Minutes: May 28, 2009
A regular meeting of the Randolph Township Council was called to order at 8:00 p.m. by Mayor Metz. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and, to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on January 12, 2009, by emailing them the annual resolution adopted by the Council on January 1, 2009. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and in the Morris County Daily Record on January 15, 2009.

PROCLAMATION: Landmarks Committee “Regeneration for a New Generation”
WHEREAS, historic preservation is an effective tool for managing growth, revitalizing neighborhoods, fostering local pride, and maintaining community character while enhancing livability; and
WHEREAS, historic preservation is relevant for communities across the nation, both urban and rural, and for Americans of all ages, all walks of life, an all ethnic backgrounds; and
WHEREAS, it is important to celebrate the role of history in our lives and the contributions made by dedicated individuals in helping to preserve the tangible aspects of the heritage that has shaped us as a people; and
WHEREAS, “Regeneration for a New Generation” is the theme for National Preservation Month 2009, co-sponsored by Randolph Township’s Landmarks Committee and the National Trust for Historic Preservation.
NOW, THEREFORE, I, Edward Metz, Mayor of the Township of Randolph, in the County of Morris, New Jersey, do proclaim May 2009 as National Preservation Month and call upon the people of Randolph to join their fellow citizens across the United States in recognizing and participating in this special observance.
OPEN TO PUBLIC
Judith Stewart, 114 Everdale Road, suggested as an alternative to a complete ban on smoking in the parks the Council place a ban on smoking in the parks when children are present.
Seeing no one further from the public, the public portion was closed.
COUNCIL AND MANAGER REPORTS
Councilman Obremski reported that the sub-committee from the Traffic Safety Advisory Committee is nearly done with their report concerning the intersection of Route 10 and Dover-Chester Road and will be presenting their report on June 10. The Freeholders have agreed that county staff would participate in the report and would hopefully participate in a meeting with the DOT to help resolve some issues at the intersection.
Councilman Algeier reported that he and Mayor Metz attended a dinner hosted by Rotary International where a number of people from the township where honored. Councilman Napoliello received the Public Service of the Year Award for his many years of service as a Councilman and Mayor as well as the many years he served with the Recreation Committee.
Councilwoman Price reported that the Parade Committee chose John Kovach and Joseph Berry to serve as co-Grand Marshals for this year’s Freedom Festival Parade. Mr. Kovach has served 70 years with the fire department as both chief and volunteer. Mr. Berry has been recognized for his work in the community with children.
Mayor Metz echoed Councilman Algeier’s comments concerning the Rotary Dinner and reported that Councilman Napoliello’s son gave a tremendous speech and introduction for his father at the Rotary Dinner. The Mayor reported that he had a very nice time while attending the High School Senior Picnic and the Random Acts of Kindness Awards for the 6th graders at the Middle School. Mayor Metz reported that the New Jersey Devils are working very hard reaching out to the communities trying to market their team and show that they care about the communities. The Mayor referred a staff member from the Morris ARC to the Devils organization and the Devils responded to their request immediately. Mayor Metz noted for the record that it’s nice to have a New Jersey team that shows an interest in local communities.
DISCUSSION
(1) Public Works/Board of Education Vehicle Maintenance Center
Bill Kerwick, the Director of Public Works, spoke about the proposed maintenance building at the current Public Works yard. His comments included:
- Presently there is a 9700 square foot building at the site which would be demolished
- The proposed project calls for a 13,000 square foot building to be constructed
- The building would be utilized by both Public Works and the Board of Education
- There will be three garage bay doors on the side of the building
- The Board of Education has two high capacity vehicle lifts that Public Works will be able to share
- The maintenance facility to work on every motorized piece of equipment within the township
- One repair section can be isolated during the cold weather months so that cold air will not flow into the main building
- There is an area in the building where parts and tools can be secured
- During the time period between demolition of the existing building and completion of the new building, Public Works will most likely share space currently leased by the School Board at the Mt. Freedom Business Park for large vehicle maintenance
- It will probably be two years before construction begins to allow for planning and permitting
- Construction of the new facility would likely take approximately nine months
Manager Lovell made the following comments:
- Ben Horten is a local architect working on this project
- The repair facility will be two stories, and the office facility will be one story
- The front of the building is relatively attractive with a country flair
- The sides and back of the building are more plain
- It is anticipated that solar panels can be placed on the roof of the building to help generate a tremendous amount of power
- The site plan will be done in-house
- The permitting process will begin at this time
- At some point next year, the Council should be in a position to consider a bond ordinance for construction
- There is a budget roughly estimated at $3.5 million, to be split between water and sewer, township general obligation, and the Board of Education
The Manager asked the Council for permission to go to the Board of Education to make a presentation to them detailing the plan.
Councilman Algeier suggested at some point the residents be told how this plan will improve efficiencies in the township. The Councilman reminded Mr. Kerwick to consider the fact that certain vehicles may be taller in the future and to provide adequate space for such vehicles into the plans.
Council indicated approval for the Manager and Director of Public Works to meet with the Board of Education to make their presentation.
(2) Amending Fertilizer Ordinance
Manager Lovell will put this item on the agenda for the June work session in order to start the process in July.
(3) Storm Water Ordinance Amendment
Manager Lovell noted that there is currently a storm water ordinance in place dealing with all formal applications in front of the Township. It does not deal with applications coming in for courtesy review. This amendment, recommended by Paul Ferriero, would capture all applications.
Councilman Algeier noted that not every entity has come before the Township for a courtesy review. He cited the County College of Morris as a case in point.
Manager Lovell responded that all entities should come before the Township for a courtesy review.
(4) New Jersey Sustainable Energy
Manager Lovell reported that the Morris County Municipal Joint Insurance Fund has been working with PermaRisk Management on a new venture to create an entity which would lie between an authority and a shared services contract. What is being proposed is the creation of a very large joint meeting in New Jersey with municipal governments to allow them to go out and purchase energy. By joining purchasing power together, towns can enjoy savings on energy costs. In order to participate in this process, the Council will need to adopt a resolution at the next meeting expressing their interest. The Manager noted that Randolph can pull out of the process if it looks like it won’t work as planned. He would like to appoint Jerry Giaimis and Gail Catania as Randolph’s representatives.
Council indicated support for the plan and the Manager will prepare a resolution for approval.
(5) Clyde Potts and Adjacent Open Space—Deer Hunt
Manager Lovell reported that Mendham holds a deer hunt in the Clyde Potts. The Mendham Township committee that deals with hunting contacted Mr. Lovell to see if Randolph would be interested in joining the program. The Mendham hunt runs for ten to twelve days. Hunters in tree stands near the reservoir use shot guns while other hunters drive the deer from the woodlands to the reservoir. All the hunters receive clearance from the Mendham Township Police Department. Mendham would like to extend their area in Randolph Township. Dates would be set well in advance so the trails could be posted and all adjacent property owners would be notified. The Randolph Parks Advisory Committee is in favor of participating in the Mendham hunt. There may be some interest in the future of adding additional municipal lands to the hunt. The Manager is asking for authorization to provide permission to the Mendham committee to undertake this project.
Deputy Mayor Alpert asked about Randolph hunters wishing to participate in the hunt.
Manager Lovell responded that he will put hunters in contact with the Mendham committee.
Deputy Mayor Alpert suggested that someone from Randolph act as a liaison to the committee.
Manager Lovell reported that trails in James Andrews Park have traditionally been closed completely during the bow hunt. This is the only Morris County park that has been closed. Rather than close the trails completely, the Manager suggested posting notices on the trails when the bow hunt is in progress advising people not to leave the trails. He noted that he received complaints from people who lose access to the trails in Freedom Park during the hunt.
Councilman Algeier expressed concern that, while the Morris County Park Commission doesn’t entirely close their other parks, he doesn’t believe their trail system is used as extensively as Randolph’s. Since the hunt calls for the closing of only three of the fourteen miles of trails in the Township, he would prefer to keep the trail closed for another year or two while people get used to the hunt. He suggested the Manager provide Council concerns to the Morris County Park Commission for further consideration.

A. Refund/Adjustment Resolutions
(1) Refund Road Opening Cash Bond for Installing Water Line at 40 Church Road to John Klatte—$500.00

WHEREAS, the Engineering Department has received a request from John Klatte for the release of a $500.00 cash road opening bond posted for installing to water line; and
WHEREAS, the road opening bond consisted of a $500.00 cash bond which was received and deposited with the Finance Department on March 17, 2009; and
WHEREAS, the applicant was required to post this cash bond to guarantee the installation to water line within the Township right-of-way; and
WHEREAS, the Engineering Department has inspected the road opening work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Raffaele Carchia, Engineering Administrator, that the cash road opening bond in the amount of $500.00 be refunded to John Klatte, 40 Church Road, Randolph, NJ 07869.
(2) Refund Day Camp Registration to Patrice Elliott—$620.00

WHEREAS, Patrice Elliott registered her child for day camp and paid the fee of $620.00; and
WHEREAS, her child will not be attending the day camp program due to a conflict.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by John Van Brunt, Director of Parks, Recreation and Community Services, that $520.00 be refunded to Patrice Elliott.
(3) Release of Road Opening Cash Bond for Connection to Water System at 19 Longview Avenue to Joseph and Lisa Cannon—$500.00

WHEREAS, the Engineering Department has received a request from Joseph and Lisa Cannon for the release of a $500.00 cash road opening bond posted for connection to the Township water system; and
WHEREAS, the road opening bond consisted of a $500.00 cash bond which was received and deposited with the Finance Department on April 13, 2009; and
WHEREAS, the applicant was required to post this cash bond to guarantee the connection to the water system within the Township right-of-way; and
WHEREAS, the Engineering Department has inspected the road opening work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Raffaele Carchia, Engineering Administrator, that the cash road opening bond in the amount of $500.00 be refunded to Joseph and Lisa Cannon, 19 Longview Avenue, Randolph, NJ 07869.
B. Appropriate/Reserve Preliminary Construction and Design Costs—Community Center Building—$38,000.00

WHEREAS, the Township Council of the Township of Randolph hereby acknowledges the requirement of additional preliminary costs to determine the scope and cost of a proposed undertaking. The purpose of these additional preliminary costs are for the improvements to the Township of Randolph Senior Community Center and that the amount to be charged is for the purpose for which bonds may be issued under Chapter 2 of Title 40A.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the amount appropriated for additional preliminary costs shall not exceed $38,000.00 and the Finance Director is authorized to set up a reserve for preliminary expenses out of the Capital Improvement Fund.
C. Professional Services Agreement with Ben Horton Architectural Design for Architectural Mechanical and Structural Engineering Services for Community Center Building—$53,900.00

WHEREAS, the Township of Randolph has a need to acquire Ben Horton Architecture and Design as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; and
WHEREAS, Gail Catania, Purchasing Coordinator, has determined and certified in writing that the value of the acquisition may exceed $17,500.00; and
WHEREAS, the anticipated term of this contract is one year and may be extended as approved by this governing body; and
WHEREAS, Ben Horten Architecture and Design has indicated they will provide the Architectural Services for an amount not to exceed $53,900.00; and
WHEREAS, Ben Horten Architecture and Design has completed and submitted a Business Entity Disclosure Certification which certifies that Ben Horten Architecture and Design has not made any reportable contributions to a political or candidate committee in the Township of Randolph in the previous one year, and that the contract will prohibit Ben Horten Architecture and Design from making any reportable contributions through the term of the contract; and
WHEREAS, funds are available for this purpose.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to enter into a contract with Ben Horten Architecture and Design as described herein.

WHEREAS, a Professional Services Agreement was awarded to Hatch Mott MacDonald on December 20, 2008, for Professional Services with regard to the Butterworth Interceptor Upgrade—Raynor Project; and
WHEREAS, the need exists to amend this agreement to include preparation of additional applications to the DEP; and
WHEREAS, the fees for this service will be $36,000.00 for a new total of $186,450.00; and
WHEREAS, funds are available for this purpose; and
WHEREAS, the Local Public Contracts Law (NJSA 40A:11-5 et seq.) requires that the resolution authorizing the award for Professional Services without competitive bid and the contract itself must be available for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, County of Morris, State of New Jersey, that Change Order #1, not to exceed $36,000.00 for a new total of $186,450.00, be approved.

WHEREAS, Gail Catania, Purchasing Coordinator, has determined and certified in writing that the value of the acquisition may exceed $17,500.00; and
WHEREAS, the anticipated term of this contract is one year and may be extended as approved by this governing body; and
WHEREAS, Larry Cohen of Courter, Kobert & Cohen has indicated they will provide the Conflict Counsel for Tax Appeals at $150.00 per hour for attorneys, $80.00 for paralegals, plus $600.00 per day for trials, for an amount not to exceed $5,000.00; and
WHEREAS, Larry Cohen of Courter, Kobert & Cohen has completed and submitted a Business Entity Disclosure Certification which certifies that Larry Cohen of Courter, Kobert & Cohen has not made any reportable contributions to a political or candidate committee in the Township of Randolph in the previous one year, and that the contract will prohibit Larry Cohen of Courter, Kobert & Cohen from making any reportable contributions through the term of the contract, and

WHEREAS, the Township of Randolph utilizes Morris County Cooperative Pricing Council Contract #15C, Utility Vehicles; and
WHEREAS, the Department of Public Works wishes to purchase three vehicles for a total not to exceed $130,000.00.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to purchase vehicles from Morris County Cooperative Pricing Council Contract #15C in an amount not to exceed $130,000.00.
H. Authorizing Payment for Hazardous Waste Removal at 42 Bennett Avenue—EcolSciences in Compliance With NJ DEP Directive—EcolSciences—$12,250.00 and Environmental Products and Services of Linden—$4,488.50

WHEREAS, on May 13, 2009, the NJDEP’s emergency response unit notified the Township that several leaking oil containers were identified at 42 Bennett Avenue, which is Township-owned property; and
WHEREAS, NJDEP’s representative ordered that the containers be removed by the end of the day and numerous bags of chemicals, plastics, and oil drums be removed within one week; and
WHEREAS, Environmental Products and Services of Linden, New Jersey, was called in to remove the oil containers on May 13, 2009, at a cost of $4,488.50; and
WHEREAS, EcolSciences, Inc., Rockaway, New Jersey, was called to remove the remainder of the items at a cost of $12,250.00; and
WHEREAS, the emergency purchases to comply with the NJDEP directive order totaled $16,738.50.
NOW, THEREFORE, BE IT RESOLVED by the Township Council,Township of Randolph, County of Morris, State of New Jersey, that payment be approved for the above invoices in the amount totaling $16,738.50.

I. Resolution Endorsing Application for Treatment Works Approval (TWA) for Construction of a Sanitary Sewer Main in Conjunction With The Shoppes at Randolph Project

WHEREAS, the Township of Randolph has received a request to endorse a Treatment Works Application for the construction of a sanitary sewer gravity main to be connected to the Randolph Township sanitary sewer system located in Quaker Church Road; and
WHEREAS, the applicant must apply to the New Jersey Department of Environmental Protection for the Treatment Works Approval for the discharge of sewer gallonage in the Randolph Township sanitary sewer collection system by way of a gravity main; and
WHEREAS, in order for the New Jersey Department of Environmental Protection (NJDEP) to consider the application, the same must be endorsed by the Township among others; and
WHEREAS, the Township desires to authorize the execution of the endorsement of the said application.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey:
1. The Township hereby endorses a request for Treatment Works Approval for The Shoppes at Randolph located on Block 111, Lots 10, 11, 12, 13, 14, 15, and 16 on the official tax map of the Township or Randolph.
2. The Township Manager is hereby authorized and directed to execute the appropriate endorsements for the Treatment Works Approval, together with other appropriate officers and employees of the Township of Randolph and is hereby authorized to take all actions necessary to effectuate the purpose.
3. This resolution shall take effect immediately.
J. Authorizing Auto Parts Purchases From Somerset County Co-Op Contract CC-6507 Using Hoffman Services, Newark, NJ, for Hydraulic Lifting Jacks for the DPW—Not to Exceed $23,000.00

WHEREAS, the Township of Randolph will utilize Somerset County Cooperative Contract #CC-6507 from Hoffman Services, Newark, New Jersey, for the DPW; and
WHEREAS, funds are available for this purchase; and
WHEREAS, these purchases will not exceed $23,000.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to purchase from Somerset County Cooperative Contract #CC-6507 from Hoffman Services, Newark, New Jersey.
REVIEW AND SET PROPOSED AGENDA FOR JUNE 4, 2009, REGULAR MEETING—7:00 P.M.
Councilman Algeier reminded the Council that there will be an Art Show in Town Hall that evening.
Manager Lovell noted that there is a contract award on the agenda for janitorial services with Employment Horizons. The current provider of janitorial services has not been working out as desired. Employment Horizons comes very highly recommended.
Councilman Algeier asked about the Memorandum of Understanding with Morris Habitat for Humanity.
Manager Lovell responded that the item will most likely be pulled following discussions and issues raised by Morris Habitat. He is hopeful that the agreement can be wrapped up within a week and would like the Council to have adequate time for review. The Memorandum of Understanding would be placed on a July agenda.
OPEN TO PUBLIC
Judith Stewart, 114 Everdale Road, suggested the Council consult the Environmental Commission for advice on ways to minimize through development the effect on storm water and the pollution effects of landscaping. She would like to see an upgrade to the ordinances that govern development to suggest or to refer developers to conditions that would minimize lawn. Mrs. Stewart reiterated her displeasure with the current tree ordinance. She believes Randolph needs to maintain its green and remain a very livable community.
Seeing no one further from the public, the public portion was closed.
COUNCIL AND MANAGER COMMENTS
Councilman Algeier thought it was very nice that the Freeholders held their meeting in Randolph and hopes they consider returning.
Councilman Obremski reported that his family has adopted one of the cats rescued from a house in Chester.
Mayor Metz noted that the Freeholders did a good job at their meeting in Randolph. The Mayor attended a one-person percussion concert at the High School. It was very well attended and the student provided an awesome performance.
Deputy Mayor Alpert nominated Susan Scola to fill an unexpired term as a member on the Economic Development Committee. Councilman Obremski seconded the motion, and the following roll call vote was taken:
