Accepting Dedication of Block 47, Lot 7.30 on the Official Tax Map of the Township of Randolph from SJC Builders, L.L.C.

WHEREAS, N.J.S.A. 40A:12-4 and 40A:12-5 authorize a municipality, by ordinance, to acquire real property by purchase, gift, devise, lease, exchange, condemnation, or installment purchase agreement; and

WHEREAS, S.J.C. Builders, L.L.C. desires to convey title to property known as Block 47, Lot 7.30 to the Township of Randolph for purposes of recreation and open space as more particularly described in a Deed dated June 5, 2019; and

WHEREAS, the property is conveyed free and clear of any liens and encumbrances; and

WHEREAS, the Township of Randolph desires to accept the dedication of Block 47, Lot 7.30 to the Township of Randolph; and

WHEREAS, S.J.C. Builders, L.L.C. has paid the sum of $50,000.00 in full and final satisfaction of municipal real estate taxes for Block 47, Lot 7.30 to the date of dedication of said property (which is the date of the adoption of this Ordinance) and which the Township accepts as full and final satisfaction of municipal taxes.

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:

SECTION 1. The dedication of Block 47.00, Lot 7.30 as described in a certain Deed dated June 5, 2019 by and between SJC Builders, L.L.C. and the Township of Randolph is hereby accepted.

SECTION 2. The Township of Randolph accepts the sum of $50,000.00 as full and final satisfaction of municipal real estate taxes due and owing for Block 47.00, Lot 7.30, in the Township of Randolph, County of Morris, State of New Jersey, through and including the date of dedication, which is the date of the adoption of this Ordinance, which sum has been paid in full.

SECTION 3. The Mayor, Township Manager and Township Clerk together with all other officers, professionals and employees of the Township are hereby authorized and directed to take any and all steps necessary to effectuate the purposes of this Ordinance.

SECTION 4. The Township Tax Collector and Tax Assessor are hereby authorized and directed to take any action necessary to further the purpose of this Ordinance.

SECTION 5. All ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION 6. If any section, subsection clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portion of this Ordinance.

SECTION 7. This Ordinance shall take effect immediately upon final passage, approval and publication as provided by law.

ORDINANCE NO. 23-19

NOTICE IS HEREBY GIVEN, that the foregoing Ordinance entitled “Accepting Dedication of Block 47, Lot 7.30 on the Official Tax Map of the Township of Randolph from SJC Builders, L.L.C.” was submitted in writing at a regular meeting of the Council of the Township of Randolph, County of Morris, State of New Jersey, held on November 5, 2019, and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The governing body of the Township of Randolph will further consider the ordinance for second reading and final passage thereof at their regular meeting to be held on November 21, 2019, at 5:30 p.m. prevailing time, at the Municipal Building in said Township, at which time and place a public hearing will be held thereon by the governing body and all parties in interest and citizens shall have an opportunity to be heard concerning said ordinance.

Statement of Purpose of Ordinance

The ordinance introduced above accepts the dedication of Block 47, Lot 7.30 from SJC Builders, L. L. C. by the Township of Randolph.

A copy of the full ordinance is available to any member of the general public without cost, at the Randolph Township Municipal Building, Office of the Clerk, between the hours of 9:00 a.m. and 4:00 p.m.
