An ordinance vacating any and all interest held by the Township of Randolph in Block 116, Lot 34 related to the construction and operation of municipal tennis courts and then a municipal roller hockey rink
WHEREAS, in the early 1970s, the Township of Randolph Board of Education (Board) and the Township of Randolph (Township) undertook a joint project to construct tennis courts on property owned by the Board known as Block 91, Lot 14A, known today as Block 116, Lot 34 on the Official Tax Map of the Township of Randolph (Property), for use by both the students and the rest of the community; and
WHEREAS, the Property consists of approximately 22 acres with the Center Grove School located on the majority of the site and approximately 2 acres of the Property located on the eastern section of the Property fronting on Millbrook Avenue was used for construction of the tennis courts; and
WHEREAS, as a result of the construction of Brundage Park, a replacement tennis center, the tennis courts located on the Property were converted to a roller hockey rink; and
WHEREAS, most recently, with the development of Stony Brook Day Camp Roller Rink, the Township ended the use of the Property for roller hockey; and
WHEREAS, the Property is no longer needed or required for municipal purposes and the Township now desires to vacate any claim to the Property so as to enable the Board to use the Property as needed for school and related purposes.
NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:
SECTION ONE. The Township of Randolph HEREBY VACATES any and all interest in Block 116, Lot 34 located on the Official Tax Map of the Township of Randolph relating to the construction and operation of municipal tennis courts and then a municipal roller hockey rink thereon. The right of the public in and to Block 116, Lot 34 related to the construction and operation of municipal tennis courts and then a municipal roller hockey rink is VACATED and FOREVER EXTINGUISHED.
SECTION TWO. Having passed a first reading, this Ordinance shall be published in the manner required by N.J.S.A. 40:49-6, at least once not less than ten (10) days prior to the time fixed for further consideration for final passage.
SECTION THREE. Pursuant to N.J.S.A. 40:49-6, at least one week prior to the time for final passage, a copy of the Ordinance, together with notice of the introduction, including time and place fixed for final passage, shall be mailed to every person whose land may be affected by the Ordinance.
SECTION FOUR. The Township shall, within sixty (60) days after the Ordinance becomes effective, file a certified copy thereof, under the seal of the Township of Randolph, together with a copy of the proof of publication thereof, in the Office of the Clerk of Morris County, pursuant to N.J.S.A. 40:67-21.
SECTION FIVE. The Mayor and Township Clerk are hereby authorized to execute any and all instruments and to do all things necessary to effectuate the purposes hereof.
SECTION SIX. All Ordinances of the Township of Randolph that are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.
SECTION SEVEN. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.
SECTION EIGHT. This Ordinance shall take effect as provided by law.

ORDINANCE NO. 22-07
NOTICE IS HEREBY GIVEN that an Ordinance entitled “An Ordinance Vacating Any and All Interest Held by The Township of Randolph in Block 116, Lot 34 Related to The Construction and Operation of Municipal Tennis Courts and then a Municipal Roller Hockey Rink” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on June 7, 2007 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on July 12, 2007 at 8 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of this Ordinance is to vacate the Township’s interest in Block 116, Lot 34 relating to the construction of municipal tennis courts and then a roller hockey rink.
A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
