An ordinance amending Section 15-91.1., Application and Review Fees, and Section 15-43.11(G)(8), Fees for a Temporary Sign/Banner Permit, of the Land Development Ordinance of the Township of Randolph to increase certain application and review fees and to decrease the fees for a temporary sign/banner permit
WHEREAS, the Municipal Land Use Law of the State of New Jersey, N.J.S.A. 40:55D-1, et seq. (“MLUL”), grants to municipalities the power to adopt a zoning ordinance relating to the nature and extent of the uses of lands, buildings and structures thereon; and
WHEREAS, Section 15-91.1., Application and Review Fees, of the Land Development Ordinance of the Township of Randolph sets forth the schedule of fees and costs for the filing of certain development applications; and
WHEREAS, the Township of Randolph (“Township”) desires to amend Section 15-91.1, Application and Review Fees, of the Land Development Ordinance of the Township of Randolph to increase certain costs and fees associated with the filing of development applications; and
WHEREAS, Section 15-43.11(G)(8), Fees for a Temporary Sign/Banner Permit, of the Land Development Ordinance of the Township of Randolph currently provides that the fee to obtain a temporary sign/banner permit is $150.00, $100.00 of which is refundable if the applicant complies with the provisions of the Temporary Signs Ordinance; and
WHEREAS, the Township desires to amend Section 15-43.11(G)(8), Fees for a Temporary Sign/Banner Permit, of the Land Development Ordinance of the Township of Randolph to decrease the fee to obtain a temporary sign/banner permit to a $75.00 non-refundable fee.
NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:
SECTION ONE. Section 15-91.1, Application and Review Fees, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey is hereby deleted in its entirety and replaced by the following:
15-91.1. Application and review fees.
A. The following schedule of fees and costs for filing applications shall be paid to the Township; such payment to be made to the department of finance in accordance with Township procedures upon the filing of the application for development:
1. Subdivisions:
a) Conceptual review plan per lot, $110.00 per lot.
b) Upon submission of sketch plat filing fee: Where no more than 4 lots will result, $420.00 per lot.
c) Lot Line Adjustment, $420.00
d) Upon submission of preliminary plat, the filing fee for each lot that will result, $560.00 per lot.
e) Upon submission of final plat, the filing fee for each lot that will result, $260.00.
f) Subdivision amendment, $625.00 per amendment.
g) Extension of major subdivision, $880.00 or 15 percent of preliminary fee or final fee, whichever is applicable and the greater.
h) Extension of minor subdivision, $320.00.
2. Site plans:
a) Conceptual review:
Up to 10,000 square feet of floor area, $0.73 per square foot.
Over 10,000 square feet of floor area, $0.35 per square foot.
Residential site plan $50.00
b) Major site plan (preliminary):
a) $425.00 per 20,000 square feet of lot area up to 5 acres.
b) $525.00 for each acre over 5 acres or fraction thereof.
c) $335.00 per 1,000 square feet of floor area up to 10,000 square feet.
d) $250.00 per 1,000 square feet of floor area over 10,000 square feet.
c) Major site plan (final):
a) $837.00 or 15 percent of preliminary fee whichever is greater.
d) Minor site plan:
a) $620.00 per application.
e) Amendment applications:
a) No expansion of building or outside facilities, $725.00.
f) Reserved.
g) Extension of major site plan:
a) $920.00 or 15 percent of preliminary fee whichever is greater.
3. Variances: Each application made for variances, appeals or special permits shall be accompanied by a fee of:
a) A or B Variances, $335.00.
b) C Variances: Existing Residential Dwelling $470.00. All other Development $585.00.
c) Conditional Uses, $770.00.
d) D Variances, $1,190.00 for new construction, and $835.00 for all others.
e) Special Home Day Care Variance, $135.00.
4. Appeals:
a) For appeals to the Township Council as authorized by statute, a fee of $110.00 shall apply.
b) For appeals to the Planning Board or zoning Board of Adjustment, pursuant to N.J.S.A. 40:55D-34 and N.J.S.A. 40:55D-36, a fee of $200.00 shall apply.
5. Resubmission or extension of preliminary plat:
a) Resubmission. Fifteen (15) percent of the original preliminary application fee but provided that it encompasses the same land as the original submission and further provided that the resubmission is filed within 6 months of the date of the last Planning Board action on the previous submission or if there was no Planning Board action then within 6 months of the previous submission.
b) Extension. Fifteen (15) percent of the original preliminary application fee for each extension.
6. Resubmission of final plat: Ten (10) percent of the original final application fee if it encompasses the same land as the original final subdivision plat and provided that the resubmission is filed within 3 years of the preliminary approval of the Planning Board.
7. Engineer’s certificate and release of two-year maintenance bond: $10.00 fee for each lot shown on plat.
8. Special meeting: Should the Planning Board or Zoning Board of Adjustment, at the request of any applicant or applicant’s authorized representatives, or where the board finds a necessity concerning any matter within the board’s jurisdiction, schedule a special meeting in respect to such matter, the person, firm or corporation for which said meeting is scheduled shall pay a fee of $2,000.00 to defray the costs of scheduling and holding such special meeting. This fee shall be in addition to all other fees and charges heretofore or hereafter established.
9. Request to amend zoning map: Any person requesting a zone change shall do so on a Zone Change Request form available in the Township Clerk’s office accompanied by a fee of $1,395.00. Any such request shall be submitted to the Township Clerk. Attached to the request shall be an appropriate scaled map identifying the area to be rezoned in specific relation to the neighborhood area and also in relation to the entire Township. Zone boundary lines shall be provided in an accurately and clearly drawn format for an area within 1,500 feet of the proposed zone change area.
10. Sediment and erosion control. Applications shall be accompanied by a fee of:
a. Subdivisions:
a. 2 to 4 lots, certification fee $625.00; inspection fee, $175.00 per lot.
b. 5--10 lots, certification fee, $1,000.00.
c. 11--25 lots, certification fee, $2,000.00.
d. 26--50 lots, certification fee, $2,000.00.
e. 51--200 lots, certification fee, $2,800.00.
f. 201 lots and over, certification fee, $3,000.00.
b. Site plans:
a. Area of disturbance, 5,000 square feet--0.25 acre, certification fee, $500.00; inspection fee, $200.00 per acre.
b. Area of disturbance, 0.26--0.5 acre, certification fee, $650.00; inspection fee, $200.00 per acre.
c. Area of disturbance, 0.51--1 acre, certification fee, $750.00; inspection fee, $175.00 per acre.
d. Area of disturbance, 2--4 acres, certification fee, $850.00; inspection fee, $175.00 per acre.
e. Area of disturbance, 5--10 acres, certification fee, $1000.00; inspection fee, $175.00 per acre.
f. Area of disturbance, 11--25 acres, certification fee, $1,500.00; inspection fee, $175.00 per acre.
g. Area of disturbance, 26--50 acres, certification fee, $1,750.00; inspection fee, $120.00 per acre.
h. Area of disturbance, 51--100 acres, certification fee, $2,000.00; inspection fee, $150.00 per acre.
i. Area of disturbance, 101 acres and over, certification fee, $2,300.00; inspection fee, $150.00 per acre.
c. Apartments, townhomes and condominiums:
a. 1--20 units, certification fee, $660.00, inspection fee, $70.00 per acre.
b. 21--40 units, certification fee, $935.00, inspection fee, $70.00 per acre.
c. 41--60 units, certification fee, $1,435.00, inspection fee, $70.00 per acre.
d. 61--100 units, certification fee, $1,935.00, inspection fee, $70.00 per acre.
e. 100--300 units, certification fee, $2,205.00, inspection fee, $50.00 per acre.
f. 300--500 units, certification fee, $2,755.00, inspection fee, $50.00 per acre.
g. 501 units and over, certification fee, $3,305.00, inspection fee, $50.00 per acre.
SECTION TWO. Section 15-43.11(G)(8), Fees for a Temporary Sign/Banner Permit, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey is hereby deleted in its entirety and replaced by the following:
Fees for a Temporary Sign/Banner Permit: $75.00.
SECTION THREE. All ordinances or parts of ordinances in conflict or inconsistent with any part of this Ordinance are hereby repealed to the extent that they are in such conflict or inconsistent.
SECTION FOUR. This Ordinance may be renumbered for codification purposes.
SECTION FIVE. In the event that any section, part or provision of this Ordinance shall be held to be unenforceable or invalid by any court, such holding shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part so held unenforceable or invalid.
SECTION SIX. This Ordinance shall take effect 20 days after passage and publication as provided by law.

NOTICE IS HEREBY GIVEN that an Ordinance entitled “An Ordinance Amending Section 15-91.1., Application And Review Fees, And Section 15-43.11(G)(8), Fees For A Temporary Sign/Banner Permit, Of The Land Development Ordinance of the Township Of Randolph To Increase Certain Application And Review Fees And To Decrease The Fees For A Temporary Sign/Banner Permit” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on April 7, 2011 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on May 5, 2011 at 8 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of the above Ordinance is to amend Section 15-91.1, Application and Review Fees, of the Land Development Ordinance of the Township of Randolph to increase certain costs and fees associated with the filing of development applications and to amend Section 15-43.11(G)(8), Fees for a Temporary Sign/Banner Permit, of the Land Development Ordinance of the Township of Randolph to decrease the fee to obtain a temporary sign/banner permit.
