Accepting Dedication of a Portion of Block 137, Lot 2 and a Portion of Block 137, Lot 5 on the Official Tax Map of the Township of Randolph, Morris County, New Jersey from Randolph 10 Developers, LLC (Quaker Church Road, Portion of)


WHEREAS, N.J.S.A. 40A:12-4 and 40A:12-5 authorize a municipality, by ordinance, to acquire real property by purchase, gift, devise, lease, exchange, condemnation, or installment purchase agreement; and

WHEREAS, Randolph 10 Developers, LLC desires to convey title to property known as a portion of Block 137, Lot 2, and a portion of Block 137, Lot 5 to the Township of Randolph for purposes of right of way (Quaker Church Road, portion of), as more particularly described in Deeds dated June 13, 2019; and

WHEREAS, the right of way dedications set forth therein are pursuant to approvals granted by the Randolph Township Board of Adjustment on December 13, 2018, and memorialized by Resolution dated January 10, 2019; and

WHEREAS, the Township of Randolph desires to accept the dedication to the Township of Randolph of a portion of Block 137, Lot 2 and a portion of Block 137, Lot 5 as more particularly described in the property descriptions attached as Exhibit A to each of the Deeds referenced above.

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:

SECTION 1. The dedication of a portion of Block 137, Lot 2, and the dedication of a portion of Block 137, Lot 5 for right of way, as described in certain Deeds June 13, 2019 by and between Randolph 10 Developers, LLC and the Township of Randolph are hereby accepted.

SECTION 2. The Mayor, Township Manager and Township Clerk together with all other officers, professionals and employees of the Township are hereby authorized and directed to take any and all steps necessary to effectuate the purposes of this Ordinance.

SECTION 3. The Township Tax Collector and Tax Assessor are hereby authorized and directed to take any action necessary to further the purpose of this Ordinance.

SECTION 4. All ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION 5. If any section, subsection clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portion of this Ordinance.

SECTION 6. This Ordinance shall take effect immediately upon final passage, approval and publication as provided by law.

ORDINANCE NO. 20-19

NOTICE IS HEREBY GIVEN, that the foregoing Ordinance entitled “Accepting Dedication of a portion of Block 137, Lot 2, and a portion of Block 137, Lot 5 on the Official Tax Map of the Township of Randolph, Morris County, New Jersey from Randolph 10 Developers LLC (Quaker Church Road, portion of)” was submitted in writing at a regular meeting of the Council of the Township of Randolph, County of Morris, State of New Jersey, held on October 24, 2019, and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The governing body of the Township of Randolph will further consider the ordinance for second reading and final passage thereof at their regular meeting to be held on November 21, 2019, at 5:30 p.m. prevailing time, at the Municipal Building in said Township, at which time and place a public hearing will be held thereon by the governing body and all parties in interest and citizens shall have an opportunity to be heard concerning said ordinance.

Statement of Purpose of Ordinance

The ordinance introduced above accepts the dedication by the Township of Randolph of a portion of Block 137, Lot 2 and a portion of Block 137, Lot 5 from Randolph 10 Developers, LLC for purposes of right of way on a portion of Quaker Church Road and in accordance with a Resolution of Approval granted by the Randolph Township Board of Adjustment on December 13, 2018, memorialized by Resolution adopted on January 10, 2019.

A copy of the full ordinance is available to any member of the general public without cost, at the Randolph Township Municipal Building, Office of the Clerk, between the hours of 9:00 a.m. and 4:00 p.m.
