A. OPENING OF REGULAR MEETING
1. Call to Order
A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Carey. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 2, 2016 by emailing them the annual resolution adopted by the Council on December 1, 2016. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph on December 8, 2016, and the Daily Record on December 6, 2016.

Mayor Carey led the Pledge of Allegiance.
B. OPEN TO THE PUBLIC
Seeing no one from the public, the public portion was closed.
C. MANAGER’S REPORT
Manager Mountain reported the following:
- Re-Launch of Randolph Local Website—the website will be re-launched within the next week. He has been working with the Economic Development Committee to revamp the old site; the new site will have a number of features which will promote the goals of highlighting the local businesses and encouraging people to shop local. There will be news items and once per month a business will be highlighted; it will still include the business index.
Councilwoman Veech stated that the township used to be able to use the billboard on Route 10, near South Salem Street, and asked how it is now being used. Manager Mountain explained that the township is given the ability to use the billboard a couple times per year; in the late summer/early fall it is used to promote the Country Fair, and in the winter months it is used to promote shopping local/Randolph Local. Going forward they plan to change the graphics on the billboard to match the new Randolph Local website. Councilwoman Veech asked who owns the billboard and who controls the use of it. Manager Mountain replied that it is a media company that owns it, and there was a settlement as to the use of it when it was determined that the billboard was located on property that they did not control.
- Volunteer Appreciation Event—a memorandum will be going out to the chair persons of the township boards and committees announcing the changes to the event. In order to have the entire Council in attendance, he asked the members to let him know if Tuesday, January 16 is a good date.
- Fall Emergency Management Test—the generators at the three complexes were tested successfully the previous week.
D. PRESENTATIONS
1. Police Awards
7:07 p.m.—Mayor Carey temporarily adjourned the meeting to allow the Manager and Council to move to the atrium for the police awards presentation.
Chief David Stokoe welcomed everyone. He also thanked the awards committee for their time and effort; the committee consisted of Detective Lieutenant Guiliani, Lieutenant Gomez, Detective Sergeant Donovan, Sergeant Mygas, Detective Edelman, and FOP President Richard Biase. The Chief explained the process for the recognition award. The Chief also thanked Gale Klatte for her work preparing for the ceremony.
Life Saving Award is awarded for an act performed in the line of duty, which through disregard for personal safety, or prompt and alert action results in the saving of a life.
First Incident: On August 1, 2016 Officer Coyle and Officer Puskas responded to Starlight Drive, as mutual aid to Morris Township for a male who was not breathing. Upon arrival, CPR was started and the AED was applied. Officer Puskas operated the AED and shocks were administered while Officer Coyle assisted in CPR with rescue breathing. The patient regained a pulse and was transported to the hospital.
Chief Stokoe presented Officer Robert Coyle and Officer Michael Puskas each with the Life Saving Award. The Chief noted that this was the second Life Saving Award for Officer Coyle, and the third for Officer Puskas.
Second Incident: On November 6, 2016 Officer Carbonaro and Officer Crowley responded to a report of a suicidal female, who was unconscious and not breathing. Upon arrival, Officer Crowley was unable to feel a pulse on the victim, and began CPR. Officer Carbonaro prepped the victim for the AED, specifically by drying her off as she had been in the bathtub. While administering aid, Officer Crowley then felt a pulse return to the victim after about a minute of chest compressions; the victim eventually began breathing on her own. The victim was transported to the hospital and was discharged several days later.
Chief Stokoe presented Officer Christopher Carbonaro and Officer Jeremiah Crowley each with the Life Saving Award. The Chief noted that this is the first Life Saving Award for Officer Carbonaro, and the second for Officer Crowley.
Third Incident: On March 7, 2017 Officer Verbist responded to Jared Drive for a report of a male possibly having a heart attack. Upon arrival, the victim was complaining of pain. EMS9 responded and began to prepare the victim to be transported to the hospital; the victim then became unresponsive. Officer Verbist placed the victim on the floor and began CPR. EMS9 prepared the AED and administered shocks to the victim. The victim eventually regained consciousness, was transported to the hospital, and was released two days later.
Chief Stokoe presented Officer Sean Verbist with the Life Saving Award; this is the second Life Saving Award for Officer Verbist.
The Ready Commendation is awarded to every officer who has successfully completed 15 years of service with the department. Chief Stokoe presented Officer Edward Shivas with the Ready Commendation Award.
The Educational Achievement Award is awarded to every officer who has successfully attained an associate’s degree or higher from an accredited college or university. The following officers all had degrees prior to starting employment with the Randolph Police Department. Chief Stokoe presented Officer Jamie Andersen, Officer Stephen Szilagyi, and Officer Nick Francica each with the Educational Achievement Award.
Chief Stokoe also recognized and thanked Crossing Guard Corina Wolfson for over twenty-five years of service; she will be retiring at the end of the year. The Chief wished Corina all the best for health and happiness as she begins the next chapter in her life, and presented her with a memento recognizing her years of service.
Chief Stokoe thanked everyone for attending. He also thanked everyone who has served our Country in a military capacity, and for preserving our way of life. He wished everyone a healthy, happy Thanksgiving and holiday season.

F. COMBINED ACTION RESOLUTIONS
Item #10, Morris County’s Special Regional Master—Councilman Tkacs asked for clarification. Keli Gallo explained that, as part of the declaratory judgement actions that are pending throughout the county, the county has appointed Richard Redding as the Special Regional Master. His job is to determine what each town’s affordable housing obligation is since COAH no longer exists. All the municipalities are being asked to contribute to Mr. Redding’s fees.

1. Release Road Opening Cash Bond for Repairing/Widening a Driveway at Block 221, Lot 30, 16 Bonnell Lane to Jenny Stevens—$500.00

WHEREAS, the Engineering Department has received a request from Jenny Stevens for the release of a $500.00 cash road opening bond posted for the purpose of repairing and widening the driveway at Block 221, Lot 30, 16 Bonnell Lane, Randolph NJ 07869; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on May 3, 2017; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the repairing and widening of the driveway at 16 Bonnell Lane, Randolph NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Jenny Stevens at 16 Bonnell Lane, Randolph NJ 07869.
2. Release Road Opening Cash Bond for Repaving the Driveway at Block 146, Lot 66, 71 Everdale Road to Julie Hooper—$500.00

WHEREAS, the Engineering Department has received a request from Julie Hooper for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at Block 146, Lot 66, 71 Everdale Road, Randolph NJ 07869; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on September 21, 2017; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the driveway at 71 Everdale Road, Randolph NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Julie Hooper at 71 Everdale Road, Randolph NJ 07869.
3. Release Road Opening Cash Bond for Connecting to the Township’s Water Service at Block 86, Lot 53, 52 Carrell Road to Jesse Dawson—$500.00

WHEREAS, the Engineering Department has received a request from Jesse Dawson for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the Township water service at Block 86, Lot 53, 52 Carrell Road, Randolph NJ 07869; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on January 10, 2017; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the connecting to the township water service at 52 Carrell Road, Randolph NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Jesse Dawson at 29 Palmer Street, Landing, NJ 07850.
4. Release Road Opening Cash Bond for Adding Belgian Block to the Driveway at Block 208.03, Lot 119.48, 15 Timber Lane to Anjal Shah—$500.00

WHEREAS, the Engineering Department has received a request from Anjal Shah for the release of a $500.00 cash road opening bond posted for the purpose of adding Belgian block to the driveway at Block 208.03, Lot 119.48, 15 Timber Lane, Randolph NJ 07869; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on October 16, 2017; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the adding of Belgian block to the driveway at 15 Timber Lane, Randolph NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Anjal Shah at 15 Timber Lane, Randolph NJ 07869.
5. Authorizing the Award of a Professional Services Agreement to Paul Ferriero Engineering for Meadowbrook Water Main Project Survey Work—Not to Exceed $17,000.00

WHEREAS, the Township of Randolph (“Township”) requires Meadowbrook Water Main project survey work; and
WHEREAS, the Township has agreed to retain Ferriero Engineering located at PO Box 571, 180 Main St, Chester, NJ 07930 to provide the necessary Meadowbrook Water Main project survey work for a total amount not to exceed $17,000; and
WHEREAS, the fees are as noted in the attached proposal; and
WHEREAS, the anticipated term of this contract is from November 16, 2017 through November 15, 2018; and
WHEREAS, the contract with Ferriero Engineering is for a total amount not to exceed $17,000 but since previous contract awards exceeding $17,500 have already been awarded to Ferriero Engineering, the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) do apply; and
WHEREAS, Ferriero Engineering has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification; and
WHEREAS, Ferriero Engineering has also submitted to the Township a New Jersey Business Registration Certificate, as required; and
WHEREAS, there are funds available for the retention of such professional services in account 04-215-55-987-300; and
WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:
- The Township hereby hires, employs and retains Ferriero Engineering having an office at PO Box 571, 180 Main St, Chester, NJ 07930 to provide Meadowbrook Water Main project survey work from November 16, 2017 through November 15, 2018.
- Ferriero Engineering shall be compensated for a total contract amount not to exceed $17,000.
- The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
- The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27 et seq.
- The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township, are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
- It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.
- This Resolution shall take effect immediately.
CERTIFICATION OF AVAILABILITY OF FUNDS

6. Authorizing the Award of a Professional Services Agreement to Ferriero Engineering for Design of a Gravity Sanitary Sewer System to Service Woodlawn Terrace and Schuman Road—Not to Exceed—$17,500.00

WHEREAS, the Township of Randolph (“Township”) requires design of a gravity sanitary sewer system to service Woodlawn Terrace & Schuman Road; and
WHEREAS, Elizabeth Crescibene, Purchasing Agent, has determined and certified in writing that the value of these services will be $17,500; and
WHEREAS, the Township has agreed to retain Ferriero Engineering located at PO Box 571, 180 Main St, Chester, NJ 07930 to provide the necessary design of a gravity sanitary sewer system to service Woodlawn Terrace & Schuman Road for a total amount not to exceed $17,500; and
WHEREAS, the fees are as noted in the attached proposal; and
WHEREAS, the anticipated term of this contract is from November 16, 2017 through November 15, 2018; and
WHEREAS, the contract with Ferriero Engineering is for a total amount not to exceed $17,500 and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and
WHEREAS, in accordance with the Anti Pay-to-Play Legislation, Ferriero Engineering has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and
WHEREAS, Ferriero Engineering has also submitted to the Township a New Jersey Business Registration Certificate, as required; and

WHEREAS, the Township of Randolph advertised for the Purchase and Delivery of One (1) New, Unused 2017 or Newer Portable Asphalt Reclaiming Machine with Water Tank, Containment System and Transport Trailer project in accordance with Local Public Contracts Law and received bids on September 20, 2017; and
WHEREAS, 1 bid was received; and
WHEREAS, the sole bid was received from the following for the bid price shown:
Asphalt Zipper, Inc., Pleasant Grove, UT: $132,890; and
WHEREAS, the Public Works Director and the Purchasing Agent recommend the award of the contract to Asphalt Zipper, Inc. as the lowest responsive, responsible bidder; and
WHEREAS, the Township of Randolph desires to award a contract for the Purchase and Delivery of One (1) New, Unused 2017 or Newer Portable Asphalt Reclaiming Machine with Water Tank, Containment System and Transport Trailer to Asphalt Zipper, Inc. of Pleasant Grove, UT in the amount of $132,890; and
WHEREAS, the Finance Officer has certified to the availability of funds for this project from 04-215-55-984-303 for $30,000.00 and 04-215-55-988-300 for $102,890.00 for a total of $132,890.00.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Asphalt Zipper, Inc. of Pleasant Grove, UT for the Purchase and Delivery of One (1) New, Unused 2017 or Newer Portable Asphalt Reclaiming Machine with Water Tank, Containment System and Transport Trailer project for the price of $132,890 per their bid proposal.

As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Darren Maloney, Director of Finance for the Township of Randolph, have ascertained that funds will be available in the General Capital Fund, Ordinance 11-17, Purchase Asphalt Zipper and Ordinance 22-17, Purchase Asphalt Zipper, to award a contract to Asphalt Zipper, Inc. for one asphalt zipper, per its response to a solicitation of bids by the Township.

8. Release Escrow Funds for Police Detail to Rockaway Township Education Foundation—$348.00

WHEREAS, the Finance Department received escrow funds for Police Detail.
WHEREAS, the Detail work has been completed.
THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey that it is recommended by the Finance Department that the escrow funds for the following amounts be refunded:
Rockaway Township Education Foundation $348.00
9. Authorizing Release of Escrow Funds Related to the Inspection of the Sussex Turnpike Sewer Project—$47,455.75

WHEREAS, the Township of Randolph (“Township”) and Pulte Homes of N.J., Limited Partnership, (“Developer”) entered into a certain Agreement dated December 1, 2015 entitled “Cost Sharing Agreement Off-Tract Improvement-Sussex Turnpike Project” (“Cost Sharing Agreement”); and
WHEREAS, the Cost Sharing Agreement was one of three Agreements related, among other things, to the construction of certain off-tract sanitary sewer improvements that would benefit both the Developer and the Township; and
WHEREAS, in general, the costs of the Project were to be pro-rated with the Township remitting 75% and the Developer remitting 25%; and
WHEREAS, in conjunction with the construction of the Project, the Developer was required to establish an Escrow Account with the Township to pay for the engineering inspection fees related to the Project; and
WHEREAS, the cost of the inspections were to be divided in the same manner as the Sussex Turnpike Project (25% attributable to the Developer and 75% attributable to the Township); and
WHEREAS, the Developer established an inspection fee escrow in the amount of $47,336.75 and with interest as of this month, the balance is now $47,484.25; and
WHEREAS, the total inspection fees related to the Sussex Turnpike Project were $79,524.00, 25% of which ($19,881.00) is to be paid by the Developer and the balance to be paid by the Township; and
WHEREAS, after reducing the escrow established by the Developer by the costs of the inspection fees, there is an excess amount of $27,455.75 in the Escrow Account; and
WHEREAS, the Township Engineer recommends that the balance of the funds in said Escrow Account be returned to the Developer inasmuch as all inspections for which the Escrow Fund was created have now been completed.
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Randolph, as follows:
- The balance of funds in Escrow Account #295077000 in the amount of $27,455.75 shall be remitted to the Developer and said account closed, all in accordance with a Memorandum from the Township Engineer, dated October 24, 2017, a copy of which is attached hereto and made a part hereof as Exhibit A.
- The Chief Financial Officer and all other employees, professionals and officers of the Township are hereby authorized and directed to take any and all steps necessary to effectuate the purposes of this Resolution.
- This Resolution shall take effect immediately.
10. Authorizing the Expenditure of $2,500 for the Purpose of Paying the Fees and Costs of Morris County’s Special Regional Master

WHEREAS, on July 2, 2015, the Township of Randolph (“Township”) filed a declaratory judgment action in the Superior Court of New Jersey entitled “In the Matter of the Application of the Township of Randolph for Declaratory Judgment,” Docket No. MRS-L-1640-15 (the “Declaratory Judgment action”); and
WHEREAS, on October 25, 2017, the Court entered an Order appointing Richard B. Reading as Morris County’s Special Regional Master (“Special Regional Master”) and appointing the law firm of Inglesino, Webster, Wyciskala & Taylor, LLC as the Escrow Agent (“Escrow Agent”) for the purpose of paying the fees and costs of the Special Regional Master (“Order”); and
WHEREAS, because several developers have intervened in the Declaratory Judgment action, the Court has ordered the Township to pay an initial escrow deposit of $2,500 to the Escrow Agent in connection with the fees and costs of the Special Regional Master, with an additional $2,500 escrow deposit to be paid by the intervening developers; and
WHEREAS, the Township desires to authorize the initial $2,500 escrow deposit to be paid to the Escrow Agent in accordance with the Order.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, they being the Governing Body thereof as follows:
- An initial escrow deposit in the amount of $2,500 is hereby authorized to be made by the Township of Randolph to the Escrow Agent for the purpose of paying the fees and costs of the Special Regional Master in accordance with the Court’s October 25, 2017 Order.
- This Resolution shall take effect immediately.
11. Authorizing Award and Rejection of MCCPC Contract #20A—Sporting Goods to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #20 (Sporting Goods); and
WHEREAS, bids had been advertised and received on October 4, 2017, in accordance with Local Public Contracts Law; and
WHEREAS, nine (9) bids were received; and
WHEREAS, Contract #20-A (Sporting Goods) is awarded on a line item basis; and
WHEREAS, the bid specifications state that vendors who do not provide catalogs or detailed literature when bidding equivalent items will be disqualified; and
WHEREAS, KTTA Enterprises (Extra Innings) in Mount Laurel, New Jersey, did not provide literature for items on which they were bidding a substitute, therefore the bids from Extra Innings for Items 3, 4 and 28 in Category A, Items 14 and 17 in Category B, Items 35 and 54 in Category H, and Items 2, 3 and 4 in Category I were disqualified; and
WHEREAS, the lowest responsive and responsible bidders for each line item contained in Contract #20-A (Sporting Goods) for the items and prices are shown on the attached Notification of Award for a one-year term with the following exceptions:
Category A: Baseball Equipment
Items 3 and 4: Little League International and Babe Ruth require Rawlings Tournament Grade. The apparent low bidder (Extra Innings) and apparent second low bidder (EJG Sports) do not meet the bid specifications, therefore it is recommended the items be awarded to R&R Trophy and Sporting Goods.
Items 5 and 6: The apparent low bidder (EJG Sports) mistakenly offered a price based on a single ball instead of the required price per dozen, therefore it is recommended the items be awarded to Triple Crown.
Item 22a: The apparent low bidder (S&S) did not offer a product that complied with the bid specifications, the apparent second low bidder (EJG) listed the incorrect item on their bid proposal form, and the apparent third low bidder (LeeZar) did not offer a product that complied with the bid specifications, therefore it is recommended the item be awarded to R&R Trophy and Sporting Goods.
Item 28: The products offered by the apparent low bidder (LeeZar) and apparent second low bidder (Metuchen Center) could not be found in the literature provided, therefore it is recommended the item be awarded to BSN.
Items 31 and 32: The products offered by the apparent low bidder (Metuchen Center) could not be found in the literature provided and the products offered by the apparent second low bidder (LeeZar) did not comply with the bid specifications, therefore it is recommended the items be awarded to BSN.
Item 48: The product offered by the apparent low bidder (BSN) did not comply with the bid specifications, therefore it is recommended the item be awarded to Triple Crown.
Category B: Playground Equipment & Supplies
Items 2 and 4: The products offered by the apparent low bidder (S&S Worldwide) did not comply with the bid specifications, therefore it is recommended the items be awarded to BSN.
Category G: Girls’ Softball Equipment
Item 6: League rules require Dudley softballs. The apparent low bidder (BSN) did not meet the bid specifications, therefore it is recommended the item be awarded to R&R Trophy and Sporting Goods.
Category H: Sports Clothing (Various)
Items 4 and 5: The products offered by the apparent low bidder (LeeZar) do not comply with the bid specifications, therefore it is recommended Item 4 be awarded to R&R Trophy and Sporting Goods and Item 5 be awarded to Extra Innings.
Items 21 and 22: The products offered by the apparent low bidder (Triple Crown) do not comply with the bid specifications, therefore it is recommended that Item 21 be awarded to R&R Trophy and Sporting Goods and Item 22 be awarded to Metuchen Center.
Item 28: The product offered by the apparent low bidder (S&S Worldwide) does not comply with the bid specifications, therefore it is recommended the item be awarded to EJG Sports.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the various bids noted above for Contract #20-A (Sporting Goods).
BE IT FURTHER RESOLVED that the Township Council on behalf of the MCCPC hereby authorizes the award of Contract #20-A (Sporting Goods) to the various vendors noted on the Notification of Award for the term January 1, 2018 - December 31, 2018.
12. Authorizing Award and Rejection of MCCPC Contract #22—DPW Uniforms/Work Shoes/Boots to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #22 (DPW Uniforms/Work Shoes/Boots); and
WHEREAS, bids had been advertised and received on October 5, 2017, in accordance with Local Public Contracts Law; and
WHEREAS, four (4) bids were received; and
WHEREAS, Contract #22 (DPW Uniforms/Work Shoes/Boots) is awarded based on the lowest aggregate total per category; and
WHEREAS, the bid submitted by Municipal Safety Supply in Quakertown, Pennsylvania, was nonresponsive because the mandatory Disclosure of Investment Activities in Iran form was not signed which is a non-curable, non-waivable defect and therefore the bid must be rejected; and
WHEREAS, the bid received for Category A from Keyport Army Navy must be rejected because the products being offered for Items 1 and 2 do not comply with the bid specifications; and
WHEREAS, there were no other bids for Category A; and
WHEREAS, Saf-Gard Safety Shoe Company in Pittsburg, Pennsylvania, was the lowest responsive and responsible bidder for Category B for the items and prices shown on the attached Notification of Award for a one-year term; and
WHEREAS, Keyport Army Navy in Brick, New Jersey, was the lowest responsive and responsible bidder for Categories C and D for the items and prices shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the bid submitted by Municipal Safety Supply and the bid for Category A submitted by Keyport Army Navy for the reasons stated above.
BE IT FURTHER RESOLVED that the Township Council on behalf of the MCCPC hereby authorizes the award of Contract #22 (DPW Uniforms/Work Shoes/Boots) to the Saf-Gard Safety Shoe Company and to Keyport Army Navy as noted above for the term January 1, 2018 - December 31, 2018.
13. Authorizing MCCPC Contract #11—Motor Oils and Miscellaneous Lubricants to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #11 (Motor Oils & Miscellaneous Lubricants); and
WHEREAS, bids had been advertised and received on October 4, 2017, in accordance with Local Public Contracts Law; and
WHEREAS, five (5) bids were received; and
WHEREAS, Contract #11 (Motor Oils & Miscellaneous Lubricants) is awarded to the lowest responsive and responsible bidder per category and the bid specifications state that bidders must bid on all items within the category for which they are submitting a bid; and

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #26 (Beam Guide Rail & Safety Ends—Installed); and
WHEREAS, bids had been advertised and received on October 5, 2017, in accordance with Local Public Contracts Law; and
WHEREAS, three (3) bids were received; and
WHEREAS, Contract #26 (Beam Guide Rail & Safety Ends—Installed) is awarded based on the lowest aggregate total of all “unit” prices;
WHEREAS, the bids were reviewed by the Engineering Department and Legal Counsel; and
WHEREAS, the bid of the apparent low bidder attempts to take unfair advantage of the manner in which the low bid is determined under the bid documents so as to increase the actual cost to the members by “penny bidding” (at $1.00 per unit) three items, the actual value of which is hundreds of dollars more than the $1.00 bid value attributed to them in the apparent low bidder’s bid; and
WHEREAS, it is recommended that the bid submitted by the apparent low bidder, J. Fletcher Creamer & Son in Hackensack, New Jersey, be rejected as being severely unbalanced, resulting in a projected increase in cost of more than $300,000.00 to the members of the MCCPC based upon the estimated quantities of the members, thereby thwarting the objectives of public bidding; and
WHEREAS, Road Safety Systems in Shamong, New Jersey, is the lowest responsive and responsible bidder for the items and prices shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the bid submitted by J. Fletcher Creamer & Son for the reason stated above.

16. Release of a Maintenance Bond for Public Improvements at Brightview at Randolph, Block 111, Lots 19, 20 and 21—$58,880.25

WHEREAS, Engineering has received a request from Brightview at Randolph to release the maintenance bond for the public improvements associated with the Brightview Development; and
WHEREAS, the Township Engineer by memo of November 19, 2017, has confirmed that the site inspection has been completed and all improvements are in satisfactory condition and recommends that the Maintenance Bond, No. 019-045-026, issued by Liberty Mutual Insurance, in the amount of $58,880.25 be released.
NOW, THEREFORE, BE IT, RESOLVED by the Mayor and Council of the Township of Randolph, that the Maintenance Surety Bond, No. 019-045-026 in the amount of $58,880.25, issued by Liberty Mutual, be released as recommended by the Township Engineer to Brightview at Randolph, LLC, 218 North Charles Street, Suite 220, Baltimore, MD 21201.
17. Release Road Opening Cash Bond for the Purpose of Connecting to the Township Sewer at 59 Everdale Road, Block 146, Lot 62 to Joseph Briganti—$500.00

WHEREAS, the Engineering Department has received a request from Joseph Briganti for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the Township sewer service at 59 Everdale Road, Randolph NJ 07869 BL 146/L 62; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on December 20, 2016; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the connection to the township sewer service at 59 Everdale Road, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Joseph Briganti at 1501 Sussex Turnpike, Randolph NJ 07869.
18. Authorizing Rescission of a Portion of MCCPC Contract #17 (items #16 and #23) Water Treatment Chemicals for the Remainder of the 2017 Year from Atlantic Coast Polymers

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #17 (Water Treatment Chemicals) for 2017; and
WHEREAS, bids were advertised and received on October 5, 2016, in accordance with Local Public Contracts Law; and
WHEREAS, the Township Council awarded Contract #17 (Water Treatment Chemicals) to various bidders on November 17, 2016, for a one-year term of January 1, 2017 - December 31, 2017; and
WHEREAS, Atlantic Coast Polymers in Austin, Texas, was awarded Items #16 and #23; and
WHEREAS, the MCCPC has discovered that the New Jersey Business Registration Certificate for Atlantic Coast Polymers is not valid at this time; and
WHEREAS, Atlantic Coast Polymers has been notified and is working with the State of New Jersey to correct the problem and have their Business Registration Certificate reinstated, however the reinstatement will not be completed before the end of the year; and
WHEREAS, it is recommended that the award of Items #16 and #23 in Contract #17 (Water Treatment Chemicals) be rescinded from Atlantic Coast Polymers for the remainder of the 2017 contract term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rescission of, and hereby rescinds, the award of Items #16 and #23 in Contract #17 (Water Treatment Chemicals) from Atlantic Coast Polymers for the reason stated above.
19. Authorizing the Award and Rejection to Various Bidders for MCCPC Contract #17—Water Treatment Chemicals for the Year 2018

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #17 (Water Treatment Chemicals); and
WHEREAS, bids had been advertised and received on October 4, 2017, in accordance with Local Public Contracts Law; and
WHEREAS, fifteen (15) bids were received; and
WHEREAS, Contract #17 (Water Treatment Chemicals) is awarded on a per line item basis; and
WHEREAS, the bid specifications state that, unless stated otherwise, minimum orders are not allowed; and
WHEREAS, Atlantic Coast Polymers in Austin, Texas, submitted a bid however it was discovered that their New Jersey Business Registration Certificate was not valid and their bid must be rejected; and
WHEREAS, Seidler Chemical in Newark, New Jersey, submitted a bid however they are currently undergoing a change in ownership and their paperwork relating to the change is not yet available and their bid must be rejected; and
WHEREAS, Universal Chemical in South Kearny, New Jersey, was the apparent low bidder for Item #1 in Contract #17 (Water Treatment Chemicals) however they subsequently contacted the MCCPC with the information that they bid the wrong item for Item #1, therefore the bid from Universal Chemical for Item #1 must be rejected; and
WHEREAS, the various lowest responsive and responsible bidders for the items and prices for Contract #17 (Water Treatment Chemicals) are shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection, and hereby rejects, the bids submitted by Atlantic Coast Polymers and Seidler Chemical as well as the bid for Item #1 submitted by Universal Chemicals as stated above.

BE IT RESOLVED, that an Ordinance entitled “AN ORDINANCE GRANTING NON-EXCLUSIVE PERMISSION AND CONSENT TO VERIZON WIRELESS TO USE ALL OF THE PUBLIC RIGHTS-OF-WAY AND PARTS THEREOF IN THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY FOR THE CONSTRUCTION, INSTALLATION, OPERATION, REPAIR, MAINTENANCE AND REPLACEMENT OF WIRELESS COMMUNICATIONS FACILITIES” be read by title on second reading and a hearing held thereon.
Manager Mountain explained that this ordinance allows Verizon Wireless the right to install wireless facilities on either existing infrastructure or to install the infrastructure in the right of way in the township.

BE IT RESOLVED, that an Ordinance entitled “AN ORDINANCE OF THE TOWNSHIP OF RANDOLPH APPROPRIATING $80,000 FROM THE WATER CAPITAL IMPROVEMENT FUND FOR THE MEADOWBROOK WATER PROJECT—$80,000” be read by title on second reading and a hearing held thereon.
Manager Mountain explained that this is a capital ordinance which funds the design cost associated with the planned Meadowbrook water project; it is a three phase water utility installation project to be completed over the next several years.

Manager Mountain explained that this is a capital ordinance which provides for the funding for the asphalt zipper; this is a machine that simultaneously mills and paves. This ordinance memorializes the shared agreement with Denville Township and Rockaway Township.

Manager Mountain explained that this is the annual fee ordinance that captures the changes in fees.

Judith Stewart of 114 Everdale Road stated that she felt the way the fees were written, specifically the Municipal code book and letter size page fees, was confusing. Manager Mountain and Mayor Carey tried to explain the way it was written, and the Mayor offered to provide more explanation after the meeting so Mrs. Stewart could better understand.

Manager Mountain explained that this is a capital ordinance which provides funding for the Calais Park project.

John Moore of 9 Dalrymple Street expressed his concern about the cost of the park, and asked why the taxpayers should pay more to improve the park. He felt there were not many people that use the trails; he felt it was not worth the expenditure. Mayor Carey explained that there is already a tax for open space and recreation; therefore, the funds for the park will come from that tax resulting in no additional tax for residents. The Mayor further explained that in 1992 there was a referendum, and residents approved the open space and recreation tax; every year this money is set aside for park improvements and open space acquisitions. Manager Mountain added that another large scale project, Freedom Park, has been retired, resulting in the capability in the township’s borrowing capacity. Manager Mountain and Mayor Carey provided more detail on the annual open space and recreation tax. Deputy Mayor Forstenhausler added that the township website includes a chart that shows the current balance in the fund, the debt the township is incurring, and the payment schedule.
Mr. Moore asked if the proposed land acquisition near the Mount Freedom Golf center was part of this. Mayor Carey explained that it is not part of the Calais Road park project, but the money would come out of the open space trust fund. Mr. Moore felt the township did not really need that additional property. Manager Mountain explained that approximately 14 acres of the property adjacent to the golf center was purchased as fee simple. The remainder of the property will continue to be owned by the golf center; however, the township purchased the development rights.

K. COUNCIL COMMENTS
Councilman Napoliello reported that a resident called him one evening to say that a Verizon Fios representative had come to her door and that she was uncomfortable with the solicitation on her property. He spoke with Manager Mountain, who then contacted the resident. The resident understood that the person was allowed to solicit since he had a permit and was following the township’s ordinance; however, she felt solicitors should not be permitted at all in the township. The Manager explained to her that there were other factors involved, not just the local ordinance; the resident still wanted him to address her concern with the entire Council. He discussed the resident’s concern with Township Attorney, Keli Gallo, and asked her to speak to the Council. Attorney Gallo explained that there is a lot of Supreme Court case law, and there is not much that can be done. Mayor Carey asked for clarification as to the township’s ordinance restrictions. Manager Mountain explained that soliciting can take place between 8:00 a.m. and 7:00 p.m., they must complete a background check, and pay a fee. If residents have a no soliciting sign, or ask to be on a “no-soliciting” list, the solicitors must comply. If the solicitor does not comply, the resident can call and township staff would follow up with a call to the solicitor. Attorney Gallo added that there sometimes are people who check to make sure that towns are allowing solicitation. Manager Mountain stated he would contact this particular resident and suggest she put a sign at her house. Deputy Mayor Forstenhausler asked if a generic blurb could be place on the website explaining that solicitors will be in the township occasionally and the various parameters that they must follow. The Manager felt that could be done, and possibly an email blast. Attorney Gallo added that members of religious organizations do not need to obtain solicitor’s permits, but may solicit at any time.
Councilman Tkacs explained that he is on the County Freight Railways Advisory Committee (FRAC). They awarded a new five year contract to a new management company for the Dover and Rockaway line; the company is the owners of the rail line that goes from Flemington to Lambertville.
Councilman Tkacs also reported that he and other Council members attended the grand opening of the Randolph Pharmacy; as a past member of the EDC, he was glad to see another new business in the township.
Councilwoman Veech reported that the Morris County Strategic Planning effort will have an open public forum on Wednesday, November 29 from 6:00 p.m. to 8:00 p.m. at the Morris County Library. They also have a web page on the Morris County website which includes an online survey. They will be advertising the forum and the survey through press releases and social media. They will be outlining for the public the objectives of the strategic plan for the county. Councilwoman Veech will attend the forum, and she invited other Council members to attend. She explained that it is like a master plan for development, targeting how to help the county with the finances over the next ten years, hiring practices, and where they should allocate their funds. Councilwoman Veech had asked Manager Mountain to provide her with items that he felt the county should focus on; he suggested public transportation, employability of students from County College of Morris, and EDC, specifically vacant properties.
Deputy Mayor Forstenhausler reported that a resident spoke to him because he tried to pay his taxes on the grace period deadline of November 10, but the offices were closed for the Veteran’s Day holiday. Manager Mountain confirmed that when the grace period ends on a holiday or weekend, the deadline is then the next business day.
Deputy Mayor Forstenhausler attended the Veteran’s Day ceremony, and was privledged to be asked to speak; the ceremony was very nice and well attended. He and other Council members also attended the fire inspection and dinner on November 11, and the NJ State League of Municipalities conference in Atlantic City.
Mayor Carey added that the Fire Chief made some changes to the program this year, he made a movie and live-action “event,” and had the Council members ride on fire trucks and fire engines from fire station to fire station.
Councilman Napoliello commented on the number of people that now attend the VFW ceremonies. He reported that there used to be only a dozen or so, and now there are over 100. Councilwoman Veech felt it might be related to the programs being advertised on TAPinto Randolph and the Randolph Reporter, and residents being more aware. Mayor Carey commended the VFW on their programs.
Mayor Carey reported that the Library Board of Trustees plans to replace the gazebo behind the library; however, excavation work needs to be done before the new gazebo can be placed due to the unstable ground that was once the pool for the Ackerman Hotel. Manager Mountain explained that the township is working with the architect to determine if the project can be scaled down so the excavation does not need to be as large. There will be a meeting on November 21 to discuss the plan with the Manager, some of the trustees, and township staff.
Councilman Guadagno noted that the library bond issue passed in the state; he asked what the Randolph Township Library was going to do to collect some of the state funds. Mayor Carey replied that they discussed that the bond issue was on the ballot, but they did not discuss how they would collect funds. She will address the issue at the next Library Board of Trustees meeting.
