A. OPENING OF REGULAR MEETING
1. Call to Order
A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Loveys. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 5, 2013 by e-mailing them the annual resolution adopted by the Council on December 5, 2013. The annual resolution, including this meeting date, was advertised in the Randolph Reporter, the official paper of the Township of Randolph, and the Daily Record on December 12, 2013.

B. OPEN TO THE PUBLIC
Judith Stewart of 114 Everdale Road asked about Resolution 317-14, Authorizing Award of Contract #49. She asked about deer carcass removal as written in the fourth paragraph. Mayor Loveys and Manager Mountain explained that the company name is “Deer Carcass Removal Service,” but the contract was not for the removal of deer carcasses.
Seeing no one further from the public, the public portion was closed.
C. MANAGER’S REPORT
Manager Mountain reported the following:
- K-Mart Plaza—he, Mayor Loveys, Darren Carney, and the subcommittee of the Economic Development Committee met to develop a strategy for further outreach with plaza owners. Darren created a profile of statistical information that the group feels will be of use to the business owners as well as the township in terms of attracting a good anchor tenant. The group also discussed a number of options to raise with the property owners when they meet in the coming weeks.
- Revaluation—four proposals were received through the RFP for the revaluation project. The workgroup will be interviewing the top three candidates on November 14th. The fourth candidate was well over the budgeted amount. The anticipated date for recommending the award is the next Council meeting; on the agenda is the introduction of the Ordinance for funding the revaluation. The Ordinance must be in place before the award.
- Retaining Walls—he and Paul Ferriero met with the first of several property owners on Everdale Road with retaining walls that are in need of repair or replacement; the meeting went well. The approach that the Council had endorsed was discussed & it was received favorably. Paul is working on additional information for the property owner. The property owner they met with has the worst of the walls; the neighboring properties are in need of repair/replacement, but to a lesser extent. The hope is to move ahead on these properties as soon as possible using 2014 money.
- Communication Tower—he is working with Darren Carney and Glen Pierson of PierCon on a presentation for the full Council. The workgroup met in September and had identified a strategy for moving forward on the communication tower. The plan is to meet with the workgroup prior to the end of the year and have them endorse the presentation. The presentation will then be scheduled in the beginning of 2015.
- He and Mayor Loveys participated in a conference call with Mayors and Managers from throughout Morris County, led by the Freeholders and the County Office of Emergency Management on infectious disease protocol. The County’s Office of Emergency Management has established a protocol for addressing the issue from a response standpoint, they have formed an infectious disease response team that is equipped to handle the unique needs of first responders who may encounter individuals who have symptoms of an infectious disease. The county team is in place as of October 31st.
- Parks Master Plan—the proposals have been received. The steering committee is in the process of reviewing the proposals. Interviews for the candidate firms will take place on November 24th. The goal of the steering committee is to have a recommendation for the Council at the December 4th meeting.

1. Approval of Regular Meeting Minutes for October 2, 2014
Councilman Forstenhausler stated that under Council Comments, what he reported about Gene Stracco and softball should reflect that Gene had suggested inviting the other softball teams to Randolph to play next year. He asked that the minutes be amended.

E. COMBINED ACTION RESOLUTIONS
Item #10, Sale of Surplus Personal Property for Public Use: Councilman Forstenhausler noted that the way the list of equipment was scanned in makes it difficult to view. He asked that in the future, it be scanned differently for the Council.
Item #14, Release of Police Detail Escrow: Councilman Guadagno asked for clarification as to what escrows they are releasing and why to these companies. Manager Mountain explained that they are for outside detail; these companies put up the escrow for the police detail. This is what remained in escrow after the work was done.
Item #33, Contract for Single Stream Recycling: Councilman Hirniak asked for Manager Mountain to discuss this award. The Manager explained that it is the recommendation of the privatization of curbside collection for recycling. Over the past year, analysis was conducted as to the cost of the in-house operation versus privatizing the operation. It went out for bid and one bid was received from Blue Diamond Disposal who is also the contractor for solid waste hauling. The privatization can save approximately $50,000. The service was bid with a variety of options, including replicating the current collection routes and process that is currently used with in-house collection. Their lowest bid for the different options was the one that replicates the current in-house collection. The Manager reported that the other part of this is that recycling will now be single stream; all of the recyclables can now be collected in a single container. The new collection process will be advertised to the residents through various routes such as the newsletter. It was discussed with each member of the workgroup, and they were all supportive. With the Council’s award, it will go into effect January 1, 2015.
Deputy Mayor Veech spoke with Eric, from the Mine Hill recycling plant. She will be touring the facility on November 25th at 3:30 p.m. to see how the comingled recycling works. She extended the invitation to attend the tour to the other Council members. Deputy Mayor Veech asked Manager Mountain how the new recycling guidelines will be publicized to the residents and how they will be educated. The Manager stated that every medium will be utilized, the newsletter, the electronic signs, email, and Swift Reach.
Councilman Forstenhausler asked for clarification on how the township would be saving $50,000. Manager Mountain explained that it is tied to two retirements happening around the turn of the year, the township will not be buying a new packer truck that was scheduled to be replaced in 2015, and the existing packer trucks will be sold.
Mayor Loveys asked if the Recycling Center operation will change. Manager Mountain explained that the Recycling Center will still be managed in-house, but the setup will be modified to add roll offs for single-stream disposal. Until individual contracts run out, separate bins will still be maintained for residents who continue to separate recyclable materials.
Councilman Guadagno asked how they will keep track of tonnage. Manager Mountain explained that there is a stipulation in the contract that requires the contractor to provide the tonnage information. Councilman Guadagno asked if there will be change to the maintenance workers now that the township will not have the packer trucks. The Manager stated that he didn’t feel there would be a change to maintenance initially, but it will be evaluated in the future.
Item #34, Endorse Application to NJDEP for the Heritage 55 Treatment Works Approval (TWA): Manager Mountain explained that it is an existing TWA that was authorized for the Heritage 55 subdivision. However, they have decided they are going to go with a different type of treatment system, a different design, and the NJDEP still requires an approval for the new design despite that they were already permitted under the TWA. The new design is a mini-package plant. Councilman Guadagno asked what protection the township has, when there is an association running a mini-package plant, to make sure the association doesn’t shut down and walk out on it. The Manager stated that he wasn’t sure if there was any protection if an association defaults on it, but the township is in a better position to take it over from them versus taking it on right up front. Keli Gallo said she would have to look into it.

3. Refund Overpayment of Taxes for 5 Hickory Place to Justin Kross—$1,944.25

WHEREAS, Capital One Bank has overpaid 2014 taxes in the amount of $1,944.25, on Block 211, Lot 2, known as 5 Hickory Place, assessed to Justin Kross; and
WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $1,944.25 to Capital One Bank.
4. Refund Overpayment of Taxes for 12 Sylvia Place to Ye Zhao—$1,664.35

WHEREAS, Ye Zhao has been granted a reduction in assessed valuation for the tax years 2012 & 2013 by the Tax Court of New Jersey on Block 224, Lot 30, known as 12 Sylvia Place; and
WHEREAS, this reduction has been approved by resolution on July 31, 2014.
WHEREAS, an overpayment exists as a result of the reduction for the year 2012 in the amount of $823.50, and 2013 in the amount of $840.85.
WHEREAS, it is recommended by the Tax Collector that these overpayments be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $1,664.35 to Ye Zhao. Corp.
5. Cancel Delinquent and Overpayment of Taxes, Water and Sewer Under $10.00

9. Authorizing Award of Contract for Janitorial Services for 6 Buildings in Municipal Complex to ACCSES NJ-CAN Services—$76,781.52

WHEREAS, the Township desires to award a contract for Janitorial Services (6 Buildings—Municipal Building, DPW Garage, Community Center, Randolph Teen Center (VFW), Randolph Artworks Studio, and Brundage Park Theater) from January 1, 2015 through December 31, 2015; and
WHEREAS, ACCSES NJ/CNA Services is the “Central Nonprofit Agency” designated by the State of New Jersey to administer the State Use Law for Rehabilitation Facilities, providing the dignity of a job and a paycheck to NJ citizens with disabilities; and
WHEREAS, ACCSES New Jersey (Association for Choices in Community Supports and Employment Services) is a non-profit organization providing leadership and support to affiliate programs which serve and employ people with disabilities and other disadvantages statewide; and
WHEREAS, ACCSES NJ/CNA Services has NJ State Contract #T1480 77110 for Janitorial Services Statewide; and
WHEREAS, ACCSES NJ/CNA Services has provided the attached quote for an annual total of $76,781.52; and
WHEREAS, the Township of Randolph is currently utilizing ACCSES NJ/CNA Services for these services and has been since November 1, 2012.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to ACCSES NJ/CNA Services for the contract period January 1, 2015 through December 31, 2015 at an annual price of $76,781.52 ($125.23 per month for the Brundage Park Theater and $6,273.23 per month for all other buildings).

10. Authorizing the Sale of Surplus Personal Property for Public Use on an Online Auction Website and/or Destruction of Certain Surplus Property

WHEREAS, the Township of Randolph has determined that the property described on the attached eight (8) Condemnation of Equipment and/or Furniture (Surplus) forms, attached hereto and incorporated herein, is no longer needed for public use; and
WHEREAS, it has been determined that the two Physio-Control AED devices (on the attached Page 8) are antiquated and should be destroyed for liability purposes instead of being auctioned off; and
WHEREAS, the Local Unit Technology Pilot Program and Study Act (P.L. 2001, c. 30) authorizes the sale of surplus personal property no longer needed for public use through the use of an online auction service; and
WHEREAS, the Township of Randolph intends to utilize the online auction services of USGovBid located at usgovbid.com; and
WHEREAS, the sale is being conducted pursuant to the Division of Local Government Services’ Local Finance Notice 2008-9.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph in the County of Morris, State of New Jersey, that the Township is hereby authorized to sell the surplus personal property as indicated on the attached Condemnation of Equipment and/or Furniture (Surplus) forms (Pages 1-7) on an online auction website entitled usgovbid.com; and
BE IT FURTHER RESOLVED that the items (AED devices) as indicated on the Condemnation of Equipment and/or Furniture (Surplus) form Page 8 be destroyed; and
BE IT FURTHER RESOLVED that the terms and conditions of the agreement entered into between USGovBid and the Township of Randolph are available at usgovbid.com and in the Township of Randolph Clerk’s office.
11. Awarding a Contract for the Quaker Church Road Repaving to Smith-Sandy Asphalt Construction Co.—$222,069.60

WHEREAS, the Township of Randolph advertised for the Quaker Church Road Repaving project in accordance with Local Public Contracts Law and received bids on October 23, 2014; and
WHEREAS, 4 bids were received; and
WHEREAS, bids were received from the following and for the bid prices listed:

Smith-Sondy Asphalt Construction Co., Inc., Wallington, NJ—Bid: $222,069.60;

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

WHEREAS, two (2) bids were received for Contract #7 (Drainage Pipe); and
WHEREAS, Chemung Supply Corporation in Elmira, New York, was the lowest responsive and responsible bidder for the items and prices shown on the attached Notification of Award for a one-year term.
NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #7 (Drainage Pipe) as noted above for the term of January 1, 2015 - December 31, 2015.
16. Authorizing Award of MCCPC Contract #9—Crushed Stone, Gravel, and Sand to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #9 (Crushed Stone, Gravel and Sand); and
WHEREAS, bids had been advertised and received on October 9, 2014, on behalf of the MCCPC in accordance with Local Public Contracts Law; and
WHEREAS, three (3) bids were received for Contract #9 (Crushed Stone, Gravel and Sand); and
WHEREAS, Eastern Concrete Materials in Elmwood Park, New Jersey, was the lowest responsive and responsible bidder for Category I, Sub-Category A, and Category II, Sub-Category A, in Contract #9 (Crushed Stone, Gravel and Sand) for the items and prices shown on the attached Notification of Award for a one-year term.
WHEREAS, Tilcon New York in Wharton, New Jersey, was the lowest responsive and responsible bidder for Category I, Sub-Category C, and Category II, Sub-Category C, in Contract #9 (Crushed Stone, Gravel and Sand) for the items and prices shown on the attached Notification of Award for a one-year term; and

WHEREAS, the sole bid was received from Blue Diamond Disposal, Inc., Succasunna, NJ for the bid prices listed below for a two-year contract, beginning January 1, 2015 and ending December 31, 2016:
Option 1: $624,000 ($312,000 per year) (Current Biweekly Collection—The residential curbside collection shall be conducted on Tuesdays, Wednesday, Thursdays and Fridays.)
Option 2: $1,248,000 ($624,000 per year) (One Day Biweekly Collection (Half the Town 1 week, 2nd half the next week)—The residential curbside collection shall be conducted on Tuesdays.)

34. Authorizing Township Manager to Endorse Application to NJDEP for the Heritage 55 Treatment Works Approval (TWA)

RESOLUTION, endorsing an application for Treatment Works Approval (TWA) for the construction of an on-site sanitary sewage treatment facility for the Heritage 55 Project.
WHEREAS Heritage 55 has an existing approved TWA and New Jersey Pollutant Discharge Elimination System (NJPDES) permits from the New Jersey Department of Environmental Protection (NJDEP) for the construction of an on-site sanitary sewage treatment facility necessary for the project; and
WHEREAS Heritage 55 wishes to modify the type of the treatment system to take advantage of the new technology available for these systems; and
WHEREAS the application must be submitted to the NJDEP for the construction of the on-site treatment system; and
WHEREAS the on-site treatment system will be privately owned and operated by Heritage 55 and their successors; and
WHEREAS in order for the NJDEP to consider the application, the same must be endorsed by the Township among others; and
WHEREAS the Township desires to authorize the execution of the endorsement of the said application,
NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Randolph, County of Morris, State of New Jersey;
- The Township hereby endorses the request for the Treatment Works Approval.
- The Township Manager is herby authorized and directed to execute the appropriate endorsements for the Treatment Works Approval, together with other appropriate officers and employees of the Township of Randolph, and hereby authorized to take all actions necessary to effectuate the purpose.
- This resolution shall take effect immediately.

F. ORDINANCES: INTRODUCTIONS
1. Ordinance Authorizing a Special Emergency Appropriation for Preparation and Execution of Complete Revaluation Program
Manager Mountain explained that this Ordinance will fund the preparation and the execution of the Revaluation. It is a little different in the sense that this is done under a special emergency; it allows for the cash to be available to fund the project immediately, but it allows the township to pay itself back over five, one-year installments. For the next five budgets there will be a line in the budget that will be 1/5 of this cost; that’s the way the money is being refunded back to the surplus that is being drawn from to pay up front.
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AUTHORIZING A SPECIAL EMERGENCY APPROPRIATION PER N.J.S.A. 40A:4-53 FOR THE PREPARATION AND EXECUTION OF A COMPLETE REVALUATION PROGRAM” be introduced, read by title by the Township Clerk and passed on first reading.
BE IT RESOLVED that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 25th of November 2014 at 7:00 o’clock in the evening, prevailing time, at the Municipal Building in said township, at which time and place all persons interested shall be given an opportunity to be heard concerning said Ordinance.
BE IT FURTHER RESOLVED that the Township Clerk be authorized and directed to advertise said Ordinance in full or by summary with the Notice of Introduction thereof in the official designated newspaper according to law.

H. DISCUSSION ITEMS
1. Fire Department Proposal—Conversion of Old Animal Pound Building—Fire Training Facility
Manager Mountain explained that the Fire Department has made a proposal with respect to the old animal pound building. In the Chief’s memorandum, he proposes converting the animal pound into a training facility for the Fire Department to use for various trainings that they currently conduct now at the fire stations or in the field. The Manager noted in his cover memo that the township hadn’t set aside a use for the vacated building. He felt it was a very good idea, and wanted the Chief and Deputy Chief to present to the Council so they could discuss the concept. If the Council is so inclined, then Manager Mountain would work with the Fire Department to memorialize the agreement.
Chief Dunn explained that they currently drill at each company; they are looking to have a centralized area in which to drill that is in a secure area that wouldn’t disturb residents in a neighborhood. They could have many drills there, including ladder drills, sub-contained breathing apparatus drills, they could smoke up the building without concern from residents, and perform other drills. There is plenty of off-road parking in which they could put the apparatus. There is a mass confidence course that Company 4 currently stores at the firehouse; this could be permanently stored at the old animal pound building. They are looking into creating by-laws that this will be a training facility that is run by the Fire Department. There are NJ State Fire Instructors within the department, they will be in charge of that building under the direction of Steve Cohrs, next year’s Fire Chief. He will be requiring an Incident Accident Plan (IAP) of what the company wants to drill there; there will be an SOP in place regarding the use of the building.
Deputy Chief Cohrs added that the building would allow them to drill more frequently. When they drill outside of their firehouses, they currently have to go to the Morris County Fire Academy where they have to work with other towns in the county for scheduling. Chief Dunn added that it would save money in their budget because they wouldn’t be paying for use of the Morris County Fire Academy.
Deputy Mayor Veech asked if this proposal would cost money for taxpayers. Chief Dunn explained that they are not looking for additional funds, they have department members from various backgrounds who could do the work to modify the building to their needs.
Councilman Hirniak asked about the potential for revenue from other fire departments using the building as a training facility. Chief Dunn explained that they have been working on making Randolph Fire Department an Eligible Organization (EO) through the state; John McAndrew III has been working with the state. This means that they would be a certified academy and could hold classes there with other towns and charge them for the classes.
Councilman Guadagno asked if the old animal pound building is in the right of way of the power company. Manager Mountain was unsure, but said he would check. The Councilman’s concern was that there may be a restriction on the building.
Councilman Forstenhausler stated that he participates in the drills each month, and has been to the Morris County Fire Academy. He felt it would be an excellent use for a building that most likely has no other use to the township. In addition to what Chief Dunn had explained, Councilman Forstenhausler said that multiple fire departments could train at the same time.
Mayor Loveys asked if the cost of the Morris County Fire Academy came out of the township budget. Chief Dunn said that it does come from the Fire Department’s budget through the township.
Since the consensus of the Council was positive, Manager Mountain stated that he, Chief Dunn, and Deputy Chief Cohrs would draft an agreement which would include how any future changes would be addressed. Once an agreement is drafted, it will be forwarded to the Council.
2. 2015 Meeting Schedule
There was some discussion on the meeting dates; overall the dates were acceptable. Manager Mountain will inform Donna Luciani so she can publicize the dates.
I. OPEN TO THE PUBLIC
Judith Stewart of 114 Everdale Road added to the Upcoming Events that there is a pancake breakfast on October 26th at the Ironia Firehouse. Mrs. Stewart also asked if the proposed meeting schedule was compared to the Board of Education’s meeting schedule so there were no conflicts. Mayor Loveys was unsure if the calendars were compared. Mrs. Stewart said that the township should compare the meeting schedule to that of the schools. She also felt that the Council should think about whether the Board of Adjustment should meet when the Council meets, and also asked if religious holidays were considered.
Seeing no one further from the public, the public portion was closed.
J. COUNCIL COMMENTS
Deputy Mayor Veech reported that the Randolph Rocks program is on November 20th. She saw Joe Nazzarro and he thanked the Council for nominating him.
Deputy Mayor Veech also asked who planned to attend the NJ State League of Municipalities. She reported that she had received something from the NJDEP inviting the Council to go on one-on-one conversations with high level staff from the NJDEP on Tuesday at the convention. She asked if there was anything the Council should discuss with them. Manager Mountain said he would ask the township staff if there were any questions and get back to the Council.
Deputy Mayor Veech also reported that she attended the 200 Club. The NJ Director of Homeland Security attended, and he spoke about his greatest fears for New Jersey.
Deputy Mayor Veech asked Manager Mountain for an update on the new animal pound. Manager Mountain stated that they are pushing for the completion to be by Thanksgiving. There was a small setback, the pump that served the pound failed; they are currently getting pricing to replace it. That impacts the project since there isn’t water service. The Manager reported that the township received a donation through the Friends of Randolph Pound for the painting supplies which tremendously helped the budget.
Councilman Guadagno asked how the doors at the Community Center would be fixed. Manager Mountain explained that there are two things in play. There is a maintenance person coming in the next few days to look at something they believe is the problem based on trouble shooting, but if that isn’t the problem then it’s a more expensive repair that will have to be part of the Capital.
Mayor Loveys reported that he and Councilman Guadagno attended a meeting led by Ralph Carchia with a neighborhood group in the Park Avenue/Pleasant Hill/Main Street area interested in getting natural gas. The township agreed to facilitate a meeting with NJ Natural Gas. There were two representatives from the gas company; the meeting was well attended by residents. NJ Natural Gas needs to determine where lines can be run, figure out cost, and get back to the residents before the end of the year. The Mayor commended Councilman Guadagno on his effort to get the meeting organized, and thanked him for his diligence. He also thanked Ralph Carchia for his effort.
K. EXECUTIVE SESSION
WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and
WHEREAS, this public body is of the opinion that such circumstances presently exist.
