Minutes: February 21, 2008

A regular meeting of the Randolph Township Council was called to order at 8:00 p.m. by Mayor Napoliello. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and, to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Morris County Daily Record and the Randolph Reporter on December 11, 2007, by emailing them the annual resolution adopted by the Council on December 6, 2007. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, on December 20, 2007, and in the Morris County Daily Record on December 27, 2007.

OPEN TO PUBLIC

Pat Hogan, 91 Morris Turnpike, spoke on behalf of the Randolph Senior Club. She is requesting that Council allot $400.00 per month to subsidize trips for senior citizens in the club since many are unable to afford them without assistance.

Judith Stewart, 114 Everdale Road, stated that if Council agrees to subsidize trips for the Senior Club, then they should instead pay the entire amount for some trips and provide no money for other trips. She believes there are seniors who can’t afford to pay even discounted prices for trips. Mrs. Stewart also expressed her frustration that minutes from Executive Sessions have not yet been released to the public, as is required by law. She also questioned the appropriateness of signs promoting one side of the upcoming pool referendum being placed on municipal property.

Manager Lovell responded that signs promoting the other side of the pool issue are also being placed on municipal property. It is his position that both sides have a right to place signs. He also noted that the signs promoting the pool are within regulation size.

Mayor Napoliello reminded the audience that signs promoting the library referendum were also placed on municipal property.

Lee Whilden, 82 Radtke Road, stated that she received many calls regarding the signs on municipal property. She expressed her belief that township officials have set a bad example for the public by allowing these signs on municipal property.

Seeing no one further from the public, the public portion was closed.

COUNCIL AND MANAGER REPORTS

Councilman Obremski reminded the council that he will be out of town for the February 28 meeting. He is a member of a sub-committee working on the new initiative for the Traffic Advisory Committee, incorporating a driver simulator program to the teen driving safety program at the school. The Police Academy on Hanover Avenue has a simulator, and he is working with them to start a pilot program where employees of the township will be trained on the simulator as well as use by the students. The Councilman asked the Manager to check with our insurance carrier to see if there could be any type of financial benefit to the town for this training. He also asked Mrs. Gallo if money in the trust fund can be used towards the purchase of an additional simulator to be maintained at the Academy.

Deputy Mayor Metz is working with the Municipal Alliance Committee to complete data required by the state.

Mayor Napoliello relayed an invitation to the council to attend the 5th Annual Morris County Municipal Summit on March 19 starting at 5:00 p.m. at the County College of Morris.

Councilman Alpert stated that the traffic light on Hanover Avenue and Shongum Road is creating problems during inclement weather when it is not changed to blinking mode.

Manager Lovell responded that he will contact Parsippany’s mayor about the issue.

DISCUSSION

(1) 2008 Budget Review

Michael Soccio, Randolph’s Finance Director, presented and summarized a document comparing the township’s operation of the water and sewer entities between 2006 and 2007.

Manager Lovell presented information touching on the following issues:

  • A document showing how funds are allocated between budget, reserve for uncollected taxes, surplus, miscellaneous revenues, state aid, and receipt of delinquent taxes
  • Breakdown of expenditures by category, such as public safety, general government, public works, and community programs
  • The Township is also the tax collector for both the school and county
  • Reserve for Uncollected Taxes has remained over 98 percent for the 10 years
  • Tax appeals and how they are affecting the budget
  • Funds in the surplus account
  • The snow removal budget numbers
  • Credit card processing, the ability of residents to use credit cards for recreation programs and court, and the ability to set up electronic transfers for tax payments
  • Municipal court changes in scheduling and salary and wages
  • Changes in the Engineering Department and savings in salary
  • Rising utility costs and potential energy enhancements to offset those costs
  • Rising fuel costs
  • Increase in salary for Planning and Zoning Administrator
  • Denial of part time consulting position for Economic Development Committee
  • Possibly reinserting proposed immunization program if off-setting revenue can be placed into the budget
  • Dealing with distressed properties in town
  • Increased salary for Fire Marshall who has taken on the responsibilities of Emergency Management Director
  • Allowing a part time mechanic position for fleet management
  • Recycling and garbage tonnage trends
  • Library budget and how it is tied to the township’s equalized base
  • Celebration of public events such as funding the Freedom Festival Parade, allocation for fireworks, and a fall Country Fair
  • Increase in part time salary for Municipal Alliance Committee, however a decrease in contribution to MAC due to money sitting in escrow account that can be used
  • Significant impact of two pension systems
  • Accumulated leave
  • Group health insurance
  • Special election expenditure
  • The amount for open space markers has been pulled from the budget and will be picked up from the Open Space Trust Fund
  • Removal of feasibility study for Mt. Freedom
  • Removal of a Landmarks Committee request for a kiosk at Combs Hollow
  • Deferral of air conditioning request for Randolph Museum due to other improvements at the museum demanding priority
  • Removal of purchase of replacement of a four wheel drive vehicle for police
  • Removal of a LED sign for Freedom Park

Deputy Mayor Metz asked why the Manager and Finance Director prepare the budget in a budget versus budget manner instead of a budget versus actual numbers manner.

Manager Lovell responded that he doesn’t want to send a message that if budgeted money is not spent, it will be lost the next year. Instead, he looks at what was spent to see if that amount is in line with past expenditures.

Mr. Soccio responded that he is often receiving bills late into the new year for past years’ expenditures, so end of year expenditure numbers are not always accurate.

The Manager noted that, in preparation for the next budget meeting, he will put together a list of further reductions to the budget at 1/3 cent increments.

Councilman Algeier asked the Manager to break down the total amount of taxes collected and indicate how much goes for purposes other than municipal, such as county and schools. His estimates indicate that only 19 cents of every dollar collected goes to municipal purposes, which includes open space. He feels this information is important for the taxpayers to be aware of. The councilman also noted that when a tax appeal is settled, the township is the only one of the three entities—meaning school, county, and township—responsible for the financial settlement.

Deputy Mayor Metz noted that he was looking at other towns in Morris County and what they pay in taxes. Of the 39 towns, Randolph places 10th highest. Those towns above Randolph offer similar services and advantages, and although a couple of towns beneath Randolph offer similar services, most of the other do not compare with Randolph. He believes Randolph is doing a good job.

(2) Proposed Zone Changes—R/PO and B-1

Manager Lovell referred to an email from Darren Carney, the Planning and Zoning Administrator, outlining areas to be addressed. They include:

  • Block 76, Lots 7 and 8, will be removed from the R/PO zone and placed into a P/OR zone
  • Change in maximum structure size
  • Change in floor area ratio
  • Slight change in B-1 floor area ratio

The Manager has asked Mr. Carney to work with the Planning Board attorney to be certain of assurances that would settle outstanding litigation. If this is the case, an ordinance will be ready for introduction in March.

Councilman Algeier asked that the ordinance be prepared in advance so as to allow enough time for council review.

(3) Schedule Highlands Presentation for March 25

Manager Lovell stated that the Executive Director and the Assistant Executive Director will be providing a presentation on the Highlands to the council. The presentation will most likely run two to three hours and include the presentation, a discussion, and a question and answer session. The Manager expressed his conviction that this presentation is important so that the council learns as much as possible about the Highlands and the impact to Randolph. It also provides an opportunity for the Highlands to hear Randolph’s concerns regarding COAH impacts.

Mrs. Stewart asked that the Environmental Commission be invited to this session.

Mayor Napoliello stated that he attended a meeting of the Morris County League of Municipalities where the new president, Bill Chegwidden, asked for possible support for a resolution to COAH indicating dissatisfaction on the part of municipalities.

Manager Lovell suggested inviting Ed Buzak, who is very knowledgeable about COAH matters, and Bob Michaels to provide a presentation to the council on COAH matters and implications to Randolph.

Councilman Algeier stated that he has heard that compliance with COAH is voluntary and asked what would happen if Randolph were to decide not to comply.

A. Refunds/Adjustment Resolutions

(1) Refund Registration Fee for Two Children to Participate in Little League to Greg Morris, 675 Millbrook Avenue—$120.00

WHEREAS, Greg Morris registered his two (2) children for Little League and paid the fee of $120.00; and

WHEREAS, he has presented the Recreation and Community Services Department with a hardship case in which he still would like the children to participate in the program while requesting a fee waiver for the program from our department.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by John Van Brunt, Director of Parks, Recreation and Community Services, that $120.00 be refunded to Greg Morris, 675 Millbrook Avenue, Randolph, NJ 07869.

(2) Refund Registration for Teen Studio and Portfolio Class Due to Lack of Enrollment to Mr. and Mrs. Storms, 46 Quail Run—$180.00

WHEREAS, Mr. and Mrs. Storms registered their child for Artworks Studio and paid the registration fee of $180.00; and

WHEREAS, their child will not be attending the program due to lack of enrollment for the “Teen Studio and Portfolio” program.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by John Van Brunt, Director of Parks, Recreation and Community Services, that the full cost of the program be refunded to Mr. and Mrs. Storms, 46 Quail Run, Randolph, NJ 07869.

(3) Release Escrow Funds for Block 42, Lot 107, to Omni Communications, c/o Gregory Meese, Esq.—$3,340.75

WHEREAS, the Planning and Zoning Department received escrow funds from Omni Communications for Block 42, Lot 107, in the amount of $7,500.00; and

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Darren Carney, Planning and Zoning Administrator, that the remaining escrow funds in the amount of $3,340.75 plus interest be refunded to Omni Communications, c/o Gregory Meese, Esq., Price, Meese, 50 Tice Boulevard, Woodcliff Lake, NJ 07677.

(4) Release Escrow Funds for Block 5, Lot 8, to Omni Communications, c/o Gregory Meese, Esq.—$7,920.75

WHEREAS, the project has been withdrawn and there are no outstanding payments due.

B. Authorizing Purchases From MCCPC Contract #23 Police Uniforms And Equipment From Various Vendors—Not to Exceed $24,000.00

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to purchase from Morris County Cooperative Pricing Council Contract #23 as needed for all departments in the township.

C. Authorizing Purchases From MCCPC Contract #47 From Various Vendors for Water Meters/Data Recorders and Radio Frequency Meter Interface Units—Not to Exceed $50,000.00

WHEREAS, these purchases are made for monthly services and equipment on an as-needed basis; and

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to purchase from New Jersey State Contract #T216A using various vendors as needed for all departments in the township.

E. Authorizing Purchases From MCCPC Contract #1 Motor Gasoline From Allied Oil Company—Not to Exceed $140,000.00

J. Authorizing an Award of Contract #20-A (Sporting Goods) as a Result Of a Coin-Toss

WHEREAS, on January 30, 2008, the Township of Randolph, on behalf of the Morris County Cooperative Pricing Council, conducted a coin-toss lottery as a result of tie bids received on October 23, 2007, for portions of Contract #20-A (Sporting Goods); and

WHEREAS, the winners of the above-mentioned coin-toss lottery appear in the summary below:

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that the above-mentioned items in Contract #20-A (Sporting Goods) be awarded to the vendors noted herein.

K. Authorizing Mayor to Sign CDBG Grant for the Purpose of Upgrading Kitchen and Second Floor Bathroom at Randolph Group Home at 40 Schoolhouse Road

WHEREAS, John Komisor, on behalf of Delta Community Supports, has made application for CDBG grant money to upgrade the kitchen and second floor bathroom at a group home located at 40 Schoolhouse Road in Randolph, NJ; and

WHEREAS, part of the application process is to present the project to council for their acknowledgement; and

WHEREAS, the Township Council recognizes that this organization provides a vital commendable service to the community and the residents of 40 Schoolhouse Road.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, does hereby support Delta Community Supports in their request for a CDBG grant.

L. Authorizing Professional Services Agreement with Integra Realty Resources for Professional Appraisal Services—Not to Exceed $20,000.00

WHEREAS, the Township of Randolph has a need to acquire Integra Realty Resources, Whippany, New Jersey, as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; and

WHEREAS, Gail Catania, Purchasing Coordinator, has determined and certified in writing that the value of the acquisition will exceed $17,500.00; and

WHEREAS, the anticipated term of this contract is one year and may be extended as approved by this governing body; and

WHEREAS, Integra Realty Resources has indicated they will provide the Professional Appraisal Services for an amount not to exceed $20,000.00; and

WHEREAS, Integra Realty Resources has completed and submitted a Business Entity Disclosure Certification which certifies that Integra Realty Resources has not made any reportable contributions to a political or candidate committee in the Township of Randolph in the previous one year, and that the contract will prohibit Integra Realty Resources from making any reportable contributions through the term of the contract; and

WHEREAS, funds are available for this purpose.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to enter into a contract with Integra Realty Resources as described herein.

BE IT FURTHER RESOLVED that the Business Entity Disclosure Certification and the Determination of Value be placed on file with this resolution.

CERTIFICATION OF AVAILABILITY OF FUNDS

Dated: February 21, 2008

As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Michael J. Soccio, Director of Finance of the Township of Randolph, have ascertained that funds are available in Ordinance #23-00, Acquisition of Land for Open Space, to award a contract to Integra Realty Resources for Professional Appraisal Services in the amount not to exceed $20,000.00.

M. Authorizing the Execution of a Webmaster Contract on Behalf of the Morris County Cooperative Pricing Council Between Randolph Township and Pavia Kriegman for the Maintenance of the Website From January 15, 2008, to January 15, 2010—Not to Exceed $6,000.00

WHEREAS, the Township of Randolph, on behalf of the Morris County Cooperative Pricing Council (“MCCPC”), undertook a joint effort with Pavia Kriegman to develop a MCCPC website for the benefit of the MCCPC members and vendors; and

WHEREAS, now that the MCCPC website has been developed and is functional, the MCCPC desires to enter into a contract with Ms. Kriegman for the maintenance of the website as specifically set forth in the Webmaster Contract for the period of January 15, 2008, through January 15, 2010, at a total cost of $250.00 per month for a total contract price of $6,000.00.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

1. The general terms and conditions of the Webmaster Contract dated February 13, 2008, by and between the Morris County Cooperative Pricing Council and Pavia Kriegman for the maintenance of the MCCPC website for the period of January 15, 2008 through January 15, 2010 at a cost of Two Hundred Fifty Dollars ($250.00) per month for a total contract price of Six Thousand Dollars ($6,000.00) are hereby approved.

2. The Township hereby authorizes and approves any non-substantive modifications to the Webmaster Contract as may be recommended and approved by the Township Manager prior to execution.

N. Authorizing the Execution of a Webmaster Contract for the Maintenance of the Township Website From January 15, 2008 to January 15, 2009 - Not to Exceed $5,400.00

WHEREAS, the Township of Randolph (“Township”) undertook a joint effort with Pavia Kriegman to develop a Township website for the benefit of the Township residents; and

WHEREAS, now that the Township website has been developed and is functional, the Township desires to enter into a contract with Ms. Kriegman for the maintenance of the website as specifically set forth in the Webmaster Contract for the period of January 15, 2008, through January 15, 2009, at a total cost of $450.00 per month for a total contract price of $5,400.00.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

1. The general terms and conditions of the Webmaster Contract dated February 15, 2008, by and between the Township of Randolph and Pavia Kriegman for the maintenance of the Township Website for the period of January 15, 2008, through January 15, 2009, at a cost of Four Hundred Fifty Dollars ($450.00) per month for a total contract price of Five Thousand Four Hundred Dollars ($5,400.00) are hereby approved.

2. The Township hereby authorizes and approves any non-substantive modifications to the Webmaster Contract as may be recommended and approved by the Township Manager prior to execution.

O. Expressing Condolences to the City of Kirkwood, Missouri, on the Tragic Murders of Two Members of the City Council, Two Police Officers, the Public Works Director, and the Serious Wounding of the Mayor

WHEREAS, the Township Council of the Township of Randolph, Morris County, New Jersey, has read of the tragedy suffered by the City of Kirkwood, Missouri, on Thursday, February 7, 2008, when two members of the City Council, two Police Officers, and the Public Works Director were murdered and the Mayor was shot and critically injured at a meeting of the City Council; and

WHEREAS, the tragedy is of great concern to all who serve their communities in public office.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, that the Township Council expresses, on behalf of the Township of Randolph, its condolences to the City of Kirkwood on the loss of its dedicated public officials and its best wishes for the recovery of the Mayor.

BE IT FURTHER RESOLVED that a certified copy of this Resolution shall be forwarded to this City Council of the City of Kirkwood, Missouri.

OPEN TO PUBLIC

Constance Stroh, 19 Dogwood Trail, noted that there has been a recent application for development on a property adjacent to Randolph and she asked if Randolph had an official position or participated in discussions related to this proposed development.

Manager Lovell responded that Randolph has been involved with this issue for a number of years due to concerns about the size of the development and the impacts to Randolph and Canfield Avenue. The final outcome of this project was tied to a large open space acquisition by Mine Hill using state and county money. From Randolph’s perspective, it makes sense to see that project approved as opposed to seeing the acquisition of the open space collapse. It remains to be seen whether or not that project is ever actually built.

Judith Stewart, 114 Everdale Road, stated that she appreciates the budget presentation and has reviewed the budget completely. She will continue to raise questions about recycling and the abatement of fees in the Parks Department, as well as how funding for senior citizens’ programs is allocated. Noting that there has been request to subsidize the Senior Club, she expressed her belief that priority should be given to providing more bus services for senior citizens and others who aren’t able to drive, enabling them all to participate in local programs. Mrs. Stewart reiterated her belief that Randolph is lucky to have the Township Manager and Finance Officer and she anticipates supporting the budget.

Seeing no one else from the public, the public portion was closed.

COUNCIL AND MANAGER COMMENTS

Councilman Algeier stated that he attended a meeting hosted by the Morris County engineering staff dealing with Sussex Turnpike. Since the state has declared that they will not be taking on the project, the county has stepped up and agreed to undertake those improvements on a limited scale, the irony being that those limited improvements are what Randolph had wanted all along. Design plans are being reviewed by township staff and will be shared with the council and public. The Councilman cautioned that any suggestions for changes to the design plans should be made quickly, because once those plans are finalized, it is difficult to get any changes through at that point.

Manager Lovell stated that he and Bill Kerwick made a presentation to the Board of Education, which was well received. Feedback from the Board is expected over the next several weeks. Their decision to participate in the fuel pump depot needs to be made quickly so that work can be done during the period when school is out of session. The Manager and Mayor Napoliello met with some senior citizens regarding proposed renovations to the senior building on Calais Road, which was also very well received. The seniors will appoint a committee to review plans as they are being formalized to provide input on issues affecting them.

EXECUTIVE

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

1. The public shall be excluded from the following portion of the meeting.

2. The general nature of the subject matter to be discussed is as follows:

EA Porter

Manager Lovell stated that Ed Buzak’s office is in the process of clearing out the squatters remaining in the EA Porter building at this time. JIF will be conducting an inspection on the building based upon his complaints to them regarding their treatment of Randolph. He has been meeting with a variety of people interested in that building over the last several months. This building has water through the Dover system, sewers, it’s in an area where redevelopment is desirable, it’s got a 40,000 square foot footprint, and if it were developed as a mid-rise level it could accommodate a lot of units.

His office has received a proposal to purchase the property. If the council were interested in selling this property, it would have to be done through an auction.

The Manager presented the following issues related to that building:

  • The council could move forward with an auction
  • The council could decide to clean up the site and plan for the re-utilization of the site and maintain control of it
  • Low/moderate income senior housing complex with Morris County
  • Combination market housing and COAH housing
  • Possible commercial uses
  • Remediation of the property is estimated at $400,000.00—perhaps money from the Developers’ Trust Fund could be used for this purpose as well as developing site plans and possible COAH housing
  • Whoever purchases this property will most likely apply for a zone change

Manager Lovell suggested that council hold off with the selling of this property until after remediation has taken place.

The council agreed with the Manager’s suggestion.
