Minutes: November 5, 2009
A regular meeting of the Randolph Township Council was called to order at 8:00 p.m. by Mayor Metz. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and, to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on January 12, 2009, by emailing them the annual resolution adopted by the Council on January 1, 2009. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and in the Morris County Daily Record on January 15, 2009.

The Manager provided a summary highlighting Lt. Giuliani’s background and accomplishments with the Randolph Police Department.

COUNCIL AND MANAGER REPORTS
Councilwoman Price reported that the H1N1 vaccines are arriving slowly. Residents who are not considered to be “at risk” have been asked to delay their immunizations until additional vaccines are in place. Information has been posted on the town’s web site.
Mayor Metz stated that he received a letter from Stephanie Mygas thanking him for attending the ribbon-cutting ceremony at the museum at the completion of her girl scout project. The Mayor noted a former Randolph student that had received a proclamation from the Council recognizing his work on behalf of Darfur is attending Princeton University on a full scholarship and has been elected President of his class.
Councilman Napoliello was selected to serve on the Morris County Rail Freight Advisory Committee.
ORDINANCES
A. Second Reading and Public Hearing
(1) Ordinance #26-09: Amending Land Development Ordinance—2 Middlebury Boulevard
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING THE LAND DEVELOPMENT ORDINANCE OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY, TO REZONE BLOCK 18.01, LOT 1.01, ON THE OFFICIAL TAX MAP OF THE TOWNSHIP OF RANDOLPH FROM THE B-1 NEIGHBORHOOD BUSINESS DISTRICT TO THE I-1 INDUSTRIAL DISTRICT” be read by title on second reading and a hearing held thereon.
Manager Lovell noted that this ordinance will return the property to the I-1 Industrial District. There is a business owner interested in building a factory at the site. The Planning Board and the Economic Development Committee have both recommended this ordinance be adopted.
Kelli Gallo stated for the record that the Planning Board reviewed this ordinance at their November 2 meeting and found that the ordinance was not inconsistent with the Master Plan.
The Mayor opened the meeting to the public for a hearing on the ordinance.
Michael Shivetz, attorney for the applicant, noted that the property owner was available to answer any questions from the Council. He requested the Council act favorably on the ordinance as it will be of benefit to the township.

(2) Ordinance #27-09: Amend Salary and Wage Ordinance
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING ORDINANCE NO. 16-09, ‘AN ORDINANCE TO PROVIDE AND DETERMINE THE RANGE OF COMPENSATION FOR SPECIFIED OFFICERS AND EMPLOYEES IN THE TOWNSHIP OF RANDOLPH’” be read by title on second reading and a hearing held thereon.
Manager Lovell noted that this ordinance will change several titles in the organization and will move people from one classification to another. This ordinance will result in a salary increase immediately for the Engineering Administrator. Increases for the others affected by this ordinance will be considered at a later time.
The Mayor opened the meeting to the public for a hearing on the ordinance.
Judith Stewart, 114 Everdale Road, noted that she is pleased to see the Community Services Coordinator receive an increase in responsibility and salary as she does an excellent job.

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $235.32.

(2) Refund Overpayment of 2009 Taxes Assessed to David and Ellen Shinberg to CitiMortgage—$2,637.03

(6) Release Road Opening Cash Bond Posted for Driveway Installation to Cheryl and Jason Freund—$500.00

WHEREAS, the Engineering Department has received a request from Cheryl Freund for the release of a $500.00 cash road opening bond posted for a driveway installation; and
WHEREAS, the road opening bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on April 15, 2009; and
WHEREAS, the applicant was required to post this cash bond to guarantee the driveway installation within the Township right-of-way; and
WHEREAS, the Engineering Department has inspected the road opening work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Ralph Carchia, Engineering Administrator, that the cash road opening bond in the amount of $500.00 be refunded to Cheryl and Jason Freund, 18 Old Shunpike Road, Randolph, NJ 07869.
(7) Cancel 2009 Delinquent Taxes, Water/Sewer Tax, and Water/Sewer Overpayments of $10.00 and Under

WHEREAS, it is recommended by the Tax Collector that the 2009 delinquent taxes, water/sewer and tax, water/sewer overpayments of $10.00 and under be cancelled.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, that the Tax Collector be instructed to cancel the 2009 delinquent taxes, water/sewer and 2009 tax, water/sewer overpayments of $10.00 and under.
(8) Refund Cash Stabilization Bond for Lawn Installation at 96 South Road to Doug Collinson—$1,000.00

WHEREAS, the Engineering Department has received a request from Doug Collinson for the release of a $1,000.00 cash bond posted for a lawn installation; and
WHEREAS, the stabilization bond consisted of a $1,000.00 cash bond, which was received and deposited with the Finance Department on March 20, 2007; and
WHEREAS, the applicant was required to post this cash bond to guarantee the lawn installation at 96 South Road; and
WHEREAS, the Engineering Department has inspected the grading work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Ralph Carchia, Engineering Administrator, that the cash stabilization bond in the amount of $1,000.00 be refunded to Doug Collinson, 96 South Road, Randolph, NJ 07869.
(9) Release Road Opening Cash Bond for 30 Olde York Road to Richard and Carrie Sabatino—$500.00

WHEREAS, the Engineering Department has received a request from Carrie Sabatino for the release of a $500.00 cash road opening bond posted for a driveway installation; and
WHEREAS, the road opening bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on August 7, 2009; and
WHEREAS, the applicant was required to post this cash bond to guarantee the driveway installation within the Township right-of-way; and
WHEREAS, the Engineering Department has inspected the road opening work and found it to be acceptable.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Ralph Carchia, Engineering Administrator, that the cash road opening bond in the amount of $500.00 be refunded to Richard and Carrie Sabatino, 30 Olde York Road, Randolph, NJ 07869.
(10) Refund Escrow Funds From Grand Slam, LLC, to North Jersey Development Group—$665.00

WHEREAS, the Planning and Zoning Department received escrow funds from Grand Slam, LLC; and
WHEREAS, the project has been completed and closed out and there are no outstanding payments due.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, that it is recommended by Darren Carney, Planning and Zoning Administrator, that the remaining escrow funds in the amount of $665.00 be refunded to Grand Slam, LLC, c/o North Jersey Development Group, 333 Route 46, 2nd Floor, Mountain Lakes, NJ 07046.
B. Authorize Execution of a Memorandum of Understanding for the Development of a Shared Vehicle Maintenance Facility With The Board Of Education

WHEREAS, Randolph Township and the Randolph Board of Education wish to execute a Memorandum of Understanding for the development of a shared vehicle maintenance facility; and
WHEREAS, both parties agree to all of the terms and conditions of said agreement.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph that authorization is given to execute the Memorandum of Understanding.
C. 2009 Budget Amendment: State Health Services Grant—$90,448.00

WHEREAS, N.J.S.A. 40:4-87 provides that the Director of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such items shall have been made available and the amount thereof was not determined at the time of adoption of the 2009 Budget; and
WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount.

H. Authorizing Increasing Bid Threshold to $29,000.00 and Appointing Qualified Purchasing Agent Gail Catania

WHEREAS, the recent changes to the Local Public Contracts Law gave local contracting units the ability to increase their bid threshold up to $29,000.00; and
WHEREAS, NJSA 40A:11-3a permits an increase in the bid threshold if a Qualified Purchasing Agent is appointed as well as granted the authorization to negotiate and award such contracts below the bid threshold; and
WHEREAS, NJAC 5:34-5 et seq. establishes the criteria for qualifying as a Qualified Purchasing Agent; and
WHEREAS, Gail Catania possesses the designation of Qualified Purchasing Agent as issued by the Director of the Division of Local Government Services in accordance with NJAC 5:34-5 et seq; and
WHEREAS, the Township of Randolph desires to take advantage of the increased bid threshold.
NOW, THEREFORE, BE IT RESOLVED that the governing body of the Township of Randolph, in the County of Morris, in the State of New Jersey, hereby increases its bid threshold to $29,000.00.
BE IT FURTHER RESOLVED that in accordance with NJAC 5:34-5.2, the local unit Clerk is hereby authorized and directed to forward a certified copy of this resolution and a copy of Gail Catania’s certification to the Director of the Division of Local Government Services.
I. Authorizing Professional Services Agreement With Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA, to Provide Special Counsel For Services Associated With Revaluation Program—Not to Exceed $1,500.00

WHEREAS, the Township of Randolph has a need to acquire Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA, as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4; and
WHEREAS, Gail Catania, Purchasing Coordinator, has determined and certified in writing that the value of the acquisition will exceed $17,500.00; and
WHEREAS, the anticipated term of this contract is one year and may be extended as approved by this governing body; and
WHEREAS, Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA, has indicated he will provide the Special Counsel for Services Associated with Revaluation Program at the hourly rate of $150.00 for an amount not to exceed $1,500.00; and
WHEREAS, Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA has completed and submitted a Business Entity Disclosure Certification which certifies that Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA, has not made any reportable contributions to a political or candidate committee in the Township of Randolph in the previous one year, and that the contract will prohibit Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA, from making any reportable contributions through the term of the contract; and
WHEREAS, funds are available for this purpose.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to enter into a contract with Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA, as described herein.
BE IT FURTHER RESOLVED that the Business Entity Disclosure Certification and the Determination of Value be placed on file with this resolution.
CERTIFICATION OF AVAILABILITY OF FUNDS
Dated: November 5, 2009
As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Michael J. Soccio, Director of Finance of the Township of Randolph, have ascertained that funds are available in the 2009 Budget, Legal, Other Expense, to award a contract with Richard P. DeAngelis, Jr., of McKirdy & Riskin, PA, for Special Counsel for Services associated with the Revaluation Program in the amount not to exceed $1,500.00.

J. Authorizing Removal of Lien From Irving Bender Property at 74 Gristmill Road

WHEREAS, Irving and Rita Bender own the property at 74 Gristmill Road, Block 146, Lot 4; and
WHEREAS, in 2007 the Benders were approved for a low interest loan in the amount of $25,000.00 for the desilting/dredging of a pond at 74 Gristmill Road; and
WHEREAS, the loan provided under the Dam, Lake, Stream, Flood Control, Water Resources Wastewater Treatment Project Bond Act of 2003, P.L. 2003, Chapter 162, required the Township of Randolph to act as a co-borrower; and
WHEREAS, on March 23, 2007, the Township filed a mortgage in the amount of the loan recorded in the Office of the Morris County Clerk; and
WHEREAS, the Benders have advised that they are abandoning the desilting/dredging of the pond inasmuch as costs associated with environmental permitting exceed their expectations and budget would be greater than the cost of the actual desilting/dredging project; and
WHEREAS, the Benders have requested that the mortgage be cancelled by Randolph Township and the Morris County Clerk so notified.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph, Morris County, New Jersey, on this 5th day of November, 2009, that the request of the Benders is hereby approved.
BE IT FURTHER RESOLVED that the Township Attorney shall cancel the mortgage and notify both the State of New Jersey Department of Environmental Protection and the Morris County Clerk of the cancellation of the mortgage.
K. Amending 2008 Professional Services Agreement With Robert Michaels For Initial COAH Analysis in an Amount Not to Exceed $5,000.00, Bringing New Total to $17,900.00

WHEREAS, there exists a need to amend the Professional Services Agreement with Robert Michaels & Associates for the initial COAH Analysis; and
WHEREAS, the cost for such amendment will not exceed $5,000.00; and
WHEREAS, the original contract was for $7,900.00, Amendment 1 was $5,000.00, and Amendment 2 will bring the new total to $17,900.00; and
WHEREAS, funds are available for this purpose; and
WHEREAS, the Local Public Contracts Law (NJSA 40A:11-5 et seq.) requires that the resolution authorizing the award for professional services without competitive bid and the contract itself must be available for public inspection.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, County of Morris, State of New Jersey, that Amendment #2, not to exceed $5,000.00 for a new total of $17,900.00, be approved.

L. Amending Professional Services Agreement With Jaman Engineering To Include Wetlands Surveying—2,453 Linear Feet for $0.50 Per Linear Foot, Totaling $1,226.50 and Now Bringing the Amended Contract to a Total Not to Exceed $18,926.50

WHEREAS, the Township of Randolph has a need to amend a Professional Services Agreement with Jaman Engineering Associates which was awarded on April 2, 2009; and
WHEREAS, the amendment will include Wetlands Surveying—2,453 linear feet; and
WHEREAS, fees for this service will be $0.50 per linear foot at 2,453 linear feet, totaling $1,226.50; and
WHEREAS, the original agreement was $17,700.00 and the amended contract will not exceed $18,926.50; and
WHEREAS, Gail Catania, Puchasing Coordinator, has determined and certified in writing that the value of the acquisition in addition to others will exceed $17,500.00; and
WHEREAS, the anticipated term of this contract is one year and may be extended as approved by this governing body; and
WHEREAS, funds are available for this purpose.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to amend a contract with Jaman Engineering Associates as described herein.

Councilman Napoliello nominated Thomas Laudone as a student member on the Landmarks Committee, Lesly Kurian as a student member to the Open Space Committee, and Robyn Hume as a student member to the Environmental Commission. Deputy Mayor Alpert asked the Manager if a meeting has been scheduled with the Board of Education.
Manager Lovell responded that he would follow up with the Board of Education.
Mayor Metz noted that one of the issues he wanted to address during his year as Mayor concerned homeland security and a system to alert residents of emergency situations. He has asked the schools to assist in communicating this effort to the residents via their email alert system but has not yet gotten cooperation from the school.
Maria Martorana, a Board of Education member who was in the audience, agreed to bring this issue up at the next Board of Education meeting.
Manager Lovell asked Mrs. Martorana to share the information with the Business Administrator as well.
Manager Lovell went to the neighborhood near Shongum School affected by a recent no parking ordinance to get a sense of the parking issue. He believes that the parking restrictions put in place make a great deal of sense. The Manager will continue to look at the situation and has asked the police to provide their insights as well. Regarding the number of signs placed in the neighborhood, he believes the crews showed sensitivity in the placement of the signs.
Mayor Metz noted that many concerned residents voiced their opinion at a recent meeting on the parking restrictions and placement of signs. The Mayor made a trip to the area and didn’t see a problem with the placement of signs. He suggested the Traffic Advisory Committee communicate with the neighborhood point person and go for a tour of the neighborhood to discuss the issue further.
