Minutes: June 7, 2012

This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and, to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 5, 2011, by emailing them the annual resolution adopted by the Council on December 1, 2011. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and in the Morris County Daily Record on December 8, 2011. The Notice of Time Change for tonight’s meeting was provided to the Randolph Reporter on May 16, 2012. The time change for this meeting was advertised in the Randolph Reporter May 24, 2012.

The public portion of the meeting was re-opened at 7:05 p.m.

OPEN TO THE PUBLIC

Judith Stewart, 114 Everdale Road, asked how many police pursuit vehicles were included in the Combined Action Item DD, #15-A. Manager Lovell replied that it was for three vehicles.

Seeing no one else from the public, Mayor Guadagno closed the public portion.

MANAGER’S REPORT

Manager Lovell reported that he and the Council received notice that the $200,000.00 grant for the reconstruction of Franklin Rd. was signed. He reported that it was a little shy of what had been requested, and the Township will have to make up the difference. The project is being carried to 2013 due to the South Salem Street Bridge being out. Permission will be asked of the Council at a future meeting to undertake another grant application related to this project. The Manager stated that he would like to replace the asphalt sidewalk that runs along Franklin Rd. from about South Morris St. all the way down to South Salem Street, and then do a sidewalk improvement of South Salem Street to the K-Mart shopping center entrance.

Manager Lovell reported that the Library/Community Center and the Public Works Maintenance Garage are moving along quickly, and the staff will begin to move in next week. The Library/Community Center budget is going to be tight, but felt that it would be fine; the Public Works Maintenance Garage budget isn’t as tight. The Manager has received many compliments from residents regarding both projects.

COMBINED ACTION ITEMS

Mayor Guadagno asked a question regarding Item d, the refund overpayment for the A&P. He asked if they receive the refund despite having outstanding violations.

Manager Lovell responded that it is a bankruptcy matter that the A&P filed and the decision affects numerous properties across New Jersey and since the bankruptcy court ordered the action, the Township has to pay the dollars.

Mayor Guadagno commented that there are two light poles that were knocked down two years ago, and complaints have been made to the A&P. However, there are still wires sticking up, and the A&P has yet to take action to replace them.

Manager Lovell stated that he would have the A&P personnel come to his office to pick up the check and talk to them about the issue.

Councilman Loveys asked for clarification on Item dd, #5, #6, and #15C. He didn’t recall the figures for Items #5 & #6 being in the budget. He also asked if the purchase in Item #15C was part of a subsequent Ordinance.

Manager Lovell responded by stating that the numbers in Item dd #5 & #6 are “not to exceed numbers,” and since everything is done by purchase order, an account cannot be over expended. There is not $700,000.00 for paving materials in the budget; however when the Manager questioned the amount, he was told that traditionally $700,000.00 is put in the budget each year. Regarding Item dd #15C, theoretically the Ordinance should be adopted before the Resolution is adopted. Manager Lovell stated that as long as the Council is satisfied, both actions would be taken to the affirmative at this meeting.

Deputy Mayor MacArthur stated that he didn’t think something that is not authorized in the budget should be approved and asked if the dollar amount in Item dd, #5 could be revised to $200,000.00 as part of the passage on the combined resolutions.

Councilwoman Veech made a motion to approve the Combined Action Items, as amended, by pulling Item p and changing the amount in Item dd, #15C to $200,000.00. Councilwoman Mitsch seconded the motion and the following roll call vote was taken:

a.) Refund Registration for Day Camp to Euphrasia Serron—$535.00

WHEREAS, Euphrasia Serron registered her child for Day Camp and paid the fee of $635.00; and

WHEREAS, her child will not be attending the Day Camp due to the family relocating during the summer

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $535.00 be refunded to Euphrasia Serron, 44 Center Grove Rd., Apt. R20, Randolph, NJ 07869.

b.) Refund Registration for 2012 Babe Ruth U14 Spring Travel Team to Maria and Michael Olsakowski—$310.00 R-146-12

WHEREAS, Michael Olsakowski registered her child for the 2012 Babe Ruth U14 Spring Travel Team and paid the fee of $310.00; and

WHEREAS, her child will not be to play this season due to injury.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $205.00 be refunded to Maria and Michael Olsakowski, 11 Winding Way, Randolph, NJ 07869.

c.) Refund Overpayment of Taxes for 17 Black Birch Drive to Donald/Iatrou Delgrosso—$3,223.87

WHEREAS, Donald/Iatrou Delgrosso has overpaid 2012 taxes in the amount of $3,223.87 on Block 208.02 Lot 20, 17 Black Birch Drive; and

WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $3,223.87 to Donald/Iatrou Delgrosso.

d.) Refund Overpayment of Taxes for 146 Center Grove Road to A&P Grocery—$106,076.67

WHEREAS, A&P Grocery has been granted a reduction in assessed valuation for the tax year 2011 by the US Bankruptcy Court on Block 79, Lot 2.01, known as 146 Center Grove Road; and

WHEREAS, an overpayment exists as a result of the reduction for the year 2011 in the amount of $106,076.67.

WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $106,076.67 to A&P Grocery.

e.) Refund Overpayment of Taxes for 6 Blue Fern Lane to Rodrigues/Carr—$2,981.13

WHEREAS, Rodrigues/Carr has been granted a reduction in assessed valuation for the tax years 2009, 2010, & 2011 by the Tax Court of New Jersey on Block 154, Lot 98, known as 6 Blue Fern Lane; and

WHEREAS, an overpayment exists as a result of the reduction for the year 2009 in the amount of $957.57, 2010 in the amount of $992.99 and 2011 in the amount of $1,030.57.

WHEREAS, it is recommended by the Tax Collector that these overpayments be refunded at this time.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $2,981.13 to Rodrigues/Carr.

f.) Release Road Opening Cash Bond for Repaving of Existing Driveway at 21 Bonnell Lane to Levato and Sons—$500.00

WHEREAS, the Engineering Department has received a request from Levato and Sons for the release of a $500.00 cash road opening bond posted for the purpose of repaving of an existing driveway at 21 Bonnell Lane, Randolph;

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on April 15, 2011 and;

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of an existing driveway at 21 Bonnell Lane within the Township Right of way, and;

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Levato and Sons, 176 Morris St., Morristown, NJ 07960.

g.) Refund Tree Bond for 16 Richter Street to Aleksandar Kuridza—$1,100.00

WHEREAS, the Planning and Zoning Department received a tree bond posted by Aleksandar Kuridza for Block 201, Lot 24.01 in the amount of $5,700.00; and

WHEREAS, all of the requirements have been met and completed.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator that the tree bond in the amount of $1,100.00 be refunded to Aleksandar Kuridza, 16 Richter Street, Randolph, NJ 07869.

h.) Cancel Tax Sale Certificate for 1164A Sussex Turnpike—$24,261.06

l.) Awarding a Professional Services Agreement to Strunk-Albert to Perform a Solar Consumption Analysis at the DPW Garage

WHEREAS, the Township of Randolph (“Township”) requires electrical engineering services in connection with the Randolph Township Garage PV Solar Study; and

WHEREAS, the Township has agreed to retain Strunk-Albert Engineering located at 804 Seven Bridge Road, Route 209, East Stroudsburg, PA 18301 to provide the necessary electrical engineering services as specifically outlined in the May 1, 2012 Proposal submitted by Kenneth R. Zimmerman, P.E. for a total amount not to exceed $1,500.00; and

WHEREAS, the contract with Strunk-Albert Engineering is for a total amount not to exceed $1,500.00 and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and

WHEREAS, in accordance with the Anti Pay-to-Play Legislation, Strunk-Albert Engineering submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and

WHEREAS, Strunk-Albert Engineering has also submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, there are funds available for the retention of such professional services; and

WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

1. The Township hereby hires, employs and retains Strunk-Albert Engineering having an office at 804 Seven Bridge Road, Route 209, East Stroudsburg, PA 18301 to provide electrical engineering services in connection with electrical engineering services in connection with the Randolph Township Garage PV Solar Study as detailed in the May 1, 2012 Proposal submitted by Kenneth R. Zimmerman, P.E..

2. Strunk-Albert Engineering shall be compensated at the rates as provided in the Proposal for a total contract amount not to exceed $1,500.00.

3. The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

4. The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.

5. The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.

6. It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.

7. This Resolution shall take effect immediately.

m.) Establishing a Complete Streets Policy for Randolph

WHEREAS, the Township of Randolph (the “Township”) is committed to creating street corridors that safely accommodate all road users of all abilities and for all trips; and

WHEREAS, “Complete Streets” are defined as roadways that enable safe and convenient access for all users, including children, persons with disabilities, bicyclists, motorists, seniors, movers of commercial goods, pedestrians, and users of public transport; and

WHEREAS, the New Jersey Department of Transportation supports Complete Streets policies and adopted its own policy on December 3, 2009; and

WHEREAS, Complete Streets are supported by the Institute of Traffic Engineers, the American Planning Association, and other transportation, planning and health officials; and

WHEREAS, the Township is committed to incorporating pedestrian safety and traffic calming measures when public streets undergo major reconstruction, including the inclusion of on-street dedicated bike lanes, where deemed feasible and practical; and

WHEREAS, the Township Council supports this Complete Streets initiative and wishes to reinforce its commitment to creating a comprehensive, integrated, connected street network that safely accommodates all road users of all abilities and for all trips.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Randolph, County of Morris, State of New Jersey that:

Whenever it is reasonable and feasible to do so, public street projects undertaken by the Township of Randolph, including both new construction and reconstruction (excluding maintenance), shall be designed and constructed as Complete Streets in order to safely accommodate travel by pedestrians, bicyclists, other forms of alternative transportation, public transit, and motorized vehicles and their passengers and shall be subject to the following conditions:

a) Pedestrian and bicycle facilities shall not be required where they are prohibited by law.

b) Public transit facilities shall not be required on streets not serving transit routes. The desirability of transit facilities will be determined on a project specific basis.

c) In the event that the cost of pedestrian, public transit, bicycle facilities and/or other alternate forms of transportation causes an increase in the costs of a public street project that would need to be funded with local tax dollars, approval from the Township Council must be obtained for same prior to bidding of the project.

d) The safety or timing of a project shall not be compromised by the inclusion of Complete Streets.

Adopted by the Township Council on June 7, 2012.

n.) Award Contract for Demolitions and Site Improvements for Cohn Farm Property—$42,000 to Drill Construction of West Orange

WHEREAS, the Township of Randolph wishes to award a contract for the Cohn Farm Demolition—Rebid; and

WHEREAS, bids have been advertised and received on May 18, 2012, in accordance with Local Public Contracts Law; and

WHEREAS, eight bids were received and the bids of the three apparent low bidders were reviewed; and

WHEREAS, the low bidder Emil DiPalma, Inc. of Hackettstown, NJ did not include a copy of the mandatory Power of Attorney with the Bid Bond and Consent of Surety thus making the bid a mandatory rejection; and

WHEREAS, the second low bidder, Drill Construction of West Orange, NJ met all the requirements of the bid thus making it the lowest responsive, responsible bidder with a bid price of $42,000; and

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Drill Construction of West Orange, NJ for the price of $42,000 per their bid proposal.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Beaver Electric Company of Roseland, NJ as the lowest responsive, responsible bidder for the price of $114,777 per their bid proposal.

WHEREAS, the Township has agreed to retain Ferriero Engineering, Inc. located at 180 Main Street, PO Box 571, Chester, NJ 07930 to provide the necessary engineering services as specifically outlined in the May 25, 2012 Proposal submitted by Paul Ferriero for a total amount not to exceed $7,000; and

WHEREAS, the contract with Ferriero Engineering, Inc. is for a total amount not to exceed $7,000 and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and

WHEREAS, the Township of Randolph advertised for the Pavement Reclamation Project and received bids on May 30, 2012; and

WHEREAS, 1 bid was received; and

WHEREAS, the Township of Randolph (“Township”) requires website/design modernization services in connection with the upgrade of the Township of Randolph Website; and

WHEREAS, the Township has agreed to retain PAVIAWEB.COM located at 2 Hamilton Road, #3J, Morristown, NJ 07960 to provide the necessary website/design modernization services as specifically outlined in the April 3, 2012 Proposal submitted by Pavia Kriegman for a total amount not to exceed $9,800.00; and

WHEREAS, the contract with PAVIAWEB.COM is for a total amount not to exceed $9,800.00 and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and

WHEREAS, in accordance with the Anti Pay-to-Play Legislation, PAVIAWEB.COM submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and

WHEREAS, PAVIAWEB.COM has also submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, there are funds available for the retention of such professional services; and

WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

2. PAVIAWEB.COM shall be compensated at the rates as provided in the Proposal for a total contract amount not to exceed $9,800.00.

3. The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

4. The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.

5. The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.

WHEREAS, the Engineering Department has received a request from Isaac Spiteri for the release of a $500.00 cash road opening bond posted for the purpose of replacing of pavers at end of driveway at 56 Quail Run, Randolph;

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on May 17, 2012 and;

WHEREAS, the Applicant was required to post this cash bond to guarantee the replacing of pavers at end of driveway at 56 Quail Run within the Township Right of way, and;

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

WHEREAS, bids were advertised and received on May 10, 2012, in accordance with Local Public Contracts Law for the contracts noted above; and

WHEREAS, two bids were received for Contract #44 but were ultimately rejected due to one bidder altering the terms of the bid proposal and the other bidder incorrectly completing a mandatory form that accompanies the bid proposal; and

WHEREAS, one bid was received for Contract #48 but was ultimately rejected due to the incorrect completion of a mandatory form that accompanies the bid proposal; and

WHEREAS, Contract #44 and Contract #48 will need to be advertised for re-bid in order to have a contract in place for the period of July 1, 2012 through June 30, 2013.

aa.) Rescinding a Portion of MCCPC Contract #20-A Sporting Goods from Cannon Sports and Re-Awarding to Metuchen Center and R&R Trophy and Sporting Goods

WHEREAS, on January 1, 2012, the Township of Randolph on behalf of the Morris County Cooperative Pricing Council (MCCPC) awarded Category A, Items 5 and 40, of Contract #20-A, Sporting Goods, to Cannon Sports; and

WHEREAS, complaints from the MCCPC members have been received since the award of this contract to Cannon Sports regarding the inability to acquire those items on a timely basis; and

WHEREAS, the MCCPC Coordinator has made two attempts to contact Cannon Sports in an effort to rectify this issue; and

WHEREAS, Cannon Sports has not responded to either attempts and is being non-responsive to that portion of Contract #20-A; and

WHEREAS, it is in the best interests of the MCCPC to rescind Contract #20-A, Category A, Items 5 and 40, from Cannon Sports at this time; and

WHEREAS, it is in the best interests of the MCCPC to re-award Category A, Item 5, to Metuchen Center as they were the qualified second low bidder and they have agreed to honor the price quoted in their bid proposal for the remainder of the contract period; and

WHEREAS, it is in the best interest of the MCCPC to re-award Category A, Item 40, to R&R Trophy and Sporting Goods as they were the qualified second low bidder and they have agreed to honor the price quoted in their bid proposal for the remainder of the contract period.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, on behalf of the MCCPC, authorize the rescission of Category A, Items 5 and 40 of Contract #20-A, Sporting Goods, from Cannon Sports.

OPEN TO THE PUBLIC

Judith Stewart, 114 Everdale Road, asked Manager Lovell how many police vehicles will be purchased this year. Manager Lovell responded that three (3) vehicles would be purchased.

Lee Whilden, 82 Radtke Road, was happy to hear that the Township was able to purchase a new generator for the Municipal Building. Ms. Whilden asked the Manager if any money was recuperated from the State from the devastating storms. Manager Lovell stated that the paperwork has been filed with the State to reimburse the Township for over $200,000 worth of damages that occurred.

COUNCIL COMMENTS

Councilman Loveys reported that the Morris County Municipal Utilities Authority approved a deer hunt on the Alamatong Well Fields property. The hunt will be a bow hunt in October and a shotgun hunt in January.

Councilwoman Mitsch reported that the Freedom Park Lacrosse Tournament was a success and that she received numerous compliments from those attending on how great the fields are in Randolph.

Deputy Mayor MacArthur reported that the Police Department used 56 hours out of the 80 dedicated to the Click It or Ticket Grant. During the grant cycle, 115 summonses were issued. Out of the 115 summonses issued, 79 were for children’s restraint seats and seatbelts.
