A. OPENING OF REGULAR MEETING
1. Call to Order
A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Deputy Mayor Carey. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 29, 2018 by emailing them the annual resolution adopted by the Council on November 1, 2018. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and the Daily Record on December 6, 2018.

3. Pledge of Allegiance
Deputy Mayor Carey led the Pledge of Allegiance.
B. ECONOMIC DEVELOPMENT COMMITTEE APPOINTMENTS
Deputy Mayor Carey reported that there was an opening on the Economic Development Committee (EDC). She explained that they would be appointing members to different positions within the committee.
Councilwoman Veech made a motion to reappoint Rachita Chandak from Alternate #1 to member to replace Ethan Blynn; Joseph Fisher from Alternate #2 to Alternate #1; and George Garcia from Student Member to Alternate #2 as they have done in past years for other boards and committees. Councilman Tkacs seconded the motion, and the following roll call vote was taken:

D. MANAGER’S REPORT
Manager Mountain reported the following:
- Combs Hollow Bridge—he was advised by the County Bridge Department that the Combs Hollow Bridge project has cleared the requirements from the State Historic Preservation Office and it is moving forward. The County consulting engineer is completing plans for the project and summer bid is anticipated. The construction of the project is anticipated to begin in the fall. The Bridge Department will be provide him with a more defined schedule and will schedule a meeting for the presentation of the final project plans. He will keep the Council updated.
- Curbside Brush Collection—the Public Works Department completed the curbside brush collection. The process took just under a month, which is much more in line with the traditional time frame. Crews are still working to pickup isolated brush put out that may have been missed during the primary collection period. The department is now focusing on the repair of potholes, drainage work and preparation of the roads scheduled for resurfacing.
- Board of Education Township Liaison Meeting—he and the Mayor, Deputy Mayor, and Police Chief met with the liaisons from the Board of Ed for their second quarter meeting. Information was shared on the road resurfacing plans, the new residents’ meeting and the appointment of the new Water & Sewer Administrator. The Board of Ed representatives advised on several items including updates on the implementation schedule for the projects approved in the referendum, the installation of cameras on school buses, and their communication plan.
- Heistein Park—speed tables have been installed to help control the speed of traffic travelling through the parking lot. The tables are removable and can be taken out in the winter months so they do not get damaged by plowing operations. The initial feedback from the Police Department is that the tables are having the desired effect of slowing down traffic in the park.
- Affordable Housing Public Information Meeting—a public information meeting is going to be scheduled to educate interested residents on the court ordered affordable housing process in which the township is engaged and to answer any questions residents may have. The meeting is tentatively planned for Thursday, June 27th at 7:00 p.m. The plan is to move the regular meeting of the Township Council to 5:30 p.m. to accommodate this special meeting. Township Attorney, Ed Buzak will be the lead presenter at the meeting. Notification will be given to the public and the press.
- The possibility of moving the June 13th meeting to 5:30 p.m. was previously discussed, but will not happen due to several Council members not being able to make it at the earlier time; the meeting will be at 7:00 p.m. as originally scheduled.
Councilwoman Potter asked if the removable speed tables can be used on township roads as well as in the parks. Manager Mountain explained that they can be used on roads, but it is much more difficult to implement because they create a noise when cars drive over them. In speaking with other communities who utilize them, they solve the speeding problem, but create a noise issue with residents. In the park there are not many residents nearby and the traffic is moving more slowly.
Councilwoman Potter also asked if the Combs Hollow Bridge was going to be widened. Manager Mountain replied that he did not recall if the width was being changed, but he believed they were trying to stay at the same angles.
Councilman Nisivoccia asked how often the brush is ground up. Manager Mountain explained that a tub grinder is rented for approximately 2-3 weeks; he believed it was only rented once per year in the spring, but would clarify.
E. APPROVAL OF MEETING MINUTES
1. Approving the Regular Council Meeting Minutes from March 7, 2019 and March 21, 2019
Councilman Nisivoccia made a motion to approve the minutes from the March 7, 2019 and March 21, 2019 regular Council meetings. Councilwoman Potter seconded the motion, and the following roll call vote was taken:

F. COMBINED ACTION RESOLUTIONS
Item #17—Quaker Church Road resurfacing—Councilman Tkacs asked if it was a county project. Manager Mountain explained that there are two projects for Quaker Church Road; one section is the county’s project, and the other, from Center Grove Rd to Reservoir Ave, is the township’s project using state aid. This resolution is awarding the township’s project; since it’s funded with state aid, it is not part of the 2019 road resurfacing list.
Item #20—Tax refund for Block 60, Lot 6—Councilman Tkacs asked if that property changed in some way. Manager Mountain replied that he did not know, but would find out and email the answer.
1. Authorizing Submission of a Supplemental Funding Application to the Morris County Board of Chosen Freeholders Stating that the Township Will Provide a 50% Match in the Amount of $1,000.00 to the Municipal Alliance Committee (MAC)

WHEREAS, the Randolph Township Municipal Alliance Committee (MAC) has submitted an application for Supplemental Funding to the Morris County Board of Chosen Freeholders; and
WHEREAS, MAC has requested the amount of $2,000.00; and
WHEREAS, in order to approve this funding, the Morris County Board of Chosen Freeholders requests that the Township provide a 50% match totaling $1,000.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph do hereby agree that the Township will provide a 50% match in the amount of $1,000 to the Municipal Alliance Committee.
BE IT FURTHER RESOLVED that the Mayor is hereby authorized to sign the letter of May 17, 2019 certifying said action.
2. Refund Portion of $320.00 Summer Day Camp Registration Fee Due to a Family Conflict to Erica Geraci—$295.00

WHEREAS, Erica Geraci registered her children for the Summer Day Camp program and paid the fee of $320.00.00; and
WHEREAS, her children will not be attending due to family conflict.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $ 295.00 be refunded to Erica Geraci, 19 Tamari Ct., Randolph, NJ 07869.
3. Refund Escrow Funds for 35 Openaki Road, Block 210, Lot 39 to James DiPiazza—$750.00

WHEREAS, the Planning and Zoning Department received escrow funds from James DiPiazza, Block 201 Lot 39, 35 Openaki Road and in the amount of $1,000.00; and
WHEREAS, the project has been completed and closed out and there are no outstanding payments due.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $750.00 be refunded to James DiPiazza, 35 Openaki Road, Randolph, NJ 07869.

4. Refunding 50 Percent of an Application Fee and the Remaining Escrow Funds due to the Applicant Withdrawing Its Application Prior to Public Hearing to Stepping Stone Healing, LLC—$2,620.00

WHEREAS, the Planning and Zoning Department received an $1,240.00 application fee and $2,000.00 escrow funds from Stepping Stone Healing, LLC (Evelyn Torres-Davis) for 325 South Morris Street, Block 141, Lot 4; and
WHEREAS, the applicant has withdrawn its application prior to public hearing and is requesting a refund of the application fee in the amount of $620.00 (50 percent of original application fee), and remaining escrow funds in the amount of $2,000.00.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator that the application fee $620.00 (50 percent of original application fee), and remaining escrow funds in the amount of $2,000.00 be refunded to Stepping Stone Healing, LLC (Evelyn Torres-Davis), 325 South Morris Street, Randolph, NJ 07869.
5. Authorizing the Township Manager to Endorse the Treatment Works Approval (TWA) Application to NJ DEP for the Construction of a Sewer Main Extension in the Township of Mine Hill Along Pine Street, Maple Ave., and Spruce Street and Connecting to the Jackson Brook Interceptor

WHEREAS, the Township of Mine Hill, (the “Applicant”) has planned the extension of a gravity sanitary sewer main along Pine Street, Maple Avenue and Spruce Street; and
WHEREAS, the permit is to convey the effluent from 42 single family residences, the American Legion Hall and one commercial establishment with a total design flow of 13,520 gallons per day through the Randolph Township system to the RVRSA treatment facility; and
WHEREAS, the application must be submitted to the New Jersey Department of Environmental Protection to obtain a TWA approval for gravity sewer main for this project; and
WHEREAS in order for the New Jersey Department of Environmental Protection to consider the application, the same must be endorsed by the Township among others; and
WHEREAS the Township desires to authorize the execution of the endorsement of the said application,
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Randolph, County of Morris, State of New Jersey;
- The Township Manager is herby authorized and directed to execute the appropriate endorsements for the Treatment Works Approval, together with other appropriate officers and employees of the Township of Randolph, and hereby authorized to take all actions necessary to effectuate the purpose.
- This resolution shall take effect immediately.
6. Authorizing Award and Rejection of MCCPC Contract #25—Janitorial Supplies with Various Companies

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #25 (Janitorial Supplies); and
WHEREAS, bids had been advertised and received on April 4, 2019, in accordance with Local Public Contracts Law; and
WHEREAS, ten (10) bids were received; and
WHEREAS, Contract #25 is awarded on a per line item basis; and
WHEREAS, the bid submitted by Haco Industries in Millburn, New Jersey, contained a Disclosure of Investment Activities in Iran form that was not properly completed which is a non-curable and non-waivable mandatory defect and their bid must therefore be rejected as non-responsive; and
WHEREAS, Interboro Packaging Corporation in Montgomery, New York, provided samples of the plastic bags on which they were bidding; and
WHEREAS, Interboro Packaging Corporation’s bid package contained a letter that stated the samples of plastic bags they provided with their bid differed from the bid specifications in size and color and that acceptance of the bid would constitute approval of the samples as being in conformance with the bid specifications which is an unacceptable exception and their bid must be rejected as non-responsive; and
WHEREAS, the bid specifications state that the MCCPC will allow case quantities offered by bidders to be no greater than ten percent (10%) of the quantity specified in the bid proposal, that bidders are to provide product size, case quantities, and an exact URL address or manufacturer print-out for equivalent items offered, and that bidders would be disqualified from an award of a particular item if the product information is not provided; and
WHEREAS, WB Mason Company in Secaucus, New Jersey, Spruce Industries in Rahway, New Jersey, Term Enterprises, Inc. (t/a Allen Paper & Supply Company) in Randolph, New Jersey, Cooper Friedman Electric Supply Company, Inc. (dba Cooper Electric Supply Company) in Monroe, New Jersey, All American Poly in Piscataway, New Jersey, Central Poly Bag Corporation in Linden, New Jersey, Office Concepts Group in Midland Park, New Jersey, and Mooney-General Paper Company in Hillside, New Jersey, are the lowest responsive and responsible bidders for the items and prices shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the bids for Contract #25 (Janitorial Supplies) submitted by Haco Industries and by Interboro Packaging Corporation for the reasons stated above.
BE IT FURTHER RESOLVED that the Township Council hereby authorizes the award of Contract #25 (Janitorial Supplies) to WB Mason Company, Spruce Industries, Term Enterprises, Inc. (Allen Paper & Supply Company), Cooper Friedman Electric Supply Company, Inc. (Cooper Electric Supply Company), All American Poly, Central Poly Bag Corporation, Office Concepts Group, and Mooney-General Paper Company as noted above for the term July 1, 2019 - June 30, 2020.
7. Authorizing Award and Rejection of MCCPC Contract #40—Personal Protection Items and Equipment for Emergency Personnel with Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #40 (Personal Protection Items & Equipment for Emergency Personnel); and
WHEREAS, bids had been advertised and received on April 4, 2019, in accordance with Local Public Contracts Law; and
WHEREAS, six (6) bids were received; and
WHEREAS, Contract #40 is awarded per line item to the responsive and responsible bidder offering the highest percentage discount; and
WHEREAS, the bid specifications state that due to compatibility issues, alternate manufacturers will not be considered; and
WHEREAS, the bid specifications state that bidders must bid on the complete line for specific manufacturers; and
WHEREAS, the bid specifications state that bidders are to submit manufacturer’s most current published price list and/or catalog in effect at the time of the bid opening; and
WHEREAS, there was a tie bid for Item #40 in Category B between Continental Fire & Safety, Inc. and Firefighter One, LLC and, as directed in the bid specifications, a name drawing was held on May 3, 2019, to determine the award for this item; and
WHEREAS, Continental Fire & Safety, Inc. in Hamilton, New Jersey, offered the apparent highest discount for Item #14 in Category A, however the price list did not cover the complete manufacturer line as required; and
WHEREAS, Turn Out Uniforms in Little Falls, New Jersey, bid an alternate manufacturer for Item #9 and Item #16 in Category A and therefore their bid for those items must be rejected as non-responsive; and
WHEREAS, All Hands Fire Equipment, LLC in Wall, New Jersey, bid alternate manufacturers for Item #22 and Item #25 in Category B and therefore their bid for those items must be rejected as non-responsive; and

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #13-A (Fire Equipment Services); and
WHEREAS, bids had been advertised and received on April 4, 2019, in accordance with Local Public Contracts Law; and
WHEREAS, five (5) bids were received; and
WHEREAS, Contract #13-A is awarded per category or sub-category with the exception that Categories 1 through 5 are awarded to the lowest responsive and responsible bidder based upon the lowest aggregate total of all five categories; and
WHEREAS, Categories 12, 13, 14C, 14D and 14E received no bids; and
WHEREAS, Witmer Public Safety Group in Coatesville, Pennsylvania, was the apparent low bidder for Categories 8 and 9 however they bid a different manufacturer than was specified and their bid for those categories must be rejected as non-responsive; and

9. Authorizing Award and Rejection of MCCPC Contract #35—Light Bulbs to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #35 (Light Bulbs); and
WHEREAS, bids had been advertised and received on April 4, 2019, in accordance with Local Public Contracts Law; and
WHEREAS, five (5) bids were received; and
WHEREAS, Contract #35 is awarded on a per line item basis; and
WHEREAS, the bid submitted by Cooper Friedman Electric Supply in Monroe, New Jersey, did not contain the mandatory Acknowledgement of Revisions & Notices form which is a non-curable and non-waivable mandatory defect and their bid must be rejected as nonresponsive; and
WHEREAS, the bid specifications state that the MCCPC will allow case quantities offered by bidders to be no greater than ten percent (10%) of the quantity specified in the bid proposal, bidders are to provide on the Bid Proposal Form an internet-searchable part number of the item they are bidding or a one-page manufacturer printout which completely describes the item being bid, the MCCPC will not be responsible for additional searches to verify compliance, and that bidders who do not provide the product information will be disqualified from an award of that particular item; and
WHEREAS, Chester Lighting in Chester, New Jersey, Jewel Electric, LLC in Jersey City, New Jersey, Warshauer Electric Supply Company in Tinton Falls, New Jersey, and Turtle & Hughes, Inc. in Linden, New Jersey, are the lowest responsive and responsible bidders for the items and prices shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the bid submitted by Cooper Friedman Electric Supply for Contract #35 (Light Bulbs) for the reason stated above.

10. Authorizing Award and Rejection of MCCPC Contract #42—Landscaping Materials and Supplies with Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #42 (Landscaping Materials & Supplies); and
WHEREAS, bids had been advertised and received on April 4, 2019, in accordance with Local Public Contracts Law; and
WHEREAS, eight (8) bids were received; and
WHEREAS, Contract #42 is awarded per line item; and
WHEREAS, Synatek Solutions in Souderton, Pennsylvania, did not sign the mandatory Statement of Ownership Disclosure Form which is a non-waivable and non-curable mandatory defect and their bid must be rejected as non-responsive; and
WHEREAS, there was a tie bid for Item #6 in Category C between Grass Roots Turf Products and Nutrien AG Solutions and, as outlined in the bid specifications, and name drawing was held on May 7, 2019, to determine the award of that item; and
WHEREAS, the bid specifications state bidders must indicate the brand or manufacturer they are bidding for all equivalent items; and
WHEREAS, the bid specifications state that product information must be provided by the bidders for all equivalent items; and
WHEREAS, the bids are reviewed by Randolph Parks Department personnel to determine compliance with the products being requested by the MCCPC and the products being offered by the bidders; and
WHEREAS, Grass Roots Turf Products in Randolph, New Jersey, Fisher & Son in Exton, Pennsylvania, Nutrien AG Solutions in North Brunswick, New Jersey, Seeton Turf Warehouse in Mount Laurel, New Jersey, Ben Shaffer Recreation in Lake Hopatcong, New Jersey, and Birds Bees & Trees Landscaping in Mine Hill, New Jersey, are the lowest responsive and responsible bidders for the items and prices shown on the attached Notification of Award for a one-year term.

12. Authorizing Award and Rejection of MCCPC Contract #20B—Sporting Goods with Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #20-B (Sporting Goods); and
WHEREAS, bids had been advertised and received on April 4, 2019, in accordance with Local Public Contracts Law; and
WHEREAS, nine (9) bids were received; and
WHEREAS, Contract #20-B is awarded on a per line item basis; and
WHEREAS, Riddell in North Ridgeville, Ohio, did not sign the Bid Proposal Page that was included in their bid package which is a non-curable and non-waivable mandatory defect and their bid must be rejected as non-responsive; and
WHEREAS, Flaghouse in Hasbrouck Heights, New Jersey, submitted a bid however it was discovered that their mandatory EEO evidence (Certificate of Employee Information Report) was not current, they indicated that they would not be obtaining a current certificate, and their bid must be rejected as non-responsive; and
WHEREAS, the bid specifications state that bidders are to indicate the brand name of the product they are bidding if no specific brand is identified by the MCCPC, that bidders must provide literature with their bid proposals when bidding an equivalent item, and that bidders would be disqualified from an award of that particular item if the product information is not provided; and
WHEREAS, R&R Trophy & Sporting Goods in North Arlington, New Jersey, Metuchen Center, Inc., in Sayreville, New Jersey, Triple Crown Sports, Inc. in Old Bridge, New Jersey, BSN Sports/Passon’s Sports/US Games in Jenkintown, Pennsylvania and Winning Teams by Nissel, LLC in Flemington, New Jersey, are the lowest responsive and responsible bidders for the items and prices shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the bids submitted by Riddell and by Flaghouse for Contract #20-B (Sporting Goods) for the reasons stated above.
BE IT FURTHER RESOLVED that the Township Council hereby authorizes the award of Contract #20-B (Sporting Goods) to R&R Trophy & Sporting Goods, Metuchen Center, Inc., Triple Crown Sports, BSN Sports/Passon’s/US Games and Winning Teams as noted above for the term July 1, 2019 - June 30, 2020.
13. Authorizing the Award of a Professional Services Agreement to Douglas R. Cabana, Esq. for Alternate Municipal Prosecutor Services from May 16, 2019 to December 31, 2019—Not to Exceed $5,000.00

WHEREAS, the Township of Randolph (“Township”) requires alternate municipal prosecutor services for the period of May 16, 2019 through December 31, 2019; and
WHEREAS, the Township has agreed to retain Douglas R. Cabana, Esq. located at 104 Elcock Ave, Boonton, NJ 07005 to provide the necessary alternate municipal prosecutor services for a total amount not to exceed $5,000; and
WHEREAS, the fees ($500 per session) are as noted in the attached proposal and will remain as stated for the term of this contract; and
WHEREAS, the term of this contract is May 16, 2019 through December 31, 2019; and
WHEREAS, the contract with Douglas R. Cabana, Esq. is for a total amount not to exceed $5,000 and therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) do not apply; and
WHEREAS, Douglas R. Cabana, Esq. has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification should the dollar amount of the contract be amended during the 2019 calendar year and exceed $17,500 and the requirements of the Anti Pay-to-Play Legislation would then apply; and
WHEREAS, there are funds available for the retention of such professional services from account #01-201-20-155-306; and
WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
NOW, THEREFORE BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, as follows:
- The Township hereby hires, employs and retains Douglas R. Cabana, Esq. having an office at 104 Elcock Ave, Boonton, NJ 07005 to provide alternate municipal prosecutor services for the period of May 16, 2019 through December 31, 2019.
- Douglas R. Cabana, Esq. shall be compensated for a total contract amount not to exceed $5,000 ($500 per session).
- The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
- The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq.
- The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township, are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
- It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.

WHEREAS, on May 3, 2018 via R 108-18 the Township of Randolph awarded a one-year contract to Jersey Mulch Products LLC of Towaco, NJ from July 1, 2018 through June 30, 2019 with the option to extend for one (1) two-year period or two (2) one-year periods ending June 30, 2021; and
WHEREAS, the prices awarded to Jersey Mulch Products LLC of Towaco, NJ are
Grinding Services, Full Day Rate: $4,190,
Grinding Services, 1/2 Day Rate: $2,990; and
WHEREAS, the Public Works Director and the Purchasing Agent recommend the extension of the contract to Jersey Mulch Products LLC of Towaco, NJ for one year from July 1, 2019 through June 30, 2020 at the same rates listed above for the not to exceed amount of $30,000 with the option to extend for an additional one-year period ending June 30, 2021; and

WHEREAS, the Township on January 17, 2019 via R 30-19 and on March 21, 2019 via R 73-19 authorized contracts with certain approved MCCPC Contract Vendors; and
WHEREAS, it’s been determined that contracts in excess of $17,500 may be entered into with an additional MCCPC Contract Vendor; and
WHEREAS, the additional MCCPC Contract Vendor has been added to the attached list; and
WHEREAS, the Township anticipates entering into contracts in excess of $17,500, the cost of which either individually or in the aggregate may exceed the prevailing bid threshold, with the attached referenced MCCPC Contract Vendors through this resolution and properly executed purchase orders/contracts, which shall be subject to all the conditions applicable to the current MCCPC contracts, but only to the extent that such purchases do not exceed duly authorized budget appropriations for each category of purchases/expenditures.
NOW, THEREFORE, BE IT RESOLVED that the Township Council, Township of Randolph, County of Morris, State of New Jersey authorizes the Qualified Purchasing Agent to purchase certain goods and services, the cost of which either individually or in the aggregate may exceed the prevailing bid threshold, from those approved MCCPC Contract Vendors on the attached list, pursuant to all conditions of the individual co-op contracts; and
BE IT FURTHER RESOLVED that the Township Council of the Township of Randolph pursuant to N.J.A.C. 5:30-5.5(b) regarding the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Financial Officer via an authorized Purchase Order; and

16. Authorizing Contracts with an Additional Approved State Contract Vendor for Contracting Units Pursuant to N.J.S.A. 40A:11-12a

WHEREAS, the Township on January 17, 2019 via R 29-19 and on May 2, 2019 via R 117-19 authorized contracts with certain approved State Contract Vendors; and
WHEREAS, it’s been determined that contracts in excess of $17,500 may be entered into with an additional State Contract Vendor; and
WHEREAS, the additional State Contract Vendor has been added to the attached list; and
WHEREAS, the Township anticipates entering into contracts in excess of $17,500, the cost of which either individually or in the aggregate may exceed the prevailing bid threshold, with the attached referenced State Contract Vendors through this resolution and properly executed purchase orders/contracts, which shall be subject to all the conditions applicable to the current State contracts, but only to the extent that such purchases do not exceed duly authorized budget appropriations for each category of purchases/expenditures.

WHEREAS, Lereta LLC made payment October 10, 2018, January 30, 2019 and May 3, 2019 to block 42 lot 87 for the 4th quarter 2018 and the1st & 2nd quarters of 2019 in the total amount of $6,566.09; and
WHEREAS, I have received documentation stating that effective September 24, 2018 said property was foreclosed by BV001 REO Blocker, LLC. This foreclosure now makes them the legal owner of the property, therefore, Lereta LLC is entitled to a full refund.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Tax Collector be authorized to refund the full payment of $6,566.09 to Lereta LLC, 1123 Park View Dr, Covina, CA 91724 which represents a refund of the 4th quarter 2018 and the 1st and 2nd quarters of 2019.
20. Authorizing Tax Collector to Refund Payments for Block 60, Lot 6 for the 1st and 2nd Quarters of 2019 as the Property was Deemed Tax Exempt by the Randolph Tax Assessor to Lereta, LLC for Nationstar Mortgage, LLC—$5,115.04

WHEREAS, effective January y 1, 2019 said property has been deemed exempt from property taxes by Randolph Township’s Tax Assessor, therefore, Lereta LLC for Nationstar LLC is requesting and is entitled to a full refund.

H. ORDINANCES: SECOND READING/PUBLIC HEARING
1. Ordinance No. 16-19 Amending and Supplementing Chapter 26, Housing, of the Revised Ordinances of the Township of Randolph to Prohibit the Short Term Rental of Residential Property
BE IT RESOLVED, that an Ordinance entitled “AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 26, HOUSING, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH TO PROHIBIT THE SHORT TERM RENTAL OF RESIDENTIAL PROPERTY” be read by title on second reading and a hearing held thereon.
Manager Mountain explained that this ordinance establishes a restriction on the rental of single family residential properties for not less than 30 days. The ordinance came about as a result of a couple of different issues in the township in separate neighborhoods where short term rentals have negatively impacted the neighborhoods. These types of rentals are becoming more prominent, and would affect more neighborhoods; therefore, it was recommended to establish a restriction.

J. COUNCIL COMMENTS
Councilwoman Potter attended the Traffic Advisory Committee (TAC) meeting; the Distracted Driver grant was completed. Over 500 tickets were issued in April.
Councilwoman Potter attended the Landmarks and Environmental Committee meeting; an 8th grader attended and presented his Capstone project related to Sustainable Communities. He explained that there is a grant for electric vehicle charging stations; the committee will summarize the student’s discussion and present it to the Council in the future. The student invited the committee to his June 11th Capstone expo.
Councilwoman Potter reported that the committee formed for the time capsule includes a representative from the Board of Education, the Landmarks and Environmental Committee, and the Parks Committee. They will set a meeting to begin discussing the plans for the time capsule. Once they create a plan, they will present it to the Township Council.
Councilman Nisivoccia commended the Township Manager and staff for the very successful New Residents’ reception. He felt it was a good program, and it received good feedback.
Councilman Nisivoccia reported that he, Mayor Loveys, and Councilwoman Veech attended the Chamber of Commerce meeting earlier in the day.
Councilman Nisivoccia attended the Community Garden participation meeting; the room was full of enthusiastic people.
Councilman Nisivoccia also attended the Library Board of Trustees meeting; they are excited about the reopening of the renovated Acme and the energy they are putting into the store as well as the community.
Councilman Nisivoccia attended the two bench dedications.
Councilman Nisivoccia reported that he was happy to see George Garcia III move up to an Alternate member on the EDC. He explained that George was very active in the committee, even as a student member, and was instrumental with providing information and video for the website.
Councilman Tkacs attended one of the bench dedications, as well as the Taste of Randolph; both were good.
Councilman Tkacs attended the Planning Board meeting; the company that will be installing the new cell tower behind the Municipal Building gave a presentation. They needed a variance for height since they wanted to make it five feet taller than what is allowed by ordinance. The Councilman recused himself since the cell tower specifications were done by the township. The company building the tower stated that they were making it according to the specifications set by the township; it was approved by the Planning Board.
Councilwoman Veech attended the bench dedications, as well as the other meetings and events that were previously noted. She also attended the Randolph Community Garden committee meeting earlier in the evening. They discussed making bluebird houses since they eat insects in the garden; since scouts have asked to do work in the garden, the committee will ask them. They also discussed having bird watching events. There were 70 people at the Community Garden educational session. She reported that there was going to be a park construction meeting on the upcoming Tuesday. There are 88 people registered for garden beds; there will be a mandatory meeting for those registered.
Councilwoman Veech attended the Parks Committee meeting. Travis Ruffo said he would be happy to be part of the time capsule committee. They received correspondence from an Associate Professor in Biology at Drew University, Alex Bajcz. He studied rubus, a plant with berries, and asked for permission to study these plants on the township’s trail system. He will be monitoring, tracking, and sampling the plants. The committee recommended that he report his findings when he’s done. The committee discussed collecting voluntary donations to have a bench dedicated to Ethan Blynn; he served on the EDC and the Parks Committee. Councilwoman Veech reported that 52 deer were taken during the deer hunt this year as opposed to 57 taken last year. The 15-20 Wayfinding volunteers helped put the signage on the trails for the blazing; it is about 95% complete. She would like to have Council members take a trip to see all the work that was done. National Trail Day is Saturday, June 2nd; the committee is doing some advertising so people are aware of this day.
Deputy Mayor Carey felt that the grand re-opening of Acme was very nice.
Deputy Mayor Carey provided photos of the bench dedications to the local papers so they would hopefully write an article. They were not at the dedications. Mr. Rosenfarb attended the dedication at Freedom Park and the Buckner family attended the dedication at Heistein Park.
Deputy Mayor Carey, Councilwoman Veech, and Councilman Forstenhausler attended the Community Iftar at the Islamic Center of Morris County. It was very nice, with an hour of speeches and prayers, and then the meal to break the fast.
Deputy Mayor Carey reported that Barbara Lukavich was honored by Morris County Clerk Ann Grossi, and presented the Cissy Laureys Award. Several people were nominated, but Barbara won the overall award. The award is presented to a person who best exemplifies the qualities of compassion, dedication and service to older Americans and physically challenged citizens.
Deputy Mayor Carey attended the Recreation Committee meeting. Three different processes are being reexamined and considered for ways to improve and streamline them: they way the officials (referees, umpires) are paid; team snap, the way the teams communicate; background checks for the coaches.
Councilman Forstenhausler reported that he sent photos with brief descriptions to both TAPinto and the Randolph Reporter.
Councilman Forstenhausler reported that the Municipal Alliance Committee (MAC) sponsored the Healthy Mind, Healthy Body Expo at the Community Center; it was very well attended. There were a lot of vendors, as well as members of the Police Department.
