A. OPENING OF REORGANIZATION MEETING

1. Call to Order

The annual Reorganization Meeting of the Randolph Township Council was called to order at 1:00 p.m. by Councilwoman Veech. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 4, 2015, by e-mailing them the annual resolution adopted by the Council on December 3, 2015. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and the Daily Record on December 10, 2015.

F. RECOGNIZE 2015 RANDOLPH MAYOR JOANNE VEECH

Manager Mountain recognizing 2015 Mayor Joanne Veech
2015 was a busy and productive year for Randolph Township and through it all Mayor Veech provided tremendous leadership for the Council and support for the entire municipal organization.

Manager Mountain personally enjoyed working with Mayor Veech on a number of projects and initiatives and appreciated greatly the guidance and support she had provided to him as Manager.

It is difficult to sum up any Mayor’s term in a few minutes, but here are just a few words that he felt best represented Joanne’s contributions during the past year:

  • Passion
  • Energy
  • Creativity (ideas)
  • Outreach

On behalf of the entire organization Manager Mountain thanked Mayor Veech for her leadership, her time and above all else her support throughout the past year.

2016 Mayor Roman Hirniak recognizing 2015 Mayor Joanne Veech:
This is typically the case that Manager Mountain will say something that will prompt thoughts in my mind and he did the same just now when he mentioned a concept of ideas and outreach. One of the things that Joanne was very good about was following through on these ideas and on outreach. These were not simply concepts that were bandied about at a Council meeting. They actually took root and not only took root during Joanne’s year as Mayor but will continue to take root as my year as Mayor and I suspect for subsequent years. In other words, these are ideas that were important for the Township and that’s why the Joanne brought them up and ideas that will continue to be important to the Township. These are ideas that I expect as the Mayor for the next twelve months to follow through on and continue with. Thank you for planting the seed that is going to make my twelve months a little easier.

2015 Mayor Joanne Veech:
Councilwoman Veech thanked Manager Mountain and Mayor Hirniak for their kind words and welcomed elected officials, volunteers, citizens, township employees, families, friends and stated the following:

Serving as Mayor, I first have to thank my husband Skip, for endless nights, at home alone, and leftover dinners. Many of you have lived or are living the same type of life style, working all day, sometimes working out of NJ or the US in my case, and then coming home only to rush out again to an important township meeting or fundraiser; coming home exhausted at the end of the night. He’s always been there to cheer me on and let me know it was okay to go ahead, leave him, and fulfill the commitment I undertook. He’s been so supportive, I can’t thank him enough. You’ll always be my first man of Randolph...

It’s been an honor to serve the people of Randolph. My goal has always been and will continue to be - preserving and advancing our township’s quality of life. That’s why we all moved here. That’s what’s important; how we treat each other, and how we come together as a community in good times and bad.

2015 has been mostly quiet, thank God. Only good things, and good progress; talking about progress, some highlights include...

  • The fact that we are almost finished with our Parks and Recreation Master Plan, last year you might remember - I was a proponent and avid cheerleader for a Community Garden; and for more passive adult activities. Well, it appears our township residents also indicated on their surveys, and in their focus groups, they too agree. A garden and much more maybe in our future, stay tuned for the recommendations of this process, and the Council’s endorsement through our budget process, of future enhancements to our parks and recreation.
  • Our Township Master Plan is also underway and getting close to being completed. It continues to focus on development in four areas of our township, and is very much in line with our plan from ten years ago.
  • Our clergy in town have united this year to form a clergy council, after having brought them together here a few months ago. We are happy to have served as a conduit for this formidable group to unite.
  • We also brought over two dozen Morris County Realtors together, providing them with the information they should use to help sell Randolph to people looking to settle in this area, and to new businesses looking for a home.
  • And this year I asked to meet with our top ten taxpayers and hear what they think, and their satisfaction with our township services. Our businesses know we support them and we truly do rejoice in their success. They were all very pleased by the way.

As my service as Mayor ends, I join three past Mayors on the dais. Collectively, this Council has decades of municipal governing experience, and that should provide our citizens comfort knowing we bring fiscal experience and knowledge of how this town works best; what our citizens expect, and the heart, will, and passion, to make living in Randolph the best it can be for everyone.

Thank you to the Council for supporting me, and for your service to this township.

Thank you Steve for the hundreds of hours of phone calls and meetings we had together, and your willingness to do whatever it took to reach our goals.

Thanks to our township employees, police, volunteer firemen, all of you, for being so receptive and willing to help me and the Council with our endeavors. Your smiles and friendliness mean so much, to so many.

Thanks also go to the citizens and business owners of this town for welcoming me as Mayor and sharing their ideas and point of view. Our Council continues to hear everyone’s voice.

I plan to continue to serve this great town, and continue to ensure the highest quality of life for our citizens.

G. COMMENTS BY MAYOR AND COUNCIL

Mayor Roman Hirniak:

I’d like to start today by welcoming our residents, friends and guests, who tempered their revelry last night in order to join us on this day of transition from one municipal year to the next.

I would like to also extend warm greetings to those dignitaries here today representing our Federal, State and County governments. Thank you for your tireless support and cooperation, as we collectively strive to improve the lives of our citizenry and maintain the quality of life which makes Randolph an exceptional place to live. A special hello as well to our colleagues from nearby municipalities and best wishes in the new year.

Beginning with today’s Reorganization Meeting and continuing over the next twelve months, I will be tasked with not only presiding over this Council, but also advocating on behalf of its members to ensure a steady and focused improvement in the quality of life enjoyed by our residents. My responsibilities will be varied and include working with Deputy Mayor Carey, Board of Education President MacKay and Interim Superintendent Fano to provide our schoolchildren with an environment that propels them into becoming future leaders within our community. I will be returning to the Planning Board and along with Councilman Guadagno, resolve in maintaining a strong voice concerning how our land use development regulations are being both interpreted and implemented. As Communications Liaison to our media and press outlets, I will be working with those institutions to provide our residents with a window into what their elected officials are legislating. And I will be liaising to the Township’s Economic Development Committee, a body which promotes the welfare of our commercial citizens, whether large or small. This Council and preceding Councils have consistently worked to expand the opportunities for Randolph businesses to flourish and grow. That has always been our mantra and it will most assuredly continue to be so in calendar year 2016. In each of these roles, I look forward to establishing new relationships with committee members who I have yet to meet and cementing existing relationships with those whom I’ve gotten to know over the years.

First and foremost, thank you to our Township Manager Steve Mountain, Township Clerk Donna Luciani and the professionals on their respective staffs. I use the term “professionals” because that is what these individuals are, best described at our recent Employee Appreciation Breakfast as the primary reason that Randolph is constantly being cited as an example of how to properly run a municipal corporation, not just amongst our peers in the County but throughout the State.

Next, thank you to Chiefs Stokoe and Cohrs. Your respective departments not only protect our material treasures, but also, and more importantly, our individual safety and security. The Council and Town Hall are able to focus on the business of running the Township, because the pride and honor of your members allow us to do so.

And finally, a thank you to Joanne Veech. Over the past 12 months, your stewardship of the Office of Mayor of Randolph has moved us in a positive direction. The accolades placed on the record by Steve at our last Council meeting are well deserved.

In closing, I’d like to wish everyone peace and prosperity in 2016. May God bless you, your families and all of us on the Township Council. And may we all gather again in this chamber 12 months from now, to celebrate and enjoy the mutual connections which have brought us together this afternoon.

Deputy Mayor Christine Carey:

Good afternoon and Happy New Year to all of you who were so kind to join us today.

Thank you to all of the family members, friends, staff, and elected officials who have come here today to be a part of our re-organization meeting.

First, I want to thank our outgoing mayor, Joanne Veech, for doing such an outstanding job this past year. Joanne, congratulations on a job very well done. Joanne brought a lot of passion and love of Randolph to her time as Mayor.

Next, I would like to congratulate our new mayor, Roman Hirniak. I have known Roman for several years and I am certain that Roman will be an excellent leader as the Mayor of Randolph in 2016.

I would also like to recognize our exceptional staff and volunteers—many of whom are here today—led by our Town Manager, Steve Mountain. The staffs who work in this building and throughout the town really do a terrific job of keeping this town safe, keeping it running very smoothly and providing quality services to Randolph residents. Steve Mountain is an outstanding Town Manager and I’m very happy that the Council brought him to Randolph almost 2 years ago now.

In 2016, my fourth year as a member of the Town Council, I have the honor of serving the Randolph community on various committees and Boards. I will continue to serve as the Mayor’s designee to the Randolph Library Board of Trustees, where this past year we conducted several focus groups and an extensive survey of library users to determine what we are doing well and where we may be falling short. In 2016, we plan to continue this initiative, but with a focus on non-users, and assess what we can be doing better to reach and serve this group of residents. I will also continue to serve on the Parks Master Plan Committee, which is working to update Randolph Township’s Parks and Recreation Master Plan. The resulting plan will set the course for township parks, recreation, and trail initiatives for the next decade.

In addition, I am looking forward to being the Council Liaison, along with the Mayor, to both the Randolph Board of Education and the County College of Morris. These two organizations play critical roles in the Randolph community and it is important that we continue to maintain a close working relationship with them.

Finally, it is an honor to serve the residents of Randolph in 2016 as Deputy Mayor. In that role, I am happy to support and assist the Mayor wherever I am needed.

I look forward to continuing to work with my esteemed colleagues on the Council, our town manager and our outstanding staff in 2016.

Councilman Mark Forstenhausler:

I would like to thank Mayor Veech for her dedicated service to the citizens of Randolph Township in 2015. She has done an outstanding job representing us, and I really appreciate all of her efforts this past year. Thank You!

Congratulations to Mayor Hirniak. I am confident that he will continue the Randolph tradition of outstanding leadership in the position of Mayor, and I look forward to serving in this Council with him at the head of the table.

And I would also like to congratulate Deputy Mayor Carey, and wish her all the best this coming year as well.

When things run smoothly, sometimes those in charge might go un-noticed, but I would like to publicly tell our Manager Steve Mountain that my colleagues and I have noticed, and would like to acknowledge his hard work which makes Randolph run so well.

In 2016 I will be serving as Council Liaison to the CDRS, the Environmental Commission, and the Public Safety Committee. Thank you all for coming, and Have a Happy, Healthy New Year.

Councilman Mike Guadagno:

I would like to thank Joanne for a job well done and congratulate Roman and Christine on their new appointments. My job in 2016 is that I am concerned with the township’s infrastructure. I work with the town on the roads, the water, the sewer, communications, retaining walls and sidewalks. I also encourage the gas companies to expand the gas line. The town has come a long way in preparation since Super Storm Sandy. We have installed backup generators and have warming stations in key locations in Randolph.

This year we have also finished out ten year Master Plan for the water the extensions to the older sections in town. We have also been working on our sewer facilities and extending the lines on the older sections of town as well. The town Master Plan has completed its seven year renewal this year and through that process we look at the town as a whole and decide where we are going to go next with improvements for the town. We have also completed out Wastewater Management Plan for the town and that has been submitted to the County.

This year I hope complete our communication facility which was lacking in Super Strom Sandy and would like to have Sussex Turnpike and West Hanover Avenue completed. I am also looking forward to the improvements that are being made to our parks services. Thank you for letting me serve as your Councilman and I hope you have a happy and healthy New Year

Councilman James Loveys:

I’d like to thank all of you for attending today and I wish everyone a happy, healthy, and safe New Year.

Special thanks to my wife Karen and two of our four children, James, and Abby for being here and sharing this day with me. My daughters Chelsea and Anna are unable to be here, but I know they are here in spirit. A commitment to public service places demands on family life and, from the bottom of my heart, I thank you for your continued support and understanding.

I thank our past year’s Mayor, Joanne Veech, for your outstanding representation of Randolph Township and this Council, the energy you brought to the office, and the leadership you provided.

And I congratulate my colleagues, Mayor Roman Hirniak and Deputy Mayor Chris Carey on your nominations. It’s an exciting day for you both. I have full faith in your abilities to lead this Council through the issues we’ll face in 2016.

In 2016 I look forward to returning as Council liaison to the Traffic Advisory Committee, which works to identify and help resolve traffic related issues throughout the township. It also assists and supports our Police Department with some of its’ initiatives such as this past year’s distracted driving awareness campaign and the use of various traffic calming devices, as well as taking a sincere interest in Randolph High School’s Share the Keys program. Historically, it has been a very productive committee and 2016 should be no different particularly in light of the ongoing County realignment of West Hanover Avenue with Brookside Road and related improvements further west on Sussex Turnpike.

I will also serve on the Municipal Alliance Committee. Overseen by the Governor’s Council on Alcoholism and Drug Abuse, administered by Morris County, and funded through Drug Enforcement Demand Reduction fines levied for drug related offenses, the MAC was established to combat alcoholism and drug abuse in our community.

Lastly, I continue to serve on the Facilities Work Group together with Deputy Mayor Carey and Councilman Forstenhausler. Our township owns and maintains seven public facilities, and leases and maintains one, out of which various services and program opportunities are offered to our residents. With the best interests of Randolph taxpayers in mind, much of the needed maintenance and renovation work is coordinated and performed by a dedicated team of township employees. Our Facilities Work Group will coordinate with our Township Manager and staff in order to plan for and prioritize our facility’s future capital improvement needs.

I continue to be thankful and appreciative for the opportunity to serve my community and all of our residents. I look forward to working with my fellow colleagues, our Township Manager, and township staff in 2016, all of whom I admire and respect, and will continue to be guided in my decision making by what is in the best interest of Randolph Township.

Thank you, and again, have a safe, happy, and healthy New Year.

Councilman Allen Napoliello:

Last year; was a very successful one as much was accomplished by the Council. The Township moved our animal pound operations to the Seeing Eye compound in Mendham. This was long anticipated and finally came to fruition and we have begun the long awaited redevelopment of the Mount Freedom area by the extension of a sewer line along Sussex Turnpike.

I personally want to thank Councilwoman Veech for the fine job she did as Mayor. I also want to congratulate our new Mayor Roman Hirniak and Deputy Mayor Chris Carey who will serve as our 2016 leaders. They will have my support.

Last year I was Council liaison to the Board of Health, the Recreation and Municipal Alliance committees. I also served as a member of the Morris County League of Municipalities as well as the League of Municipalities legislative committee which meets in Trenton.

The Board of Health meets every month with the Township Health Director. The Board is comprised of the Health director, three doctors, the former Randolph Animal Control Officer, three other residents, and a student member.

The Board of Health provides male and female cancer screenings, blood pressure screenings, Chem 23 blood profiles, flu shots, and curbside recycling. They oversee inspections of restaurant facilities, in town, to see that they are clean and that the food they serve is healthy.

The Recreation Committee oversees all recreational sports and facilities in the township. This affords residents from seven years old on up to our senior citizens to participate on recreational teams throughout the year.

The Municipal Alliance (MAC) is comprised of five resident members, a Police Officer, and several Board of Education and school officials. Their mission is to educate our students about drugs and alcohol abuse.

There are school based programs for both elementary and high school students. The MAC Committee applies for government grants and then uses the grant money to hire experts to come to speak to students and in some cases speak to parents. The harm that is done to young people if they take drugs or alcohol can be irrevocable.

This year I will continue to be liaison to the Board of Health and Recreation committee and I will also continue to be a member of the League of Municipalities and its Legislative Committee. I look forward to another very successful year for Randolph.

4. Cash Management

WHEREAS, the Township of Randolph adopted a Cash Management Plan on April 2, 1997; and

WHEREAS, the State of New Jersey periodically amends the statutory provisions governing cash management plans and permitted investments; and

WHEREAS, the Director of Finance has amended the Cash Management Plan of the Township of Randolph to incorporate these provisions.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Cash Management Plan as amended be approved.

BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey, that Pamela Vasta be appointed Certifying Officer and Darren Maloney be appointed as Supervisor for the Township’s Police and Firemen’s Retirement System and the Public Employees’ Retirement System for the year 2016.

6. Fees for Agendas

WHEREAS, N.J.S.A. 10:4-6 et seq., known as the “Open Public Meetings Act,” requires notices to be given of meetings of public bodies, as defined and prescribed in said statute, and further provides for the fixing of a reasonable charge to be paid by any person requesting such notices.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey, as follows:

  1. The Randolph Reporter and the Morris County Daily Record, as the newspapers having the greatest likelihood of informing the public of meetings to be held by the Township Council of the Township of Randolph, are hereby designated as the newspapers to receive notices of all meetings of this Township Council for the calendar year 2016 as required by the “Open Public Meetings Act.”
  2. The bulletin board located immediately adjacent to the Municipal Clerk’s Office in the main hallway of the Randolph Municipal Building shall be the place for posting of all notices of meetings of the Township Council during the 2016 calendar year.
  3. The sum of twenty ($20) dollars is hereby fixed as the fee to be paid by any person requesting that notices of meetings of the Township Council of the Township of Randolph during the 2016 calendar year be mailed to such person; but, as provided in N.J.S.A. 40:4-19, no charge shall be made to any newspaper requesting the mailing of such notices to its business office.
  4. Certified copies of this resolution shall be mailed by the Clerk of the Township to the Randolph Reporter and the Morris County Daily Record and a certified copy shall be filed with the Clerk of the Township.

7. Official Newspaper

BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey, that the Randolph Reporter be designated as the Official Newspaper for the Township of Randolph for the year 2016 and the Morris County Daily Record is the “backup” Official Designated Newspaper and are hereby designated as the newspapers to receive legal notices for the Township of Randolph for the calendar year 2016.

8. Rate of Interest on Delinquent Taxes and Delinquent Water and Sewer

WHEREAS, N.J.S.A. 54:4-67 has been amended to permit the charging of 8% of the first $1,500.00 of delinquent taxes and assessments, and 18% on any amount in excess of $1,500.00; and

WHEREAS, N.J.S.A. 54 also permits the charging of 8% interest on the first $1,500.00 of delinquent water and sewer charges and 18% interest on any amount in excess of $1,500.00; and

WHEREAS, the delinquent charges on finance agreements is 1 1/2 % per month in each installment in default for thirty (30) days.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, as follows:

  1. The rate of interest to be charged for nonpayment of taxes, assessments, water and sewer charges, on or before the due date shall be 8% per annum for the first $1,500.00 and 18% on any amount in excess of $1,500.00.
  2. No interest shall be charged if payment of any taxes and assessments is made within ten (10) calendar days of due date.
  3. The rate of interest to be charged on delinquent finance agreements is 1 1/2 % per month in each installment in default for thirty (30) days.
  4. This resolution shall take effect on January 1, 2016.

WHEREAS, Elizabeth Crescibene, Purchasing Agent, has determined and certified in writing that the value of these services will exceed $17,500; and

WHEREAS, the Township has agreed to retain The Buzak Law Group located at 150 River Rd, Ste N-4, Montville, NJ 07045 to provide the necessary Township Attorney services for a total amount not to exceed $300,000 ($25,000 per month) plus $160 per hour for litigation and escrow appeals; and

WHEREAS, the fees are as noted in the attached proposal; and

WHEREAS, the anticipated term of this contract is for the 2016 calendar year; and

WHEREAS, the contract with The Buzak Law Group is for a total amount not to exceed $300,000 ($25,000 per month) plus $160 per hour for litigation and escrow appeals and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and

WHEREAS, in accordance with the Anti Pay-to-Play Legislation, The Buzak Law Group has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and

WHEREAS, The Buzak Law Group has also submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, there are funds available for the retention of such professional services; and

WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

24. Resolution Appointing the Emergency Management Coordinator and Deputy Emergency Management Coordinator for the Township of Randolph

WHEREAS, the State of New Jersey Office of Emergency Management requires that each municipality appoint an Emergency Management Coordinator and;

WHEREAS, William Wagner, has been designated by the Mayor to act as the Emergency Management Coordinator for three (3) years with the term beginning January 1, 2016 for the Township of Randolph and;

WHEREAS, the Fire Official for Randolph Township, Richard Briant, has been designated by the Mayor to act as the Deputy Emergency Management Coordinator for three (3) years with the term beginning January 1, 2016 and;

WHEREAS, it is the intention of the Township Council of the Township of Randolph to comply with requirements set forth by the State of New Jersey Office of Emergency Management and to forward a resolution naming the appointees to the Office for its records.

NOW, THEREFORE, BE IT RESOLVED that the Township Council of the Township of Randolph hereby appoints William Wagner, to serve as Emergency Management Coordinator Officer and Richard Briant, Fire Official, to serve as the Deputy Emergency Management Coordinator for three (3) years with their terms beginning January 1, 2016; and

BE IT FURTHER RESOLVED that a copy of this resolution shall be forwarded to the State of New Jersey Office of Emergency Management.
