control programs and initiatives as well as general advice on wildlife management within the community; and

WHEREAS, Article XVII, Wildlife Management Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph contained an expiration date that was inadvertently not extended by the Township; and

WHEREAS, the Township desires to re-adopt Article XVII, Wildlife Management Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph.

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:

SECTION ONE. Article XVII, Wildlife Management Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph is hereby deleted in its entirety and replaced by the following:

ARTICLE XVII. - WILDLIFE MANAGEMENT ADVISORY COMMITTEE

Sec. 10-340. - Creation.

There is hereby established a wildlife management advisory committee as the advisory board to the township council on deer control programs and initiatives as well as general advice on wildlife management within the community.

Sec. 10-341. - Appointment and term.

(a) The committee shall consist of:

(1) Five general members and one alternate member, all of which are to be appointed by the township council;

(2) One member from the advisory parks committee, which shall be appointed by the advisory parks committee;

(3) One member from the township council, who shall serve as liaison to the township council;

(4) The township manager or his/her designee; and

(5) One student member, who shall be appointed by the township council and shall not take part in voting.

The alternate member shall participate in the absence of any of the general members.

(b) The initial appointment of all committee members except the student member shall occur on January 1, 2013 and the initial appointment of the student member shall occur on January 1, 2014. The committee members shall serve according to the following terms:

(1) Three general members serving for two-year terms;

(2) Two general members serving for one-year terms;

(3) The members from the advisory parks committee, the township council and the township manager serving one-year terms;

(4) The alternate member serving for a one-year term;

(5) The student member serving for a one-year term coinciding with the academic calendar and expiring on July 1 of each year.

(c) The successors to the general members shall be appointed for three-year terms at the township council annual reorganization meeting.

(d) The successors to the advisory parks committee member shall be appointed for one-year terms at the advisory parks committee annual reorganization meeting.

(e) The successors to the township council member shall be appointed by the mayor for one-year terms at the township council annual reorganization meeting.

(f) The successors to the alternate member shall be appointed for two-year terms at the township council annual reorganization meeting.

(g) If a vacancy shall occur, it shall be filled by appointment, as provided above, for the unexpired term.

Sec. 10-342. - Duties and powers with regard to wildlife management.

The wildlife management advisory committee shall:

(a) Monitor wildlife management programs in other communities to remain current on the latest activities and trends.

(b) Interface with municipal departments, county and state agencies as well as volunteer groups to assist in deer control programs.

(c) Assist the township with public education through newsletters, the municipal website and other information channels.

(d) Act as an information conduit between hunters licensed by NJ Division of Fish and Wildlife and Randolph property owners wishing to implement hunting on their private property.

(e) Maintain an updated inventory of municipal open space and park lands to be assigned for hunting.

(f) Develop and maintain a list of qualified hunters to be issued Randolph local access permits for hunting on township controlled lands.

(g) Annually determine and set commencement and termination dates for hunting on township controlled lands. Promulgate standards governing the annual selection of hunters to be placed on the Randolph local access permit list based upon performance measures (number of deer taken from assigned lands in the prior season and adherence to rules established by the committee and the NJ Division of Fish and Wildlife). Determine the number of permits to be issued.

(h) Develop and present an annual report to the Township Council on the Randolph deer harvest including, but not limited to:

Randolph local access permit lands.
Clyde Potts Watershed.
James Andrews County Park.
Hedden County Park.
Alamatong Well fields.
Automobile accidents.
Private properties if available.

The report may also include a summary of other relevant wildlife management activities on which the committee wishes to report.

SECTION TWO. All Ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION THREE. If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

SECTION FOUR. This Ordinance shall take effect as provided by law.

Notice is hereby given that an Ordinance entitled "An Ordinance Re-Adopting Article XVII, Wildlife Management Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph " was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on March 3, 2022 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on March 17, 2022 at 6 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to re-adopt Article XVII, Wildlife Management Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph.
