A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 6:30 p.m. by Mayor Loveys. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 29, 2018 by emailing them the annual resolution adopted by the Council on November 1, 2018. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and the Daily Record on December 6, 2018. The time change for the meeting was emailed to the Randolph Reporter and Daily Record on September 11, 2019 and published in the Randolph Reporter and Daily Record on September 19, 2019. The meeting date and time change from November 7, 2019 at 7 p.m. to November 5, 2019 at 6:30 p.m. was emailed to the Randolph Reporter and the Daily Record on September 11, 2019 and advertised on September 19, 2019.

C. MANAGER’S REPORT

Manager Mountain updated the Council on Veterans Community Park. He advised the Council that after several months of process and negotiations that tonight, under Combined Actions, is the tender agreement for the Veterans Community Park project. The agreement memorializes the terms the township and the Surety Company, for defaulting contractor Abraham Contracting, have established for the final resolution of the obligations for the Surety under the performance bond for the project. The agreement provides the terms under which the replacement contractor, Rochelle Contracting of Landing, NJ will be required to complete the project, along with the Surety’s financial obligations both to the township as well as any other entities owed for work and/or services performed in support of the defaulting contractor. The terms of the agreement and the scope of remaining work have also been thoroughly reviewed by the Township Attorney and Township Engineer. The township is satisfied that the agreement not only covers all of the requisite areas of obligation, but also that the takeover contractor has provided a thorough price/plan for successful completion for the project. The Council’s action tonight will move to finalize the execution of the agreement this week and to work through any other administrative requirements necessary to get the contractor mobilized by mid-November. The contractor has already placed his construction trailer on-site and has advised the township that he is ready to start.

G. ORDINANCES: INTRODUCTION

1. Ordinance No. 23-19 Accepting Dedication of Block 47, Lot 7.30 on the Official Tax Map of the Township of Randolph from SJC Builders

Manager Mountain explained that, with the conclusion of the SJC Builders development originally associated with the golf course project, there were a number of properties that were dedicated to the township. This is the last of those properties to be dedicated to the township. He explained the reasons why this property took a longer time to be dedicated.

BE IT RESOLVED, that an Ordinance entitled “ACCEPTING DEDICATION OF BLOCK 47, LOT 7.30 ON THE OFFICIAL TAX MAP OF THE TOWNSHIP OF RANDOLPH FROM SJC BUILDERS, LLC” be introduced, read by title by the Township Clerk and passed on first reading.

BE IT RESOLVED, that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 21st of November 2019 at 7:00 p.m. in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said ordinance.

BE IT FURTHER RESOLVED, that the Township Clerk be authorized and directed to advertise said Ordinance in full or by summary with the notice of introduction thereof, in the official designated newspaper according to law.

Councilwoman Veech asked Manager Mountain to explain, particularly for the newer Council members, why the township typically refuses properties. Manager Mountain explained that the value of this particular property is that it connects with other open space in a greenway fashion that will allow the township to extend trails that will benefit that neighborhood and other parts of the community; it is also in the best interest of the township in order to maintain the property. Mayor Loveys added that this was different than the usual properties offered to the township, this was an agreement between the township and SJC Builders several years ago; the property was always planned to be dedicated to the township if the golf course project did not move forward.

2. Ordinance No. 24-19 Amending Section 31-75, No Parking Certain Hours, of Chapter 31, Traffic and Vehicles, of the Revised Ordinances of the Township of Randolph, Morris County, New Jersey

Manager Mountain explained that occasionally the township receives requests from a resident or group of residents, or it can be an internal recommendation where an existing restriction has to be reviewed due to changes that happen to the underlying reason the restriction was issued to begin with. This is regarding no parking restrictions associated with the Shongum School. Over the years the school district’s timing has changed as far as when the school is in session as well as drop-off and pick-up times. The changes to the ordinance were driven by the recommendations related to the timing changes. The ordinance was reviewed by the support services division of the police department.

1. 2020 Council Meeting Calendar

There was a brief discussion on the February 15, 2020 Budget Meeting date. It was decided to move the meeting to February 22, 2020.

R-310-19 Resolution of the Mayor and Council of the Township of Randolph, Morris County, New Jersey, to Establish a Schedule of Regular Meetings of the Mayor and Council of the Township of Randolph During the 2020 Calendar Year

I. OPEN TO THE PUBLIC

J. COUNCIL COMMENTS

Councilwoman Potter reported that the Environmental and Landmarks Committee established a Single-Use Plastics Research Committee. She wanted to possibly make a motion to limit the timeframe of their research to potentially one year and asked for Council feedback. A few of the Council members felt one year was too long. It was decided that the committee could complete their research by the end of June 2020. If there was a legitimate reason for them to continue longer, they could ask the Council for an extension.

Councilwoman Potter reported that the small sub-committee for NJ 2-1-1 has been established; the members include Councilwoman Potter, Julie Swenson and Liz Ritter. They will communicate with Manager Mountain and Mayor Loveys.

Councilman Nisivoccia attended the MAC meeting for Councilman Forstenhausler; he had nothing to report from the meeting.

Councilman Forstenhausler had nothing to report.

Councilman Tkacs attended the Planning Board meeting; they approved the new zoning ordinance that was approved at a previous Township Council meeting related to the recommendations from the Board of Adjustment through their annual report. They also heard testimony on a new child care center going up behind the CVS next to the medical building; this building was part of the original development of that property.

Councilman Tkacs received a complaint from a resident regarding the four trash collection routes and the four leaf collection routes in the township, and how the routes are not the same. The people in the neighborhood got confused with the route number for leaf collection. Manager Mountain explained that there is logic to how the leaf collection districts were created.

Councilman Tkacs reported that he attempted to take the historic bus tour of Randolph; however, he was told that he did not make his reservation in time and the bus was full. At least two other couples were turned away.

Councilwoman Veech had nothing to report.

Deputy Mayor Carey had nothing to report.

Mayor Loveys explained that this time of year the Council works on the performance evaluations for the Township Manager and the Township Clerk. Deputy Mayor Carey and Councilman Nisivoccia have agreed to take the lead. By the end of this week the performance evaluation questionnaires will be emailed to the Council members and they will have two weeks to complete them; the responses need to be returned by Monday, November 25th. If they are received on time, Deputy Mayor Carey and Councilman Nisivoccia will compile the information and email it to the Council by Monday, December 2nd. The Council members will present the Manager with his performance evaluation in the Executive Session of the December 5th Council meeting. It has been agreed upon for this year and moving forward that the Council will not present the Township Clerk with her performance evaluation as a group in Executive Session; it will be presented by the Mayor, Deputy Mayor and Manager in the Manager’s Office at a convenient time for all.
