A. OPENING OF COMBINED MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Veech. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 19, 2014 by e-mailing them the annual resolution adopted by the Council on December 4, 2014. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and the Daily Record on December 24, 2014.

B. PRESENTATIONS/PROCLAMATIONS

1. Police Awards

There was a reception in the lobby for the police awards.

C. OPEN TO THE PUBLIC

Judith Stewart of 114 Everdale Road spoke about busing for seniors in the township. She felt that the bus should also take seniors to the library. Mayor Veech suggested to Manager Mountain that the need for the service should be researched.

Seeing no one further from the public, the public portion was closed.

D. MANAGER’S REPORT

Manager Mountain reported the following:

  • Community Development Block Grant—the county has officially announced Randolph’s award of a grant of $80,000 towards the installation of an elevator at the VFW building. The township will be responsible for the 20% match on the $100,000 project. Along with the other ongoing and planned improvements, the elevator will address the building’s remaining ADA compliance issues.
  • Revaluation Project—the Revaluation project will be kicking off next month with the Public Information meeting on June 23rd at 7 p.m. in the Municipal Building. A letter to all property owners advising of the meeting as well as an informational brochure will be going out to residents in the next week. The summer quarterly and the township website will also have information.
  • Water Master Plan—the draft of the Water Master Plan has been finalized by consultant Hatch Mott MacDonald. He will review it with the Infrastructure Work Group; it is anticipated that it will be ready for final presentation to the Council at the end of June.

1. Release of Road Opening Bond for Block 174, Lot 19 at 6 Oak Drive to Ninel Lerner—$500.00

WHEREAS, the Engineering Department has received a request from Ninel Lerner, for the release of a $500.00 cash road opening bond posted for the purpose of paving a new driveway at 6 Oak Dr., Block 174/Lot 19, Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on Oct. 7, 2014; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the driveway at 6 Oak Dr., Block 174/Lot 19, within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Ninel Lerner, 6 Oak Dr., Randolph, NJ 07869.

2. Release of a Road Opening Cash Bond for Extending and Paving Current Driveway at 14 Cherry Lane, Block 175, Lot 9 to Scott Brezinski—$500.00

WHEREAS, the Engineering Department has received a request from Scott Brezinski, for the release of a $500.00 cash road opening bond posted for the purpose of extending and paving current driveway at 14 Cherry Lane, Block 175/Lot 9, Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on June 5, 2013; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the driveway at 14 Cherry Lane, Block 175/Lot 9, within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Scott Brezinski, 14 Cherry Lane, Randolph, NJ 07869.

3. Authorizing the Public Display of Fireworks for the 2015 Freedom Festival by Pyro Engineering, Inc. dba Bay Fireworks on July 3, 2015

WHEREAS, the Township of Randolph annually holds its Freedom Festival at the County College of Morris; and

WHEREAS, the Freedom Festival includes the public display of fireworks; and

WHEREAS, this year’s Freedom Festival fireworks will be held on Friday, July 3, 2015 with a July 5, 2015 rain date; and

WHEREAS, International Fire Code 2006, New Jersey Edition, Section 3301.2.4.3 requires the governing body to grant permission for the public display of fireworks; and

WHEREAS, upon application to the Fire Official and after receipt of all necessary documentation a permit shall be issued by the Fire Official, pursuant to N.J.A.C. 5:70-2.7 for the fireworks display; and

WHEREAS, the Purchasing Agent solicited quotes from seven (7) fireworks vendors; and

WHEREAS, quotes were received from two vendors; and

WHEREAS, the contract was awarded to Pyro Engineering, Inc. dba Bay Fireworks; and

WHEREAS, Pyro Engineering, Inc. dba Bay Fireworks provided proof of proper insurance coverage which has been approved by the MEL Underwriting Manager.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that permission is hereby granted for the public display of fireworks at the 2015 Freedom Festival by Pyro Engineering, Inc. dba Bay Fireworks on July 3, 2015 (rain date July 5, 2015) after issuance of a permit by the fire official as stated above.

4. Refund Road Opening Cash Bond for Repaving the Driveway at 15 James Road, Block 21.07, Lot 4 to A-1 Professional—$500.00

WHEREAS, the Engineering Department has received a request from A-1 Professional, for the release of a $500.00 cash road opening bond posted for the repaving the driveway at 15 James Rd., Block 21.07/Lot 4, Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on April 8, 2015; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the driveway at 15 James Rd., Block 21.07/Lot 4, within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to A-1 Professional, 95 Berkshire Ave., Paterson, NJ.

5. Release Lawn Stabilization Cash Bond for Seeding and Grading at New Home Construction at 130 Quaker Church Rd., Block 136, Lot 8 to Michael Alessandra—$1,500.00

WHEREAS, the Engineering Department has received a request from Michael Alessandra for the release of a $1500.00 cash lawn stabilization bond posted for the purpose of seeding and grading for a new home construction at 130 Quaker Church Rd. Block 136 Lot 8, Randolph; and

WHEREAS, the Lawn stabilization Bond consisted of a $1500.00 cash bond, which was received and deposited with the Finance Department on March 9, 2015; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the seeding and grading at 130 Quaker Church Rd., Block 136 Lot 8, within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the seeding and grading work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $1500.00 be refunded to Michael Alessandra, 130 Quaker Church Rd., Randolph, NJ. 07869.

6. Authorizing Mayor to Sign State Local Cooperative Housing Inspection Agreement for Town to Conduct Inspections on Behalf of State and Be Reimbursed Up to $19,000

WHEREAS, the Township wishes to enter into an agreement with the State of New Jersey, Department of Community Affairs; and

WHEREAS, the Township agrees to conduct State mandated inspections of hotels and multiple dwellings within its jurisdiction on behalf of the Bureau of Housing during Fiscal Year 2016; and

WHREAS, these inspections will be conducted between July 1, 2015 and June 30, 2016; and

WHEREAS, the amount the Township will receive is based upon the number of hotels, motels, and multiple dwellings that require inspection during the fiscal period; and

WHEREAS, the State agrees to pay the Township a sum of $19,000.00 for this service.

NOW, THEREFORE, BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey that the Mayor be authorized to sign this Agreement.

7. Authorizing Award of MCCPC Contract #10 for Lumber, Insulation, Hardware, Paint & Paint Supplies to Various Low Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #10 (Lumber, Insulation, Hardware, Paint & Paint Supplies); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, six (6) bids were received for Contract #10 (Lumber, Insulation, Hardware, Paint & Paint Supplies); and

8. Authorizing Award of MCCPC Contract #13-B for Fire Water Pumps on Fire Apparatus to First Priority Emergency Vehicles in Flanders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #13-B (Fire Water Pumps on Motorized Fire Apparatus); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, two (2) bids were received for Contract #13-B (Fire Water Pumps on Motorized Fire Apparatus); and

WHEREAS, First Priority Emergency Vehicles in Flanders, New Jersey, was the lowest responsive, responsible bidder for the items and prices shown on the attached Notification of Award for a two-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #13-B (Fire Water Pumps on Motorized Fire Apparatus) as noted above for the term of July 1, 2015 - June 30, 2017.

9. Authorizing Award of MCCPC Contract #30 for Office Paper Supplies to Various Low Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #30 (Office Paper Supplies); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, three (3) bids were received for Contract #30 (Office Paper Supplies); and

WHEREAS, Contract #30 (Office Paper Supplies) is awarded on a per line item basis; and

WHEREAS, Paterson Papers in Paterson, New Jersey, W.B. Mason in Secaucus, New Jersey, and Paper Mart, Inc., in East Hanover, New Jersey, are the lowest responsive and responsible bidders per line item as shown on the attached Notification of Award for a one-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #30 (Office Paper Supplies) as noted above for the term of July 1, 2015 - June 30, 2016.

10. Authorizing Award of MCCPC Contract #34 for Tree Spraying to Rich Tree Service in South Plainfield for $300.00 Per Hour for a One Year Term

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #34 (Tree Spraying); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, one (1) bid was received for Contract #34 (Tree Spraying); and

WHEREAS, Rich Tree Service in South Plainfield, New Jersey, was the lowest responsive, responsible bidder at a price of $300.00 per hour/per job for a one-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #34 (Tree Spraying) as noted above for the term of July 1, 2015 - June 30, 2016.

11. Authorizing Rejection of MCCPC Contract #43 Propane Gas from Amerigas Propane

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #43 (Propane Gas); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, one (1) bid was received for Contract #43 (Propane Gas); and

WHEREAS, the bid received from Amerigas Propane in Chester, New Jersey, was non-responsive in that they did not include the mandatory Consent of Surety with their bid submission and must therefore be rejected.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rejection of the bid from Amerigas Propane.

12. Authorizing Award to Accurate Waste and Kleiz Enterprises & Rejection of Russell Reid Waste Hauling for Contract #45 for Septic Pumping/Sludge Removal & Disposal Service/Pump Station Wet Well Pumping/Pump Station Bypass Pumping

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #45 (Septic Pumping/Sludge Removal & Disposal Services/Pump Station Wet Well Pumping/Pump Station Bypass Pumping); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, three (3) bids were received for Contract #45 (Septic Pumping/Sludge Removal & Disposal Services/Pump Station Wet Well Pumping/Pump Station Bypass Pumping); and

WHEREAS, Russell Reid Waste Hauling in Keasbey, New Jersey, was the apparent low bidder for Categories B and D, however their bid was non-responsive in that they required a minimum number of gallons with their pricing which is not compliant with the bid specifications and must therefore be rejected; and

WHEREAS, Accurate Waste Systems in Lake Hopatcong, New Jersey, was the lowest responsive and responsible bidder for Categories A, B and D as shown on the attached Notification of Award for a two-year term; and

WHEREAS, Kleiza Enterprises in Hackettstown, New Jersey, was the lowest responsive and responsible bidder for Categories C and E as shown on the attached Notification of Award for a two-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the rejection of the proposal submitted by Russell Reid Waste Hauling as stated above.

BE IT FURTHER RESOLVED that the Township on behalf of the MCCPC hereby authorizes the award of Contract #45 (Septic Pumping/Sludge Removal & Disposal Services/Pump Station Wet Well Pumping/Pump Station Bypass Pumping) as stated above for the period July 1, 2015 - June 30, 2017.

13. Authorizing Award of MCCPC #46 for Preventive Maintenance—Repair of Emergency Generator to Atlantic Switch & Generator

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #46 (Preventive Maintenance/Repair of Emergency Generators); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, four (4) bids were received for Contract #46 (Preventive Maintenance/Repair of Emergency Generators); and

WHEREAS, the contract is awarded on a per county basis for the lowest annual preventive maintenance cost; and

WHEREAS, Atlantic Switch & Generator in Hainesport, New Jersey, was the lowest responsive and responsible bidder for each county as shown on the attached Notification of Award for a two-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #46 (Preventive Maintenance/Repair of Emergency Generators) as noted above for the term of July 1, 2015 - June 30, 2017.

14. Authorizing Award of MCCPC Contract #47 for Water Meters-Data Recorders & Radio Frequency Meter Interface Units to HD Supply Waterworks and Rio Supply

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #47 (Water Meters/Data Recorders & Radio Frequency Meter Interface Units); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, two (2) bids were received for Contract #47 (Water Meters/Data Recorders & Radio Frequency Meter Interface Units); and

WHEREAS, HD Supply Waterworks in Edison, New Jersey, and Rio Supply in Sicklerville, New Jersey, are the lowest responsive and responsible bidders as shown on the attached Notification of Award for a one-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #47 (Water Meters/Data Recorders & Radio Frequency Meter Interface Units) as noted above for the term of July 1, 2015 - June 30, 2016.

15. Authorizing Award of MCCPC Contract #50 Fire Department Uniforms—Purchase to Action Uniform Company

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #50 (Fire Department Uniforms—Purchase); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, two (2) bids were received for Contract #50 (Fire Department Uniforms—Purchase); and

WHEREAS, Action Uniform Company in Egg Harbor Township, New Jersey, was the lowest responsive and responsible bidder for the items and prices shown on the attached Notification of Award for a one-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #50 (Fire Department Uniforms—Purchase) as noted above for the term of July 1, 2015 - June 30, 2016.

16. Authorizing Award of MCCPC Contract #40—Personal Protection Items & Equipment for Emergency Personnel to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #40 (Personal Protection Items & Equipment for Emergency Personnel); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, four (4) bids were received for Contract #40 (Personal Protection Items & Equipment for Emergency Personnel); and

WHEREAS, Contract #40 (Personal Protection Items & Equipment) is awarded on a line item basis for the highest discount offered; and

WHEREAS, Firefighter One in Sparta, New Jersey, Continental Fire & Safety in Hamilton, New Jersey, Emergency Equipment Sales in Trenton, New Jersey, and Turn Out Uniforms in Little Falls, New Jersey, are the responsive and responsible bidders offering the highest discounts per line item as shown on the attached Notification of Award for a one-year term with the following exceptions:

  1. Emergency Equipment offered a higher discount for Item #10 (Cutters Edge) in Category B, however it was determined by the Deputy Fire Chief that the product offered was not equivalent to Cutters Edge and it is recommended that the award go to Continental Fire & Safety.
  2. Emergency Equipment offered multiple discounts for Item #12 (Fire Research Corp.) in Category B, however the bid specifications state that only one discount per line item is permitted; as there is no second bidder this item will not be awarded for this contract.
  3. Emergency Equipment, Continental Fire & Safety, and Firefighter One all offered discounts for Item #35 (Ziamatic Corp.) in Category B, however all of the price lists offered expire on June 30, 2015, therefore no award can be made.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #40 (Personal Protection Items & Equipment for Emergency Personnel) as noted above for the term of July 1, 2015 - June 30, 2016.

17. Authorizing Award and Rejection of MCCPC Contract #13-A for Fire Equipment Services to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #13-A (Fire Equipment Services); and

WHEREAS, bids had been advertised and received on April 23, 2015, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, three (3) bids were received for Contract #13-A (Fire Equipment Services); and

WHEREAS, the bid received from Fail Safe Testing in Manalapan, New Jersey, was non-responsive in that they did not include a properly executed mandatory Ownership Disclosure Statement with their bid submission and must therefore be rejected; and

WHEREAS, City Fire Equipment Company in East Hanover, New Jersey, was the lowest responsive and responsible bidder for Categories 1, 2, 3, 4 and 5 as shown on the attached Notification of Award for a one-year term; and

WHEREAS, Continental Fire & Safety in Hamilton, New Jersey, was the lowest responsive and responsible bidder for Categories 11, 14 and 16 as shown on the attached Notification of Award for a one-year term; and

WHEREAS, no bids were received for Categories 6, 7, 8, 9, 10 and 15 therefore no awards will be made for those categories; and

WHEREAS, Fail Safe Testing was the sole bidder for Categories 12 and 13 and since their bid must be rejected no awards will be made for those categories.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the bid proposal submitted by Fail Safe Testing is rejected as stated above.

BE IT FURTHER RESOLVED that the Township on behalf of the MCCPC hereby authorizes the award of Contract #13-A (Fire Equipment Services) as stated above for the period July 1, 2015 - June 30, 2016.

18. Authorizing a Time Extension Supplemental and Increase in Price of a Professional Services Agreement with Environmental Technology Inc. for Delineation of Wetlands Boundaries & NJDEP Permit Applications & Transition Area Waiver—Special Activity Waiver for Redevelopment Services for an Additional $750.00 Bringing New Total to $4,250

WHEREAS, the Township of Randolph (“Township”) adopted Resolution 272-13 on September 3, 2013 awarding a professional services agreement to Environmental Technology Inc. of Chester, NJ for the delineation of wetlands boundaries and NJDEP permit applications services for Block 195, Lots 10 and 25 ; and

WHEREAS, the project itself and Environmental Technology Inc. require additional time to perform the services; and

WHEREAS, additional services are needed to prepare and submit an application for a Special Activity Transition Area Waiver-General Permit for Block 195, Lot 10 concurrently with the application being prepared under the original PSA awarded September 3, 2013; and

WHEREAS, the term of this agreement will be until the project is fully completed; and

WHEREAS, the original agreement amount of $3,500 will be increased by $750 as a result of the addition of the services needed to prepare and submit an application for a Special Activity Transition Area Waiver-General Permit for Block 195, Lot 10 per the attached proposal.

WHEREAS, there are funds available for this increase.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

  1. The Township amends the professional services agreement to Environmental Technology Inc. of Chester, NJ by extending the term of the agreement until the project is fully completed, by supplementing the scope of work to include additional services needed to prepare and submit an application for a Special Activity Transition Area Waiver-General Permit for Block 195, Lot 10 concurrently with the application being prepared under the original PSA awarded September 3, 2013 and by increasing the dollar amount by $750 from $3,500 to $4,250 for the additional services.
  2. The agreement with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
  3. The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.
  4. The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
  5. It is hereby directed that Notice of Award of this Agreement shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.
  6. This Resolution shall take effect immediately.

19. Rejecting all Bids for Towing Services—Rebid

WHEREAS, the Township of Randolph advertised for the Towing Services—REBID project in accordance with Local Public Contracts Law and received bids on May 19, 2015; and

WHEREAS, 1 bid was received; and

WHEREAS, the sole bid was received from the following and for the bid prices listed:

Sameis Holdings LLC dba Tow New Jersey, Houston, TX

Basic Towing Days—Flat Rate: $170.00
Basic Towing Nights—Flat Rate: $185.00
Daily Rate—Storage Services: $40.00; and

WHEREAS, the bid received from Sameis Holdings LLC dba Tow New Jersey was non-responsive in that they did not include a properly executed mandatory Consent of Surety form with their bid submission; and

WHEREAS, the bid was also non-responsive in that the bidder did not provide with their bid references, photographs of their equipment or subcontractors’ equipment, the address and ownership of a secured storage area for all vehicles towed by the contractor and names, addresses and driver’s license numbers of all proposed drivers and employees as required by the bid specifications; and

WHEREAS, the bid was also non-responsive in that the bidder took exception to the bid specifications as they are modifying the services and how they are to be performed if awarded the contract; and

WHEREAS, for the reasons stated above the bid from Sameis Holdings LLC dba Tow New Jersey must be rejected since it is non-responsive.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the sole bid from Sameis Holdings LLC dba Tow New Jersey for the Towing Services—REBID project is hereby rejected as being non-responsive to the bid specifications.

20. Endorsing an Application for a Treatment Works Approval (TWA) for Sanitary Sewer System to Serve the Proposed Affordable Housing Site at 42 Bennett Avenue, Block 195, Lot 10

WHEREAS, Stewart Engineering has completed the design phase for the site plan and sanitary sewer design for the Township Affordable Housing project on Lot 10 in Block 195 along Bennett Avenue; and

WHEREAS, the Township of Randolph must apply to the New Jersey Department of Environmental Protection for a Treatment Works Approval for the connection of the proposed development to the existing sanitary sewer system; and

WHEREAS, in order for the New Jersey Department Environmental Protection (“NJDEP”) to consider the extension, the same must be endorsed by the Township, among others; and

WHEREAS, the Township desires to authorize the execution of the endorsement of said extension.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey as follows:

  1. The Township hereby endorses a request for a Treatment Works approval for an extension of the existing sanitary sewer to serve the affordable housing development Block 195, Lot 10 on the official tax map of the Township of Randolph.

WHEREAS, the Township of Randolph Consulting Engineer has completed the design phase for an eight inch sanitary sewer main extension to be constructed to service Lot 67-81 in Block 73 along Mac Spar Drive; and

WHEREAS, the Township of Randolph must apply to the New Jersey Department of Environmental Protection for a Treatment Works Approval for the extension of the existing eight inch sanitary sewer main; and

WHEREAS, in order for the New Jersey Department Environmental Protection (“NJDEP”) to consider the extension, the same must be endorsed by the Township, among others; and

WHEREAS, the Township desires to authorize the execution of the endorsement of said application.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey as follows:

22. Endorsing an Application for Waiver of EPA Grant Restrictions Related to Sewer Serving Lots with Wetlands in Respect to 42 Bennett Avenue Redevelopment Project—Block 195, Lot 10

WHEREAS, the Township of Randolph proposes a sanitary sewer connection at the project known and designated as 42 Bennett Avenue, Block 195 Lot 10, on the official tax map of the Township of Randolph, to the Randolph Township Sewer System for ultimate discharge to the Rockaway Valley Sewerage Authority (“RVRSA”) System and;

WHEREAS, a portion of the property to be connected to the System contains wetlands as defined and delineated by the United States Fish & Wildlife Service; and

WHEREAS, one of the conditions imposed by the United States Environmental Protection Agency (“EPA”) upon the grant for the construction of the RVRSA facilities prohibits the connection of any sewerage generating structure located within any parcel of land containing a wetland area to the System for a period of 50 years after November 29, 1983; and

WHEREAS, said grant conditions provide for exceptions to the prohibition if approved, in writing, by the Regional Administrator of EPA; and

WHEREAS, the procedures for mapping revisions and waiver requests established by EPA, the New Jersey Department of Environmental Protection (“DEP”) and the RVRSA require that Randolph Township endorse the submission of such waiver request or mapping revision; and

WHEREAS, those procedures provide that projects which do not adversely impact wetlands may be approved by way of mapping revision or waiver request; and

WHEREAS, the Township of Randolph has submitted an application for sewer gallonage and indicated that no sewerage generating structures are to be located within the wetlands; and

WHEREAS, the Township’s project consultant Stewart Surveying and Engineering, LLC finds that the project, as proposed by the Township will not involve the construction of sewerage generating structures within a delineated wetland and is designed so as to minimize any adverse impacts on such delineated wetlands.

NOW, THEREFORE, be it resolved that the application prepared by Stewart Surveying and Engineering LLC, for the Township of Randolph be submitted to the RVRSA for a waiver of the EPA grant condition, related to servicing the property with wetlands for Block 195, Lot 10, on the Tax Maps of the Township of Randolph, is hereby endorsed.

Manager Mountain explained that this Ordinance amends the existing township Ordinances prohibiting parking on certain streets to allow the Chief of Police to temporarily waive parking restrictions on one side of Dawson Road, the south side of Jared Drive, and the area on South Road along the fencing fronting the cemetery. It also allows for the temporary waiver of parking restrictions on Mohawk Place during Primary and General elections.

Jim McConnell of 45 Carrell Road stated that he felt that residents should be able to park on the street in front of their own houses. Manager Mountain explained that the parking restrictions are for public safety, and that if a resident needs to park on the street due to driveway paving, etc., they can contact the Police Department to inform them of the necessity.

I. DISCUSSION ITEMS

1. Cell Tower—Council Ltr #20-15

Manager Mountain explained the Council Communication Workgroup met and has reviewed the draft technical specification. This specification will allow the township to move ahead on the bidding of the cell tower behind the Municipal Building. The Manager reviewed the draft bid specifications:

  • They allow for a bid that would bring in bidders for both a lead agency to build the tower, as well as a non-lead, land-lease only set of bidders to co-locate their antennas and equipment on the tower.
  • They are written so the bidder with the highest amount wins the opportunity to be the lead bidder on the construction of the tower, they would pay the township the amount bid for the lease for that arrangement. They would also be winning the right of first choice for where their antennas go on the tower, and the ability to collect a fee from all of the other co-locators toward their cost for the construction of the tower; the fee would be in addition to what the co-locators would be obligated to pay the township.
  • They require the bidders to submit a minimum bid in order to be qualified for consideration; each carrier would have to submit a bid for lead agency and for co-locator.
  • All bidders must be FCC licensed.
  • They propose a lease term for both the land lease and the co-location lease of 25 years. There would be an initial 5 year term, and then 4 successive roll-over 5 year terms that would be renewable.
  • They set a minimum bid threshold for the lead lease and for the co-location; the lead lease minimum bid is $30,000 and the co-location lease is $18,000.
  • They call for an annual increase on the lease payments that are tied to the Consumer Price Index or 3%, whichever is higher.
  • They include the technical requirements to ensure the look of the tower remains consistent with the design preferences established by the Council.
  • They require that the township takes ownership of the tower at the end of the lease for $1 or at any time prior if an abandonment occurs.
  • They call for the lead agency to maintain the tower, and to provide to the municipality any changes that may be coming during the course of the lease. The township controls the approval of any additions to the tower.
  • The tower would be required to be taken down by mutual agreement if there is no further need for the tower.
  • The lead agency is required to carry the project through the Planning Board; it would have to go through a site plan process before the construction could occur.

Manager Mountain reiterated that these are draft bid specifications to ensure the Council has seen them and has had the chance for questions and concerns to be addressed. Once the Manager has feedback from the Council, they will go through a review by Attorney Ed Buzak’s office. Purchasing Agent Liz Crescibene will review them and put them into a final form for bidding. It is anticipated that the bid package go out in June.

Councilman Guadagno stated his concern about the 3%; he felt the Consumer Price Index was good, but the 3% isn’t fair to the builder over 25 years. Mayor Veech asked if that was an industry standard. Manager Mountain stated there is no standard; that figure is a local decision. There was some discussion on this aspect of the bid specifications.

Councilman Forstenhausler stated that he is pleased that the specifications include that the township will retain full control over the tower and the equipment allowed on the tower since that was a concern of his. He asked for clarification that the wording about the township possessing the right to review/approve any items proposed for future installation on the tower also meant the township could disapprove. Manager Mountain stated that was correct.

Councilman Loveys asked for clarification that there is a maximum of four providers at any given time. Manager Mountain stated that was correct. Councilman Loveys clarified that, until the 25 year lease term is complete, it is up to the carrier whether they want to renew, the township has no say. Manager Mountain stated that was correct.

Mayor Veech asked where the figures of $30,000 and $18,000 came from as minimum bids. Manager Mountain stated there was much discussion with the technical expert who said he couldn’t give a specific number, but he could give an idea based on what other similar type towers and similar locations have required for minimum bids. Mayor Veech also asked about the township’s control on what goes on the tower as far as color, shape, etc. Attorney Buzak couldn’t answer since he had not yet read the specifications, but referred to Manager Mountain. The Manager stated that he believed the language protects the township against odd color antennas, shape, etc. but if the attorneys feel the language needs to be changed once they read it, then it will be changed.

Councilman Forstenhausler stated that the builder of the tower has to get Planning Board approval. He asked what would happen if the Planning Board puts conditions on it which would make it too difficult or if they don’t give approval for the tower. Manager Mountain stated that there is a site plan approval, but there is no guarantee what the Planning Board might decide.

There was some discussion on the number of bidders based on building the tower and putting antennas on the tower.

2. Council Ltr #19-2015—Dover Chester Road

Manager Mountain explained that the Council has discussed this in the past, but it has come to light again due to the county being scheduled to resurface Dover Chester Road this year. The Manager also received correspondence from the Pastor of Holy Trinity Orthodox Church on Dover Chester Road concerning the difficulty of making the turn out of the church and crossing two lanes of traffic with it being a four lane road as currently designed. The township staff took the information to the County Engineer, and met with him. They asked what it would take for the county to reconsider how they were originally planning to design and bid the project to redesign it to be a two lane road with a turning lane in the appropriate areas where required and a wider side area for pedestrians or biking. Manager Mountain said they were very receptive of the idea; they have not gone out to bid yet. They indicated that if it is the interest of the Council to have them go back and redesign the road as indicated above, properly engineered and studied, all they would need is a letter from Manager Mountain stating it is the Council’s wishes. The county would then go back to their consultant and start the process immediately; they felt it would not delay the project from being done this year. The county felt the constituents along Dover Chester Road would find the redesign to be favorable. The Manager stated that it is up to the Council to give their approval for the requested change; however, there is not time to review and approve the county’s plan once the changes are made.

Mayor Veech asked if the center turning lanes would line up with residents’ driveways. Manager Mountain explained the turning lanes would line up with side streets, and the major driveways, but he didn’t know whether there would be a turning lane at every driveway along the road since they didn’t get into that level of detail. The township would see the county’s updated plan before it is finalized, and it may be possible to make some minor adjustments, but going back to the original design would not be possible.

Councilman Forstenhausler asked how making it a two lane roadway with a center turning lane might affect traffic during rush hours. Manager Mountain stated there might be some potential impacts to traffic, but he didn’t think the county felt it would be a major difference from the current traffic. There was some discussion on the traffic patterns at rush hour. Once the new plan is designed by the county, the township, the Council, and the TAC will be able to review the design.

After some discussion, the consensus of the Council was to support the Manager moving forward with a letter to the county to redesign Dover Chester Road to a two lane road with a center turning lane in the appropriate areas, and a wider side area for pedestrians or biking. He will include the concern about traffic and ask that the county traffic engineer review the plan as well. The Manager will also ask for the courtesy of a review of the plan prior to finalization.

3. Special Meeting—Mid July

Manager Mountain explained that he was looking to have a very brief Special Meeting on July 9th at 5:00 p.m. The reason for the meeting is because there are two time sensitive bid awards that need addressing; the bids are the re-bid of the Sussex Turnpike Water Line Project and the HVAC project which has to be completed during a specific timeframe before the winter. Manager Mountain will have Donna Luciani send out a reminder email.

Manager Mountain reminded the Council that the second meeting in June is moving from the 18th to the 16th at 7:00 p.m.

J. OPEN TO THE PUBLIC

Judith Stewart of 114 Everdale Road stated that cars often use the center turning lane on Millbrook Avenue to pass her when she’s driving the speed limit; she felt it is very dangerous to have a center turning lane.

Seeing no one further from the public, the public portion was closed.

K. COUNCIL COMMENTS

Councilman Guadagno reported that Denise Thornton completed a Tap the Talent form; she lives by him, she works for the Morris County Sheriff’s Department, she has a great resume, and he felt she would be an asset to the Library Board of Trustees.

Councilman Guadagno made a motion to appoint Denise Thornton to the Library Board of Trustees. Councilman Napoliello seconded the motion, and the following roll call vote was taken:

Councilman Guadagno reported that the Landmarks Committee has cancelled two meetings so he has nothing new to report.

Deputy Mayor Hirniak reported that there are two openings on the Board of Adjustment. Doug Lucas is the current Alternate member. Former full member, Maryann Spagnuolo resigned. Per the tradition of moving Alternate members to Full members, Doug Lucas would fill the unexpired 4 year term of Maryann Spagnuolo which ends on December 31, 2018. This would open an Alternate member position. Kevin Dunn has completed a Tap the Talent form. Deputy Mayor Hirniak reported that he had spoken to Kevin Dunn, and felt he would make a wonderful addition to the Board of Adjustment as Alternate Member #1. He would fill Andrew Shevchenko’s unexpired term which ends December 31, 2015.

Deputy Mayor Hirniak made a motion to appoint Doug Lucas as a Full Member and Kevin Dunn as Alternate Member #1 of the Board of Adjustment. Councilman Guadagno seconded the motion, and the following roll call vote was taken:

Councilman Loveys reported that there is also a vacancy on the Economic Development Committee (EDC). A Tap the Talent form has been submitted by Milton Hunter; he is a 20 year resident, he is an attorney, he and his wife own a law firm in Randolph, and he has been an active member of the Randolph Chamber of Commerce since 2012 serving on the Board of Directors.

Councilman Loveys made a motion to appoint Milton Hunter to the EDC. Councilman Guadagno seconded the motion, and the following roll call vote was taken:

Deputy Mayor Hirniak reported that he, Councilwoman Carey, and Mayor Veech attended a meeting of the Parks Master Plan Steering Committee. Manager Mountain was at the meeting, as well as other members of the committee. The process is moving along nicely. A memo was received which memorializes the results of the first round of solicitation of the residents’ opinions; what they like about the Parks and Recreation set up, and what they feel is lacking. They will now undergo a second round process which will include some additional public meetings, there will not be anymore stakeholder meetings. Deputy Mayor Hirniak stated that people are very excited about the 90 acres and the potential to properly develop it in a way that will benefit the community for the future. Copies of the memo were made for Council members; however, it is an internal document and not yet meant to be shared with the public.

Mayor Veech reported that at the EDC meeting they spoke about Randolph, “where life is worth living” and how to encourage more people to buy homes in the township and open businesses. They spoke about the fact that realtors are the ones who attract people to Randolph and who talk to potential buyers. An idea that came up was something that was done many years ago, and that was to have a realtor’s lunch where both the township and the school district put together packages and speak about the wonderful things happening in Randolph. Mayor Veech stated that Manager Mountain is in the process of gathering trail maps, the Randolph Quarterly, the Annual Report, and other things such as a fact sheet on the different programs in the township. Superintendent David Browne is also compiling information about the school programs. Once it is all together, the EDC will review the materials and on June 17th there will be a luncheon which will include the EDC, the Council, and the school district. Manager Mountain added that he will work with David Browne to put together a presentation for that day in addition to the handouts. They will also answer any questions or concerns from the realtors about Randolph.

L. EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

1. The public shall be excluded from the remaining portion of the meeting.
