An ordinance amending Divisions 2 and 11 of Article III of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, to reflect changes in organizational structure of the Office of the Manager and the Department of Engineering, Public Works and Zoning Administration/GIS


WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce ordinances to prescribe and define the duties and terms of employment of all officer and employees of the municipality; and

WHEREAS, the Township of Randolph desires to reorganize the Department of Engineering, Public Works and Zoning Administration/GIS and eliminate the position of Township Engineer/Director of Public Works; and

WHEREAS, the Township of Randolph desires the Division of Engineering and the Division of Zoning Administration/GIS, which are currently organized as part of the Department of Engineering, Public Works and Zoning Administration/GIS, to be reorganized as part of the Office of the Manager; and

WHEREAS, the Township of Randolph desires to create a new Department of Public Works, the head of which shall be the Director of Public Works.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Township of Randolph, in the County of Morris, State of New Jersey, as follows:

SECTION ONE. Division 11, Section 2-344, Division of Engineering, of Article III, General Administrative Organization, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby renumbered and amended as follows:

Sec. 2-157. Division of engineering.

Qualifications. The township engineer, prior to appointment by the township manager, shall be licensed as a professional engineer in the State of New Jersey.

Within the office of the manager, there shall be a division of engineering, the head of which shall be the township engineer. The division of engineering shall:

(1) Provide and maintain maps, plans, specifications, surveys and operating records with respect to public property, works and facilities owned or operated by the township; and maintain the tax map on a current basis with assistance of the tax assessor.

(2) Issue certificates as to liability for assessment for municipal improvements pursuant to law (N.J.S.A. 54:5-18.1 et seq.) and such other certificates as may be prescribed by general law or ordinance.

(3) Inspect and approve or reject:

a. The installation of public improvements prior to acceptance of the improvements by the township and return of the developer’s bonds and maintenance guarantees.

b. Construction work in connection with the installation or repair of water and sewer utilities.

(4) Maintain current indexed records of as-built plans of all township utility construction and a chart of utility contracts entered into by the township.

(5) Maintain a bond chart listing all performance and maintenance bonds delivered to the township containing pertinent information as required by the township manager.

(6) Review and accept or reject plans and descriptions of easements required in connection with public utilities and improvements.

(7) Assist as authorized in planning and execution of public works and utility projects.

(8) In accordance with existing ordinances, issue street opening permits, upon proof of payment of the fee and posting of bond, and inspect restoration of streets for the purpose of determining compliance with ordinances permitting authorization of return of cash bonds or release of surety.

(9) Review and approve or reject plans for:

a. Connections from buildings to the public water system.

b. Connections from buildings to the public sewer system.

(10) Prepare bills and, upon proof of payment of such bills, issue permits for connections to water and sewer mains.

(11) Perform other engineering services and issue reports as may be required by the council, township manager or planning board and board of adjustment.

(12) Provide technical and engineering advice and assistance to all other departments as needed.

(13) Be responsible for the Township Storm Water Management System ensuring compliance with the approved Stormwater Management Plan and State regulations governing storm water systems.

(14) Administer the provisions of Section 15-48, tree removal and protection, of the Township Land Development Ordinance.

(15) Supervise maintenance and repair of specified public buildings.

(16) Recommend to the township manager the use of consulting engineers for specific projects, subject to the approval of the council.

(17) Not review or exercise jurisdiction over any project in which the engineer or any member of the engineer’s firm rendered professional services.

(18) Supervise the staff of the Engineering Division.

(19) In accordance with existing ordinances, issue permits and enforce provisions with regard to soil removal, soil conservation and protection, and steep slope disturbance.

(20) Exercise duties in accordance with Land Development 15-84 “Final Approval of Major Subdivision and Site Plans.”

(21) Issue work orders directed to the Director of Public Works for repair, maintenance and improvements of township owned streets and properties.

SECTION TWO. Division 11, Section 2-347, Division of Zoning Administration/GIS, of Article III, General Administrative Organization, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby renumbered, renamed and amended as follows:

Sec. 2-158. Division of planning/zoning administration/GIS.

(1) For purposes of this chapter, “GIS” means geographical information system, which is a computer mapping system used in the analysis of geographic data.

(2) Within the office of the manager there shall be a division of planning/zoning administration/GIS, the head of which shall be the planning and zoning administrator.

(3) The planning and zoning administrator shall be the staff liaison to the planning board, board of adjustment and environmental commission. Further, the planning and zoning administrator shall undertake the following:

a. Supervise the staff of the planning/zoning administration/GIS division.

b. Advise and determine the completeness of applications pending before the planning board and board of adjustment.

c. Supervise the development and maintenance of a GIS and related systems.

d. Act as the municipal housing liaison for the purpose of administering the township’s affordable housing program pursuant to the Fair Housing Act.

e. Interface with consulting planners employed by the township council and boards.

f. Act as staff liaison for the administration of matters of land use and planning activities ongoing within the township, County, State and Highlands Council.

g. Be the administrative officer for the purposes of carrying out the statutory responsibility of N.J.S.A. 40:55S-1, et seq. the Municipal Land Use Act.

(4) A zoning officer appointed by the township manager shall enforce the zoning regulations of the township. Responsibilities include, but are not limited to the following:

a. Review of applications for development and/or construction prior to the issuance of construction permits to determine compliance with zoning standards.

b. Issuance of zoning permits and zoning certificates of occupancy.

c. Performance of regular inspections within the township to ensure compliance with zoning ordinances and approvals.

d. Issuance of notices and/or summonses for violations of the zoning code or violations of site plan conditions as set by the planning board or board of adjustment.

e. Preparation of reports on applications pending before the board of adjustment.

SECTION THREE. Division 11, Department of Engineering, Public Works and Zoning Administration/GIS, of Article III, General Administrative Organization, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, is hereby renumbered, renamed and amended to read as follows:

DIVISION 11. DEPARTMENT OF PUBLIC WORKS

Sec. 2-341. Established; head; qualifications of director of public works.

(1) There shall be a department of public works, the head of which shall be the director of public works.

(2) The director of public works, prior to appointment by the township manager, shall have experience in road construction, be able to operate road construction equipment and be a certified public works manager in the State of New Jersey.

Sec. 2-342. Organization.

Within the department of public works, there shall be the following divisions:

(1) Division of public roads, vehicle maintenance and recycling.

(2) Division of water and sewer.

Sec. 2-343. Powers and duties of director of public works.

The director of public works shall:

(1) Be responsible for the proper and efficient conduct of all public work projects of the township government.

(2) Supervise and direct:

a. The work of the department of public works;

b. The administration of records, payroll and inventory controls and cost analysis of the department of public works.

Sec. 2-344. Division of public roads, vehicle maintenance and recycling.

(1) Duties. The division of public roads, vehicle maintenance and recycling:

a. Maintain, clean and repair all public roads of the township including storm drainage systems.

b. Improve, construct and provide for the repair and maintenance of roads, sidewalks, parking lots, storm drainage systems, assigned buildings, curbs, gutters and trails.

c. Plan, administer, provide and control snow removal, sanding and salting operations on public roads and grounds that must be cleared to provide proper access and egress for emergency vehicles.

d. Control and supervise storage areas and equipment used by the department of public works.

e. In consultation with the department of police and emergency management, post and maintain regulatory and advisory signs and traffic control markings.

Sec. 2-345. Division of water and sewer.

(1) Established; head. Within the department of public works there shall be a division of water and sewer, the head of which shall be the superintendent of water and sewer.

(2) Qualifications of employees. The division of water and sewer shall have employees with the proper water and sewer operator’s licenses as required by the State.

(3) Composition. The division of water and sewer shall consist of a supervisor, maintenance operators and utility workers.

(4) Powers and duties generally. The division of water and sewer shall have such functions, powers and duties as may be prescribed by general law, ordinance or resolution.

(5) Specific duties. The division of water and sewer shall:

a. Inspect and maintain existing water and sewer facilities.

b. Assist in planning and construction of new water and sewer facilities.

c. Supervise and inspect planning and construction of water and sewer lines installed by private contractors.

SECTION FOUR. All Ordinances of the Township of Randolph that are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

SECTION FIVE. If any section, subsection, clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.

SECTION SIX. This Ordinance shall take effect as provided by law.

NOTICE IS HEREBY GIVEN that an Ordinance entitled “An Ordinance Amending Divisions 2 and 11 of Article III of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, to Reflect Changes in Organizational Structure of the Office of the Manager and the Department of Engineering, Public Works and Zoning Administration/GIS” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on November 1, 2007 and was introduced, read by title and passed on the first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for a second reading and final passage thereof at their regular meeting to be held on December 6, 2007, at 8:00 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be held thereon by the Governing Body and all parties in interest and citizens shall have the opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to amend Divisions 2 and 11 of Article III, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey, to reflect changes in the organizational structure of the Office of the Manager and the Department of Engineering, Public Works and Zoning Administration/GIS. The amendments bring the Division of Engineering and the Division of Planning/Zoning Administration/GIS under the office of the Manager. It restructures the Department of Engineering, Public Works and Zoning Administration/GIS to be named the Department of Public Works consisting of two Divisions: the Division of Public Roads and Grounds and the Division of Water and Sewer.
