An Ordinance Amending Sections 15-2.2, 15-50.2, 15-43.9, 15-43.21 and 15-81.2 of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey
WHEREAS, the Municipal Land Use Law (“MLUL”) of the State of New Jersey, N.J.S.A. 40:55D-1 et seq. grants to municipalities the power to adopt a zoning ordinance relating to the nature and extent of the uses of lands, buildings and structures thereon; and
WHEREAS, the Township of Randolph Board of Adjustment (“Board of Adjustment”) issued an Annual Report recommending certain revisions to the Land Development Ordinance of the Township of Randolph regarding Houses of Worship, Signs and Site Plan Exemptions; and
WHEREAS, the Township of Randolph (“Township”) desires to amend Sections 15-2.2, 15-50.2, 15-43.9, 15-43.21 and 15-81.2 of the Land Development Ordinance consistent with the revisions recommended by the Board of Adjustment.
NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Randolph, County of Morris, and State of New Jersey as follows:
SECTION ONE. The definition of “House of Worship” set forth in Section 15-2.2, Definitions, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey is hereby deleted in its entirety and replaced with the following:
House of worship means a building or structure, or groups of buildings or structures primarily intended as a place of assembly for religious services or worship. Associated accessory uses include, but are not limited to, residence for the facility’s religious leader, facilities for education and instruction including after-school learning, day care, or any other type of education or instruction, and facilities for social functions such as weddings, funerals, bar/bat mitzvahs and other similar events.
SECTION TWO. The definition of “Church” set forth in Section 15-2.2, Definitions, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey is hereby deleted in its entirety and replaced with the following:

SECTION THREE. The Off-Street Parking Requirements for a House of Worship as set forth in Exhibit 2 to Section 15-50.2, Number of Parking Spaces, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey, is hereby deleted in its entirety and replaced with the following:
House of Worship | 1 per 3 seats If no permanent or fixed seating, 1 per 3 persons based on the maximum capacity of the facility, which shall be calculated by taking the total square footage of the place of assembly for religious services or worship and dividing it by the square footage of space allotted to each person in attendance as determined by the State of New Jersey Uniform Construction Code or Uniform Fire Code as applicable. |
SECTION FOUR. Subsection B. of Section 15-43.9, Prohibited Signs, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey, is hereby deleted in its entirety and replaced with the following:
B. Moving or revolving signs and signs using blink, flashing, vibrating, flickering, tracer or sequential lighting, with the exception of any time or temperature, changeable copy displays or gas station price designation as permitted by this Chapter.
SECTION FIVE. Section 15-43, Signs, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey, is hereby amended by the addition of the following:
15-43.21. - LED Gas station price designation
Gas station price designation utilizing light-emitting diode (LED) lighting on monument signs is permitted subject to the following:
- The only portion of the sign that is permitted for LED lighting is the price designation.
- The LED signage is not permitted to move, revolve, blinking, flash, vibrate, or flicker.
- The price changes can take place no more than once every 24 hours.
- LED signs shall employ a light sensing device that can automatically reduce the brightness of the display during nighttime hours.
- LED signs shall not create glare or blinding effects upon motor vehicle traffic.
SECTION SIX. Section 15-81.2, Site Plan Exemptions, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey, is hereby amended by the addition of the following:
D. The installation of commercial communication antenna and equipment on a lawfully existing tower provided it does not constitute a substantial change as defined in Section 6409 (a) of the Middle Class Tax Relief and Job Creation Act of 2012.
SECTION SEVEN. All ordinances or parts of ordinances in conflict or inconsistent with any part of this Ordinance are hereby repealed to the extent that they are in such conflict or inconsistent.
SECTION EIGHT. This Ordinance may be renumbered for codification purposes.
SECTION NINE. In the event that any section, part or provision of this Ordinance shall be held to be unenforceable or invalid by any court, such holding shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part so held unenforceable or invalid.
SECTION TEN. This Ordinance shall take effect 20 days after passage and publication as provided by law.

ORDINANCE NO. 23-18
Notice is hereby given that an Ordinance entitled “An Ordinance Amending Sections 15-2.2, 15-50.2, 15-43.9, 15-43.21 and 15-81.2 of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on October 18, 2018, and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on November 29, 2018, at 7 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of the above Ordinance is to amend Sections 15-2.2, 15-50.2, 15-43.9, 15-43.21 and 15-81.2 of the Land Development Ordinance consistent with certain revisions recommended by the Township of Randolph Board of Adjustment regarding Houses of Worship, Signs and Site Plan Exemptions.
