A. OPENING OF REGULAR MEETING
1. Call to Order
A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Forstenhausler. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 17, 2017 by emailing them the annual resolution adopted by the Council on October 10, 2017. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph on November 23, 2017, and in the Daily Record on November 21, 2017.

Mayor Forstenhausler led the Pledge of Allegiance.
B. PRESENTATIONS/PROCLAMATIONS
1. Presentation by Rescue Squad President Steve Jancarek: Recognition of Rescue Squad Members for “Live Saves”
Rescue Squad Sergeant Caitlin Costello recognized the following Squad members:
- 2 CPR saves: Todd Houston, Jason Bell, George Houston, Kevin Fennell, Cameron Record, Bryan Manfred, Larry Melone
- 1 CPR save: Megan Holt, Caitlin Costello, John Freudenberg, Adam Glauberg, Ramon Lopez, Jenna Luciano, Mary Luciano, Kellie Montalto, Jared Sousa, Harold Katchen
- Stroke save: Caitlin Costello, Marc Moffitt, Ben Palmer—the patient was at the meeting and thanked the Squad for their quick response and efforts.
There was a short break.
2. Fire Department Presentation—Engine 52 Replacement Proposal
Chief Tony Moschella distributed a copy of the presentation, and introduced Past Chief Steve Cohrs and Project Chairman and Assistant Chief at Shongum Fire Company 5, Jeff Novak.
Steve explained the current situation, township needs and ISO, specification process and committee approach, supplier analysis, and the recommendation/next steps.
The recommendation/next steps include:
- EVI as Support 54 supplier (Ford F550 chassis)
- Fully meets specification requirements
- Proposal within Capital Budget
- Seeking approval to purchase
- Remaining project items:
- Approve Resolution to purchase
- Issue Purchase Order

Deputy Mayor Loveys asked what becomes of old Engine 52. Steve Cohrs replied that engines have been sold or traded in the past.
The Deputy Mayor also asked how to prevent change orders. Steve Cohrs replied that he and Chief Moschella managed the budget for the last purchase, and they have created the budget the same way. He explained that there will be change orders; however, the cost will remain within budget. Manager Mountain added that there was a lot of work done at the construction stage of the previous purchase to maintain the cost.
Attorney Ed Buzak asked if this purchase was available through a co-op; Steve Cohrs responded that it was, through the Houston-Galveston Area Council. Manager Mountain added that a lot was learned from the last purchase, and that Steve Cohrs worked with Purchasing Agent, Liz Crescibene, following the same procedural items.
Attorney Buzak asked about the anticipated delivery time. Steve Cohrs replied that it takes a little less than one year, it is contingent on when Ford can deliver chassis and cab to the manufacturer, but it should be 8 to 10 months from when the purchase order is issued.
Mayor Forstenhausler clarified that they were requesting approval on the $277,000 for the vehicle and at a later date spending the other $23,000; Steve Cohrs replied that it was correct.
Mayor Forstenhausler asked for clarification on the bidding process and the co-op if one vehicle is less than the other. Manager Mountain explained that under the co-op and contracting rules, the price can be considered, even though it is higher; they just needed to demonstrate that the NJ contract was looked at as an option, and provide valid reasons for why the Houston-Galveston Area Council was chosen. It is not a low bid situation, it can be based on a combination of the price and the specification.
Councilman Guadagno asked why the amount in the Resolution is for $267,484.00, and not the full amount. Steve Cohrs replied that the difference between that amount and the $277,000.00 is the cost of travel for the two meetings. Once the purchase order is issued, there are two trips; they meet with the supplier in the beginning and again at the end to make sure they complied. This supplier is in Florida.
C. OPEN TO THE PUBLIC
Rachita Chandak of 6 Brookview Circle stated that she wanted to create awareness in the town of the upcoming Indian American holiday, Diwali. Ms. Chandak provided the Council with an explanation of the holiday. She asked that the Council help build awareness of Diwali. She provided a draft resolution explaining the significance of Diwali and recognizing November 7th as Diwali Awareness Day in Randolph. She explained that a number of community members, whose names were attached to the draft resolution, supported the request.
Councilman Guadagno asked Ms. Chandak if she was inviting the Council to a service. She replied that there was an event coming up on Sunday, November 18 at the Randolph Community Center. She would send an email with the invitation to Mayor Forstenhausler, and he would distribute it to the Council.
Judith Stewart of 114 Everdale Road expressed her appreciation for the number of volunteer first responders who dedicate themselves and their time to the community.
Seeing no one further from the public, the public portion was closed.
D. MANAGER’S REPORT
Manager Mountain reported the following:
- He noted that the members of the Fire Department are volunteers. He explained that those who presented the information on the purchase of the new fire truck put in time above and beyond their regular duties. He commended all of the volunteer first responders in the community.
- DOT plan for the Randolph section of Route 10—he, Mayor Forstenhausler, Deputy Mayor Loveys met with the DOT, as well as staff and representatives from the County Engineer’s office, and the township’s Traffic Advisory Committee (TAC) Chairperson. He explained that it was a long and somewhat frustrating meeting. The state indicated that they are not ready to proceed with the township’s alternative recommendations for improvements to the Canfield Ave and Dover Chester Road intersection as an alternative to what they had proposed as part of their preliminary plan for the Center Grove Rd intersection. They are taking the position that it was originally a paving and drainage project and that the intersection improvement at Center Grove Road was added at the township’s request; the input given by the township, because it did not endorse what was proposed in the preliminary plan, was taken as the township opposing it. After much debate, the township agreed, at the state’s recommendation, to submit a separate set of problem statements, which is the state’s term for setting in motion a plan for a new project for the intersections. The state is unwilling to accept further amendments under the existing project. Township staff and Council fought hard to keep intact the Center Grove Road improvement piece, but with other recommended alterations with further communication between the township and the DOT. The state allowed that project to remain open, as well as an alternate suggestion which would allow the township to request the monies that were set aside for that element of the improvement project being earmarked to go toward the future project involving all four intersections if that was how it was to proceed as a new project. The Manager, Mayor Forstenhausler, and Deputy Mayor Loveys decided that there would be some discussion with the legislative delegation as far as other available options. The plan now is to submit the problem statements; it will require a set of supporting resolutions from the Council, a resolution from the Freeholders, as well as endorsement letters from the TAC and the Police Department.
- Assistant Director for Parks, Recreation, and Community Services position—several good resumes were received. He and Russ Newman will conduct interviews in the coming weeks, with the plan to have the person selected by mid-November.
- Brundage Park Playhouse improvements—first phase is underway, which includes replacement of flooring, carpeting, and the installation of new seats. This phase should be completed by the end of November, in time for the scheduled holiday shows.
Councilwoman Veech asked about the progress of Veterans Community Park. Manager Mountain replied that the contractor has begun earth movement. The contractor is not moving as aggressively as the township would like, but Paul Ferriero is on him every day. Councilwoman Veech asked if there was any recourse; the Manager stated that there was recourse and they are moving on it.
Councilman Guadagno asked if the state also denied the left lane turn expansion on Center Grove Road. Manager Mountain explained that some of what the state proposed on paper would technically not be possible; they did not have topography and other elements in their preliminary design. He explained that they told the state if they weren’t going to accept other alternatives, then build the improvement, but build it with the township’s comments incorporated. The current project that is on the books will not happen until at least 2023. He explained that they have used the legislative delegation once before; he felt the township was at a point to bring them in again. There was more discussion on the various issues that arose in the meeting with the state. Another meeting is scheduled.
Councilman Tkacs asked if Dover Chester Road was being repaved this year. Manager Mountain replied that the County has it scheduled for 2019.

1. Approval of September 6, 2018 Regular Minutes
Deputy Mayor Loveys made a motion to approve the September 6, 2018 Council meeting minutes. Councilwoman Veech seconded the motion, and the following roll call vote was taken:

F. COMBINED ACTION RESOLUTIONS
Item #27, Authorizing the cancellation of certain accounts payable—Councilmen Guadagno and Tkacs asked for clarification. Manager Mountain explained that if there are balances left once a project is completed, and there is nothing further to pay, the accounts are closed out and the money goes back in the general fund.
Item #28, Council meeting dates for 2019—Councilwoman Veech asked if the May 23, 2019 meeting could be moved to May 16, 2019 since it is the Thursday before Memorial Day weekend. Manager Mountain stated that there was no reason in particular that the meeting had to be May 23rd. The Council was agreeable to change that meeting date to May 16, 2019.
1. Release Cash Road Opening Bond for the Purpose of Repaving a Driveway at 52 Misty Mountain Road, Block 219, Lot 10 to Kate Mathe—$500.00

WHEREAS, the Engineering Department has received a request from Kate Mathe for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at 52 Misty Mountain Road, Randolph, NJ 07869 (BL 219/L 10); and
WHEREAS, the road opening bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on June 5, 2018; and
WHEREAS, the applicant was required to post this cash bond to guarantee the repaving of the driveway at 52 Misty Mountain Road, Randolph, NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the cash road opening bond in the amount of $500.00 be refunded to Kate Mathe at 52 Misty Mountain Road, Randolph, NJ 07869.
2. Release of Police Detail Escrow to Sawyer Lyons GMC—$87.00; Advanced Fiberworks—$130.50; Eagle Rock Utility Services, Inc.—$87.00; High Point Utilities—$106.00; and Sun High Orchards, LLC—$47.50

WHEREAS, bids had been advertised and received on October 4, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, six (6) bids were received; and
WHEREAS, Contract #6 is awarded to the lowest responsive and responsible bidder by category, however for this contract Categories A, B, and G are combined for one award due to the logistics of the contract; and
WHEREAS, there were no bidders for Categories D and E; and
WHEREAS, Tilcon New York, Inc. in Parsippany, New Jersey, was the lowest responsive and responsible bidder for Categories A, B and G for the items and prices shown on the attached Notification of Award for a one-year term; and

4. Authorizing the Rejection of a Bid from BWE, LLC and Award to Bi-Lo Industries for the MCCPC Contract #8—Anti-Freeze

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #8 (Anti-Freeze); and
WHEREAS, bids had been advertised and received on October 4, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, three (3) bids were received; and
WHEREAS, Contract #8 is awarded to the lowest responsive and responsible bidder for the lowest aggregate total of all items; and
WHEREAS, the bid specifications clearly state that a vendor cannot establish a minimum order requirement; and
WHEREAS, BWE, LLC in Manchester, New Hampshire, was the apparent low bidder however the bid proposal indicated that minimum purchases were required for several items, and therefore the bid must be rejected as non-responsive; and
WHEREAS, Bi-Lo Industries in Deer Park, New York, is the lowest responsive and responsible bidder for the items and prices shown on the attached Notification of Award for a one-year term
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the bid submitted by BWE, LLC for the reason stated above.
BE IT FURTHER RESOLVED that the Township Council hereby authorizes the award of Contract #8 (Anti-Freeze) to Bi-Lo Industries as noted above and on the attached Notification of Award for the term January 1, 2019 - December 31, 2019.
5. Authorizing the Award of MCCPC Contract #14—Catch Basins & Manhole Castings to General Foundries, Inc., a Campbell Foundry Company

6. Authorizing the Rejection of a Bid from Southern Computer Warehouse and Awarding to W.B. Mason and The Office Concepts Group for MCCPC Contract #16—Office Supplies

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #16 (Office Supplies); and
WHEREAS, bids had been advertised and received on October 4, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, three (3) bids were received; and
WHEREAS, Contract #16 is awarded by category based on the highest percentage discount offered; and
WHEREAS, Southern Computer Warehouse in Marietta, Georgia, did not bid on a hard-copy catalog as required in the bid specifications and they did not bid a specific discount for those categories on which they bid, therefore their bid must be rejected as non-responsive; and
WHEREAS, W.B. Mason in Secaucus, New Jersey, and The Office Concepts Group in Midland Park, New Jersey, were the responsive and responsible bidders offering the highest percentage discounts for each category as shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection of, and hereby rejects, the bid submitted by Southern Computer Warehouse for the reasons stated above.

7. Authorizing the Award of MCCPC Contract #21—Oil and Stone Treatment to the Morris Asphalt Company

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #39 (Furnishing Trophies & Plaques); and
WHEREAS, bids had been advertised and received on October 5, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, one (1) bid was received; and
WHEREAS, Contract #39 is awarded by catalog based on the highest percentage discount offered; and
WHEREAS, two of the catalogs specified in the bid proposal (Ovation and Recognizing Success) have been discontinued, therefore there is no award for those catalogs; and
WHEREAS, TJ’s Sportwide Trophy & Awards, Inc. in Randolph, New Jersey, was the responsive and responsible bidder offering the highest percentage discounts for each of the catalogs as shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the award of Contract #39 (Furnishing Trophies & Plaques) to TJ’s Sportwide Trophy & Awards, Inc. as noted on the attached Notification of Award for the term January 1, 2019 - December 31, 2019.
14. Authorizing the Award of MCCPC Contract #52—Fire Alarms, Sprinklers, Standpipe Systems, Fire Pumps to Fire and Security Technologies and to Absolute Protective Systems, Inc.

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #52 (Fire Alarms, Sprinklers, Standpipe Systems, Fire Pumps); and
WHEREAS, bids had been advertised and received on October 5, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, six (6) bids were received; and
WHEREAS, Contract #52 is awarded to the lowest responsive and responsible bidder per category based on the hourly rates; and
WHEREAS, Fire and Security Technologies (FAST) in Lebanon, New Jersey, is the lowest responsive and responsible bidder for Category A for the items and prices shown on the attached Notification of Award for a two-year term; and
WHEREAS, Absolute Protective Systems, Inc. in Edison, New Jersey, is the lowest responsive and responsible bidder for Category B for the items and prices shown on the attached Notification of Award for a two-year term.

WHEREAS, bids had been advertised and received on October 5, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, two (2) bids were received; and
WHEREAS, Contract #23 is awarded to the lowest responsive and responsible bidder per category; and
WHEREAS, Universal Uniform Sales Company, Inc. in Morristown, New Jersey, is the lowest responsive and responsible bidder in all categories for the items and prices shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the award of Contract #23 (Police Uniforms and Equipment) to Universal Uniform Sales Company, Inc. as noted above and on the attached Notification of Award for the term January 1, 2019 - December 31, 2019.
16. Requesting the Approval of Insertion of Items of Revenue and Appropriations into the 2018 Budget per NJSA 40A:4-87—Drunk Driving Enforcement Fund Grant—$9,161.93

WHEREAS, NJSA 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item has been made available by law and the amount was not determined at the time of the adoption of the budget; and
WHEREAS, the Director may also approve the insertion of an item of appropriation for an equal amount.
NOW, THEREFORE, BE IT RESOLVED, that the Council of the Township of Randolph, in the County of Morris, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2018 in the sum of $9,161.93, which is now available from the FY 2018 Drunk Driving Enforcement Fund Grant in the amount of $9,161.93.
BE IT FURTHER RESOLVED, that the like sum of $9,161.93 is hereby appropriated in the 2018 budget under the caption Drunk Driving Enforcement Fund Grant 2018; and
BE IT FURTHER RESOLVED, that the above is the result of funds from the State of New Jersey’s Division of Motor Vehicle’s 2018 Drunk Driving Enforcement Fund Grant in the amount of $9,161.93.

NOW, THEREFORE, BE IT RESOLVED, that the Council of the Township of Randolph, in the County of Morris, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2018 in the sum of $11,505.00, which is now available from the FY 2018 US Department of Justice Bulletproof Vest Partnership Grant; and
BE IT FURTHER RESOLVED, that the like sum of $11,505.00 is hereby appropriated under the caption 2018 US Department of Justice Bulletproof Vest Partnership Grant; and
BE IT FURTHUR RESOLVED, that the sum of $11,505.00 representing the amount required for the municipality’s share of the aforementioned undertaking or improvement, as it appears in the capital fund’s Ordinance #06-18 Purchase Soft Body Armor and Ordinance #08-17 Purchase Soft Body Armor, is hereby appropriated as the town match for said purpose; and

19. Authorizing the Purchase of a New Fire Service Apparatus, the ID03 Ford F-550, 4-Door Single Axle 12’ Non-Walk-In Rescue from Emergency Vehicle Inc.—$267,484.00

WHEREAS, the Township of Randolph may, as a contracting unit, without advertising for bids, purchase any materials, supplies or equipment through the use of a nationally-recognized and accepted cooperative purchasing agreement that has been developed utilizing a competitive bidding process by another contracting unit within the State of New Jersey, or within any other state; and
WHEREAS, the Council has, by separate resolution, authorized the Township to enter into a Cooperative Purchasing Agreement with the Houston-Galveston Area Council (“H-GAC”) for the purchase of fire service apparatus; and
WHEREAS, the Township’s Purchasing Agent has reviewed the bidding process of the H-GAC with regard to the purchase of a new fire service apparatus and determined that H-GAC has met the requirements of using a fair and open process and that the use of the H-GAC will result in cost savings, after all factors have been considered; and
WHEREAS, a Notice of Intent to Award Contract under a National Cooperative Purchasing Agreement was published on October 22, 2018 in The Morris County Daily Record and posted on the Township’s website; and
WHEREAS, Emergency Vehicle Inc.’s ID03 Ford F-550 4-door single axle 12’ non-walk-in rescue meets the requirements of the Fire Department; and
WHEREAS, the Township Council authorizes the purchase of Emergency Vehicle Inc.’s ID03 Ford F-550 4-door single axle 12’ non-walk-in rescue through the H-GAC for the total contract award price of $267,484 which includes the price of a performance bond ($2,978), NJ Delivery of Apparatus ($3,420) and pre-delivery service ($992); and
WHEREAS, the Finance Officer has certified to the availability of funds for this project from account 04-215-55-995-302.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, as follows:
- The purchase of Emergency Vehicle Inc.’s ID03 Ford F-550 4-door single axle 12’ non-walk-in rescue through the Houston-Galveston Area Council for the contract award amount of $267,484 in accordance with and pursuant to H-GAC contract FS12-17 dated December 1, 2017 through November 30, 2019 is authorized.
- The Mayor and Township Clerk are authorized to execute any and all documents, including H-GAC agency information documentation, necessary for the purchase of Emergency Vehicle Inc.’s ID03 Ford F-550 4-door single axle 12’ non-walk-in rescue.
- This Resolution shall take effect immediately.

WHEREAS, the Engineering Department has received a request from TNJ Landscaping for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the Township catch basin at 126 Shady Lane, Randolph, NJ 07869 (BL 221/L 20); and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on June 4, 2018; and
WHEREAS, the applicant was required to post this cash bond to guarantee the connection to the Township catch basin at 126 Shady Lane, Randolph, NJ 07869, within the Township Right of Way; and
WHEREAS, the Engineering Department has inspected the road opening work and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the cash road opening bond in the amount of $500.00 be refunded to TNJ Landscaping at 47 Carrell Road, Randolph, NJ 07869.

WHEREAS, the apparent second low bidder, Integrity Facility Service, Inc., provided a Bid Bond and a Consent of Surety that were not signed by their Surety Company, thus making these mandatory non-waivable, non-curable defects; and
WHEREAS, the third apparent low bidder, Divine Professional Cleaning Services, Inc., provided a bid bond that was not signed by the Principal, thus making this a mandatory non-waivable, non-curable defect; and
WHEREAS, Divine Professional Cleaning Services, Inc. also indicated no addenda were issued on the mandatory Acknowledgement of Revisions and Notices form but an addendum was, in fact, issued thus making this a mandatory, non-waivable, non-curable defect; and
WHEREAS, the Buildings & Grounds Supervisor and the Purchasing Agent recommend the award of the contract to Best Cleaning Building Service Inc. as the lowest responsive, responsible bidder; and
WHEREAS, the Township of Randolph desires to award a contract for the 2019 Janitorial Services to Best Cleaning Building Service Inc. of Ridgefield, NJ in the amount of $58,800.00 for the period of January 1, 2019 through December 31, 2019 with the option to extend the contract for an additional year for the same bid price if the services are being performed in an effective and efficient manner and funds are appropriated in the subsequent year’s budget; and
WHEREAS, the Finance Officer has certified to the availability of funds for this project from 01-201-26-310-306 pending approval of the 2019 budget.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Best Cleaning Building Service Inc. of Ridgefield, NJ for the 2019 Janitorial Services project for the price of $58,800.00 per their bid proposal for the period of January 1, 2019 through December 31, 2019 with the option to extend the contract for an additional year for the same bid price if the services are being performed in an effective and efficient manner and funds are appropriated in the subsequent year’s budget.

24. Authorizing the Rejection from Several Bidders and the Award to Eastern Concrete Materials, Inc. and Tomco Construction Inc., for MCCPC Contract #9—Crushed Stone, Gravel, and Sand

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #9 (Crushed Stone, Gravel and Sand); and
WHEREAS, bids had been advertised and received on October 4, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, four (4) bids were received; and
WHEREAS, Contract #9 is awarded to the lowest responsive and responsible bidder per sub-category in each category; and
WHEREAS, the bid specifications state that bidders are to bid on all items within the sub-category for which they are bidding, however if an item is not bid on by all bidders, that item would be eliminated and the remaining items will be used to determine the lowest responsive and responsible bidder; and
WHEREAS, there are four separate items in Sub-Category C in Categories I and II; and
WHEREAS, the three bidders (Tomco Construction, Tilcon New York and Stavola Construction) who bid on that sub-category each bid on different items thereby eliminating all four items from a possible award, therefore Sub-Category C in Categories I and II will not be awarded; and
WHEREAS, there were no bids for Sub-Categories B and D in Category II; and
WHEREAS, Eastern Concrete Materials, Inc. in Saddle Brook, New Jersey, is the lowest responsive and responsible bidder for Sub-Category A in Categories I and II for the items and prices shown on the attached Notification of Award for a one-year term; and

WHEREAS, bids had been advertised and received on October 5, 2018, in accordance with Local Public Contracts Law; and
WHEREAS, seven (7) bids were received; and
WHEREAS, Contract #41 is awarded by line item based on the highest percentage discount offered; and
WHEREAS, there was a tie bid for Item #7 between Spectrum Communications and Atlantic Communications and, as stated in the bid specifications, a name drawing was held to determine the award for that item; and
WHEREAS, Atlantic Communications in Lake Hopatcong, New Jersey, Triangle Communications in Scotch Plains, New Jersey, Spectrum Communications in Kenvil, New Jersey, Northeast Communications in Wharton, New Jersey, and Communications Specialists in East Brunswick, New Jersey, were the responsive and responsible bidders offering the highest percentage discounts for each item as shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the award of Contract #41 (Purchase of Communications Equipment—Radios) to Atlantic Communications, Triangle Communications, Spectrum Communications, Northeast Communications and Communications Specialists as noted on the attached Notification of Award for the term January 1, 2019 - December 31, 2019.

WHEREAS, N.J.S.A. 10:4-6 et seq., known as the “Open Public Meetings Act” requires that all public bodies of the State of New Jersey provide adequate notice to the public of its intended meetings.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY, AS FOLLOWS:
1. The regular meetings of the Township Council for the Township of Randolph to discuss or act upon public business during the calendar year 2019 will be held on Thursdays on the dates listed below. Regular meetings and work session meetings are scheduled to begin at 7:00 p.m. prevailing time. The public is invited to attend work sessions, but there is no public participation except at the beginning of the meeting during the “Open to the Public” portion of the agenda. Final action may or may not be taken at all scheduled meetings which are held at the Randolph Township Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey, on the following dates:

2. This Resolution shall, within seven days of its adoption, be emailed to the Randolph Reporter, the official newspaper designated by the Randolph Township Council, and to the Daily Record.
3. A certified copy of this said Resolution shall also be maintained throughout the year 2019 on the bulletin board located immediately adjacent to the Municipal Clerk’s Office in the main hallway of the Municipal Building.
4. A certified copy of this said Resolution shall be mailed to any person requesting notices of meetings of the Township Council pursuant to N.J.S.A. 10:4-19 and whoever has paid the required fee for such notice.

H. DISCUSSION ITEMS
1. Manager/Clerk Evaluation Process and Dates—Deputy Mayor Loveys
Mayor Forstenhausler explained that Deputy Mayor Loveys agreed to facilitate the process.
Deputy Mayor Loveys explained that the performance evaluations consist of several different factors; each factor is rated on a scale of 1-5. He will distribute the evaluations to the Council November 8th or 9th via email; Council members should return the completed evaluations to him by November 26th. Deputy Mayor Loveys will compile the results, and distribute to the Council the beginning of the week prior to the December 6th meeting. The Executive Session of the December 6th Council meeting will include the review of the evaluations with Manager Mountain and Donna Luciani. He asked that both submit their self evaluations for 2018 and their goals for 2019. Deputy Mayor Loveys will forward the self evaluations and goals to the Council at the same time he forwards the compilation of the performance evaluations. He explained that there will be blank copies available for the public to view.
I. OPEN TO THE PUBLIC
Judith Stewart of 114 Everdale Road stated that the public was not given a copy of the blank performance evaluation with enough time to bring their concerns to the Council prior to the start of the evaluation process. She asked that in the future, it be provided to the public earlier.
Mrs. Stewart also stated that she was pleased that the League of Women Voters held public information sessions for the candidates for the Board of Elections and the Township Council.
Seeing no one from the public, the public portion was closed.
J. COUNCIL COMMENTS
Councilman Guadagno reported that the Jersey City Water & Sewer issue was settled today in the courts; he had not yet read through it, but he understood that it was favorable. Manager Mountain added that he spoke with Attorney Buzak, and he will present the information at the next Council meeting; Attorney Buzak provided the Manager with a summary which he will forward to the Council.
Councilman Tkacs reported that he and Manager Mountain attended the unity meeting at Temple Shalom in Succasunna; it was very nice, with the rabbi and the ministers from a couple local churches leading the service.
Councilwoman Carey attended the MAC met last week; upcoming events include a suicide prevention program on November 13th at 7:30 p.m. at Resurrection Parish. She also reported that the police department was hosting another “Coffee with a Cop” program on November 14th at A&B Bagel on Sussex Turnpike between 8am and 10 am. The police department is also hosting Movie Night at Randolph High School on December 7th featuring the movie “Elf.” Councilwoman Carey also reported that MAC has invited Matt Bellace back for a program, but a date has not yet been chosen.
Deputy Mayor Loveys reported that he and Mayor Forstenhausler attended two solidarity and remembrance services; one at Adath Shalom in Parsippany and one at the Mount Freedom Jewish Center. They were very moving ceremonies. Mayor Forstenhausler added that he spoke at both ceremonies. He also added that the police department immediately took action after the incident in Pittsburgh.
Mayor Forstenhausler reminded everyone about the significant fire in Dover; one of the Randolph fire engines went down to the river and pumped water from the river. There were no fatalities, and only one minor injury to a police officer. The response to the fire by the first responders was excellent; the Mayor offered his thoughts and prayers to the displaced families.
K. EXECUTIVE SESSION
WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and
WHEREAS, this public body is of the opinion that such circumstances presently exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:
1. The public shall be excluded from the Executive portion of the meeting.
2. The general nature of the subject matter to be discussed is as follows:

3. As nearly as now can be ascertained, the matter or matters to be discussed at this time will be disclosed to the public at such time and under such circumstances as are prescribed by law.
4. At the conclusion of the Executive Session, the Council may or may not reconvene in public session for the purpose of taking formal action.
