An ordinance amending the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey to rezone Block 76, Lots 7 and 8 on the official tax map of the Township of Randolph from R/PO Residential and Professional Office District to the PO/R Professional Office and Residential District, to increase the floor area ratios in the B-1 Neighborhood Business District and in the PO/R Professional Office and Residential District and to remove the maximum structure size restriction in the PO/R Professional Office and Residential District
WHEREAS, the Municipal Land Use Law (“MLUL”) of the State of New Jersey, N.J.S.A. 40:55D-1 et seq. grants to municipalities the power to adopt a zoning ordinance relating to the nature and extent of the uses of lands, buildings and structures thereon; and
WHEREAS, the Township of Randolph (“Township”) desires to modify its existing Land Development Ordinance by rezoning Block 76, Lots 7 and 8 on the Official Tax Map of the Township of Randolph, commonly known as 714 Route 10 and 720 Route 10, from R/PO Residential and Professional Office District to the PO/R Professional Office and Residential District to allow professional office use as requested by the owner; and
WHEREAS, the Township of Randolph (“Township”) desires to amend Section 15-26.4, Article IV, Zoning, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey to increase the floor area ratio in the B-1 Neighborhood Business District to 0.15; and
WHEREAS, the Township of Randolph (“Township”) desires to amend Section 15-31.3, Article IV, Zoning, of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey to increase the floor area ratio in PO/R Professional Office and Residential District to 0.15 and to delete the maximum structure size restriction in the PO/R Professional Office and Residential District.
NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Randolph, County of Morris, and State of New Jersey as follows:
SECTION ONE. The Zoning District for the following properties listed by block, lot and street address shall be changed as follows:

SECTION TWO. Section 15-26.4G of Article IV, Zoning, of the Land Development Ordinance of the Township of Randolph is hereby amended to read as follows:
G. Maximum Floor area ratio: 0.15.
SECTION THREE. Section 15-31.3F of Article IV, Zoning, of the Land Development Ordinance of the Township of Randolph is hereby amended to read as follows:
F. Maximum Floor area ratio: 0.15.
SECTION FOUR. Section 15-31.3H of Article IV, Zoning, of the Land Development Ordinance of the Township of Randolph is hereby deleted in its entirety.
SECTION FIVE. The Zoning Map of the Township of Randolph, Morris County, New Jersey is hereby amended to reflect the Zoning Map revisions set forth in this Ordinance and as set forth in the attached Exhibit A entitled, Zoning Map Revision Block 76, Lots 7 & 8.
SECTION SIX. All ordinances or parts of ordinances in conflict or inconsistent with any part of this Ordinance are hereby repealed to the extent that they are in such conflict or are inconsistent.
SECTION SEVEN. This Ordinance may be renumbered for codification purposes.
SECTION EIGHT. In the event that any section, part or provision of this Ordinance shall be held to be unenforceable or invalid by any court, such holding shall not affect the validity of this Ordinance as a whole, or any part thereof, other than the part so held unenforceable or invalid.
SECTION NINE. This Ordinance shall take effect twenty (20) days after passage and publication as provided by law.

ORDINANCE NO. 6-08
NOTICE IS HEREBY GIVEN that an Ordinance entitled “An Ordinance Amending the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey to Rezone Block 76, Lots 7 and 8 on the Official Tax Map of the Township of Randolph from R/PO Residential and Professional Office District to the PO/R Professional Office and Residential District, to Increase the Floor Area Ratios in the B-1 Neighborhood Business District and in the PO/R Professional Office and Residential District and to Remove the Maximum Structure Size Restriction in the PO/R Professional Office and Residential District” was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on March 6, 2008 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on April 3, 2008 at 8 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of the above Ordinance is to modify the zoning of Block 76, Lots 7 and 8 on the Official Tax Map of the Township of Randolph from the R/PO Residential and Professional Office District to the PO/R Professional Office and Residential District to allow professional office use as requested by the owner and to amend the Zoning Map of the Township of Randolph , Morris County, New Jersey, as appropriate. The purpose of the above Ordinance is also to increase the floor area ratios in the B-1 Neighborhood Business District and the PO/R Professional Office and Residential District to 0.15 from its current 0.13 and to delete the maximum structure size restriction of 7500 square feet in the PO/R Professional Office and Residential District.
