A. OPENING OF REGULAR MEETING
1. Call to Order
A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Loveys. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 5, 2013 by e-mailing them the annual resolution adopted by the Council on December 5, 2013. The annual resolution, including this meeting date, was advertised in the Randolph Reporter, the official paper of the Township of Randolph, and the Daily Record on December 12, 2013.

3. Mayor Loveys led the Pledge of Allegiance.
Mayor Loveys asked for a moment of silence prior to the start of the meeting in memory of the two Randolph High School students killed in the car accident on July 26th. On behalf of the Council, the Mayor expressed that thoughts and prayers were with the families and the friends of those involved. He acknowledged the incredible support of the entire Randolph community, from both residents and businesses.
B. RECOGNITION/PROCLAMATION
1. Proclamation Honoring Kate Rubenstein
Mayor Loveys explained that the New Jersey Battered Women’s Services oversees teams of volunteer citizen advocates who assist, and work with, local police departments on units called the Crisis Response Team. They assist victims of domestic violence. The Mayor explained that Kate has worked in that capacity with the Randolph Police Department for the past 16 years, but is now stepping down from this position. To thank her for her many years of service to Randolph Township, Mayor Loveys presented her with the following Proclamation:
WHEREAS, the New Jersey Battered Women’s Services oversees a volunteer team of trained citizen advocates that work with local police departments known as the Crisis Response Team to assist victims of domestic violence; and
WHEREAS, Kate Rubenstein has been a volunteer member of the Crisis Response Team serving the Randolph Police Department for over 16 years; and
WHEREAS, Kate Rubenstein has dedicated countless hours of her time counseling and providing assistance to the victims of domestic violence at all hours of the day and night; and
WHEREAS, Kate Rubenstein was a vital part of the process of assisting Randolph police officers when victims wished to obtain temporary restraining orders; and
WHEREAS, Kate Rubenstein, consistently went the extra mile, assisting both officers and other volunteers in the learning process of dealing with victims of domestic violence; and
WHEREAS, as the Crisis Response Team Leader, Kate Rubenstein ran the yearly volunteer meeting, made certain that the Crisis Response Team office was always in good order, and had all the supplies it needed on hand; and
WHEREAS, Kate Rubenstein has decided to step down from the team and pass on the torch.
NOW, THEREFORE, BE IT PROCLAIMED that the Mayor & Township Council wish to honor Kate Rubenstein for her selfless volunteer service in assisting the Randolph Police Department and to thank her on behalf of the Randolph community and especially those whose lives have been affected by domestic violence.

Chief Stokoe explained that Kate Rubenstein spent countless hours aiding victims of domestic abuse as well as the entire Police Department. He commended and thanked Kate for all that she had done over the years. Kate Rubenstein thanked the Chief and stated that she felt part of a team with the police officers, and thanked the officers for all of their help and support as well.
C. OPEN TO THE PUBLIC
Judith Stewart of 114 Everdale Road thanked the Council for their dedication to the town as well as their encouragement for residents to volunteer in the town.
Seeing no one further from the public, the public portion was closed.
D. MANAGER’S REPORT
Manager Mountain reported the following:
- He met with the workgroup for the curbside recycling program. The group has made some decisions that will move them forward on the process. They received a proposal from the Morris County MUA, and they are continuing to consider the possibility of a private company bidding on the service for the future. The workgroup is looking more toward the privatization route as they feel there would be an ultimate cost savings potential as well as more flexibility as to the services delivered. It is felt that it would be more obtainable from a private company than the MCMUA. The next steps for the workgroup:
- Looking at a 2 year contract. The solid waste contract has 2 more years remaining & the hope is to have the recycling and the solid waste collection on a singular contract or a singular contracted set of years. The contract would only be for curbside recycling; the Recycle Center would remain unchanged.
- For the bid process to provide 4 options. 1. A match to the current collection process; 2. A one day, biweekly collection in which half the town collected on one week and the second half on the following week; 3. To provide one day collection weekly for the entire town; 4. To provide one day collection every other week for the entire town.
- The bid document would also specify that the schools, municipal locations, apartment and condominium complexes would remain on the Monday pickup schedule. It would also specify single stream recycling, which would take what is being done on a pilot basis now and make it permanent. The workgroup also wants to include in the bid document the next day collection when pickup is on a holiday.
- The bid package is currently being finalized with the goal that bids would be submitted in October. At that point the workgroup will review the tabulation and give their recommendation.
- The workgroup will be working on a public information campaign to advertise the change. The campaign will go into full swing once the determination of services is made. The idea is for the contract to go into effect in January 2015.
- The workgroup for the Municipal Complex cell tower evaluation has met; township staff has also been working on the project. It is in the early stages, answering questions needed to guide the Council on the next steps in the process; a more detailed report is anticipated in early September.

Item #15, Tennis-Basketball court crack sealing: Manager Mountain explained that he spoke to Russ Newman and he confirmed that it is a full resurfacing, not just sealing cracks.
Item #16, Authorizing Award of PSA to Jaman Engineering—Millbrook Ave & Quaker Church Rd.: Manager Mountain explained that for State Aid jobs, there are added levels of surveying for intersections to determine elevations and other things to be noted on a plan submitted to the state.

1. Release Road Opening Cash Bond for 20 Canfield Ave., to Peter Cascio—$500.00

WHEREAS, the Engineering Department has received a request from Peter Cascio, for the release of a $500.00 cash road opening bond posted for the purpose of repaving an existing driveway at 20 Canfield Ave., Randolph; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on May 29, 2014; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of an existing driveway at 20 Canfield Ave. within the Township Right of way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Peter Cascio, 20 Canfield Ave., Randolph, NJ 07869.
2. Refund Overpayment of 2012 Taxes on Block 187, Lot 1 to Louis Miller—$11,771.57

WHEREAS, Louis Miller has been granted a reduction in assessed valuation for the tax year 2012 by the Tax Court of New Jersey on Block 187, Lot 1, known as 158 S Salem Street; and
WHEREAS, an overpayment exists as a result of the reduction for the year 2012 in the amount of $11,771.57; and
WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $11,771.57 to Louis Miller.
3. Refund Escrow Fees for Block 136, Lot 8 to Michael Alessandra—$608.50

WHEREAS, the Planning and Zoning Department received escrow funds from Michael Alessandra, 8 Semrau Road, Denville, NJ 07834, Block 136 Lot 8, and in the amount of $1,000.00; and
WHEREAS, the project has been completed and closed out and there are no outstanding payments due.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $608.50 be refunded to Michael Alessandra, 8 Semrau Road, Denville, NJ 07834.

WHEREAS, the Engineering Department has received a request from Sean McConnell, for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the water line at 242 Quaker Church Rd., Randolph; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on Dec. 11, 2013; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the connection of the water line at 242 Quaker Church Rd. within the Township Right of way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Sean McConnell, 8102 Diablo Ct., Trinity, Fla. 34655.
5. Refund Registration Fee for Ice Hockey Jr. Rams Program to Nancy and Tom Martin—$450.00

WHEREAS, Nancy and Tom Martin registered her child for Randolph Township Ice Hockey Jr. Rams program and paid the fee of $450.00; and
WHEREAS, their child will not be participating since their child did not make the team.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $450.00 be refunded to Nancy and Tom Martin, 17 Crest Drive, Randolph, NJ 07869.
6. Refund Registration Fee for Ice Hockey Jr. Rams Program to Lisa and Gary Sofia—$450.00

7. Refund Summer Day Camp Program to Jennifer DeSalvo—$265.00

WHEREAS, their children will not be attending Randolph Township Summer Day Camp program (Sessions 4) due to a conflict.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $265.00 be refunded to Jennifer DeSalvo, 42 Treaty Rd., Randolph, NJ 07869.
8. Refund Outside Tax Sale Certificate for 1 Cambridge Court to US Bank Cust—$1,207.09

WHEREAS, Outside Tax Sale Certificate #1991 held by US Bank Cust for BV001 Trust, assessed to Melissa Truitt, Block 115, Lot 83.16, 1 Cambridge Court; and
WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $707.09, and premium in the amount of $500.00.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $1,207.09 to US Bank Cust for BV001 Trust holder of Tax Sale Certificate #1991.
9. Authorizing Additional Vendor Under State Purchasing

WHEREAS, the Township of Randolph on February 6, 2014 (R 70-14), February 20, 2014 (R 85-14), May 22, 2014 (R 151-14), and June 12, 2014 (R 164-14) authorized contracts with certain approved State Contract Vendors pursuant to N.J.S.A. 40A:11-12a and N.J.A.C. 5:34-7.29(c); and
WHEREAS, it’s been determined that contracts in excess of $17,500 will be entered into with an additional State Contract Vendor; and
WHEREAS, the additional State Contract Vendor has been added to the attached list.
NOW, THEREFORE, BE IT RESOLVED, that the Township of Randolph authorizes the Purchasing Agent to purchase certain goods and services from the additional approved New Jersey State Contract Vendor on the attached list, pursuant to all conditions of the individual State contracts; and
BE IT FURTHER RESOLVED that the governing body of the Township of Randolph pursuant to N.J.A.C. 5:30-5.5(b) regarding the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Financial Officer via an authorized Purchase Order; and
BE IT FURTHER RESOLVED that the duration of the contracts between the Township of Randolph and the Referenced State Contract Vendors shall be until December 31, 2014 or upon expiration of the vendor’s contract whichever is first.
10. Awarding Bid—to Purchase Ford F550 for Water and Sewer Department

WHEREAS, the Township of Randolph advertised for the Purchase of One (1) New, Unused 2015 Ford F-550 or Equivalent Cab & Chassis with Options in accordance with Local Public Contracts Law and received bids on July 10, 2014; and
WHEREAS, 3 bids were received; and
WHEREAS, bids were received from the following and for the bid prices listed:
Morris Auto Enterprises, LLC DBA Performance Ford Lincoln, Randolph, NJ—Base Bid: $35,812.16;
Beyer Ford LLC, Morristown, NJ—Base Bid: $33,501.00;
Route 23 Automall LLC, Butler, NJ—Base Bid: $33,627.10; and
WHEREAS, the bid from Beyer Ford LLC took exception to the Delivery and penalty clauses thereby making their bid non-responsive; and
WHEREAS, the Engineering Administrator/W&S and Purchasing Agent recommend the award of the contract to Route 23 Automall LLC as the lowest responsive, responsible bidder; and
WHEREAS, the Township of Randolph desires to award a contract for the Purchase of One (1) New, Unused 2015 Ford F-550 or Equivalent Cab & Chassis with Options to Route 23 Automall LLC of Butler, NJ.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Route 23 Automall LLC of Butler, NJ for the Purchase of One (1) New, Unused 2015 Ford F-550 or Equivalent Cab & Chassis with Options project for the price of $33,627.10 per their bid proposal.

As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Darren Maloney, Director of Finance of the Township of Randolph, has ascertained that funds will be available in the Water Capital Fund Ordinance (14-13) Water/Sewer Utility Truck account, to award a contract to Route 23 Automall, LLC for the delivery of one brand new Ford F550 truck, per its proposal.

11. Refund Landscaping Performance Bond for Site Lighting Added to County College of Morris—Contracting Systems Inc. II—$10,000.00

WHEREAS, the Engineering Department has received a request from Contracting Systems, Inc. II, for the release of a $10,000.00 Landscaping Performance bond posted for the purpose of ensuring completion of the site lighting added to the County of Morris College entrance at 214 Center Grove Rd., Randolph; and
WHEREAS, the Landscaping Performance Bond consisted of a $10,000.00 cash bond, which was received and deposited with the Finance Department on July 25,2006; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the completion of the site lighting at the entrance to the County College of Morris; and
WHEREAS, the Engineering Department has inspected the site lighting work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Landscaping Performance Bond in the amount of $10,000.00 be refunded to Contracting Systems Inc., II, 472 California Rd., Quakertown, PA. 18951.
12. Release Police Detail Escrow for DJB Event Consultants Inc.—$528.04

WHEREAS, the Finance Department received escrow funds for Police Detail.
WHEREAS, the Detail work has been completed.
THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey that it is recommended by the Finance Department that the escrow funds for the following amounts be refunded:

13. Authorizing Agreement for Randolph to Perform Housing Inspections on Behalf of the State of New Jersey, Department of Community Affairs

WHEREAS, the Township wishes to enter into an agreement with the State of New Jersey, Department of Community Affairs; and
WHEREAS, the Township agrees to conduct State mandated inspections of hotels and multiple dwellings within its jurisdiction on behalf of the Bureau of Housing during period from July 1, 2014 to June 30, 2015; and
WHEREAS, the State agrees to pay the Township a sum of $700.00 for this service.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Mayor be authorized to sign this Agreement.
14. Refund Pool Filling Fee Due to Cancellation at 62 Fords Road to James Shernius—$500.00

WHEREAS, the Engineering Department has received a check in the amount of $500.00 from James Shernius for the utilization of hydrant and hydrant meter for pool filling for 62 Fords Rd., Randolph; and
WHEREAS, the Applicant was required to pay this fee of $500.00 for the utilization of hydrant and hydrant meter which was received and deposited with the Finance Department on June 23, 2014; and
WHEREAS, the Engineering Department received his request to cancel this service due to pool liner issues, therefore a refund request was made; and
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the hydrant and meter fee in the amount of $500.00 be refunded to James Shernius, 62 Fords Rd., Randolph, NJ 07869.
15. Awarding Contract for Tennis-Basketball Court Crack Sealing—Sport Tech Construction Corp—$80,005.00

WHEREAS, the Township of Randolph advertised for the Tennis/Basketball Court Crack Sealing project in accordance with Local Public Contracts Law and received bids on July 18, 2014; and
WHEREAS, 1 bid was received; and
WHEREAS, the sole bid was received from the following and for the bid price listed:
Sport-Tech Construction Corp, Brewster, NY—Base Bid: $80,005.00; and
WHEREAS, the Engineer and the Purchasing Agent recommend the award of the contract to Sport-Tech Construction Corp as the lowest responsive, responsible bidder; and
WHEREAS, the Township of Randolph desires to award a contract for the Tennis/Basketball Court Crack Sealing to Sport-Tech Construction Corp of Brewster, NY.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Sport-Tech Construction Corp of Brewster, NY for the Tennis/Basketball Court Crack Sealing project for the price of $80,005.00 per their bid proposal.

16. Authorizing Award of PSA to Jaman Engineering for Preparation of Intersection Plans for Millbrook Ave. and Quaker Church Road—Not to Exceed $6,000.00

WHEREAS, the Township of Randolph (“Township”) requires preparation of intersection topographic plans for Millbrook Avenue and Quaker Church Road for the period of 7/31/14 - 7/30/15; and
WHEREAS, the Township has agreed to retain Jaman Engineering Associates located at 320 Route 10 West, Randolph, NJ 07869 to provide the necessary preparation of intersection topographic plans for Millbrook Avenue and Quaker Church Road for a total amount not to exceed $6,000 per their proposal; and
WHEREAS, the Township desires to award the contract to Jaman Engineering Associates based upon its qualifications, expertise and experience in topographic plans; and
WHEREAS, the fees are as noted in the attached proposal; and
WHEREAS, the anticipated term of this contract is for the period of 7/31/14 - 7/30/15; and
WHEREAS, the contract with Jaman Engineering Associates is for a total amount not to exceed $6,000 and therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) do not apply; and
WHEREAS, Jaman Engineering Associates has submitted to the Township a New Jersey Business Registration Certificate, as required; and
WHEREAS, there are funds available for the retention of such professional services; and
WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:
- The Township hereby hires, employs and retains Jaman Engineering Associates having an office at 320 Route 10 West, Randolph, NJ 07869 to prepare intersection topographic plans for Millbrook Avenue and Quaker Church Road for the period of 7/31/14 - 7/30/15.
- Jaman Engineering Associates shall be compensated for a total contract amount not to exceed $6,000.

17. Authorizing Rescission from Stadium System and Re-Award to R&R Sporting Goods on MCCPC Contract #20-B, Category I, Item 20a

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #20-B (Sporting Goods); and
WHEREAS, bids had been advertised and received on April 10, 2014, in accordance with Local Public Contracts Law; and
WHEREAS, the Randolph Township Council awarded Contract #20-B (Sporting Goods) to various vendors on May 22, 2014; and
WHEREAS, Item #20a (Wilson Footballs) in Category I of Contract #20-B was awarded to Stadium System as the lowest responsive and responsible bidder; and
WHEREAS, Stadium System contacted the MCCPC on July 7, 2014, and stated that the manufacturer for Item #20a would no longer allow Stadium System to be a distributor for that item for the Morris County area; and
WHEREAS, the MCCPC contacted R&R Sporting Goods, the second lowest responsive and responsible bidder for Item #20a in Category I of Contract #20-B, and R&R Sporting Goods agreed to hold the price submitted in their bid for the term of the contract (July 1, 2014 - June 30, 2015); and
WHEREAS, it is in the best interest of the MCCPC that Item #20a in Category I of Contract #20-B be rescinded from Stadium System and awarded to R&R Sporting Goods.

18. Authorizing Rescission from Liberty Paper Janitorial Supply Co. and Re-Awarding of MCCPC Contract #25, Item 31 in Category B to Central Poly Bag Corp.

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #25 (Janitorial Supplies); and
WHEREAS, bids had been advertised and received on April 10, 2014, in accordance with Local Public Contracts Law; and
WHEREAS, Contract #25 (Janitorial Supplies) was awarded to various vendors by the Randolph Township Council on May 22, 2014; and
WHEREAS, All American Poly was initially awarded Item #31 (trash can liners, 3 mil thick) in Category B, however All American Poly notified the MCCPC shortly after the award that they bid the item erroneously; and
WHEREAS, Item #31 of Category B was rescinded from All American Poly on June 26, 2014, and re-awarded to Liberty Paper Janitorial Supply Company as the second lowest responsive and responsible bidder; and
WHEREAS, the product being supplied by Liberty Paper Janitorial Supply Company was found to be deficient and it was subsequently verified in writing by Liberty Paper Janitorial Supply Company that the product they were supplying for Item #31 in Category B did not meet the requirements in the bid specifications; and
WHEREAS, it is recommended that Liberty Paper Janitorial Supply Company be found to be in default for Item #31 in Category B of Contract #25 (Janitorial Supplies) and that Item #31 be rescinded; and
WHEREAS, the MCCPC contacted Central Poly Bag Corporation, the third lowest responsive and responsible bidder for Item #31 in Category B; and
WHEREAS, Central Poly Bag Corporation has verified in writing that their product meets or exceeds the requirements in the bid specifications and has agreed to honor their pricing bid for Item #31 in Category B for the term of the contract; and
WHEREAS, it is recommended that Central Poly Bag Corporation be awarded Item #31 in Category B of Contract #25 (Janitorial Supplies) for the one-year term of July 1, 2014 - June 30, 2015.

WHEREAS, on May 30, 2013, the Township of Randolph awarded a contract from May 31, 2013 through June 30, 2014 to J.H. Reid On-Site Recycling, Inc. of S. Plainfield, NJ for the fees of:

H. ORDINANCES: INTRODUCTIONS
1. Ordinance No. 21-14: An Ordinance Amending and Supplementing Sections 8-1 and 8-10 of Chapter 8, Animals, of the Revised Ordinances of the Township of Randolph to Ban the Retail Sale of Dogs and Cats
Manager Mountain explained that at a prior meeting the Council had an extensive discussion on the issue of the retail sale of dogs and cats and how it ties to puppy and kitten mills. The Council made a decision at that meeting to direct counsel to prepare an Ordinance for discussion.
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING AND SUPPLEMENTING SECTIONS 8-1 AND 8-10 OF CHAPTER 8, ANIMALS, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH TO BAN THE RETAIL SALE OF DOGS AND CATS” be introduced, read by title by the Township Clerk and passed on first reading.
BE IT RESOLVED that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 4th of September 2014 at 7:00 o’clock in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said Ordinance.
BE IT FURTHER RESOLVED that the Township Clerk be authorized and directed to advertise said Ordinance in full or by summary with the Notice of Introduction thereof in the official designated newspaper according to law.
Councilman Hirniak stated that there is an exception in the Ordinance not to make the statute retroactive to pre-existing uses. He asked if there were any of those in the township. Manager Mountain explained that there were 3: the township animal pound, Paws, and Eleventh Hour. Councilman Hirniak confirmed with Manager Mountain that all three are rescue/adoption based and none engage in retail sales. The Manager explained that the entity which sparked this discussion did not renew its license as well as another entity which didn’t renew its license.
Councilman Hirniak stated that he felt that the Council should unanimously support this Ordinance based on the discussion at the previous meeting, Health Officer Mark Caputo’s discussion and recommendation, and similar actions taken by other municipalities.
There was some discussion on the specific wording of the definition of pet shop.
Councilman Forstenhausler stated that he felt the Ordinance accomplished what the Council intended.
There was some discussion on Section Three, Item (c), Prohibition as related to whether a kennel operator could breed dogs and cats in Randolph.

2. Ordinance No. 22-14: An Ordinance Granting a Conservation Restriction/Easement Over a Portion of Block 222, Lot 11.01 on the Official Tax Map of the Township of Randolph to the New Jersey Department of Environmental Protection
Manager Mountain explained that as part of the Butterworth Phase II, a piece of property was acquired to establish a pump station in conjunction with the project. In permitting for the project, one of the criteria the DEP mandates as part of a flood hazard area permit is for a dedication of easement or restriction on the portion of the property that is not going to be built upon to ensure that the riparian buffer is protected. This Ordinance memorializes the granting of that easement.

I. DISCUSSION ITEMS
1. Confirmation Special Meeting—Week of August 18th—Award of Contract—HVAC Municipal Building and Animal Shelter
Manager Mountain explained that there are two contracts that are time sensitive that are ready for the award of contract, but there isn’t another Council meeting until September. A special meeting on August 21st at 5:00 p.m. was scheduled.
2. Council Field Tour/Worksession—Mount Freedom Planning & Development
Manager Mountain explained that with the sewer improvements that are coming for Mount Freedom as well as the county’s improvement of Sussex Turnpike, there are development opportunities that will be forthcoming. Since it’s been awhile since the Council and staff met to look at that area from a planning perspective and reviewed any issues, it was proposed to meet on September 18th prior to the Council meeting to tour the area via bus and return for a discussion. It would be a public meeting and would be advertised. The meeting/tour would start approximately 4:00 to 4:30 p.m., and it would last about 2 to 2 1/2 hours.
3. December Meeting—EDC and Volunteer Appreciation Dinner
Manager Mountain explained that he, Mayor Loveys, and Deputy Mayor Veech discussed the light attendance at the EDC and Volunteer Appreciation dinners the past couple of years. It was proposed that the Council meeting on December 4th begin at 6:00 p.m., either break or end at 7:00 p.m., and have the award ceremony at that time. The thought was that if the ceremony began later, more people would be able to attend. The Council members were in agreement to begin the December 4th meeting at 6:00 p.m. followed by the awards reception.
J. OPEN TO THE PUBLIC
Norma Jacobs of 3 Blue Fern Lane thanked the Council for their time and effort in approving Ordinance #21-14.
Judith Stewart of 114 Everdale Road stated that the Boy Scout sitting next to her had to attend a Council meeting and she has been trying to get the Board of Education to require a Civics course. Mrs. Stewart felt that students should know more about how the government works.
Leslie Moran of 42 Oak Lane asked the procedure for Ordinance introduction and adoption; Mayor Loveys explained the procedure. Ms. Moran thanked the Council for their efforts in approving Ordinance #21-14.
Seeing no one further from the public, the public portion was closed.
K. COUNCIL COMMENTS
Councilman Napoliello reported that he attended a meeting about the Country Fair. It will be held on October 11th from 10 am to 5 p.m. Planning is going well, there are currently 25 vendors, there will be a dog parade, a Tricky Tray, pony rides, and a yard sale. Deputy Mayor Veech brought up that the New Jersey Mobile Museum, which she saw at the Municipalities Convention in Atlantic City, will attend Country Fairs for free. Mayor Loveys stated that Ray Nisivoccia who is on the board of the New Jersey Mobile Museum has arranged to be at the Country Fair and that the Rotary should be aware of it.
Councilman Hirniak asked Manager Mountain for an update on the Parks Master Plan and the Revaluation. Manager Mountain explained that the committee for the Parks Master Plan has met. Their goal is to get the Request for Proposal put together and out, with the intention of getting the consultant hired and the process moving. Anne Standridge is the Chairperson for the committee. The Revaluation workgroup will be meeting again on August 4th and will be reviewing a draft Request for Proposal. The goal is to have a set of candidates ready for interviews in the fall with a recommendation to the Council by the end of the year. Councilman Hirniak stated that he is very pleased with Manager Mountain and his team in the township for the fact that the township is well ahead of the issues, with solid committees, and solid people working on them.
Councilwoman Carey reported that the library addition looks great and the dedication ceremony is on September 20th. The library patron survey was completed with over 200 responses. She will bring a summary to a future Council meeting, but overall the comments are very positive.
Councilman Forstenhausler reported that he attended the Safety Committee meeting in July. He also attended the Recreation meeting on July 10th. There was a proposal for the 90 acres to be open space, but he explained that the parcel will be included in the Parks Master Plan. There was also a proposal for signs to be placed on ball fields and various recreational fields, and a motion was approved for a sign which basically says “let the kids be kids, let the kids play the game, and let the parents not get too involved.” There was mention of the ribbon cutting at Kiwanis Park, and a bench dedication on September 9th. Councilman Forstenhausler also reported that Recreation is working with Randolph High School to share the fields.
Councilman Guadagno reported that the automatic deduction for taxes and water and sewer have been implemented, 8 residents have already signed up. He explained when taxes are due; a statement arrives in the mail indicating that the amount will be deducted from the resident’s bank account. There is no fee for the automatic payment. Sign up for the service is on the township website.
Councilman Guadagno stated that the library in the docket online only shows 2012. He stated that he thought there was going to be an archive of the monthly reports. Deputy Mayor Veech stated that she had asked Manager Mountain if Darren Carney could spend time with the Council to show them how to navigate the various items online such as the ordinances and other reports.
Councilman Guadagno asked if in the future when an ordinance was amended, if the portion being changed could be underlined in order to make it easier to compare to the previous version.
L. EXECUTIVE SESSION
WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and
WHEREAS, this public body is of the opinion that such circumstances presently exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

Tax Appeal—Resolution Authorizing the Settlement of Certain Residential Tax Appeals

WHEREAS, appeals of the real property tax assessments of the following properties have been filed in the Tax Court of New Jersey:

WHEREAS, the property owners and the Township have agreed to a settlement for the pending appeals; and
WHEREAS, the property owner and the Township of Randolph have further agreed that the refund resulting from the settlement shall be made within sixty (60) days of the date of entry of Judgment by the Tax Court of New Jersey; and
WHEREAS, the property owner has agreed to waive pre-judgment interest due on any refunds payable as a result of the proposed settlement provided that the refund is made within sixty (60) days of the date of entry of Judgment by the Tax Court; and
WHEREAS, the settlement of this matter, as set forth herein, is in the best interest of the Township of Randolph and is recommended by the Township Tax Assessor and should, therefore, be settled pursuant to the terms set forth herein.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Randolph, in the County of Morris, State of New Jersey, as follows:
1. The settlement of the following tax appeals filed at the Tax Court of New Jersey is hereby authorized as follows:
