An ordinance authorizing and accepting the conveyance of Block 116, Lot 32 as shown and designated on the official tax map of the Township of Randolph, County of Morris, State of New Jersey from the owners thereof


WHEREAS, N.J.S.A. 40A: 12-5(a)(1) authorizes a municipality, by ordinance, to acquire real property by purchase, gift, devise, lease, exchange, condemnation, or installment purchase agreement; and

WHEREAS, N.J.S.A. 40:60-25.54, N.J.S.A. 40A:12-13(b)(1) and N.J.S.A. 40A:12-19 authorize the acquisition of property by a municipality for the purpose of making property available to a school district for nominal or other consideration; and

WHEREAS, the Township of Randolph (“Township”), desires to purchase certain property within the Township, commonly known as 565 Millbrook Avenue and formally designated at Block 116, Lot 32 on the Official Tax Map of the Township of Randolph (“Property”); and

WHEREAS, said property will be conveyed to the Board of Education of the Township of Randolph (“Board of Education”) pursuant to the Lease/Purchase Agreement, dated April 27, 2017, which is contingent upon the Township entering into the Agreement for Conveyance of Real Estate (“Agreement”) with Sylvia Weiland (“Owner”) for the above-described transaction; and

WHEREAS, the Township desires to enter into the Agreement with the Owner, which sets forth the rights, duties, and obligations of the parties; and

WHEREAS, the Township desires to authorize the acceptance of the conveyance of the Property to the Township upon fulfillment of all the provisions of the Agreement.

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:

SECTION 1. The Township Council approves the terms and conditions of a certain Agreement for Conveyance of Real Estate by and between the Owner and the Township of, a copy of which is filed in the Office of the Township Clerk.

SECTION 2. The Mayor and Clerk of the Township shall execute the Agreement with the Owner for the conveyance of the Property to the Township.

SECTION 3. The conveyance of Block 116, Lot 32 on the Official Tax Map of the Township of Randolph, County of Morris, State of New Jersey is hereby accepted upon the fulfillment of the terms and conditions of the Agreement.

SECTION 4. The Mayor, the Township Clerk, and all other officers, employees and professionals are hereby authorized to take all steps necessary to effectuate the purpose of this Ordinance.

SECTION 5. The Township Tax Collector and Tax Assessor are hereby authorized and directed to take any action necessary to further the purpose of this Ordinance, including, without limitation, the removal of the Property from the Township’s tax rolls as of the date of closing of title.

SECTION 6. All ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION 7. If any section, subsection clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portion of this Ordinance.

SECTION 8. This Ordinance shall take effect immediately upon final passage, approval and publication as provided by law.

ORDINANCE NO. 13-17

Notice is hereby given that an Ordinance entitled “An Ordinance Authorizing and Accepting the Conveyance of Block 116, Lot 32 as Shown and Designated on the Official Tax Map of the Township of Randolph from the Owners Thereof” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on May 18, 2017 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on June 15, 2017 at 7 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to authorize the execution of an agreement with the owner of Block 116, Lot 32 on the Official Tax Map of the Township of Randolph, County of Morris, State of New Jersey, and to accept the conveyance of same from its owner.

A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
