Minutes: March 5, 2009
A regular meeting of the Randolph Township Council was called to order at 8:00 p.m. by Deputy Mayor Alpert. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and, to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on January 12, 2009, by emailing them the annual resolution adopted by the Council on January 1, 2009. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and in the Morris County Daily Record on January 15, 2009.

Deputy Mayor Alpert led the Pledge of Allegiance.
OPEN TO PUBLIC
Judith Stewart, 114 Everdale Road, stated that she found the ordinance up for introduction to be confusing and believes it should be clarified before introduction.
Mr. Buzak explained that the language is in the existing ordinance. This proposed ordinance will merely reduce the number of Alternate members on a couple of township committees.
Mrs. Stewart reiterated her desire to see an ordinance that would ban smoking in township parks. The Council has previously remarked that such a ban would be difficult to enforce, however Mrs. Stewart stated that there is a state law that bans smoking in schools and that ordinance is enforced.
Seeing no one further from the public, the public portion was closed.
COUNCIL AND MANAGER REPORTS
Manager Lovell noted that the Quaker Meeting House recently celebrated their 250th anniversary. The Manager reported that a Point of Distribution program will be undertaken this year in the Shongum area in connection with Emergency Management. It will be a door to door exercise utilizing volunteers and staff. He is in the process of determining how best to get the information to the affected residents. The Manager will keep the Council informed on this issue as the date gets closer.
ORDINANCES
A. Introduction
(1) Amending Committee Ordinance
Manager Lovell stated that the proposed ordinance deals with a couple of minor modifications to the ordinance for boards and committees in Randolph Township. Under the new ordinance, if a newly appointed member fails to take the Oath of Office within three weeks of their appointment, the Council can declare that seat vacated and a new appointment can be made. This proposed ordinance will also reduce the number of Alternate members for the Community Services Advisory Committee and the Landmarks Committee.
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING SECTIONS 10-3, 10-222, 10-302, AND 10-303 OF CHAPTER 10, BOARDS, COMMISSIONS, COMMITTEES, AND AGENCIES, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY” be introduced, read by title by the Township Clerk and passed on first reading.
BE IT RESOLVED that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 2nd of April, 2009, at 8:00 in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said ordinance.
BE IT FURTHER RESOLVED that the Township Clerk be authorized and directed to advertise said ordinance in full or by summary with the Notice of Introduction thereof, in the official designated newspaper according to law.
Councilman Napoliello stated his displeasure at a section of the ordinance dealing with members who miss 60 percent of duly called meetings within a three month period without being excused by their peers.
Manager Lovell explained that, should a member be recovering from a serious illness or fulfilling a work assignment out of the area, the Council should be able to use discretion in excusing members from missing meetings. The language in the ordinance provides that discretion.
Councilman Napoliello reiterated his belief that the ordinance should be stricter in its language dealing with members who consistently miss meetings.

B. Second Reading and Public Hearing
(1) Ordinance #05-09: Position of Court Administrator/Defined Contribution Retirement Program
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING SECTIONS 2-138 AND 2-139 OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY, TO INDICATE THAT THE POSITION OF COURT ADMINISTRATOR IS NOT ELIGIBLE FOR AND REQUIRED TO PARTICIPATE IN AND IS EXEMPT FROM PARTICIPATION IN THE DEFINED CONTRIBUTION RETIREMENT PROGRAM” be read by title on second reading and a hearing held thereon.
Manager Lovell noted that the state made modifications to the pension system which placed certain categories of employees in a defined contribution retirement program. The court administrator was one of those positions. Since then, the state has changed their position on court administrators and is placing them back into the pension system. This proposed ordinance will allow the township to be compliant with state statute.
The Mayor opened the meeting to the public for a hearing on the ordinance. Seeing no one, the public portion was closed.

(2) Ordinance #06-09: Amend Inspection Fees of the Land Development Ordinance
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING SECTION 15-91.2, INSPECTION FEES, OF ARTICLE VII, ADMINISTRATION, ENFORCEMENT AND FEES, OF THE LAND DEVELOPMENT ORDINANCE OF THE TOWNSHIP OF RANDOLPH TO INCREASE THE INSPECTION FEE ON SITE PLANS” be read by title on second reading and a hearing held thereon.
Manager Lovell stated that this proposed ordinance will bring uniformity to inspection fees for site plans and subdivisions. Since the introduction of this ordinance, it was learned that the Township had not been treating these fees as escrow, however it will do so in the future.
The Mayor opened the meeting to the public for a hearing on the ordinance. Seeing no one, the public portion was closed.

COMBINED ACTION ITEMS
Manager Lovell stated that Item E will be pulled from the agenda and will be revisited at a later date.
Councilman Obremski asked the Manager to thank whoever is responsible for adding battery back-ups for the traffic lights in the DOT grant request resolution.
Manager Lovell responded that they have been trying to move in this direction for a number of years. When there is a power outage, police need to be immediately placed at several intersections for traffic control. During an emergency, this depletes the police force significantly. With battery back-up, it would allow for more officers to be called in for duty and allow them to remain functional in the community.

A. Refund/Adjustment Resolutions
(1) Refund Outside Tax Sale Certificate for Block 201, Lot 21, 17 Richter Street to Plymouth Park Tax Services—$15,000.00

WHEREAS, Outside Tax Sale Certificate #1882 held by Plymouth Park Tax Services, LLC, assessed to Paul Randazzo, Block 201 , Lot 21, 17 Richter Street; and
WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $22,861.89 and premium in the amount of $15,000.00.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $37,861.89 to Plymouth Park Tax Services, LLC, holder of Tax Sale Certificate #1882.
(2) Refund Overpaid Taxes for 9 Forest Hill Road to Angel and Margarita Borghini—$2,536.27

WHEREAS, Angel and Margarita Borghini have overpaid 2009 taxes in the amount of $2,536.27 on Block 172 , Lot 10, 9 Forest Hill Road; and
WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $2,536.27 to Angel and Margarita Borghini.
(3) Release Escrow From Block 82, Lot 40, to Resurrection Parish—$920.00

WHEREAS, the Planning and Zoning Department received escrow funds from Resurrection Parish for Block 82, Lot 40, in the amount of $7,500.00; and
WHEREAS, the project has been completed and closed out and there are no outstanding payments due.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Darren Carney, Planning and Zoning Administrator, that the remaining escrow funds in the amount of $920.00 plus interest be refunded to Resurrection Parish, 651 Millbrook Avenue, Randolph, NJ 07869.
(4) Release Escrow From Block 103.01, Lot 11, to Stephen Quinnan—$770.50

WHEREAS, the Planning and Zoning Department received escrow funds from Stephen Quinnan for Block 103.01, Lot 11, in the amount of $1,000.00; and
WHEREAS, the project has been completed and closed out and there are no outstanding payments due.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Darren Carney, Planning and Zoning Administrator, that the remaining escrow funds in the amount of $770.50 be refunded to Stephen Quinnan, 2 Old Coach Road, Randolph, NJ 07869.
(5) Overpaid 2008 Taxes by Reason of Veteran’s Deduction—38 Morris Turnpike to Janice Sefcik—$250.00

WHEREAS, Janice Sefcik has overpaid 2008 taxes by reason of veteran’s deduction in the amount of $250.00 on Block 45, Lot 3, 38 Morris Turnpike; and
WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $250.00 to Janice Sefcik.
B. Authorizing Approval to Submit Grant Applications for Discretionary Aid to the NJ DOT for Various Roadway Improvement Projects

WHEREAS, the Township of Randolph has determined that the following roads are in need of milling and resurfacing:
1. Center Grove Road from the intersection of Carrell Road to Wilkshire Blvd.
2. Morris Turnpike from the intersection of Dover Chester Road to Sussex Turnpike.
3. Shongum Road from the intersection of Farm Road to the Randolph/Denville boundary line.
4. South Road from the intersection of Jared Drive to the Randolph/Mendham boundary line.
5. Radtke Road entire length, partial reconstruction, milling, and resurfacing.
WHEREAS, the Township of Randolph will also make discretionary aid grant applications for the upgrade of traffic signals to LED lights with battery back-up units for the following intersections:
1. South Salem Street and Route 10.
2. South Morris St. & Quaker Church Rd.
3. Franklin Rd. & South Salem St.
4. Route 10 & Millbrook Ave.
5. Quaker Church Rd. & Center Grove Rd.
6. Route 10 & Center Grove Rd.
7. Route 10 & Dover Chester Rd.
8. Route 10 & Canfield Ave.
9. Dover Chester Rd. & Morris Tpke.
10. Dover Chester Rd. & Calais Rd.
WHEREAS, the Township of Randolph may apply to the New Jersey Department of Transportation for discretionary aid as needed.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorizes the Engineering Department to proceed with the grant application process for the aforementioned projects.
C. Authorizing the Award of Contract for Engineering Services to PK Environmental—Not to Exceed $10,000.00

WHEREAS, the Township of Randolph has a need to acquire Peel, Kehrley, Inc., dba PK Environmental, as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; and
WHEREAS, Gail Catania, Purchasing Coordinator, has determined and certified in writing that the value of the acquisition may exceed $17,500.00; and
WHEREAS, the anticipated term of this contract is one year and may be extended as approved by this governing body; and
WHEREAS, Peel, Kehrley, Inc., dba PK Environmental, has indicated they will provide the Environmental Engineering Services for an amount not to exceed $10,000.00; and
WHEREAS, Peel, Kehrley, Inc., dba PK Environmental, has completed and submitted a Business Entity Disclosure Certification which certifies that Peel, Kehrley, Inc., dba PK Environmental, has not made any reportable contributions to a political or candidate committee in the Township of Randolph in the previous one year, and that the contract will prohibit Peel, Kehrley, Inc., dba PK Environmental, from making any reportable contributions through the term of the contract; and
WHEREAS, funds are available for this purpose.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to enter into a contract with Peel, Kehrley, Inc., dba PK Environmental, as described herein.
BE IT FURTHER RESOLVED that the Business Entity Disclosure Certification and the Determination of Value be placed on file with this resolution.

F. Authorizing Budget Transfers—2008 Appropriation Reserves

WHEREAS, various 2008 bills have been presented for payment this year, which bills were not covered by order number and/or recorded at the time of transfer between the 2008 Budget Appropriation Reserve in the last two months of 2008; and
WHEREAS, N.J.S.A. 40A:4-59 provides that all unexpended balances carried forward after the close of the year are available, until lapsed at the close of the succeeding year, to meet specific claims, commitments or contracts, incurred during the preceding fiscal year, and allow transfers to be made from unexpended balances which are expected to be insufficient during the first three months of the succeeding year.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, that the transfers in the amount of $43,000.00 are made between the 2008 Budget Appropriation Reserves.

WHEREAS, the Township of Randolph utilizes Morris County Cooperative Pricing Council Contract #23, Police Uniforms and Equipment, from various vendors as needed for all departments in the township; and
WHEREAS, these purchases will not exceed $24,000.00.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to purchase from Morris County Cooperative Pricing Council Contract #23 as needed for all departments in the township.
H. Authorizing Purchases From State Contract #T0106, Police and Homeland Security Equipment and Supplies, Using Various Vendors as Needed

WHEREAS, the Township of Randolph utilizes New Jersey State Contract #T0106 for Police and Homeland Security Equipment and Supplies from various vendors; and
WHEREAS, these purchases are made on an as-needed basis; and
WHEREAS, these purchases will not exceed $40,000.00.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to purchase from New Jersey State Contract #T0106 using various vendors as needed for all departments in the township.
I. Authorizing on Behalf of MCCPC the Rescission and Re-Awarding of Contract #41

WHEREAS, on December 18, 2008, the Township of Randolph on behalf of the Morris County Cooperative Pricing Council awarded a portion of Contract #41 (Purchase of Communications Equipment) to Royal Communications for Items #B-19, I-10 and I-17; and
WHEREAS, in compliance with the bid specifications the award of Items #B-19, I-10 and I-17 to Royal Communications was based on Royal being a “direct” authorized dealer for the manufacturers covered under the items noted; and
WHEREAS, after being notified by another vendor and additional investigation as to the compliance of Royal’s bid for the items noted, we find that Royal Communications is not a “direct” authorized dealer for these manufacturers covered under Items #B-19, I-10 and I-17; and
WHEREAS, it is in the MCCPC’s interest to rescind a portion of Royal Communications’ initial award for items #B-19, I-10 and I-17 for non-compliance with the bid specifications and re-award these items to the “compliant” bidder who submitted the second highest discount noted below:
#B-19 (Manufacturer: Raytheon/JPS): Re-award item to Atlantic Communications who is a “direct” authorized dealer for submitting the second highest discount at 19.85%.
#I-10 (Manufacturer: Telex): Re-award item to Triangle Communications who is a “direct” authorized dealer for submitting the second highest discount at 17%.
#I-17 (Manufacturer: Kustom Signals): There were no other bidders, therefore, no re-award for Item #I-17.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that the above mentioned Items #B-19, I-10 and I-17 be rescinded from Royal Communication’s initial contract award and the re-awarding of the items as noted to the bidders who submitted the second highest discounts for the manufacturers under the 2009 MCCPC Contract #41 (Purchase of Communications Equipment).
J. Authorizing Award of Contract for Printing Services to Various Companies

WHEREAS, the Township of Randolph wishes to award a contract for Printing Services for a contract period of one (1) year, February 1, 2009—January 31, 2010; and
WHEREAS, bids have been advertised and received on January 27, 2009, in accordance with the “Local Public Contracts Law”; and
WHEREAS, Ridgewood Press, Ridgewood, New Jersey, was low bidder for Item #1; Pinnacle Graphics Communications, Morris Plains, New Jersey, was low bidder for Items #2, 3, 3A, 3B, 4, 4A, 4B, 5, 5A, 5B, 7, 8, 8A, 8B, 9, 9A, 9B, 10, 10A, 10B, 13, 23, 24, 25; Postnet, Voorhees, New Jersey, was low bidder for Items #2A, 2B, 7A, 7B, 14, 15, 16, 17, 18, 19a,c, 20a,c,e,g,i, 26, 27, 28; Hawk Graphics, Mt. Freedom, New Jersey, was low bidder on Items #6, 6A, 19b,d,e,f,g,h,i,j, 20b,d,f,j; BP Services was low bidder on Items #21, 22; and Graphicolor Corp., Vineland, New Jersey, was the low bidder for Item #20; and
WHEREAS, Items #11 and 12 are not being awarded as they are duplicated within the bid and Items #6, 6A and 6B will be awarded by a later resolution.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that contracts be awarded as stated above for Printing Services for the Township of Randolph for the contract term February 1, 2009 to January 31, 2010.

WHEREAS, the Township of Randolph has a need to acquire Anthony M. Bucco, of Johnson, Murphy, Hubner, McKeon, Wubbenhorst, Bucco & Appelt, PC, as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; and
WHEREAS, Gail Catania, Purchasing Coordinator, has determined and certified in writing that the value of the acquisition may exceed $17,500.00; and
WHEREAS, the anticipated term of this contract is one year and may be extended as approved by this governing body; and
WHEREAS, Anthony M. Bucco, of Johnson, Murphy, Hubner, McKeon, Wubbenhorst, Bucco & Appelt, PC, has indicated they will provide the Negotiations and Preparation of Developers’ Agreements for an amount not to exceed $15,000.00; and
WHEREAS, Anthony M. Bucco of Johnson, Murphy, Hubner, McKeon, Wubbenhorst, Bucco & Appelt, PC, has completed and submitted a Business Entity Disclosure Certification which certifies that Anthony M. Bucco of Johnson, Murphy, Hubner, McKeon, Wubbenhorst, Bucco & Appelt, PC, has not made any reportable contributions to a political or candidate committee in the Township of Randolph in the previous one year, and that the contract will prohibit Anthony M. Bucco of Johnson, Murphy, Hubner, McKeon, Wubbenhorst, Bucco & Appelt, PC, from making any reportable contributions through the term of the contract; and
WHEREAS, funds are available for this purpose.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to enter into a contract with Anthony M. Bucco of Johnson, Murphy, Hubner, McKeon, Wubbenhorst, Bucco & Appelt, PC, as described herein.
BE IT FURTHER RESOLVED that the Business Entity Disclosure Certification and the Determination of Value be placed on file with this resolution.

WHEREAS, the Township of Randolph has a need to acquire Landmark I Appraisal as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; and

WHEREAS, Landmark I Appraisal has completed and submitted a Business Entity Disclosure Certification which certifies that Landmark I Appraisal has not made any reportable contributions to a political or candidate committee in the Township of Randolph in the previous one year, and that the contract will prohibit Landmark I Appraisal from making any reportable contributions through the term of the contract, and

M. Endorsing a Treatment Works Approval for the Construction of a Pumping Station at 353 Route 10 East—Envision Plaza

RESOLUTION, endorsing an application for Treatment Works Approval for the construction of a pumping station and force main to be constructed in conjunction with the Envision Plaza Project, 353 Route 10 East, Block 145, Lot 2, on the official tax map of the Township of Randolph.
WHEREAS, the Township of Randolph has received a request to endorse a Treatment Works Application for the construction of a privately owned sanitary pump station and force main to be connected to the Randolph Township Sanitary Sewer System location within the Route 10 East right-of-way; and
WHEREAS, the applicant must apply to the New Jersey Department of Environmental Protection for the Treatment Works Approval for the discharge of sewer gallonage into the Randolph Township sanitary sewer collection system by way of a pump station and force main; and
WHEREAS, Envision Plaza has submitted an application to the Township of Randolph for endorsement; and
WHEREAS, in order for the New Jersey Department of Environmental Protection (NJDEP) to consider the application, the same must be endorsed by the Township among others; and
WHEREAS, the Township desires to authorize the execution of the endorsement of the said application.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Randolph, County of Morris, State of New Jersey, that:
1. The Township hereby endorses a request for Treatment Works Approval for Envision Plaza located on Block 145, Lot 2, on the official tax map of the Township of Randolph.
2. The Township Manager is hereby authorized and directed to execute the appropriate endorsements for the Treatment Works Approval, together with other appropriate officers and employees of the Township of Randolph, and hereby authorized to take all actions necessary to effectuate the purpose.
3. This resolution shall take effect immediately.

OPEN TO PUBLIC
Judith Stewart, 114 Everdale Road, stated that the road crew did a wonderful job removing snow during the last snow storm earlier in the week. Mrs. Stewart commented that the school PTAs will not be providing camperships to the township this year. Although it will impinge on the budget, she asked the Council to learn more about this issue and to provide money for camperships so that township programs remain open to everyone. She asked the Manager to provide an analysis of the Recreation Department from a program point of view. Mrs. Stewart reiterated her concern about this issue and cautioned the Council that she will revisit it during the budget hearing if it is not resolved.
Seeing no one further from the public, the public portion was closed.
COUNCIL AND MANAGER COMMENTS
Councilwoman Price asked for a clarification for the next budget meeting.
Manager Lovell responded that there will be a regular Council Meeting on Tuesday, March 17. Thursday, March 19, is tentatively scheduled as a budget work session.
Manager Lovell thanked Mrs. Stewart for her comments regarding snow removal after the last storm.
