Amendment to Chapter 15, Land Development Ordinance, Article I, General Provisions, Section 15-2, Definition of Terms and Article IV, Supplementary Zoning Regulations, Section 15-42, Outdoor Storage, of the Revised Ordinances of the Township of Randolph

WHEREAS, pursuant to N.J.S.A. 40:48-1, a municipality may make, amend, repeal and enforce Ordinances to manage, regulate and control real property of the municipality; and

WHEREAS, the Township of Randolph (Township) desires to amend Article I, General Provisions, Section 15-2, Definition of Terms to revise the definition of outdoor storage; and

WHEREAS, the Township desires to amend Article IV, Supplementary Zoning Regulations, Section 15-42, Outdoor Storage, to reorganize a portion of the existing ordinance and add reference to the newly created B2-ENV zone to the existing ordinance.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Township of Randolph, in the County of Morris, State of New Jersey, as follows:

SECTION ONE. The definition of (outdoor storage within Chapter 15, Land Development Ordinance, Article I, General Provisions, Section 15-2, Definition of Terms, Subsection 15-2.2, Definitions, of the Randolph Township Code shall be amended to read as follows:

Outdoor storage is the storage of any good(s), junk, object(s), material(s), equipment, merchandise or vehicles outside the confines of a building.

SECTION TWO. Chapter 15, Land Development Ordinance, Article IV, Supplementary Zoning Regulations, Section 15-42, Outdoor Storage, paragraph 15-42A2 in its entirety shall be relocated and renumbered as paragraph 15-42B4.

SECTION THREE. Chapter 15, Land Development Ordinance, Article IV, Supplementary Zoning Regulations, Section 15-42, Outdoor Storage, paragraph 15-42C1 shall be revised to read as follows:

1. Outdoor storage, display or sales in the B-1, B-2, B-3, B-4 and B2-ENV zones shall be limited to nursery stock, horticultural products, and building supplies, which can not ordinarily be accommodated indoors, when such activity is accessory to a principal use and does not occupy an area greater than 1,500 square feet and further provided that such outdoor storage, display and sales area is subject to site plan review and approval by the Planning Board.

SECTION FOUR. All Ordinances of the Township of Randolph that are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION FIVE. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

SECTION SIX. This Ordinance shall take effect as provided by law.

ORDINANCE NO. 28-07

NOTICE IS HEREBY GIVEN that an Ordinance entitled “Amendment to Chapter 15, Land Development Ordinance, Article I, General Provisions, Section 15-2, Definition of Terms and Article IV, Supplementary Zoning Regulations, Section 15-42, Outdoor Storage, of the Revised Ordinances of the Township of Randolph” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on August 7, 2007 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on October 18, 2007 at 8 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of this Ordinance is to amend the definition of (outdoor storage, renumber an existing section of the outdoor storage ordinance and to add reference to the newly created B2-ENV zone within the outdoor storage ordinance.
