Amendment and supplement to Chapter 31, Traffic and Vehicles, Article III, Through Streets, Stop Intersections and Yield Intersections of the Revised Ordinances of the Township of Randolph

WHEREAS, in its continuing efforts to enhance traffic and pedestrian safety for the residents of the Township of Randolph, the Township wishes to establish a crosswalk on Quaker Church Road in the Township in accordance with law; and

WHEREAS, N.J.S.A. 39:4-8d, provides that a municipality may, without the approval of the Commissioner of Transportation and consistent with the current standards prescribed by the Manual on Uniform Traffic Control Devices for Streets and Highways, establish by ordinance, the installation or placement of an in-street pedestrian crossing right-of-way sign at a marked crosswalk or unmarked crosswalk at an intersection; and

WHEREAS, the Township Engineer certified in a letter dated July 30, 2009 that the installation of a crosswalk on Quaker Church Road is in the interest of safety and expedition of traffic and that the proposed signage conforms to the current standards prescribed by the Manual of Uniform Traffic Control Devices for Streets and Highways; and

WHEREAS, the Township of Randolph desires to establish a crosswalk on Quaker Church Road to be located approximately 300 feet west of the intersection of Quaker Church Road and Center Grove Road at the driveway opening for the A&P shopping center and the apartment complex with installation of the appropriate signage and street markings.

NOW, THEREFORE, BE IT ORDAINED, by the governing body of the Township of Randolph, County of Morris, State of New Jersey, as follows:

SECTION 1. Chapter 31, Traffic and Vehicles, Article III, Through Streets, Stop Intersections and Yield Intersections shall be re-titled and supplemented with the addition of Section 31-54, Crosswalks, which shall read as follows:

ARTICLE III. THROUGH STREETS, STOP INTERSECTIONS, YIELD INTERSECTIONS AND CROSSWALKS

Sec. 31-54. Crosswalks.

All crosswalk markings and signage shall be installed in accordance with the Manual on Uniform Traffic Control Devices for Streets and Highways. Crosswalks are established as follows:

Quaker Church Road, 300 feet west of the intersection of Quaker Church Road and Center Grove Road at the driveway opening for the A&P Shopping Center and the apartment complex.

SECTION 2. All Ordinances of the Township of Randolph that are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION 3. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

SECTION 4. This Ordinance shall take effect as provided by law.

ORDINANCE NO. 23-09

NOTICE IS HEREBY GIVEN that an Ordinance entitled “Amendment and Supplement to Chapter 31, Traffic and Vehicles, Article III, Through Streets, Stop Intersections and Yield Intersections of the Revised Ordinances of the Township of Randolph” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on August 6, 2009 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on September 3, 2009 at 8 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of this Ordinance is to establish a crosswalk on Quaker Church Road, 300 feet west of the intersection of Quaker Church Road and Center Grove Road at the driveway opening for the A&P Shopping Center and the apartment complex and to authorize the appropriate street signage and markings.

A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9:00 a.m. and 4:30 p.m.
