An Ordinance to Amend and Supplement Ordinance No. 03-21 Provisions of Subtitle One of Title 39 with Various Traffic Regulations Applicable to the Gas Station/Convenience Store (Wawa) on Lots 2 and 5 in Block 137, 358 Route 10 West, Regulating the Use of Said Roadways, Streets, Driveways, Parking Lots by Motor Vehicles and Amending and Supplementing Article III, Section 31-52; Article IV, Division 4, Section 31-133; Article V, Section 31-205 and Article X, Section 31-323 of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey
WHEREAS, pursuant to N.J.S.A.40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this title, subtitle or by any law; and
WHEREAS, Randolph 10 Developers, LLC with offices located at 1195 Route 70, Suite 2000, Lakewood, New Jersey 08701, Wawa Convenience Store/Gas Station has filed a written consent with the Township of Randolph that the provisions of Subtitle 1 of Title 39 of the Revised Statues of New Jersey be made applicable and enforceable to the semi-public road, streets, driveways and parking lots at the Wawa Convenience Store/Gas Station located at 358 Route 10 West in the Township of Randolph.
WHEREAS, the municipality deems it necessary to amend Ordinance No. 03-21 to regulate traffic within the Wawa Convenience Store/Gas Station located in the Township of Randolph; and
WHEREAS, the Township of Randolph also desires to amend Article III, Section 31-52, Stop Intersections Designated; Article IV, Division 4, Section 31-133, Reserved Parking Spaces Designated; Article V, Section 31-205, Left Turn Prohibitions and Article X, Section 31-323, Prohibition of Parking Zones, Designated of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey.
NOW, THEREFORE BE IT ORDAINED by the Township of Council of the Township of Randolph, County of Morris, State of New Jersey that Ordinance 03-21 is hereby amended and supplemented as follows:
SECTION 1: Subtitle 1 of Title 39 of the revised statues of New Jersey is hereby made applicable to the semi-public roads, streets, driveways and parking lots at Block 137, Lots 2 and 5 located at 358 Route 10 West, Wawa Convenience Store/Gas Station, in the Township of Randolph, County of Morris and shall be amended to include the following enforceable regulations as designated on the site plan on file in the office of the township engineer:
REGULATION(S):
1. General Parking:
All vehicles must park in designated areas and between the lines provided.
2. Stop Intersection(s):
The following described intersections are hereby designated as Stop Intersections. Stop signs shall be installed as provided therein:
Stop Sign(s) on:
* Entrance/Exit Wawa Driveway and Route 10
* Wawa Driveway and Quaker Church Rd
* Rear of Building (north most) Traffic Lane Stop Bar near Dumpsters
3. Left Turn Prohibitions
The following left turns are prohibited. Signage shall be installed as provided therein:
* Route 10 Entrance/Exit

* Wawa Driveway and Quaker Church Rd/Exit
Left Turn Prohibited
4. Reserved Parking Spaces (Handicapped):
There shall be two 8ft x 20ft stalls with 8ft striped access and signed with the R7-8 and R7-8P (Reserved Parking Sign and Penalty Plate), in the designated parking areas for persons who have been issued the Handicapped Parking Permit by the Division of Motor
Vehicles.
5. Prohibition of Parking Zones
No person shall park a vehicle at any time in the areas designated “no parking fire zones,” which zones are designated on the site plan on file in the office of the township engineer. There shall be no parking in the fire zones as outlined by cross-hatching as designated on the site plan.
6. Tow Away Zones:
Any vehicle parked or standing as to obstruct or impede normal flow of traffic, block entrances or exit ways, loading zones, fuel fills, any grassy area, pedestrian walkway, or present in any way a safety or traffic hazard may be removed by towing the vehicle at the owners or operators expense.
7. Loading Zone(s):
No person shall park a vehicle in the loading zone during the times indicated other than for the loading or unloading of goods and materials. No delivery trucks are to use the Quaker Church Road entrance or exit.
8. Weight Restriction(s):
Vehicles over 5 tons are hereby prohibited from using the Quaker Church Road access to enter site. Vehicles over 5 tons must use the Route 10 access only. Signage shall be installed as provided therein.
9. That all signs, posts or other necessary materials shall be installed and paid for by the applicant. All signing shall conform to the current Manual on Uniform Traffic Control Devices, pursuant to N.J.S.A. 39:4-198 and N.J.S.A. 39:4-183.27.
10. Unless another penalty is expressly provided for by New Jersey Statute, every person convicted of a violation of this ordinance or any supplement thereto shall be liable to a penalty of not more than ($50.00) dollars or imprisonment for a term not exceeding fifteen (15) days or both.
SECTION 2. Article III, Section 31-52, Stop Intersections Designated, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby supplemented and amended by the addition of the following intersections to be designated as stop intersections:
* Entrance/Exit Driveway located at 358 Route 10 West, Wawa Convenience Store/Gas Station
* Wawa Convenience Store/Gas Station Driveway located at 358 Route 10 West and Quaker Church Rd
* Rear of Building (north most) Traffic Lane Stop Bar near Dumpsters located at 358 Route 10 West, Wawa Convenience Store/Gas Station
SECTION 3. Article IV, Division 4, Section 31-133, Reserved Parking Spaces Designated, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby supplemented and amended by the addition of the following described locations and are hereby designated as reserved (handicapped) parking spaces for use by persons who have been issued special identification cards by the state division of motor vehicles. A special handicapped license plate or handicapped placard must be displayed. No other persons shall park in these spaces:
Wawa Convenience Store/Gas Station located at 358 Route 10 West
* Two handicapped spaces in the front/right of Wawa Convenience Store.
The handicapped spaces shall be 8ft x 20ft stalls with 8ft striped access.
SECTION 4. Article V, Section 31-205, Left Turn Prohibitions, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby supplemented and amended by the addition of the following intersections to be designated as a no left turn intersection:
Wawa Convenience Store/Gas Station located at 358 Route 10 West:
* Route 10 West Entrance/Exit
* Wawa Driveway and Quaker Church Rd
SECTION 5. Article X, Section 31-323, Prohibition of Parking Zones, Designated, of Chapter 31, Traffic and Vehicles, (b.) No Parking Fire Zones, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby supplemented and amended by the addition of the below:
* Wawa Convenience Store/Gas Station - 358 Route 10 West
SECTION 6. All ordinances or parts of ordinances in conflict or inconsistent with any part of this Ordinance are hereby repealed to the extent that they are in such conflict or inconsistent.
SECTION 7. This Ordinance may be renumbered for codification purposes.
SECTION 8. In the event that any section, part or provision of this Ordinance shall be held to be unenforceable or invalid by any court, such holding shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part so held unenforceable or invalid.
SECTION 9. This Ordinance shall take effect immediately upon final passage and publication in accordance to law.

Notice is hereby given that an Ordinance entitled “AN ORDINANCE TO AMEND AND SUPPLEMENT ORDINANCE NO. 03-21 PROVISIONS OF SUBTITLE ONE OF TITLE 39 WITH VARIOUS TRAFFIC REGULATIONS APPLICABLE TO THE GAS STATION/CONVENIENCE STORE (WAWA) ON LOTS 2 AND 5 IN BLOCK 137, 358 ROUTE 10 WEST, REGULATING THE USE OF SAID ROADWAYS, STREETS, DRIVEWAYS, PARKING LOTS BY MOTOR VEHICLES AND AMENDING AND SUPPLEMENTING ARTICLE III, SECTION 31-52; ARTICLE IV, DIVISION 4, SECTION 31-133; ARTICLE V, SECTION 31-205 AND ARTICLE X, SECTION 31-323 OF CHAPTER 31, TRAFFIC AND VEHICLES, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on March 18, 2021 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held virtually on April 8, 2021 at 5 p.m. prevailing time, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of the above Ordinance shall be to amend and supplement Ordinance No. 03-21 and to amend Chapter 31 of Traffic and Vehicles to include enforceable regulations pertaining to general parking, stop intersections, left turn prohibitions, reserved parking spaces, prohibition of parking zones, tow away zones, loading zones, et al. A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
