Amendment to Article IX, Emergency Towing and Road Service, of the Revised Ordinances of the Township of Randolph to delete all of Article IX due to an existing contract for Towing Services
WHEREAS, on June 29, 2006, after publicly advertising for bids and receipt of the same, the Township of Randolph (Township) entered into a contract with Tony’s Towing and Recovery, Inc. located in Dover, New Jersey (Tony’s) for towing services for Randolph Township from July 1, 2006 through June 30, 2009; and
WHEREAS, Article IX, Emergency Towing and Road Service, of the Revised Ordinances of the Township of Randolph, provides policies and procedures for towing services in the Township that are inconsistent with the Contract entered into between the Township and Tony’s; and
WHEREAS, the Township desires to continue the towing services with Tony’s as specifically set forth in the June 29, 2006 Contract; and
WHEREAS, due to the existing Contract with Tony’s for towing services in Randolph Township, the Township of Randolph desires to delete the entire Article IX, Emergency Towing and Road Service, as it is inconsistent with the June 29, 2006 Contract with Tony’s and is unnecessary.
NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:
SECTION ONE. Article IX, Emergency Towing and Road Service, is hereby deleted in its entirety and shall now read as follows:
ARTICLE IX. RESERVED
SECTION TWO. All ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of the inconsistency.
SECTION THREE. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not effect the remaining portion of this Ordinance.
SECTION FOUR. This Ordinance shall take effect immediately upon final passage, approval, and publication as provided by law.

ORDINANCE NO. 17-07
NOTICE IS HEREBY GIVEN that an Ordinance entitled “Amendment to Article IX, Emergency Towing and Road Service, of the Revised Ordinances of the Township of Randolph to Delete All of Article IX Due to an Existing Contract for Towing Services” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on May 3, 2007 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on June 7, 2007 at 8 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of this Ordinance is to delete the entirety of Article IX, Emergency Towing and Road Service, of the Revised Ordinances of the Township of Randolph due to an existing contract for towing services with Tony’s Towing & Recovery, Inc.
A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
