A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Loveys. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 5, 2013 by e-mailing them the annual resolution adopted by the Council on December 5, 2013. The annual resolution, including this meeting date, was advertised in the Randolph Reporter, the official paper of the Township of Randolph, and the Daily Record on December 12, 2013.

B. RECOGNITION/PROCLAMATION

1. Proclamation—Relay for Life—Bonnie Rosenthal

Mayor Loveys introduced Bonnie Rosenthal and presented and read the Relay for Life Proclamation:

WHEREAS, one in three people will be diagnosed with cancer within their lifetime and, in Morris County, an estimated 212 individuals are diagnosed with cancer each month, and 68 individuals will not survive each month; and

WHEREAS, Relay For Life is the signature activity of the American Cancer Society and celebrates cancer survivors and caregivers, remembers loved ones lost to this disease, and empowers individuals and communities to fight back against cancer; and

WHEREAS, Relay For Life is a unique team event designed to raise awareness about cancer and raise funds to support the American Cancer Society’s mission of fighting cancer, raising awareness of cancer prevention, and eliminating cancer; and

WHEREAS, the money raised at Relay For Life saves lives and creates a world with less cancer and more birthdays through funding cutting-edge cancer research, early detection and prevention education, advocacy efforts, and life-affirming patient services helping people to get well, stay well, and finding cures for cancer by fighting back;

WHEREAS, since the first Relay for Life, the event has raised more than $1.8 billion; and

WHEREAS, Randolph, one of seven united communities included within Relay for Life of Central Morris County is joining over 5,200 other communities worldwide on every continent to host the American Cancer Society’s Relay for Life, an event to celebrate cancer survivors and remember those who are no longer with us; and

WHEREAS, more than three million people , about one in 99 Americans will take part in Relay for Life this year, of which half a million of the participants are cancer survivors;

NOW, THEREFORE, I, James Loveys, Mayor of the Township of Randolph proclaim May 31st to June 1st to be American Cancer Society’s Relay for Life of Central Morris County and ask all of our Randolph citizens to participate and extend heartfelt appreciation and sincere thanks to staff and participants as well as the generous people who donate to this worthy cause, and urge all of our citizens to pay tribute to this very special group in our community.

1. Authorizing the Award of a Professional Services Agreement to Dewberry Engineers, Inc. for Butterworth Phase III

WHEREAS, the Township of Randolph (“Township”) requires Butterworth Phase III (Mt. Freedom sewer design project) services for a period not to exceed one year (March 6, 2014 - March 5, 2015); and

WHEREAS, Elizabeth Crescibene, Purchasing Agent, has determined and certified in writing that the value of these services will exceed $17,500; and

WHEREAS, the Township has agreed to retain Dewberry Engineers, Inc. located at 600 Parsippany Rd, Ste 301, Parsippany, NJ 07054 to provide the necessary Butterworth Phase III (Mt. Freedom sewer design project) services for a total amount not to exceed $85,700 per their proposal; and

WHEREAS, the fees are as noted in the attached proposal; and

WHEREAS, the anticipated term of this contract is for a period not to exceed one year (March 6, 2014 - March 5, 2015); and

WHEREAS, the contract with Dewberry Engineers, Inc. is for a total amount not to exceed $85,700 and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and

WHEREAS, in accordance with the Anti Pay-to-Play Legislation, Dewberry Engineers, Inc. has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and

WHEREAS, Dewberry Engineers, Inc. has also submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, there are funds available for the retention of such professional services; and

WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

  1. The Township hereby hires, employs and retains Dewberry Engineers, Inc. having an office at 600 Parsippany Rd, Ste 301, Parsippany, NJ 07054 to provide Butterworth Phase III (Mt. Freedom sewer design project) services for a period not to exceed one year (March 6, 2014 - March 5, 2015).
  2. Dewberry Engineers, Inc. shall be compensated for a total contract amount not to exceed $85,700.
  3. The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
  4. The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.
  5. The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
  6. It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.
  7. This Resolution shall take effect immediately.

2. Authorizing the Award of a Professional Services Agreement to Piercon to Assist in the Technical Development of a Cell Tower Bid Specification

WHEREAS, the Township of Randolph (“Township”) requires assistance in the creation of a bid specification for a new cell tower at Randolph Municipal Complex for a period not to exceed one year (March 6, 2014 - March 5, 2015); and

WHEREAS, the Township has agreed to retain PierCon Solutions LLC located at 63 Beaver Brook Rd, Suite 201, Lincoln Park, NJ 07035 to provide the necessary assistance in the creation of a bid specification for a new cell tower at Randolph Municipal Complex for a total amount not to exceed $4,375 per their proposal; and

WHEREAS, the hourly rate for these services is $175 as noted in the attached proposal; and

WHEREAS, the anticipated term of this contract is for the calendar year of March 6, 2014 - March 5, 2015; and

WHEREAS, the contract with PierCon Solutions LLC is for a total amount not to exceed $4,375 and therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) do not apply; and

WHEREAS, PierCon Solutions LLC has submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, there are funds available for the retention of such professional services; and

WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

3. Refund Outside Tax Sale Certificate for Block 173, Lot 14 to US Bank Cust—$4,237.42

R-89-14

WHEREAS, Outside Tax Sale Certificate #1996 held by US Bank Cust. for BV001 Trust, assessed to Christiana Trust, Block 173, Lot 14, 1072 Sussex Tpke.; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $2,937.42, and premium in the amount of $1,300.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $4,237.42 to US Bank Cust. for BV001 Trust holder of Tax Sale Certificate #1996.

4. Authorizing Rescission and Re-Award of Contract #16 Office Supplies

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #16 (Office Supplies); and

WHEREAS, bids had been advertised and received on October 1, 2013, in accordance with Local Public Contracts Law; and

WHEREAS, all categories of Contract #16 (Office Supplies) were awarded to various vendors by the Randolph Township Council on November 7, 2013; and

WHEREAS, Category D (Miscellaneous Office Equipment) was awarded to Staples; and

WHEREAS, Staples provided a copy of the Full Line 2014 catalog as bid on the bid proposal, however after the award of the contract it was discovered that not all items listed in the catalog contained pricing information; and

WHEREAS, the MCCPC made several attempts to obtain a price list from Staples for the items in the catalog that did not show pricing; and

WHEREAS, the various price lists obtained in response to the MCCPC’s requests were not consistent and did not contain firm pricing throughout the contract period; and

WHEREAS, it is recommended that Staples be found to be in default and Category D (Miscellaneous Office Equipment) of Contract #16 (Office Supplies) be rescinded; and

WHEREAS, W.B. Mason, the second low bidder for Category D, has agreed to hold firm the discount they bid for the duration of the contract period; and

WHEREAS, it is recommended that Category D (Miscellaneous Office Equipment) of Contract #16 (Office Supplies) be re-awarded to W.B. Mason.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rescission of Category D (Miscellaneous Office Equipment) of Contract #16 (Office Supplies) from Staples.

BE IT FURTHER RESOLVED that the Township Council, Township of Randolph, County of Morris, State of New Jersey, authorizes the award of Category D (Miscellaneous Office Equipment) of Contract #16 (Office Supplies) to W. B. Mason.

5. Authorizing Amendment to Recycling Services Agreement with Ecovanta for the Collection of Televisions at $0.25 per Pound

WHEREAS, there is a need to make a 3rd amendment to the Recycling Services Agreement originally entered into on February 15, 2013 with Ecovanta; and

WHEREAS, this 3rd amendment is for the collection of televisions at $0.25lb

WHEREAS, both parties agree to abide by the terms set forth in the Agreement dated February 26, 2014, attached hereto.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph do hereby approve the Agreement between Randolph Township and Ecovanta.

6. Raffle License, Off-Premise Merchandise Raffle, St. Andrew Greek Orthodox Community of Morris County, at St. Andrew Hall, 1447 Sussex Turnpike, Randolph, NJ on June 29, 2014 at 12:30 p.m.

7. Raffle License, Off-Premise Merchandise, St. Matthew the Apostle Parish, 335 Dover Chester Road, Randolph, on August 31, 2014 at 12:30 p.m.

F. ORDINANCES: SECOND READING/PUBLIC HEARING

1. Ordinance No. 3-14: Vacation of Ridge Street (to be tabled indefinitely)

Manager Lovell explained that the township staff believes that this Ordinance will eventually be necessary. However, the Ordinance was an attempt to fix something that the residents didn’t feel was necessary. There is one undeveloped lot that fronts Ridge Street that is looking to build a driveway. By vacating a portion of Ridge Street, that driveway gets pushed close to another individual’s property. The Manager feels the developer can apply to the Board of Adjustment, and the Board of Adjustment can make a determination as to where the driveway can gain access to an existing public road. Once that process is complete, the Council can determine whether there is the need to vacate Ridge Street. The benefit of vacating is that there are three lots that were subdivided when the road was removed from the tax map, they believe they already own the property, and they do not. None of those residents has come forward to request that the Council act on this Ordinance.

Attorney Buzak stated that if the Ordinance is tabled indefinitely, it sits out there in limbo and it may get forgotten. If it gets reactivated, notice will again be required. Rather than have the Ordinance hanging out there, he recommended moving to withdraw the Ordinance. If in the future it needs to move forward, or if a modification is needed, it will be introduced again.

Councilman Guadagno made a motion to withdraw the Ordinance. Councilman Forstenhausler seconded the motion, and the following role call vote was taken:

2. Ordinance No. 6-14: An Ordinance Accepting the Dedication of Block 131.01, Lot 7 for Municipal Public Purposes—Panetta

BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE OF THE TOWNSHIP OF RANDOLPH ACCEPTING THE DEDICATION OF BLOCK 131.01, LOT 7 LOCATED WITHIN THE TOWNSHIP OF RANDOLPH FOR MUNICIPAL PUBLIC PURPOSES” be read by title on second reading and a hearing held thereon.

Manager Lovell explained that this Ordinance relates to a project from the 1990s. It is a retention basin for homes built by Mr. Panetta on Penn Rise Court; the township is taking title to the retention basin.

3. Ordinance No. 7-14: Amending Stormwater Control Ordinance

BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING SECTIONS 15-95.3, 15-96 AND 15-97.1 OF ARTICLE VIII, STORMWATER CONTROL ORDINANCE, OF THE LAND DEVELOPMENT ORDINANCE OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY” be read by title on second reading and a hearing held thereon.

Manager Lovell explained that Randolph Township is a licensed stormwater operator under the State of New Jersey. This Ordinance embraces the standards that New Jersey has in place for stormwater control measures and the regulations set forth in those standards.

Attorney Buzak stated that the typographical error can be administratively corrected without need for the Council to act any further. That it has been pointed out for the record is sufficient for the Clerk to make the change.

G. ORDINANCES: INTRODUCTIONS

1. Ordinance #8-14: Amending Police Promotional Process

Manager Lovell explained that the township was advised last year that the vendor for testing would no longer service the Randolph Township account as a result of a law suit that has been filed. That required the township to look for other testing agencies. It was recognized that there was a need to update the Promotional Ordinance. The eligibility criteria for officers have been modified in several categories, making officers eligible earlier in their careers. The second part deals with the selection process. One of the components created, “A Four Year Personnel File Summary Review,” places a weighted measure on that component as part of this test. The staff has reviewed the Ordinance and it is felt that this is a good format and should serve the township well. A copy of this Ordinance has been shared with the President of the FOP and the Chief.

BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING AND REPLACING SECTION 2-328, PROMOTIONAL PROCESS FOR SERGEANTS AND LIEUTENANTS, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH” be introduced, read by title by the Township Clerk and passed on first reading.

BE IT RESOLVED that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 27th of March 2014 at 5:00 o’clock in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said Ordinance.

BE IT FURTHER RESOLVED that the Township Clerk be authorized and directed to advertise said Ordinance in full or by summary with the Notice of Introduction thereof in the official designated newspaper according to law.

Manager Lovell explained that the recommendation to amend the screening rates came from the Advisory Board of Health; it was reported by Councilman Napoliello.

BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING APPENDIX A, FEE SCHEDULE, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH” be introduced, read by title by the Township Clerk and passed on first reading.

BE IT RESOLVED that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 3rd of April 2014 at 7:00 o’clock in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said Ordinance.

I. DISCUSSION ITEMS

1. Supporting a Free, Democratic, and Independent Ukraine

Councilman Hirniak explained the need to support the individuals in Ukraine who are giving their lives in seeking the form of government that is enjoyed and promoted here in the United States, particularly given the large and well organized Ukrainian-American community in Randolph Township. He requested that the Township Council, at a future meeting, issue a Resolution and present it to a representative of the Ukrainian-American community from the Ukrainian Cultural Center in Whippany. The Resolution would acknowledge the Council’s support for the struggle for freedom in Ukraine and acknowledge the sacrifices made by those individuals who have already given their lives.

Councilman Hirniak made a motion to create a Resolution supporting a free, democratic, and independent Ukraine. Councilman Guadagno seconded the motion, and the following role call vote was taken:

J. OPEN TO THE PUBLIC

Judith Stewart of 114 Everdale Road supported the idea of creating a resolution about the Ukraine. She asked for clarification on the March 13th and March 27th Council meetings. Mrs. Stewart also commented on the recent changes to the township website; she felt some changes are better, and some are worse. Lastly, she mentioned the low ambient noise in the Council Chambers, how it affects her hearing, and asked if something can be done to correct the situation.

K. COUNCIL COMMENTS

Deputy Mayor Veech stated that on March 21st between 5 p.m. and 7 p.m. at the Wellness Center the Chamber of Commerce will be hosting a networking evening.

Deputy Mayor Veech reported that the Green Team workgroup, she, Councilwoman Carey, and Councilman Forstenhausler, met at 3 p.m. with Donna Luciani, Ralph Carchia, and Darren Carney. In their research, they found that the parameters for a Green Team had changed since November. Rules have been strengthened, there are Ordinances that the township would have to have word for word, and there are work plans involved. There would be a lot of time required by the staff and volunteers in order to be in compliance. As a group it was decided that it is not currently a good time to move forward with the Green Team.

L. EXECUTIVE SESSION

Mayor Loveys stated that there would be no action taken following the Executive Session.

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

1. The public shall be excluded from the following portion of the meeting.

2. The general nature of the subject matter to be discussed is as follows:

3. As nearly as now can be ascertained, the matter or matters to be discussed at this time will be disclosed to the public at such time and under such circumstances as are prescribed by law.
