A. OPENING OF REGULAR MEETING
1. Call to Order
A regular meeting of the Randolph Township Council was called to order at 6:00 p.m. by Mayor Forstenhausler. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 17, 2017 by emailing them the annual resolution adopted by the Council on October 10, 2017. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph on November 23, 2017, and in the Daily Record on November 21, 2017. The time change for this meeting was emailed to the Randolph Reporter on June 5, 2018, and published in the Randolph Reporter on June 7, 2018.

3. Pledge of Allegiance
Mayor Forstenhausler led the Pledge of Allegiance.
B. OPEN TO THE PUBLIC
Judith Stewart of 114 Everdale Road asked if the meetings were now going to begin at 6:00 p.m. Mayor Forstenhausler responded that they were not; it was just this meeting that was changed.
Seeing no one further from the public, the public portion was closed.
C. MANAGER’S REPORT
Manager Mountain reported the following:
- Weis Market—the soft opening and ribbon cutting ceremony will be on July 18th, with the official grand opening on July 19th. The contractors have renovated the entire interior of the store, they will be replacing the facade, and the parking lot will be updated. The Weis liquor store will open later in the fall. They are expecting to employ approximately 110 people. He is awaiting a press release from Weis regarding the store opening; he will forward it to the Council and to local media.
- He and the Mayor met with representatives from the township’s Economic Development Committee, the Morris County Economic Development Corporation, and Revco who is responsible for 140 Randolph Square, formerly the K-mart Plaza. They discussed the status of the redevelopment efforts. The meeting was very productive; the township will be working with the owner in the coming months on sharing information and helping to market the site in any way possible. The Planning Board recently approved the planned upgrade for 140 Randolph Square, including a new pylon sign for Route 10; these improvements are essential to the owner’s redevelopment strategy for the center. The township will continue this outreach to other property owners in town over the next several months.

E. COMBINED ACTION RESOLUTIONS
Item #15, Amending a Professional Services Agreement with Robert Michaels and Associates—Councilman Tkacs noted that it seemed like a large increase and asked if it was because the workload increased significantly. Manager Mountain explained that there has been a lot of activity in the last year in support of the affordable housing litigation.
Item #24, LOSAP—Deputy Mayor Loveys noted that Roger Colardeau’s name is misspelled. Manager Mountain replied that he will have it corrected.
Item #25, Approval of liquor licenses—Councilman Guadagno asked what the total amount was, and felt that the total should be included in the resolution.
1. Refund Portion of $990.00 Teen Camp Registration Fee to Dawn Hamm—$890.00

WHEREAS, Dawn Hamm registered her child for the Teen Camp program and paid the fee of $990.00; and
WHEREAS, her child will not be attending Teen Camp due to an unforeseen personal issue.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $890.00 be refunded to Dawn Hamm, 44 Rose Way, Randolph, NJ 07869.
2. Refund Payment for a Mulch Delivery which was Cancelled due to the Recipient Not Living in Randolph—Anthony Cresti, 14 Spring Lake Drive, Far Hills, NJ 07931—$520.00

WHEREAS, the Engineering Department has received a request from Anthony Cresti for the return of $520.00 for payment of four (4) loads of mulch to be delivered to 14 Spring Lake Drive, Far Hills, NJ 07931; and
WHEREAS, the payment was received and deposited with the Finance Department on May 8, 2018; and
WHEREAS, the Engineering Department has accepted the cancellation of the mulch order.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the mulch order payment in the amount of $520.00 be returned to Anthony Cresti at 14 Spring Lake Drive, Far Hills, NJ 07931.
3. Release of a Road Opening Cash Bond Posted for Repaving the Driveway at 56 Green Lane, Block 2, Lot 5—Pasquale Dattalo—$500.00

WHEREAS, the Engineering Department has received a request from Pasquale Dattalo for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at 56 Green Lane, Randolph, NJ 07869 (BL2/L5); and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on April 5, 2017; and
WHEREAS, the applicant was required to post this cash bond to guarantee the repaving of the driveway at 56 Green Lane, Randolph, NJ 07869 within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator, that the Cash Road Opening Bond in the amount of $500.00 be refunded to Pasquale Dattalo at 14 Castle Court, Randolph NJ 07869.
4. Requesting the Approval of Items of Revenue and Appropriation per NJSA 40:A:4-87—Municipal Alliance Grant—(MAC Grant)—$17,248

WHEREAS, NJSA 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item has been made available by law and the amount was not determined at the time of the adoption of the budget; and
WHEREAS, the Director may also approve the insertion an item of appropriation for an equal amount;
NOW, THEREFORE, BE IT RESOLVED, that the Council of the Township of Randolph, in the County of Morris, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2018 in the sum of $17,248.00, which is now available from the FY 2018/19 Municipal Alliance Grant in the amount of $17,248.00; and
BE IT FURTHER RESOLVED, that the like sum of $17,248.00 is hereby appropriated under the caption Municipal Alliance Grant—2018; and
BE IT FURTHER RESOLVED, that the sum of $4,312.00 representing the amount required for the municipality’s share of the aforementioned undertaking or improvement, appears in the budget of the year 2018 under the caption Municipal Alliance— Other Expense and is hereby appropriated under Municipal Alliance—Town Match; and
BE IT FURTHER RESOLVED, that the above is the result of a State grant of $17,248.00 from the Governor’s Council on Alcoholism and Drug Abuse Fiscal Grant—Cycle July-2018 through June 2019.
5. Release Road Opening Cash Bond Posted for the Connection to the Water Service at 8 Woodlawn Terrace, Block 101, Lot 17 to Dan Schmidt—$500.00

WHEREAS, the Engineering Department has received a request from Dan Schmidt for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the Township water service at 8 Woodlawn Terrace, Randolph NJ 07869 (BL101/L17); and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on August 30, 2017; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the connecting to the Township water service at 8 Woodlawn Terrace, Randolph, NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Dan Schmidt at 24 Homestead Way, Rockaway, NJ 07866.
6. Release Road Opening Cash Bond Posted for Connecting to the Township Catch Basin at 31 Warren Road, Block 133, Lot 11 to Thomas Coward—$500.00

WHEREAS, the Engineering Department has received a request from Thomas Coward for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the township catch basin at 31 Warren Road, Randolph, NJ 07869 (BL 133/L 11); and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on April 20, 2018; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the connecting to the township catch basin 31 Warren Road, Randolph NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Thomas Coward at 31 Warren Road, Randolph, NJ 07869.
7. Refund Police Detail Escrow to Robert Roselle—$435.00

WHEREAS, the Finance Department received escrow funds for Police Detail.
WHEREAS, the Detail work has been completed.
THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey that it is recommended by the Finance Department that the escrow funds for the following amounts be refunded:

8. Authorizing and Directing the Tax Collector to Sell All Municipal Liens in Accordance with NJ Statutes and NJ Administrative Code, Which Shall Take Place in 2018

WHEREAS, the Governing Body of the Township of Randolph in the County of Morris and the State of New Jersey, desires to collect all taxes, assessments and other municipal charges that are now delinquent; and
WHEREAS, the Tax Collector is directed to sell, by holding an electronic tax sale, all municipal delinquencies through December 31, 2017 in a manner prescribed by NJSA 54:5-19 and amended by Chapter 99, Public Laws of 1998 and NJAC 5:33-1.1, and
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph that the Tax Collector is hereby authorized and directed to sell all municipal liens in accordance with the New Jersey Statutes and New Jersey Administrative Code, as described above, and that said electronic tax sale shall take place in 2018.
9. Refund Tax Sale Certificate for 107 Boulder Ridge Dr., Block 184, Lot 1.07 for Fig Cap Inv. NJ13—$351.96

WHEREAS, Tax Sale Certificate #17-26 held by TFS cust for Fig Cap Inv NJ13, and assessed to Amanda Aemisegeo Hladun and known as, Block 184, Lot 1.07 and also known as 107 Boulder Ridge Dr., and;
WHEREAS, the above mentioned Tax Sale Certificate has been redeemed by Amanda Aemisegeo Hladun, the owner of said property. The redemption includes principal and interest in the amount of $151.96 and the return of the premium in the amount of $200.00.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the total amount of $351.96 TFS cust for Fig Cap Inv NJ13, PO Box 54472, New Orleans, LA 70154 the lien holder of Tax Sale Certificate #17-26.
10. Refund Water Connection Fee in the Amount of $2,610.00 and Road Opening Fee $700.00 at 60 Radtke Road, Block 153.1, Lot 18 to Michael Bellero—$3,310.00

WHEREAS, the Engineering Department has received a request from Michael Bellero at 60 Radtke Road, Randolph, NJ 07869, Block 153.1, Lot 18 for the refund of water connection fee and road opening fee; and
WHEREAS, on May 2, 2018, the homeowner paid for a water connection fee and road opening fee associated with 60 Radtke, Randolph, NJ; and
WHEREAS, the homeowner has opted to not connect to the public water system and has requested a refund for this connection fee in the amount of $2,610.00 and road opening fee of $700.00; and
WHEREAS, the Engineering/W&S Administrator recommends the connection fee and road opening fee be refunded.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering/W&S Administrator that the water connection fee in the amount of $2,610.00 and road opening fees of $700.00 be refunded to Michael Bellero at 60 Radtke Road, Randolph, NJ 07869.
11. Refund Road Opening Cash Bond for the Purpose of Replacing the Sewer Clean-Out at 36 Harmony Road, Block 57, Lot 20 to Mark Lindsay & Sons Plumbing & Heating—$500.00

WHEREAS, the Engineering Department has received a request from Mark Lindsay & Sons Plumbing & Heating, Inc. for the release of a $500.00 cash road opening bond posted for the purpose of replacing the sewer clean-out at 36 Harmony Road, Randolph, NJ 07869—Block 57 Lot 20; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on June 16, 2016; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the replacing of the sewer clean-out at 36 Harmony Road, Randolph NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Mark Lindsay & Sons Plumbing & Heating, Inc. at 21 Union Valley Road, Newfoundland, NJ 07435.
12. Release of a Stabilization Bond for the Purpose of Ensuring the Retaining Wall Stabilization at 9 South Road, Block 38.01, Lot 22—Christopher Schappert—$5,000.00

WHEREAS, the Engineering Department has received a request from Christopher Schappert for the release of a $5,000.00 Stabilization Bond posted for the purpose of ensuring the retaining wall stabilization to 9 South Road, Randolph, NJ 07869, Block 38.01, Lot 22; and
WHEREAS, the Stabilization Bond consisted of a $5,000.00 cash bond, which was received and deposited with the Finance Department on October 10, 2016; and
WHEREAS, the Applicant was required to post this Stabilization Bond to guarantee the retaining wall stabilization at 9 South Road, Randolph, NJ 07869; and
WHEREAS, the Engineering Department has inspected the property and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Stabilization Bond in the amount of $5,000.00 be refunded to Christopher Schappert at 22 Shawnee Trail, Sparta, NJ 07871.
13. Refund Road Opening Cash Bond for the Purpose of Installing a Driveway at 15 Waterfall Drive, Block 52, Lot 2.05 to Domenic DiSiena—$500.00

WHEREAS, the Engineering Department has received a request from Domenic DiSiena for the release of a $500.00 cash road opening bond posted for the purpose of installing a driveway at 15 Waterfall Drive, Mendham, NJ 07945 (BL 52/L 2.05); and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on February 21, 2017; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the installing of a driveway at 15 Waterfall Drive, Mendham, NJ 07945 within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Domenic DiSiena at 15 Waterfall Drive, Mendham NJ 07945.
14. Authorizing the Public Display of Fireworks for the 2018 Freedom Festival on June 30, 2018 (Rain Date—July 1, 2018) after Issuance of a Permit by the Fire Official

WHEREAS, the Township of Randolph annually holds its Freedom Festival at the County College of Morris; and
WHEREAS, the Freedom Festival includes the public display of fireworks; and
WHEREAS, this year’s Freedom Festival fireworks will be held on Saturday, June 30, 2018 with a July 1, 2018 rain date; and
WHEREAS, International Fire Code 2006, New Jersey Edition, Section 3301.2.4.3 requires the governing body to grant permission for the public display of fireworks; and
WHEREAS, upon application to the Fire Official and after receipt of all necessary documentation a permit shall be issued by the Fire Official, pursuant to N.J.A.C. 5:70-2.7 for the fireworks display; and
WHEREAS, the Purchasing Agent solicited quotes from seven (7) fireworks vendors; and
WHEREAS, two quotes were received; and
WHEREAS, the contract was awarded to Pyrotecnico Fireworks, Inc.; and
WHEREAS, Pyrotecnico Fireworks, Inc. provided proof of proper insurance coverage which has been approved by the MEL Underwriting Manager.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that permission is hereby granted for the public display of fireworks at the 2018 Freedom Festival by Pyrotecnico Fireworks, Inc. on June 30, 2018 (rain date July 1, 2018) after issuance of a permit by the fire official as stated above.
15. Amending a Professional Services Agreement with Robert Michaels and Associates for Planning Services for the Affordable Housing Program to be Extended to June 30, 2019 with an Increase of $5,000.00 in the Contract Award Amount for a New Not-to Exceed Total of $30,000.00 with No Increase in the $150.00 Hourly Rate

WHEREAS, the Township of Randolph (“Township”) adopted Resolution 196-12 on June 28, 2012 awarding a professional services agreement to Robert Michaels and Associates for planning services for the affordable housing program for $15,000 for the period of June 28, 2012 through June 27, 2013; and
WHEREAS, the Township adopted Resolution 161-15 on June 16, 2015 authorizing an extension through June 30, 2016; and
WHEREAS, the Township adopted Resolution 137-16 on April 21, 2016 since the Planning and Zoning Administrator had advised that this project was still not complete due to issues with the courts and should therefore be extended through June 30, 2017 as well as be increased an additional $5,000 to $20,000 for additional costs; and
WHEREAS, the Township adopted Resolution 68-18 on February 15, 2018 since the Planning and Zoning Administrator had advised that this project was still not complete due to issues with the courts and should therefore be extended through June 30, 2018 as well as be increased an additional $5,000 to $25,000 for additional costs; and
WHEREAS, the project is still not complete and should be extended through June 30, 2019 at the request of the Planning and Zoning Administrator; and
WHEREAS, additional monies of $5,000 are needed to cover additional costs incurred as a result of the extension; and
WHEREAS, the hourly rate will remain at $150 which was authorized on April 21, 2016 via R 137-16.
WHEREAS, the Finance Officer has certified to the availability of funds for this project in account #13-225-00-000-000.
NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey that the professional services agreement awarded to Robert Michaels and Associates for planning services for the affordable housing program be extended to June 30, 2019 with an increase of $5,000 in the contract award amount for a new not to exceed total of $30,000 with no increase in the hourly rate.

16. Authorizing Award and Rejection of MCCPC Contract #20-B—Sporting Goods to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #20-B (Sporting Goods); and
WHEREAS, bids had been advertised and received on April 19, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, seven (7) bids were received; and
WHEREAS, Contract #20-B (Sporting Goods) is awarded on a line item basis; and
WHEREAS, the bid specifications state that bidders who do not provide catalogs or detailed literature when bidding an equivalent item will be disqualified from that item; and
WHEREAS, Stadium Systems in Canaan, Connecticut, did not provide catalogs or literature for numerous equivalent items they were bidding, therefore the bids for those items must be disqualified; and
WHEREAS, the bid submitted by Aluminum Athletic Equipment Company in Royersford, Pennsylvania, did not include a signed bid proposal which is a non-curable and non-waivable defect and therefore the bid must be rejected as non-responsive; and
WHEREAS, the bid submitted by Triple Crown Sports in Old Bridge, New Jersey, did not include a completed mandatory Acknowledgement of Revisions & Notices form which is a non-curable and non-waivable defect and therefore the bid must be rejected as non-responsive; and
WHEREAS, the bid submitted by R&R Trophy and Sporting Goods in North Arlington, New Jersey, did not include the mandatory Non-Collusion Affidavit nor the Bidder’s Affidavit which are non-curable and non-waivable defects and therefore the bid must be rejected as non-responsive; and
WHEREAS, the lowest responsive and responsible bidders offering products that comply with the bid specifications for Contract #20-B (Sporting Goods) are reflected in the attached Notification of Award for a one-year period.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection, and hereby rejects, the bids submitted by Aluminum Athletic Equipment Company, Triple Crown Sports, and R&R Trophy and Sporting Goods for Contract #20-B (Sporting Goods) as noted above.
BE IT FURTHER RESOLVED that the Township Council hereby authorizes the award of Contract #20-B (Sporting Goods) to the bidders noted on the Notification of Award for the term July 1, 2018 - June 30, 2019.
17. Authorizing Award and Rejection of MCCPC Contract 25—Janitorial Supplies to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #25 (Janitorial Supplies); and
WHEREAS, bids had been advertised and received on April 19, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, nine (9) bids were received; and
WHEREAS, Contract #25 (Janitorial Supplies) is awarded on a line item basis; and
WHEREAS, the bid specifications require bidders to provide an exact URL address or manufacturer print-out for equivalent items offered and any items that cannot be verified with the information provided will be rejected; and
WHEREAS, numerous products and line items submitted by W.B. Mason, Allen Paper & Supply Company, The Office Concepts Group, Spruce Industries, Cooper Friedman and American Pride Paper and Plastic could not be verified with the information provided and those items were awarded to the next lowest responsive and responsible bidder; and
WHEREAS, the bid submitted by Interboro Packaging Corporation (“IPC”), Montgomery, New York, is found to be non-responsive to the bid specifications based upon their formal and stated position as set forth, in part, in various e-mails transmitted from IPC to the MCCPC and its representatives that they will not acknowledge, or abide by, or be bound to, and formally reject, the open-end nature and provisions of Contract #25 which require that the successful bidder, if awarded the contract for that product or line item, must provide the product or line item for which the bid was submitted and awarded, irrespective of whether the estimated quantity for that product or line item is purchased during the contract term by the MCCPC participants; and
WHEREAS, upon learning of that above position articulated by IPC, the MCCPC gave IPC the opportunity to withdraw their bid for products and line items in Contract #25; and
WHEREAS, IPC declined to withdraw their bid, despite their stated position that IPC does not accept the open-end contract provisions by which they would have to abide and to which they would have to be bound if awarded any products and line items under Contract #25 as set forth above; and
WHEREAS, the lowest responsive and responsible bidders offering products that comply with the bid specifications for Contract #25 (Janitorial Supplies) are reflected in the attached Notification of Award for a one-year period.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection, and hereby rejects, the bid submitted by Interboro Packaging Corporation for Contract #25 (Janitorial Supplies) for the reasons as set forth in the preamble of this resolution as noted above; and
BE IT FURTHER RESOLVED that the Township Council hereby rejects the line items bid by W.B. 18. Authorizing Rescission from All Hands Fire Equipment and Re-Award to Continental Fire & Safety for a Portion (Item #7) of MCCPC Contract #40 (Personal Protection Items & Equipment for Emergency Personnel)

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #40 (Personal Protection Items & Equipment for Emergency Personnel); and
WHEREAS, bids had been advertised and received on April 19, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, the Township Council awarded Contract #40 to various vendors on May 17, 2018; and
WHEREAS, the bid specifications state that bidders are to submit the most current published price list; and
WHEREAS, for Item #7 (Dragon Fire Gloves) All Hands Fire Equipment submitted a 2018 price list offering a 10% discount while all other bidders submitted a 2015 price list with discounts varying from 20% to 23%; and
WHEREAS, based upon the instructions in the bid specifications that the most current price list be awarded, Item #7 was awarded to All Hands Fire Equipment; and
WHEREAS, subsequent to the award of Item #7 to All Hands Fire Equipment, the manufacturer confirmed that the 2015 price lists are the most current, thereby making all price lists submitted for Item #7 the same; and
WHEREAS, the discount offered by Continental Fire & Safety is significantly higher at 23%; and
WHEREAS, it is recommended by the MCCPC that the award of Item #7 be rescinded from All Hands Fire Equipment and re-awarded to Continental Fire & Safety for a one-year period.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rescission of the award of Item #7 (Dragon Fire Gloves) from All Hands Fire Equipment for the reason stated above.

WHEREAS, the Engineering Department has received a request from Seneca Hill Corporation for the release of a $1,500.00 Driveway Bond for the purpose of installing a driveway at 59 Oak Lane, Randolph NJ 07869 (BL 117/L 6.01); and
WHEREAS, the Driveway Bond consisted of a $1,500.00 cash bond, which was received and deposited with the Finance Department on February 23, 2017; and
WHEREAS, the Applicant was required to post this Driveway Bond to guarantee the installation of a driveway at 59 Oak Lane Randolph NJ 07869; and
WHEREAS, the Engineering Department has inspected the driveway and found it to be acceptable.

21. Authorizing Award and Rejection of MCCPC Contract #42—Landscaping Materials & Supplies to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #42 (Landscaping Materials & Supplies); and
WHEREAS, bids had been advertised and received on April 19, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, ten (10) bids were received; and
WHEREAS, Contract #42 (Landscaping Materials & Supplies) is awarded on a line item basis; and
WHEREAS, there were tie bids for Items #2 and #3 in Category A and, as stated in the bid specifications, a name drawing was held on May 22, 2018, to determine the winner for each of the items; and
WHEREAS, the bid submitted by Jersey Mulch Products in Towaco, New Jersey, did not include the mandatory Non-Collusion Affidavit nor the Bidder’s Affidavit which are non-curable and non-waivable defects and therefore the bid must be rejected as non-responsive; and
WHEREAS, the lowest responsive and responsible bidders offering products that comply with the bid specifications for Contract #42 (Landscaping Materials & Supplies) are reflected in the attached Notification of Award for a one-year period.

22. Authorizing Change Order #1 in the Amount of $14,100.00 for the On-Site Brush Grinding Services Bid Awarded to JH Reid On-Site Recycling, Inc. of S. Plainfield, NJ to a New Not-to-Exceed Total of $44,100.00

WHEREAS, on April 27, 2017 via R 103-17, the Township Council awarded a contract extension to JH Reid On-Site Recycling, Inc. for the on-site brush grinding services bid for the period of July 1, 2017 through June 30, 2018 for a not to exceed contract award total of $30,000; and
WHEREAS, multiple Nor’easters hit the State of NJ in March, including the Township of Randolph, causing substantial tree damage which resulted in a significant increase in the amount of brush collected by the Township; and
WHEREAS, this significant increase in the amount of brush collected caused the Township to exceed the estimated contract costs for on-site brush grinding services by more than 20%; and
WHEREAS, the Township Manager has provided the attached Certification in compliance with N.J.A.C. 5:30-11.9; and
WHEREAS, it is anticipated that an additional not to exceed amount of $14,100 is required to complete the brush grinding of the brush in the DPW yard as well as the remainder still to be collected; and
WHEREAS, the Finance Officer has certified to the availability of funds for these changes in account #02-213-41-750-300 ($3,868.16) and #02-213-41-760-300 ($10,231.84).
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey that Change Orders #1 is approved and authorized, for a total net increase of $14,100, increasing the total contract award amount from a not to exceed $30,000 to a not to exceed $44,100.
BE IT FURTHER RESOLVED, that the Township Council authorizes a written amendatory contract to be entered into covering the changes to be made.

Manager Mountain explained that the state changed the ages for both the purchase and possession of tobacco products; therefore, the ordinance needed amending.

Manager Mountain explained that he and Darren Maloney met with the Fire Department to review the status of the Capital Ordinance. Since there was a balance in the 2017 ordinance, the recommendation was to amend Ordinance No. 08-17 to allow a broader use of those funds to include thermal imaging equipment.

H. OPEN TO THE PUBLIC
Seeing no one from the public, the public portion was closed.
I. COUNCIL COMMENTS
Councilman Guadagno attended the Wildlife Management Advisory Committee meeting. The county has not yet provided last season’s deer hunt numbers.
Councilman Guadagno also attended the Trails Committee meeting. Projects are moving along. There was discussion on the ticks this season. Manager Mountain explained that signage was posted at the trail heads about ticks; he will also have information in the newsletter and on social media. The committee is also looking into the program that will locate problems and send it to the township. The Manager replied that they are looking into it with Darren Carney. Councilwoman Veech asked if the scouts have been given projects related to the trails. There was a short discussion on the boy scouts working on the trails.
Councilman Guadagno reported that he has received two complaints about Calais Road. One is that there has been a styrofoam container on the roadway for about three weeks. The other is the brush is becoming overgrown at the intersection of Dover Chester Road, Calais Road, and Pleasant Hill Road, making it difficult to see.
Councilman Napoliello attended the Board of Health meeting; there was a discussion on this year being a bad year for ticks and mosquitoes due to the large amounts of rain.
Councilman Tkacs attended the Traffic Advisory Committee meeting and there was one more complaint on Calais Road; the bike path on either side of the road is full of grit and is unsafe for bicyclists.
Councilwoman Veech reported that the following night at 6:30 p.m. there will be a meeting at the Chester Community Garden; Randolph is modeling the community garden after Chester’s.
Councilwoman Veech reported that she plans to attend the joint meeting of the Parks and Recreation committees on June 14.
Councilwoman Veech also reported that there is a survey under review for TransOptions; it will be ready to disseminate to residents to determine their interest in transportation services.
Deputy Mayor Loveys reported that the Sheriff’s Office’s Hope One vehicle was at the Acme on May 29 from 9 a.m. to 2 p.m.; several people approached the vehicle. He also reported that he attended the recent MAC meeting in Councilwoman Carey’s absence. The MAC would like to install Stigma Free Randolph signs in the community; they are proposing ten signs. At the end of last year, he met with Kate Olsakowski and Liz Ritter to discuss the signs. Deputy Mayor Loveys suggested that they get a consensus from the MAC and then bring it before the Council. He described the proposed sign and dimensions, and reported that they received an estimate of $72 per sign. The Deputy Mayor stated that in his opinion the signs could be placed at the entry points to the township; but he felt that posting them in the parks was not necessary. Councilwoman Veech offered to bring up the subject of posting the signs in the parks at the upcoming Parks Committee meeting. There was discussion on what other towns have posted the signs, and exactly what it means that Randolph is a stigma-free town. Manager Mountain added that the MAC hosted other programs earlier in the year, such as Mental Health First Aid Training. Deputy Mayor Loveys reported that the MAC has been working hard on the stigma-free initiative.
Mayor Forstenhausler reported that several Council members attended the Memorial Day service at the VFW; it was very well attended.
Mayor Forstenhausler and Deputy Mayor Loveys attended an outreach iftar dinner at the Islamic Center in Rockaway; it was a very interesting panel discussion.
Mayor Forstenhausler attended the Greek Festival at St. Andrew’s Church; he and Senator Bucco were there for the ribbon cutting ceremony to kick off the event.
The Mayor reported that he received a letter from Assemblyman Bucco congratulating the township for being designated as one of the best communities for music education by the National Association of Music Merchants. He read the citation from the New Jersey State Senate.
Mayor Forstenhausler reported that on May 31st Randolph hosted the Morris County Cooperative Pricing Council (MCCPC) luncheon for its members. The Mayor gave a brief description of the MCCPC; Manager Mountain added that it’s the longest standing shared services in the state, since 1974. The luncheon was very well attended.
