A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Deputy Mayor Carey. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 4, 2015 by e-mailing them the annual resolution adopted by the Council on December 3, 2015. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and the Daily Record on December 10, 2015.

3. Pledge of Allegiance

Deputy Mayor Carey led the Pledge of Allegiance.

B. OPEN TO THE PUBLIC

Judith Stewart of 114 Everdale Road encouraged Council members to view the art displayed in the Municipal Building by Artworks Studios.

Seeing no one further from the public, the public portion was closed.

C. MANAGER’S REPORT

Manager Mountain reported the following:

  • West Hanover Waterline Realignment—the project is going on simultaneously with the County work. The project is expected to be completed in the next 6 weeks; once completed, the County will complete the new section of roadway that will connect the section with Sussex Turnpike and West Hanover Avenue. Once this project is completed, the Water Department will work on the water line extension at Harvey Terrace and Carellen; this will likely begin in July.
  • Millbrook Avenue Resurfacing—the pre-construction meeting with the contractor took place. The contractor is looking to begin the work in the next couple of weeks, and finish in mid-June.
  • Road Overlay Program—he met with Paul Ferriero and Tom Spring to review the status of the program. The DPW has been working on the basin repairs that need to be done prior to the paving. The first stage of the project is scheduled to begin in early June; there will likely be 3 stages of paving. The first stage will be those needing only resurfacing, the more complicated projects will be staged in mid-summer and early fall.
  • YMCA Facility Improvements—he met with Bill Lamia to discuss their plans. They discussed the Parks and Recreation Master Plan; he referenced Mrs. Stewart’s comment about looking for an area for indoor activities. Mr. Lamia is very interested in partnering with the township. The Manager also told Mr. Lamia that one goal/recommendation of the Parks and Recreation Master Plan was to look to complement with existing private, non-profit recreation offerings, not compete with them. Russ Newman will follow up with Bill Lamia.
  • Board of Education—he attended the BOE liaison meeting; the meeting covered a lot of ground, but he will add more detail during Council Comments, if needed.
  • Retaining Wall Project—Paul Ferriero has completed the design work for the project scheduled this year. Two of the four resident meetings have taken place; feedback from the two property owners was positive. The way Paul has designed the plans, it is possible that there may be little wall work, and more grading of the properties. If so, the cost will be much less than originally projected; grading and tree planting will also cut down on future maintenance.

Councilman Forstenhausler noted that the cracks in the roadway near the horse farm on Everdale Road are much bigger. Manager Mountain explained that Paul Ferriero met with that homeowner, and he is pleased that the work is beginning.

Councilman Loveys noted that the wall at Heisteins Park is in bad shape. Manager Mountain spoke to Paul Ferriero to design the repair of that wall. The money was set aside from the Recreation Trust Fund.

D. APPROVAL OF MEETING MINUTES

1. Approval of Regular Council Meeting Minutes of April 7, 2016

Councilman Guadagno made a motion to approve the Regular Council Meeting minutes from April 7, 2016. Councilman Loveys seconded the motion, and the following roll call vote was taken:

1. Refund Outside Tax Sale for Block 119, Lot 109.40—40 Spruce Tree Lane to Tower Fund Services—$3,406.64

WHEREAS, Outside Tax Sale Certificate #2015 held by Tower Fund Services, assessed to Joseph Grassi, Block 119, Lot 109.40, 40 Spruce Tree Lane; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $2,206.64, and premium in the amount of $1,200.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $3,406.64 to Tower Fund Services holder of Tax Sale Certificate #2015.

2. Refund Outside Tax Sale for Block 177, Lot 14—13 Southview Road to Ridgeback Ventures, LLC—$13,059.29

WHEREAS, Outside Tax Sale Certificate #2049 held by Ridgeback Ventures LLC Cust. JB, assessed to Susan Rosenberg, Block 177, Lot 14, 13 Southview Road; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $8,559.29 and premium in the amount of $4,500.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $13,059.29 to Ridgeback Ventures LLC Cust JB, holder of Tax Sale Certificate #2049.

3. Refund Outside Tax Sale for Block 215, Lot 66—30 Ash Lane to US Bank—$5,562.84

WHEREAS, Outside Tax Sale Certificate #2026 held US Bank for BV001 Trust, assessed to Ihor/Lyudmyla Mahdzyer, Block 215, Lot 66, 30 Ash Lane; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $3,262.84 and premium in the amount of $2,300.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $5,562.84 to US Bank for BV001 Trust holder of Tax Sale Certificate #2026.

4. Refund Escrow Funds for Block 34, Lot 5—386 Dover Chester Road to KOS Enterprises, LLC—$219.45

WHEREAS, the Planning and Zoning Department received escrow funds from KOS Enterprises, LLC, 386 Dover-Chester Road, Block 34 Lot 5, and in the amount of $8,500.00; and

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $219.45 plus interest be refunded to KOS Enterprises, LLC, 29 Avalon Drive, Montville, NJ 07045.

5. Refund Summer Day Camp Program Registration to Armindo Rodrigues of 6 Blue Fern Lane—$425.00

WHEREAS, Armindo Rodrigues registered his child for Summer Day Camp program and paid the fee of $ 425.00; and

WHEREAS, his child will not be attending Summer Day Camp, Week # 6 (Aug. 1-5) and Day Camp Trip Week (Aug. 8-12) due to conflict.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $ 400.00 be refunded to Armindo Rodrigues, 6 Blue Fern Lane, Randolph, NJ 07869.

6. Release Road Opening Cash Bond for Repaving a Driveway for Block 38.01, Lot 18—33 South Road to John Gehbayer—$500.00

WHEREAS, the Engineering Department has received a request from John Gehbayer for the release of a $500.00 cash road opening bond posted for the purpose of repaving an existing driveway at 33 South Road, Block 38.01/L 18, Mendham, NJ 07945; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on April 15, 2016; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the existing driveway at 33 South Road, Block 38.01/L 18, within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to John Gehbayer.

7. Release Road Opening Cash Bond for a Driveway Repair on Block 220, Lot 29—35 Ash Lane to Juan Gallego—$500.00

WHEREAS, the Engineering Department has received a request from Juan J. Gallego for the release of a $500.00 cash road opening bond posted for the purpose of a driveway repair at 35 Ash Lane, Randolph, NJ 07869, Block 220/Lot 29, Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on March 30, 2016; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repair to the driveway at 35 Ash Lane, Block 220/Lot 29, within the Township Right of way, and;

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Juan J. Gallego.

8. Authorizing the Award of a Professional Services Agreement to Dewberry Engineers for Engineering Services to Break Out the Brookside Road Sewer from the Mount Freedom Sewer Project, Submit for NJDEP Permit and Prepare a Bid Package—Not to Exceed $8,400.00

WHEREAS, the Township of Randolph (“Township”) requires professional engineering services to break out the Brookside Road Sewer from the Mount Freedom Sewer project, submit for an NJDEP permit and prepare a bid package; and

WHEREAS, the Township has agreed to retain Dewberry Engineers Inc. located at 600 Parsippany Rd, Ste 301, Parsippany, NJ 07054 to provide the necessary professional engineering services to break out the Brookside Road Sewer from the Mount Freedom Sewer project, submit for an NJDEP permit and prepare a bid package for a total amount not to exceed $8,400; and

WHEREAS, the fees are as noted in the attached proposal; and

WHEREAS, the anticipated term of this contract is until the project is fully completed; and

WHEREAS, the contract with Dewberry Engineers Inc. is for a total amount not to exceed $8,400 and therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) do not apply; and

WHEREAS, Dewberry Engineers Inc. has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification since the aggregate of contracts awarded to Dewberry Engineers this year exceeds $17,500; and

WHEREAS, Dewberry Engineers Inc. has also submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, there are funds available for the retention of such professional services; and

WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

  1. The Township hereby hires, employs and retains Dewberry Engineers Inc. having an office at 600 Parsippany Rd, Ste 301, Parsippany, NJ 07054 to provide professional engineering services to break out the Brookside Road Sewer from the Mount Freedom Sewer project, submit for an NJDEP permit and prepare a bid package until the project is fully completed.
  2. Dewberry Engineers Inc. shall be compensated for a total contract amount not to exceed $8,400.
  3. The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
  4. The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.
  5. The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township, are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
  6. It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.
  7. This Resolution shall take effect immediately.

Dated: May 19, 2016

As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Darren Maloney, Director of Finance for the Township of Randolph, have ascertained that funds will be available in the 2016 Water and Sewer Budget, O & E, Engineering Consulting Services, to award a contract to Dewberry Engineers, per its proposal submitted to the Township.

9. Authorizing the Public Display of Fireworks for the 2016 Freedom Festival

WHEREAS, the Township of Randolph annually holds its Freedom Festival at the County College of Morris; and

WHEREAS, the Freedom Festival includes the public display of fireworks; and

WHEREAS, this year’s Freedom Festival fireworks will be held on Saturday, July 2, 2016 with a July 3, 2016 rain date; and

WHEREAS, International Fire Code 2006, New Jersey Edition, Section 3301.2.4.3 requires the governing body to grant permission for the public display of fireworks; and

WHEREAS, upon application to the Fire Official and after receipt of all necessary documentation a permit shall be issued by the Fire Official, pursuant to N.J.A.C. 5:70-2.7 for the fireworks display; and

WHEREAS, the Purchasing Agent solicited quotes from six (6) fireworks vendors; and

WHEREAS, one quote was received; and

WHEREAS, the contract was awarded to Pyro Engineering, Inc. dba Bay Fireworks; and

WHEREAS, Pyro Engineering, Inc. dba Bay Fireworks provided proof of proper insurance coverage which has been approved by the MEL Underwriting Manager.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that permission is hereby granted for the public display of fireworks at the 2016 Freedom Festival by Pyro Engineering, Inc. dba Bay Fireworks on July 2, 2016 (rain date July 3, 2016) after issuance of a permit by the fire official as stated above.

10. Refunding a Tree Bond for Block 89, Lot 8—177 Morris Tpke. To Brian Petroski—$1,000

WHEREAS, the Planning and Zoning Department received a tree bond posted by Brian Petroski, 177 Morris Turnpike, for Block 89, Lot 8 in the amount of $1,000; and

WHEREAS, all requirements have been met and completed.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator that the tree bond in the amount of $1,000.00 be refunded to Brian Petroski, 177 Morris Turnpike, Randolph, NJ 07869.

11. Authorizing Award and Rejection of MCCPC Contract #10 (Lumber, Insulation, Hardware, Paint and Paint Supplies) to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #10 (Lumber, Insulation, Hardware, Paint & Paint Supplies); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, seven (7) bids were received; and

WHEREAS, Contractors Cooperative in Watchung, New Jersey, was the apparent low bidder for Category J (Paint), however their bid was non-responsive since several of the items bid were not available in all colors as is required in the bid specifications and therefore their bid must be rejected; and

WHEREAS, the following bidders were the lowest responsive and responsible bidders for Contract #10 (Lumber, Insulation, Hardware, Paint & Paint Supplies) for the items and prices shown on the attached Notification of Award for a one-year term:

BE IT FURTHER RESOLVED that the Township Council authorizes the award of Contract #10 (Lumber, Insulation, Hardware, Paint & Paint Supplies) as noted above for the term July 1, 2016 - June 30, 2017.

12. Authorizing Award and Rejection of MCCPC Contract #13-A (Fire Equipment Services) to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #13-A (Fire Equipment Services); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, four (4) bids were received; and

WHEREAS, City Fire Equipment Company in East Hanover, New Jersey, was the apparent low bidder for Categories 3, 6A, 6B, 6D, 6F and 6G, however their bid was non-responsive because they did not submit the required certifications with their bid proposal and they did not bid on all items within Categories 6A and 6B as required in the bid specifications and therefore their bid must be rejected; and

WHEREAS, Allied Fire & Safety Equipment in Neptune, New Jersey, Firefighter One in Sparta, New Jersey, and Fail Safe Testing in Manalapan, New Jersey, were the lowest responsive and responsible bidders for the items and prices shown on the attached Notification of Award for a one-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rejection of the bid submitted by City Fire Equipment Company as stated above.

BE IT FURTHER RESOLVED that the Township Council authorizes the award of Contract #13-A (Fire Equipment Services) as noted above for the term July 1, 2016 - June 30, 2017.

13. Authorizing Award of MCCPC Contract #20-B (Sporting Goods) to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #20-B (Sporting Goods); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, eight (8) bids were received; and

WHEREAS, the lowest responsive and responsible bidders for each line item contained in Contract #20-B (Sporting Goods) are reflected in the attached Notification of Award for a one-year term with the following exceptions:

Category I, Items #13A (a & b): The bid submitted by Riddell in Elyria, Ohio, stated that there was an extra charge for a helmet pump which is not in compliance with the bid specifications; there were no other bidders for these items.

Category I, Items #13B (a & b): The bid submitted by Riddell in Elyria, Ohio, stated that there was an extra charge for a helmet pump which is not in compliance with the bid specifications; there were no other bidders for these items.

Category I, Item 23: The bid submitted by Riddell in Elyria, Ohio, stated that there was an extra charge for painting the helmets which is not in compliance with the bid specifications; the item was awarded to the second low bidder (R&R Trophy & Sporting Goods).

Category III, Item 16: The bid submitted by Riddell in Elyria, Ohio, stated that there was an extra charge for painting the helmets which is not in compliance with the bid specifications; there were no other bidders for this item.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #20-B (Sporting Goods) as noted above for the term July 1, 2016 - June 30, 2017.

14. Authorizing Award and Rejection of MCCPC Contract #25 (Janitorial Services) to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #25 (Janitorial Services); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, fourteen (14) bids were received; and

WHEREAS, the bid submitted by Glopak Corporation in South Plainfield, New Jersey, was non-responsive in that the mandatory Disclosure of Investment Activities in Iran form was not signed, which is a non-curable defect, and the bid must be rejected; and

WHEREAS, the bid submitted by M&M Frankel in Brooklyn, New York, and by G&B Janitorial Supply in Bound Brook, New Jersey, were non-responsive in that the bidders did not complete or submit the mandatory Acknowledgement of Revisions and Notices form, which is a non-curable defect, and their bids must be rejected; and

WHEREAS, the lowest responsive and responsible bidders for each line item contained in Contract #25 (Janitorial Supplies) are reflected in the attached Notification of Award for a one-year term with the following exceptions:

Category B (Utility Products):
Item #32—the low bid by W.B. Mason stated that pricing was not valid for the entire term of the contract which is not in compliance with the bid specifications, therefore the item was awarded to the second low bidder (Central Poly)

Category C (Paper and Related Items):
Item #22—the low bid by Spruce Industries offered a product that did not meet the bid specifications, therefore the item was awarded to the second low bidder (Circle Janitorial)

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rejection of the bids submitted by Glopak Corporation, M&M Frankel and G&B Janitorial Supply as stated above.

BE IT FURTHER RESOLVED that the Township Council authorizes the award of Contract #25 (Janitorial Services) as noted above for the term July 1, 2016 - June 30, 2017.

15. Authorizing Award of MCCPC Contract #29 (Pest Control Services—Buildings) to E&G Exterminators—$23.00 per Hour for a Two-Year Term

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #29 (Pest Control Services - Buildings); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, two (2) bids were received; and

WHEREAS, E & G Exterminators in South Amboy, New Jersey, was the lowest responsive and responsible bidder at a price of $23.00 per hour for a two-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #29 (Pest Control Services - Buildings) to E & G Exterminators for the term July 1, 2016 - June 30, 2018.

16. Authorizing Award to Jen Electric and Rejection of Bid from Allan Briteway on MCCPC Contract #37 (Traffic Signal Maintenance and Repairs)

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #37 (Traffic Signal Maintenance & Repairs); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, two (2) bids were received; and

WHEREAS, the bid submitted by Allan Briteway in Whippany, New Jersey, was non-responsive because they did not submit the required personnel and contractor qualifications that were required at the time of the bid submission and therefore their bid must be rejected; and

WHEREAS, Jen Electric in Springfield, New Jersey, was the lowest responsive and responsible bidder for the items and prices shown on the attached Notification of Award for a two-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rejection of the bid submitted by Allan Briteway as stated above.

BE IT FURTHER RESOLVED that the Township Council authorizes the award of Contract #37 (Traffic Signal Maintenance & Repairs) to Jen Electric for the term July 1, 2016 - June 30, 2018.

17. Authorizing Award and Rejection to MCCPC Contract #40 (Personal Protection Items & Equipment for Emergency Personnel) to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #40 (Personal Protection Items & Equipment for Emergency Personnel); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, six (6) bids were received; and

WHEREAS, the bids submitted by Turn Out Uniforms in Little Falls, New Jersey, and by All Hands Fire Equipment in Wall, New Jersey, were non-responsive because they did not submit product information on searchable CDs as is required in the bid specifications and therefore their bids must be rejected; and

WHEREAS, the bid submitted by Montague Tool & Supply Company in Branchville, New Jersey, was non-responsive because they did not properly complete the mandatory Ownership Disclosure Form, which is a non-curable defect, and therefore their bid must be rejected; and

WHEREAS, the bid specifications state that items will be awarded to the bidder submitting the most current price list; and

WHEREAS, the following bidders were responsive and responsible and submitted the highest discounts for the items shown on the attached Notification of Award for a one-year term with the following exceptions:

Category A, Item 10: The bidder submitting the second highest discount (Skylands) is providing the most current price list

Category A, Item 28: Two bidders (Skylands and Firefighter One) both offer a 5% discount however Skylands is providing the most current price list

Category B, Item 4: Two bidders (Skylands and Continental Fire & Safety) both offer a 24% discount however Continental is providing the most current price list

Category B, Item 15: Two bidders (Continental Fire & Safety and Firefighter One) both offer a 22.5% discount however both price lists expire before the end of the contract, therefore no award for this item will be made

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rejection of the bids submitted by Turn Out Uniforms, All Hands Fire Equipment and Montague Tool & Supply Company as stated above.

BE IT FURTHER RESOLVED that the Township Council authorizes the award of Contract #40 (Personal Protection Items & Equipment for Emergency Personnel) as noted above for the term July 1, 2016 - June 30, 2017.

18. Authorizing Award and Rejection of MCCPC Contract #42 (Landscaping Materials and Supplies) to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #42 (Landscaping Materials & Supplies); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, seven (7) bids were received; and

WHEREAS, the bid submitted by Reed & Perrine in Tennent, New Jersey, was non-responsive because they did not sign the Bid Proposal Page which is a non-curable defect and therefore their bid must be rejected; and

WHEREAS, the bid submitted by Levitt’s in Pine Brook, New Jersey, was non-responsive because they did not submit the signature page for the mandatory Disclosure of Investment Activities in Iran form which is a non-curable defect and therefore their bid must be rejected; and

WHEREAS, the lowest responsive and responsible bidders for each line item contained in Contract #42 (Landscaping Materials & Supplies) are reflected in the attached Notification of Award for a one-year term with the following exceptions:

Category B, Item #3: None of the bidders proposed a product that was compliant with the bid specifications; there is no award for this item

Category B, Item #4: The apparent low bidder (Grass Roots) and second low bidder (SiteOne) proposed a product that was not compliant with the bid specifications; the award will be made to the third low bidder (Fertl-Soil)

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rejection of the bids submitted by Reed & Perrine and by Levitt’s as stated above.

BE IT FURTHER RESOLVED that the Township Council authorizes the award of Contract #42 (Landscaping Materials & Supplies) as noted above for the term July 1, 2016 - June 30, 2018.

19. Authorizing Award of MCCPC Contract #47 (Water Meters/Data Recorders & Radio Frequency Meter Interface Units) to HD Supply Waterworks and Rio Supply

20. Authorizing Award of MCCPC Contract #48 (Equipment Parts for Turf Care) to Power Place

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #48 (Equipment Parts for Turf Care); and

WHEREAS, bids had been advertised and received on April 6, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, one (1) bid was received; and

WHEREAS, there were no bids for Category A (The Toro Company—Commercial Parts) or for Category B (The Case Corporation—Agriculture Parts); and

WHEREAS, Power Place, Inc. in Rockaway, New Jersey, was a responsive and responsible bidder offering the highest discount of 12.0% for Category C (John Deere—General Parts Price List) for a one-year term.

21. Authorizing Award of MCCPC Contract #49 (Disposal/Recycling of Municipal Road Clean-Up Materials—Categories B & C Only) to Custom Environmental Management Company

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for a portion of Contract #49 (Disposal/Recycling of Municipal Road Clean-Up Materials—Categories B and C Only); and

WHEREAS, on February 25, 2016, the Township Council rescinded the previous award of Categories B and C made on November 6, 2014, to Grinnell in Sparta, New Jersey, because Grinnell notified the MCCPC that they were no longer going to be involved in this type of business; and

WHEREAS, bids had been advertised and received on April 20, 2016, in accordance with Local Public Contracts Law; and

WHEREAS, one (1) bid was received; and

WHEREAS, Custom Environmental Management Company (CEMCO) in Hainesport, New Jersey, was the lowest responsive and responsible bidder for the items and prices reflected in the attached Notification of Award for the remainder of the contract (December 31, 2016.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #49 (Disposal/Recycling of Municipal Road Clean-Up Materials—Categories B and C Only) as noted above for the term to expire on December 31, 2016.

22. Authorizing Award to Universal Uniform and Rejection of Bid from Turn Out Uniforms on MCCPC Contract #50 (Fire Department Uniforms-Purchase)

23. Authorizing Award of MCCPC Contract #51 (Deer Carcass Removal and Disposal) to Space Farms and Deer Carcass Removal Service for Various Counties

WHEREAS, two (2) bids were received; and

24. Authorizing the Director of Finance to Transfer Various Tree Bonds to the Tree Bank Fund

WHEREAS, in accordance with the Tree Removal and Protection Ordinance, bond monies will be forfeited to the Tree Bank Fund if full replacements are not completed within two years of the granting of the tree removal/protection permit; and

WHEREAS, it is recommended by the Planning/Zoning Administrator that the attached list of Tree Bonds be forfeited to the Tree Bank Fund.

NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, that the Director of Finance be instructed to transfer the attached list of Tree Bonds to the Tree Bank Fund.

25. Authorizing Support and Certifying 50% Match ($1,000.00) of the Request for Funding from the Municipal Alliance Committee to the Board of Chosen Freeholders for Supplemental Funding

WHEREAS, the Randolph Township Municipal Alliance Committee (MAC) has submitted an application for Supplemental Funding to the Morris County Board of Chosen Freeholders; and

WHEREAS, MAC has requested the amount of $2,000.00; and

WHEREAS, in order to approve this funding, the Morris County Board of Chosen Freeholders requests that the Township provide a 50% match totaling $1,000.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph do hereby agree that the Township will provide a 50% match in the amount of $1,000 to the Municipal Alliance Committee.

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to sign the letter of May 19, 2016 certifying said action.

26. 2015 LOSAP Benefit to be Paid in 2016—Volunteer Fire Department and Randolph Rescue Squad

WHEREAS, the Randolph Township Fire Department as well as the Randolph Rescue Squad have submitted the attached list of volunteers who qualify for the 2015 LOSAP Benefit, which is paid in 2016; and

WHEREAS, this list have been reviewed by the Director of Finance and found to be accurate.

NOW THEREFORE BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey as follows:

  1. Both the Fire Department and the Randolph Rescue Squad shall post this list in their administrative offices for a period of 30 days to allow sufficient time for membership review.
  2. This list shall also be posted at the office of the Township Clerk while the Fire Department shall post the list at each township fire station.
  3. This Resolution shall take effect immediately.

Councilman Forstenhausler stated that the Randolph Township Council team for the Relay for Life could use more donations; donations are lower than last year.

G. ORDINANCES: INTRODUCTION

1. Ordinance #16-16: An Ordinance Revising Ordinance No. 20-13 Amending Appendix A, Fee Schedule, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey

Manager Mountain explained that the Ordinance is an amendment to the “Special Duty” fee schedule for the Police Officers used for outside details.

BE IT RESOLVED, that an Ordinance entitled “AN ORDINANCE REVISING ORDINANCE NO. 20-13 AMENDING APPENDIX A, FEE SCHEDULE, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY” be introduced, read by title by the Township Clerk and passed on first reading.

BE IT RESOLVED, that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 2nd of June, 2016 at 7 o’clock in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said ordinance.

BE IT FURTHER RESOLVED, that the Township Clerk be authorized and directed to advertise said Ordinance in full or by summary with the notice of introduction thereof, in the official designated newspaper according to law.

H. DISCUSSION ITEMS

1. Environmental—Landmarks Committee Ordinance

Manager Mountain reported that the key item for discussion is a set of recommendations received from the Environmental Commission after they reviewed the Ordinance. They support the Ordinance, but ask for a couple of items to be considered; the Manager has had discussions with Keli Gallo and Chairperson and Vice Chairperson of the Commission. There is nothing, from a legal standpoint, which would change what has been established in the Ordinance. The discussion items are policy decisions for the Council; the majority of the items are for housekeeping. Manager Mountain shared with the Chairpersons of the Commission two recommendations which he didn’t think were necessary for the Council to discuss. The student liaison recommendation—the Commission was unaware of the Council’s past discussions regarding taking the student liaison references out of Ordinances to make them all consistent. The recommendation to add the wording, “the Mayor, or governing body of the municipality, may remove any member of the committee for cause, unwritten charges served upon the member and after a hearing thereon at which the member shall be entitled to be heard in person or by counsel”—he explained to them that typically a Council would move to not reappoint an individual if there was a real issue as opposed to removing him/her mid-term. The Manager expressed to the Commission members that wording such as this might be counterproductive, and that he felt it was unnecessary. Manager Mountain reviewed the other recommendations from the Environmental Commission Chairperson and Vice Chairperson:

  • Article II Sec. 10-34. Creation; Purpose.—To add...natural resources “including water resources” located within...
  • Article II Sec. 10-35(a) Appointment; Term;—To add “one member shall be a member of the municipal planning board.” The Manager explained that this would be consistent with how it is now. The feeling is that cross-involvement helps to keep people aware of what is going on.
  • Article II Sec. 10-36. Powers and Duties.—Again, where natural resources are mentioned, include water resources.
  • To add “The committee may establish sub-committees to accomplish its responsibilities.”
  • Article II Sec. 10-36(a)—To add “by providing timely informational copies of every application for development submitted to the planning board or board of adjustment.” The Manager explained that he and Keli Gallo talked about this item, and the wording might need to be worked out, but the request for of the additional wording seems reasonable. He explained to the Commission that the Council is not looking to change what they are doing, but rather to change the structure of the commission/committee.
  • Manager Mountain explained that their last recommendation was not meant to be included in the Ordinance. They want the former Landmarks Committee members to be asked if they have interest in being on the new Environmental Committee because members of the current Commission do not have the history with landmarks.

Councilman Forstenhausler stated that, as liaison, he fielded the questions when they were presented the proposed Ordinance. At the time, he had questioned adding the section about wanting to remove people, and the Chairperson and Vice Chairperson responded that they thought that would protect members; that they could not be removed unless there were written charges, a hearing, etc. Councilman Forstenhausler spoke to Manager Mountain, and they both felt it wasn’t necessary; however, he hadn’t spoken to the Chairperson or Vice Chairperson since. The Manager reported that he had spoken to the both of them earlier in the day, and expressed to them how he felt about that particular item and how he felt it might actually become a problem. He felt they understood the reasoning behind not including that wording.

Councilman Forstenhausler asked if there was anything formal that addresses the issue of the Council wanting to remove a member from a volunteer committee. Attorney Buzak stated that there is a statute related to attendance on the committee. Attorney Buzak also stated that he looked at the Environmental Commission statute, and he believes that it is in there. Councilman Forstenhausler stated that it is in the Environmental Commission state statute, and that is why they asked to have it included in the Ordinance; they felt that would give them some protection.

Councilman Forstenhausler agreed with Manager Mountain’s recommendation to not put the section in about the student liaison; he also felt there was no need to include a provision to allow the Council to remove members of the committee. He felt the other recommendations they requested were acceptable.

Councilwoman Veech agreed with all that Councilman Forstenhausler stated.

Councilman Guadagno asked what the Environmental Committee was doing to incorporate the Landmarks Committee. Manager Mountain explained that there was wording in the Ordinance merging the Environmental Commission and the Landmarks Committee that addressed that issue. He also stated that the recommendation from the Chairperson and Vice Chairperson was that if someone on the former Landmarks Committee was interested in serving on the Environmental Committee, it would be helpful.

Councilman Guadagno objected to the idea of having to have someone from the Planning Board on the Environmental Committee. He explained that the Environmental Committee already gets all the information from the Planning Board; therefore, there is no need to have a Planning Board member serve on the Environmental Committee.

Councilman Guadagno added that the DEP covers most of the other recommendations, so he felt the additions unnecessary.

Manager Mountain stated that he understood Councilman Guadagno’s reservations. However, as far as including the wording about water resources, it doesn’t change anything in the Ordinance, and if it makes the Chairperson and Vice Chairperson feel their interests were heard, it helps to make the transition smoother.

Manager Mountain stated that he couldn’t speak to the issue of having someone from the Planning Board on the Environmental Committee. He felt that they might be more comfortable having a member from the Planning Board in order to provide them with a greater perspective. Councilman Guadagno objected to this recommendation. Attorney Buzak explained that, under the statute, the Land Use Laws specifically recognize an Environmental Commission, as opposed to a committee, and it is required to have a dual member. He believed that was where the recommendation had come from. Councilman Forstenhausler explained that at the meetings related to this issue, the members of the Environmental Commission felt they had certain legal protections based on the statute; they were afraid that those protections were being taken away by forming a committee as opposed to a commission. They looked through the statute to determine what protections/powers they had as a commission, that they no longer would have as a committee, and they asked for those to be included. Councilman Forstenhausler explained that they initially asked for everything in the statute be included in the Ordinance. Both he and Darren Carney explained that it was unnecessary, it would be too complicated, and the result would be conflicting language, etc. The Councilman asked them to be more concise, and to ask for specific things they would like to include to make themselves feel more comfortable that they are not losing some authority or input, etc. Attorney Buzak added that the Land Use Law is very specific, and a Class IV member cannot hold any other position in a municipality. He was unsure if a member of the Planning Board can be on an advisory committees. Councilman Guadagno again expressed that he objected to this recommendation.

There was discussion regarding why the Environmental Commission members want to have a Planning Board member as part of the new committee. It was noted that Darren Carney attends both the Planning Board and Environmental Commission meetings, therefore, providing the necessary information. Councilman Forstenhausler added that the Environmental Commission members acknowledged that they are an advisory entity, whether a commission or a committee. He noted that, as such, they cannot make decisions and they can only advise; therefore, they would not be losing anything.

Attorney Buzak found the specific statute, NJSA 40:55D-23, and read that a Class IV member cannot hold any other position, office, or employment in a municipality.

The Council concluded that they agreed with four, out of the seven, recommendations. Manager Mountain stated that he and Keli Gallo will work to get the Ordinance ready for introduction at the June 2nd Council meeting.

2. Morris County Trail Grant

Manager Mountain explained that Mayor Hirniak circulated the information from the County on this new program. The County is looking for a Letter of Intent from the municipalities by July 29th. The application deadline is September 1st; they will then notify the applicants in late December/early January. The eligible projects include new trails, rehab and restoration, trailside and trailhead facilities. They require that applicants own the property, and there is at least a 20% matching fund either in direct financial contribution or in-kind services. In addition to the presentation the County will be giving at the League of Municipalities, they will have a workshop on June 6th. Darren Carney and Russ Newman will attend the workshop. The Manager asked Darren and Russ to identify a project that is ready to move forward. The Parks and Recreation Master Plan process will not be completed in time for the submission deadline. Before the application is completed, the Manager will discuss the identified project with the Council.

Councilman Guadagno asked if Council members would be able to attend the June 6th meeting. Manager Mountain will find out, and let the Council know.

Councilman Guadagno asked how this grant will affect the creation of the committee for the trails. Manager Mountain explained that he spoke to Russ Newman; Russ has gotten input from the Parks Advisory Committee. The recommendation is to create a group of approximately 5-8 members for the trails committee, designed similar to the Parks Master Plan Committee. The Manager suggested including a more specific discussion on the agenda for a future Council meeting. Ideally, the committee should be assembled in June. One aspect of the project is to recommend some money toward an outside facilitator to prepare the plan, and allow staff to contribute to the plan. The first task of the committee would be to prepare and finalize the RFP, and getting the facilitator in place in order to have the committee start in July.

Councilman Loveys asked for clarification as to the role of the consultant. Manager Mountain replied that the role of the consultant would be to drive the process to create a professional, non-biased document. The mapping would be done by Darren Carney.

J. COUNCIL COMMENTS

Councilman Guadagno asked if the Landmarks sign was found; Manager Mountain replied that had been located.

Councilman Guadagno stated that he received a complaint from residents on Birchwood Road that the road is too narrow. He asked if the 25 foot roads could be widened to 30 feet, at least Birchwood Road, where it meets Elm, and possibly Maple Drive. Manager Mountain stated that it would be difficult to do significant work as part of the road resurfacing program. If there is an opportunity within the right of way for the base to get a little wider, then it could be done; however, if there is not a right of way, then it would be difficult to do as part of the road resurfacing program.

Councilwoman Veech reported that she attended the Chamber of Commerce luncheon. There were questions about retail establishments in the township; she explained to them all the work being done by staff to fill retail spaces. Councilwoman Veech also reported that she, Mayor Hirniak, and Deputy Mayor Carey attended the Fernbrook Elementary School bingo and tricky tray fundraiser. She also attended the Artworks Studios annual art show reception. Councilwoman Veech attended the breakfast with Congressman Frelinghuysen; he spoke about government being behind in technology. She felt it was a very good update on what was happening in Washington, D.C. The Councilwoman also noted that the Parks Committee is very supportive of the Trails Committee as an advisory committee; they are looking forward to the partnership related to the Parks and Recreation Master Plan.

Councilman Forstenhausler asked Manager Mountain for an update on the cell tower project. Manager Mountain stated that the signed documents are to be returned in early June. Once received, they have 90 days in which to schedule the Land Use hearing. From time of award, they have six months to start construction, unless they have a technical issue for which they cannot proceed. Councilman Forstenhausler stated that he believed that some of the traffic lights at intersections in town were equipped with connections to allow them to use an emergency generator if there was a power failure, but he heard that the County was not doing the same. He heard that the light at Dover Chester Road and Sussex Turnpike does not have that capability. Manager Mountain stated that he had not heard that, but would look into it and report back to the Council.

Deputy Mayor Carey reported that the bench and tree dedication ceremony the previous week was very emotional, and she commended Russ Newman and Jeanne Montemarano for their work with the program. Councilwoman Veech added that Deputy Mayor Carey did a great job preparing for the dedications, and presented touching sentiment.
