An ordinance amending Section 31-74, Municipal Complex Parking Lot, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey


WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and

WHEREAS, the Township desires to amend Section 31-74, Municipal complex parking lot, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, to prohibit board of education employees and Randolph Township students from parking in the municipal complex parking lot when school is in session unless special circumstances arise and the restriction is waived by the township manager;

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:

SECTION ONE. Section 31-74, Municipal complex parking lot, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby deleted and replaced by the following:

Sec. 31-74. Municipal complex parking lot.

It shall be unlawful for any person to park or cause to be parked or to permit their agents, servants or employees to park any vehicle in the municipal complex parking lot, except as follows:

(1) All vehicles shall be parked only within the area designated as a parking space, and no part of any vehicle shall occupy any portion of any other parking space.

(2) No persons other than those having business in the municipal complex shall utilize the municipal complex parking lot.

(3) No unauthorized person shall park in any space designated for reserved parking or in the reserved parking lot. Authorized vehicles shall be properly identified as per the site plan dated July 27, 1990, and revised October 19, 1990, attached to the ordinance from which this section is derived.

(4) No unauthorized person shall park in any space designated for handicapped parking in accordance with the regulations as shown on the site plan dated July 27, 1990, and revised October 19, 1990, attached to the ordinance from which this section is derived.

(5) No person shall park a vehicle at any time upon any of the following described streets or parts of streets:

(6) Appropriate directional and traffic signs and markings complying with N.J.S.A. Title 39 shall be erected in accordance with the regulations established in this section.

(7) At all times when the Randolph Township Public Schools are in session, board of education employees and Randolph Township students are prohibited from parking in the municipal complex parking lots, as defined in [section 31-1] and as detailed on Schedule A, attached hereto and made a part hereof.

These restrictions on parking in the municipal complex may be waived at the discretion of the township manager when special situations arise.

Any person who violated this section shall, upon conviction thereof, be punished by a fine of $100.00.

SECTION TWO. All Ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION THREE. If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

SECTION FOUR. This Ordinance shall take effect as provided by law.

ORDINANCE NO. 07-10

NOTICE IS HEREBY GIVEN that an Ordinance entitled “An Ordinance Amending Section 31-74, Municipal complex parking lot, Of Chapter 31, Traffic and Vehicles, Of The Revised Ordinances Of The Township of Randolph, Morris County, New Jersey” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on May 6, 2010 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on June 3, 2010 at 8 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to amend and supplement Section 31-74, Municipal complex parking lot, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, to prohibit board of education employees and Randolph Township students from parking in the municipal complex parking lot when school is in session unless special circumstances arise and the restriction is waived by the township manager.

A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
