A. OPENING OF REORGANIZATION MEETING

1. Call to Order

The annual Reorganization Meeting of the Randolph Township Council was called to order at 11:00 a.m. by Former Mayor Carey. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 17, 2017 by emailing them the annual resolution adopted by the Council on October 10, 2017. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph on November 23, 2017, and the Daily Record on November 21, 2017.

F. SWEARING IN OF MAYOR AND DEPUTY MAYOR

Manager Mountain welcomed everyone and congratulated Councilmen Forstenhausler and Loveys on their appointments as Mayor and Deputy Mayor.

Mayor Mark Forstenhausler was sworn in by his daughter Lauren, and his wife Susan held the bible.

Deputy Mayor James Loveys was sworn in by his wife Karen, and his son James and daughter Abby held the bible.

G. RECOGNIZE FORMER MAYOR CHRISTINE CAREY

Manager Mountain explained that 2017 was another busy year for Randolph, and the township received tremendous leadership from former Mayor Carey. He noted her poise and composure throughout the year, no matter the issue. He commended her for her dedication to the community and the time she spent attending events and committee meetings. The Manager also commended former Mayor Carey for her timely response to residents and the press. He noted several projects that former Mayor Carey was involved with over the past year, the new park being built on Calais Road, the trail master plan, and the activities with the Economic Development Committee. On behalf of the entire organization, he thanked former Mayor Carey for her dedication and service to the community.

On behalf of the Council, Mayor Forstenhausler stated that he echoed everything that Manager Mountain said about former Mayor Carey. He explained that he learned a lot from her over the past year, and he hoped to do as well of a job as Mayor. Mayor Forstenhausler presented former Mayor Carey with a gavel plaque.

H. COMMENTS BY MAYOR AND COUNCIL

Councilwoman Chris Carey:

Good morning and Happy New Year to all of you who were so kind to join us today.

Thank you to all of the family members, friends, staff, and elected officials who have come here today to be a part of this re-organization meeting, especially to my husband Frank who is here today.

I would first like to congratulate our new mayor, Mark Forstenhausler. I have known Mark for several years and worked with him closely this past year when he served as Deputy Mayor. I am certain that Mark will be an excellent leader as the Mayor of Randolph in 2018.

I also want to congratulate Jim Loveys who will be serving as Randolph’s Deputy Mayor in 2018. This is Jim’s second time around serving in this role, so I know he’ll do great job.

Serving as Mayor of Randolph this past year has been an honor and a privilege and I have enjoyed it tremendously. My husband and I have lived in Randolph for 25 years and we have raised our 3 children here. I really love living in Randolph and just can’t tell you how wonderful it has been to serve as Mayor of this great community this past year.

I want to thank my fellow council members for all of their support and assistance this year. We have a very experienced and dedicated Council who really work hard on behalf of Randolph residents.

I would also like to recognize our exceptional staff led by our Town Manager, Steve Mountain. The staff who work in this building and throughout the town really do a terrific job of keeping this town safe, keeping it running very smoothly, and providing quality services to Randolph residents. Steve Mountain is an outstanding Town Manager and we are very fortunate to have him in Randolph.

As a team, I think we accomplished a great deal in 2017. Some highlights include:

  • We were able to adopt a fiscally responsible budget that balanced the short- and long-term needs of the community, maintained current services and included no increase in the municipal tax levy.
  • We approved the design for a new park on Calais Road which will be a beautiful enhancement to our community. Funding for the park comes from the current Open Space Trust Fund, with no new tax impact.
  • We finalized a long-term master plan for Randolph trails that includes recommendations for new trail segments, signage, and improved connectivity of trails.
  • We thoughtfully considered, and then revised, two policies that impact residents—curbside leaf collection and recycling schedules—based on feedback from residents.
  • We updated the Mt. Freedom Master Plan to provide a blueprint for future development in that area of town.
  • We extended water and sewer service to several areas of Randolph.
  • And we welcomed many new businesses and expansions of current businesses to town—many grand openings and ribbon cuttings that will continue into 2018.

While serving as Mayor, I also got to work with a lot of our wonderful Randolph organizations this year, including the VFW, Chamber of Commerce, Rotary, Kiwanis, and many others that are made up of outstanding people who volunteer so much of their time to make Randolph an even better community.

I am very grateful for the honor to have served as Mayor.

In 2018, my sixth year as a member of the Town Council, I will be serving on several committees and boards. I will continue to serve as the Mayor’s designee to the Randolph Library Board of Trustees. This past year, the Board selected Ms. Lore Reinhart to be the new Library Director and Lore is spearheading many new, exciting initiatives at the Library. I will also serve on two committees. I will be serving on the Randolph Municipal Alliance Committee (MAC) which has a goal of combating alcoholism and drug abuse in our community. I will also serve as the Council liaison to the Environmental and Landmark Advisory Committee. This committee is empowered to conduct research relating to the protection, development and use of open space and natural resources within the township and the protection, enhancement and preservation of township sites and structures with historical, architectural or cultural significance.

I look forward to continuing to work with my esteemed colleagues on the Council, our town manager and our outstanding staff in 2018.

Councilman Mike Guadagno:

I would like to thank the township staff and Council members for the excellent job they did in 2017. The town would not be the same without them; the town runs very smoothly.

I would like to thank the Mayor and Deputy Mayor for taking on the demanding jobs. I also would like to thank all of the volunteers in Randolph.

On the County level, I serve as Commissioner and Secretary to the Rockaway Valley Sewer Authority. The Authority deals with the sewers in the northeast part of the township. I am also the Chairman of the Solid Waste Advisory and Recycling Board for the County. This board deals with the location of the dump stations, the contracts for dumping, and separation of county solid waste.

In Randolph, I will serve on the Infrastructure Committee, dealing with the township roads and repairs. All of the repairs are paid for with cash, the township does not bond these repairs. There are 161 miles of roads in Randolph, most of which are in very good shape. I am on the Solid Waste and Recycling Committee; in 2017 the change to the recycling collection was challenging. In 2018 the recycling will be picked up every-other-week with the solid waste. I would like to thank Blue Diamond for changing their contract at no cost to Randolph.

Wall Repairs—the township has been replacing the wooden walls on the side of some roads and in the parks. The wooden walls are being replaced with landscaping and stone walls. All the walls needing to be replaced have been identified; the project should be finished in the next few years. This project is also being paid with cash, not bonding.

Water—we have completed our ten year plan to extend the water lines to parts of the town that do not have this service. I would like to thank the Randolph Fire Department for their input.

Sewer—we have completed the main sewer line to the Butterworth plant in Morris Township. The ten year plan to start connecting the north part of the township to the plant can now begin.

Gas—the township is not in control of the expansion of the gas lines, but we can encourage the gas company to lay their new gas lines when we are laying our new sewer and water lines.

Trails—there is now a master plan for the trails. As the Council liaison, I am looking forward to help improve and increase the town’s 16 miles of trails.

Planning Board—the township’s seven year master plan revision is complete. This plan is what we want our town to look like in the next seven years. We have to take into account the fair share housing, which is a problem because we have no idea what that count will be. If the demand from the courts are too great and take up our precious resources, we will be limited to the amount of sewer and water lines that we can provide to the older part of town.

Councilman Allen Napoliello:

Good morning and Happy New Year.

Last year was a very successful one, as much was accomplished by this Council. Several miles of roads were repaved, and paid for with cash, not bonded debt, avoiding years of interest payments. We replaced many retaining walls and moved forward with a new cell tower behind town hall. We finalized a trails master plan after meeting with residents to hear their thoughts on the subject. We will move quickly to mark the trails as there has been some difficulty in locating people.

I also want to thank Councilwoman Chris Carey for the fine job she did as Mayor last year. In addition to running all Council meetings, she made many very difficult decisions for the betterment of our town.

Lastly, I want to congratulate new Mayor, Mark Forstenhausler and new Deputy Mayor, Jim Loveys, who will serve as our 2018 leaders; they will have my support.

Last year I was Council liaison to the Board of Health and the Traffic Advisory Committee. I also served as President of the Morris County League of Municipalities, as well as the League of Municipalities Legislative Committee, which meets in Trenton. The Board of Health meets monthly with the township Health Director. The Board is comprised of the Health Director, three doctors, a former Randolph animal control officer, three other residents, and a student member. The Board of Health provides male and female cancer screenings, blood pressure screenings, Chem 23 blood profiles, flu shots, and curbside recycling; they receive inspections of restaurant facilities in town so that they are clean and the food they serve is healthy.

This year I will continue to be liaison to the Board of Health. I will also continue to be a member of the League of Municipalities and its Morris County Legislative Committee.

Councilwoman Joanne Veech:

Thank you all for coming. Congratulations to you, Mark and to Jim; I know you’re going to be great leaders this year. Chris, what a great job, congratulations.

I’ve had the pleasure to liaison with the Parks Committee and the Recreation Committee and work on the Parks and Recreation Master Plan Committee which produced plans for the 90 acres on Calais Road.

After an 18-month information-gathering process that included extensive community input, including meetings with more than 40 different stakeholder groups, input from over 600 residents via an online survey, and responses to a mailed survey from 520 households, final recommendations were presented to the committee and ultimately this Council.

This new park will house Randolph’s first community garden, a general public meeting on that topic is scheduled for 7:00 p.m. on January 30th at the Community Center. All are invited.

There will be a great lawn area with a band shell surrounded by a lighted 1/2 mile of paved walkway. There will be two other trails, a 1/4 mile and a 1/3 mile trail as well. There will be pickle ball courts, other shelters, picnic areas, connections to other trails, restrooms, and more. We are looking for resident volunteers in the future to assist in building out many more community-friendly elements like a butterfly garden, and bocce ball courts, to name a few. We are hoping our boy and girl scouts will consider projects to expand this park’s multipurpose use. We will be breaking ground this spring. The new park’s name will also be decided this coming year, with input from our residents. I’ll be continuing to work with the Parks Committee on this new community park.

Deputy Mayor Loveys:

Good Morning. I’d like to thank all of you for attending this morning and I wish everyone a safe, healthy, and happy New Year.

Special thanks to my wife Karen and two of our children, James and Abby, for being here and sharing this day with me. My daughters Chelsea and Anna are unable to attend, but I know they are with us in spirit. A commitment to public service places demands on family life and, from the bottom of my heart, I thank you for your continued support and understanding.

I thank outgoing Mayor Chris Carey for the leadership she provided, the tireless energy she brought to the office, and the personal sacrifice and commitment made representing our township and our Council.

Lastly, I congratulate Mayor Mark Forstenhausler on his nomination. I know it’s an exciting day for him and his family. It is an honor and privilege to serve as Deputy Mayor, and I thank my fellow Council colleagues for their support. Mayor, I have full faith in your abilities to lead this Council through the issues we’ll face in 2018. I look forward to working with you, and please know I will be there to assist if ever you find there is a need.

I look forward to serving this year as Council liaison to our township’s Recreation Advisory Committee, which recommends and develops seasonal recreational programs and activities, administered by the Parks and Recreation Department, for all Randolph residents. It also, in a coordinated effort with the Parks Advisory Committee, develops and recommends Randolph’s short and long term plans regarding present and future recreational needs.

I will also serve as a Council liaison to a work group comprised of township and Board of Education representatives. Over the years, the township and the Board of Education have shared services and facilities and continue to look for ways to increase efficiencies to better serve our residents. The quarterly meetings provide an opportunity for discussion as well as working to identify and resolve any issues that may arise.

Lastly, I will continue to serve on the Council’s Facilities Work Group. Our township owns and maintains seven public facilities, and leases and maintains one, out of which various services and programs are offered to our residents. Township Clerk Donna Luciani, who also serves as Buildings and Grounds Supervisor, coordinates and oversees the required maintenance and renovation work while keeping in mind the best interests of our Randolph taxpayers. Our Facilities Work Group coordinates with our Township Manager and staff to plan for, and prioritize, our facility’s future capital improvement needs. Without question our parks, trails, recreational facilities and open space help define a quality of life unlike that experienced in other communities. We must continue to invest in and be good stewards of these valuable assets.

I continue to be thankful and appreciative for the opportunity to serve my community and all of our residents. I look forward to working with my fellow colleagues, our Township Manager, and township staff in 2018, all of whom I admire and respect, and will continue to be guided in my decision making by what is in the best interest of Randolph Township.

Mayor Mark Forstenhausler:

Happy New Year and thank you for taking time out of your day to attend our reorganization meeting. I know that your time is precious and appreciate you spending this morning with us. Special thanks to my wife Susan, daughter Lauren, and Mother-In-Law Inge, as well as my brother Matt, Sister-In-Law Diana, nephew Alex and niece Emma. Without the support of my family, I could not volunteer the time necessary to serve our community.

I would like to thank Mayor Carey for her dedicated service to Randolph Township this past year. Her upbeat energy and desire to represent this council and township at so many events was truly incredible. Thank you Mayor.

I would also like to thank my colleagues on the Council for their faith in me, and for selecting me to serve as Mayor of Randolph for 2018. I will do my best to serve our township, and will always look for ways to improve our quality of life.

Congratulations to Deputy Mayor Loveys, I look forward to working with him. His knowledge and experience are second to none.

Our Manager Steve Mountain has successfully steered us through another year. There was a lot going on this past year, with the revaluation, parks master plan, trails master plan, and many other projects. Steve and his staff did a great job successfully completing so many major efforts.

Our Township Clerk, Donna Luciani is a hard working and happy, pleasant person. Those of us that rely on her dedication and attention to detail know just how much she contributes to our success. She never fails to attack any project or job with vigor. Thank you Donna and your staff for all of your hard work this past year.

I would also like to take a moment to thank all of our employees in Randolph. They do an outstanding, professional job every day, and we appreciate their efforts.

As a member of our Volunteer Fire Department for 23 years, I can tell you that you will never find a group of more dedicated volunteers who literally risk their own lives to protect everyone in our area. They, along with our Rescue Squad and Police, spend hundreds of selfless hours serving our community. They have earned and deserve our profound thanks.

As a prostate cancer survivor, I can tell you from personal experience that the three worst words anyone can hear are “you have cancer.” I cannot emphasize enough that all of us should have an annual physical, and please, take advantage of the Randolph Health Department cancer screenings held throughout the year. You can find the dates on our website.

In addition to working closely with our Deputy Mayor and Council, I will continue to serve as liaison to the Board of Education. The greatest asset we have is our children, and I will help the board in any way that I can.

I will continue to serve on several sub-committees, including infrastructure and retaining walls and will liaise to the Safety Committee.

I look forward to working on our new budget for 2018; will do my best to minimize any tax increase, and to be a good steward of our tax dollars. Last year your township council did not increase the municipal tax levy at all.

The efforts of our EDC, Chamber of Commerce, Board of Adjustment, and Planning Boards have been very successful, and business in Randolph has been great! We just welcomed Wendy’s two weeks ago and have ribbon cuttings planned for Dickerson Dental and Primrose School later this month. Weis Market will open soon, and we do have more new business openings ahead.

We also have many exciting new projects planned for this year including:

  • A multi-year project to replace the 50 year old water main on Meadowbrook Road.
  • The Freedom Park basketball court will be resurfaced.
  • Improvements will be completed to the Freedom Park entranceway and overflow parking area.
  • A new turf playing surface will be installed to replace the old turf on the multi-purpose field at Freedom Park.
  • A second turf field will be constructed at Freedom Park.
  • Work will begin on the new park planned for the “90 Acre property” located on Calais Road.
  • Our Fire Department will welcome a new Fire Engine for Company #3 in Mount Freedom.
  • The sewer extension at Woodlawn and Shuman will be installed.
  • A water main loop will be installed on Bennett Ave in conjunction with the site development there.
  • A new septic system is planned for Heistein Park.
  • A Trail Advisory Committee will be appointed and work will begin on the implementation of the recently adopted Trail Master Plan.
  • The program to replace deteriorating retaining walls in town will continue with the replacement of walls along Fords Road.
  • And the Randolph Volunteer Awards will be presented on January 16th at the Community Center.

Volunteers in all areas are vital to our safety, as well as to our many recreational programs, boards and committees. I have a very positive outlook for 2018, and will enjoy working with this council, township workers and all of our community volunteers to continue to keep Randolph a most desirable place to live, work and enjoy life.

WHEREAS, N.J.S.A. 54:4-67 has been amended to permit the charging of 8% of the first $1,500.00 of delinquent taxes and assessments, and 18% on any amount in excess of $1,500.00; and

WHEREAS, N.J.S.A. 54 also permits the charging of 8% interest on the first $1,500.00 of delinquent water and sewer charges and 18% interest on any amount in excess of $1,500.00; and

WHEREAS, the delinquent charges on finance agreements is 1 1/2 % per month in each installment in default for thirty (30) days.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, as follows:

  1. The rate of interest to be charged for nonpayment of taxes, assessments, water and sewer charges, on or before the due date shall be 8% per annum for the first $1,500.00 and 18% on any amount in excess of $1,500.00.
  2. No interest shall be charged if payment of any taxes and assessments is made within ten (10) calendar days of due date.
  3. The rate of interest to be charged on delinquent finance agreements is 1 1/2 % per month in each installment in default for thirty (30) days.

WHEREAS, N.J.S.A. 10:4-6 et seq., known as the “Open Public Meetings Act,” requires notices to be given of meetings of public bodies, as defined and prescribed in said statute, and further provides for the fixing of a reasonable charge to be paid by any person requesting such notices.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey, as follows:

  1. The Randolph Reporter and the Morris County Daily Record, as the newspapers having the greatest likelihood of informing the public of meetings to be held by the Township Council of the Township of Randolph, are hereby designated as the newspapers to receive notices of all meetings of this Township Council for the calendar year 2018 as required by the “Open Public Meetings Act.”
  2. The bulletin board located immediately adjacent to the Council Chambers in the Randolph Municipal Building shall be the place for posting of all notices of meetings of the Township Council during the 2018 calendar year.
  3. The sum of twenty ($20) dollars is hereby fixed as the fee to be paid by any person requesting that notices of meetings of the Township Council of the Township of Randolph during the 2018 calendar year be mailed to such person; but, as provided in N.J.S.A. 40:4-19, no charge shall be made to any newspaper requesting the mailing of such notices to its business office.
  4. Certified copies of this resolution shall be mailed by the Clerk of the Township to the Randolph Reporter and the Morris County Daily Record and a certified copy shall be filed with the Clerk of the Township.

8. Cash Management Plan

WHEREAS, the Township of Randolph adopted a Cash Management Plan on April 2, 1997; and

WHEREAS, the State of New Jersey periodically amends the statutory provisions governing cash management plans and permitted investments; and

WHEREAS, the Director of Finance has amended the Cash Management Plan of the Township of Randolph to incorporate these provisions.

9. Award of 2018 PSA Agreement to the Buzak Law Group for Township Attorney Services

WHEREAS, the Township of Randolph (“Township”) requires Township Attorney services for the 2018 calendar year; and

WHEREAS, Elizabeth Crescibene, Purchasing Agent, has determined and certified in writing that the value of these services will exceed $17,500; and

WHEREAS, the Township has agreed to retain The Buzak Law Group, LLC located at 150 River Rd, Ste N-4, Montville, NJ 07045 to provide the necessary Township Attorney services for a total amount not to exceed $306,000 ($25,500/month) plus $170/hour for litigation and escrow appeals; and

WHEREAS, the fees are as noted in the attached proposal; and

WHEREAS, the term of this contract is for the 2018 calendar year; and

WHEREAS, the contract with The Buzak Law Group, LLC is for a total amount not to exceed $306,000 and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and

WHEREAS, in accordance with the Anti Pay-to-Play Legislation, The Buzak Law Group, LLC has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and

WHEREAS, The Buzak Law Group, LLC has also submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, Elizabeth Crescibene, Purchasing Agent, has determined and certified in writing that the value of these services will exceed $17,500; and

WHEREAS, the Township has agreed to retain Matthew R. Petracca, LLC located at 51 Gibraltar Drive, Suite 2F, Morris Plains, NJ 07950 to provide the necessary Municipal Prosecutor services for a total amount not to exceed $27,000 ($2,250/month) and Special Session Services for a not to exceed amount of $4,000 annually at $500 each up to four hours plus $135/hour in excess of 4 hours; and

WHEREAS, the fees are as noted in the attached proposal; and

WHEREAS, the term of this contract is for the 2018 calendar year; and

WHEREAS, the contract with Matthew R.   5. The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township, are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
  6. It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.
  7. This Resolution shall take effect immediately.

23. 2018 Temporary Budget

R-23-18

WHEREAS, 40A:4-19 Local Budget Act provides that (where any contracts, commitments or payments are to be made prior to the final adoption of the 2018 budget) temporary appropriations be made for purposes and amount required in the manner and time therein provided; and

WHEREAS, the date of this resolution is within the first thirty days of January, 2018; and

WHEREAS, the total general appropriations in the 2017 Budget, exclusive of any appropriations made for Interest and Principal of Debt, Capital Improvements and Public Assistance is the Sum of $34,509,729; and

WHEREAS, 26.25 percent of this total is the sum of $9,058,803.

NOW, THEREFORE, BE IT RESOLVED by the Council of the Township of Randolph, County of Morris, State of New Jersey, that the following temporary appropriations be made and that a certified copy of this resolution be transmitted to the Chief Financial Officer for his records:
