A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor MacArthur. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 7, 2012, by e-mailing them the annual resolution adopted by the Council on November 29, 2012. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and the Daily Record on December 13, 2012.

B. RECOGNITION/PROCLAMATION

1. Millbrook United Methodist Church—180th Anniversary

Mayor MacArthur read the proclamation:

WHEREAS, the Millbrook United Methodist Church located at 246 Millbrook Avenue was dedicated in July 1, 1833; and

WHEREAS, during the past 180 years, improvements and expansion has enabled the continued preaching and teaching of the Gospel to the congregants who have met in the core of the Church building, which is the original structure; and

WHEREAS, the Millbrook United Methodist Church now consists of approximately 98 congregants who meet each Sunday to worship under the teaching of the Word by their pastor, Reverend David Edwards; and

WHEREAS, the Millbrook United Methodist Church is active in the Randolph community taking part in an inter-faith gathering with their Catholic, Free Methodist, Presbyterian, and Jewish brothers & sister in supporting a variety of local causes; and

WHEREAS, the Millbrook United Methodist Church, in addition to Sunday School and Bible Study classes is actively supporting national and international causes through the larger United Methodist Church; and

WHEREAS, the vision statement of the Millbrook United Methodist Church is:

Learn the Word! - Live the Word! - Share the Word!

NOW, THEREFORE, I, Thomas MacArthur Mayor of Randolph Township, Morris County, New Jersey, on behalf of the Randolph Township Council and our residents, do hereby recognize and celebrate the 180 Year Anniversary of the Millbrook United Methodist Church.

2. Firefighter Horton Miller for 50 Years of Service (In Memory)

Mayor MacArthur explained that Horton Miller had been an active person in the Fire Department. The Proclamation will be read at the Fire Department dinner on Saturday night.

C. OPEN TO THE PUBLIC

Jonathan Gold of 10 Blue Fern Lane expressed his gratitude for all the support from the town, particularly from John Lovell. He explained that in his 28 years of being a camp director, he hadn’t seen as much accomplished in such a short period of time; they couldn’t have done it without the full support of the town.

Judith Stewart of 114 Everdale Road stated that she and her husband enjoy some of the functions at the Millbrook Church.

Seeing no one further from the public, the public portion was closed.

D. MANAGER’S REPORT

Manager Lovell:

  • Donna has completed a first draft of a Council meeting calendar for next year which will be discussed at the next Council meeting so please review it. A few Saturdays are set aside for budget meetings.
  • Darren Maloney is the new Finance Director. He will be meeting with the Mayor and Deputy Mayor next week and attending a staff meeting. He will formally begin with the township on December 1.
  • The Nash Dance Studio, Hyperglow Show, is scheduled for tomorrow evening. He and the Zoning Officer will be looking into the file on the Board of Adjustment variance to determine if this event is outside the defined uses. There was a great deal of effort to advise the owner of Nash Dance Studio of the problems associated with these types of events.
  • Tax sales certificates and how tax sales run was explained in some detail.
  • Morris County Cooperative Pricing Council bid awards are listed. All the bid awards listed are the uncontested, low bid awards. The next agenda will also include a number of contract awards, but those are ones in which the low bid was rejected for one reason or another.
  • Many recruits from the Morris County Police Academy were interviewed. Two recruits were offered jobs and they have accepted; they are expected to begin in January.
  • Leaf collection is on target. The company that is removing the leaves is removing them as fast as they’re being collected. The operation is moving along smoothly. The new facility is meeting the township’s needs very nicely, and staff members appreciate the Council authorizing the development of that facility.
  • There was some discussion regarding more education to the residents with wooded lots to put leaves in the woods instead of curbside.
  • The technical review committee is about to get the Kensington Square project application. It hasn’t been determined if it will be ready for the December agenda for the Planning Board.
  • Dover has signed off on the Brightview water application. They are now working their way through DEP to get their permitting. Whether or not they break ground in December is unknown, but that is their desire.
  • The Camp Tamarack floating dock application was signed by the Manager today and it is being submitted to DEP.
  • Bill Lamia from the YMCA told the Manager that their electronic message sign contract was signed. The sign says “Randolph YMCA” on one side and “The Y” on the narrow side with the street address. It will be installed before year’s end as will the sign in front of the municipal building.
  • Cohn Farm is complete. The cleanup of the property has been completed, the trails are agreed upon, and a number of trails have been paved. In house crews were used for the paving; they used the new paving box that is shared with Denville and Roxbury.

E. APPROVAL OF MEETING MINUTES

1. Approval of Regular Meeting Minutes of June 27, 2013 and September 3, 2013

The June 27th minutes were pulled until Tiena Cofoni could review them to be sure they’re correct due to their technical information.

Councilwoman Veech made a motion to approve the minutes from September 3, 2013. Deputy Mayor Loveys seconded the motion, and the following roll call vote was taken:

F. COMBINED ACTION RESOLUTIONS

Item #9, purchase of used bulldozer:

Deputy Mayor Loveys had emailed Manager Lovell with some questions regarding the need for this equipment.

  1. Most of the retention basins are going to be wet, would it be better to use a different piece of equipment or a smaller one? A: For this size of equipment, the township would be leasing it. A smaller piece of equipment would not do the job efficiently and effectively.
  2. Aside from the retention basins, where else would the township be able to use this bulldozer? A: It would also be used for grading and for some of the stone lots around the town, Heistein Pond is a good example.

Manager Lovell reported that Public Works Directors from Chester, Denville, and Dover all said they would have a use for it and they would lease it. There was a price of $85,000 from the private sector to do the Darlene Court basin. With the bulldozer, a minimum of 2 basins per year can be done. The township is now a licensed operator of a storm water system and the rules have changed, these basins have to be maintained. It will probably be a 10 to 15 year turn around, and once that 15 year turnaround is finished, the first one will need to be done again.

1. Refund Road Opening Cash Bond to Filippa Mammana—$500.00

WHEREAS, the Engineering Department has received a request from Filippa Mammana, for the release of a $500.00 cash road opening bond posted for the purpose of putting Belgium Blocks around the driveway at 6 Shaw Farm Ct., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on October 4, 2013; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the Belgium blocks around the driveway at 6 Shaw Farm Ct. within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Filippa Mammana, 6 Shaw Farm Ct., Randolph, NJ 07869.

2. Refund Tree Bond for Block 21, Lot 181 to Vikas Bangia—$600.00

WHEREAS, the Planning and Zoning Department received a tree bond posted by Vikas Bangia for Block 21, Lot 181 in the amount of $1,800.00; and

WHEREAS, a portion of the requirements have been met and completed.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator that the tree bond in the amount of $600.00 be refunded to Vikas Bangia, 9 Revere Court, Randolph, NJ 07869.

3. Refund Road Opening Cash Bond for 26 Shongum Road to Joe Liquore—$500.00

WHEREAS, the Engineering Department has received a request from Joe Liquore, for the release of a $500.00 cash road opening bond posted for the purpose of repaving an existing driveway at 26 Shongum Rd., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on August 19, 2013; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the existing driveway at 26 Shongum Rd. within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Joe Liquore, 26 Shongum Rd., Randolph, NJ 07869.

4. Refund Road Opening Cash Bond for 24 Misty Mountain Road to Richard Rogers—$500.00

WHEREAS, the Engineering Department has received a request from Richard Rogers, for the release of a $500.00 cash road opening bond posted for the purpose of repaving an existing driveway at 24 Misty Mountain Rd., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on July 22, 2013; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the existing driveway at 24 Misty Mountain Rd. within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Richard Rogers, 24 Misty Mountain Rd., Randolph, NJ 07869.

5. Refund Outside Tax Sale for 6 Aldebaran Drive—Lien Times—$28,474.42

WHEREAS, Outside Tax Sale Certificate #1938 held by Lien Times, L.L.C., assessed to Rosemarie Pontoriero, Block 23, Lot 12, 6 Aldebaran Drive; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $17,174.42, and premium in the amount of $11,300.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $28,474.42 to Lien Times, L.L.C. holder of Tax Sale Certificate #1938.

6. 2013 Budget Amendment—Recycling Tonnage Grant

WHEREAS, N.J.S.A.40:4-87 provides that the Director of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such items shall have been made available and the amount thereof was not determined at the time of adoption of the 2013 Budget.

WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount.

SECTION 1

NOW, THEREFORE, BE IT RESOLVED, that the Township Council of the Township of Randolph, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2013 in the sum of $63,541.44 which item is now available as revenue from:

Special Items of General Revenue Anticipated with prior written consent of Director of Local Government Services - Public and Private Revenue Off-Set with Appropriation: State of New Jersey - Recycling Tonnage Grant

7. Refund Road Opening Cash Bond for 91 Everdale Road to Mariusz Gedzior—$500.00

WHEREAS, the Engineering Department has received a request from Mariusz Gedzior, for the release of a $500.00 cash road opening bond posted for the purpose of a water connection at 91 Everdale Rd., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on August 1, 2013; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the water connection at 91 Everdale Rd. within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Mariusz Gedzior, 91 Everdale Rd., Randolph, NJ 07869.

9. Authorizing Award of Contract to Harter Equipment Inc. for Purchase of Used 1999 John Deere 450H LT Bulldozer for Public Works Dept.—$28,000

WHEREAS, the Township of Randolph (“Township”) wishes to purchase a used 1998 or newer John Deere 450H LT or equivalent bulldozer with less than 2500 hours of use, open ROPS, seat belt included, 6-way blade, joystick steer for the Public Works Department; and

WHEREAS, the Purchasing Agent has solicited quotes from seven different vendors for this item; and

WHEREAS, only one of the vendors responded; and

WHEREAS, the sole quote was received from the following, for the described unit and the price listed:

Harter Equipment, Inc., Millstone Twp, NJ—1999 John Deere 450H LT with 2144 hours, $28,000; and

WHEREAS, the Public Works Director has reviewed the quote and recommends the award to Harter Equipment, Inc., of Millstone Twp, NJ; and

WHEREAS, the award also includes scheduled maintenance of the unit to be performed prior to acceptance of the vehicle by the Township of Randolph (engine oil, air filter, oil filter, fuel filter and all levels topped off); and

WHEREAS, the funds for this project will come from 04-215-55-932-305; and

WHEREAS, the quotes were not solicited through receipt of sealed quotes, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and

WHEREAS, in accordance with the Anti Pay-to-Play Legislation, Harter Equipment, Inc. submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and

WHEREAS, Harter Equipment, Inc. has also submitted to the Township a New Jersey Business Registration Certificate, as required.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

  1. The Township hereby awards a contract to Harter Equipment, Inc., Millstone Twp, NJ for the purchase of a used 1999 John Deere 450H LT bulldozer for the price of $28,000.
  2. This Resolution shall take effect immediately.

10. Authorizing Maintenance Agreement with Avaya from December 2013 to December 2017 for Telecommunications Equipment—Not to Exceed $33,527.04

WHEREAS, the Township of Randolph requires a maintenance agreement for the Avaya telephone system in the Municipal Building and Police Department; and

WHEREAS, the State Contract #T1316 for Telecommunications Equipment and Services provides for this agreement; and

WHEREAS, the term of the agreement is 48 months (December 31, 2013 through December 30, 2017); and

WHEREAS, the cost of this 48-month agreement will not exceed $33,527.04; and

WHEREAS, funds will be available for this purpose in subsequent years’ budgets.

NOW THEREFORE, BE IT RESOLVED that the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, authorize the Township of Randolph to enter into a 48-month maintenance agreement with Avaya (#80802) under New Jersey State Contract #T1316 for Telecommunications Equipment and Services for maintenance of the telephone system in the Municipal Building and Police Department.

11. Authorizing Release of Road Opening Cash Bond to General Contracting Inc.—$500.00

WHEREAS, the Engineering Department has received a request from Randolph General Contracting Inc., for the release of a $500.00 cash road opening bond posted for the purpose of a water connection at 1 Longview Ave., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on Sept. 27, 2013; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the water connection at 1 Longview Ave. within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Randolph General Contracting Inc., 1 Patty Lane, Randolph, NJ 07869.

12. Refund Overpayment of 2013 Taxes for Block 59, Lot 6—$2,591.84

WHEREAS, Fred/Mary Lee Colonna has overpaid 2013 taxes by reason of tax exempt Veteran in the amount of $2,591.84 on Block 59, Lot 6, 28 Treaty Road ; and

WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $2,591.84 to Fred/Mary Lee Colonna.

13. Cancellation of Outstanding Checks from the General Account and Grant Fund

WHEREAS, the attached list of checks issued between 2011 and 2012 are currently outstanding.

WHEREAS, the Finance Department has sent numerous letters with no response; and

WHEREAS; it is recommended by the Finance Director that the checks outstanding from the following accounts be cancelled:

THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey that the Finance Director be instructed to cancel the attached list of outstanding checks.

14. Refund Escrow Fees for Block 44, Lot 8 & 9 to SJC Builders—$1,000.00

WHEREAS, the Planning and Zoning Department received escrow funds from SJC Builders, LLC, 1360 Sussex Turnpike, Suite B, Randolph, NJ, for Block 44, Lots 8 and 9, Account No. P50294767; and

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $1,000.00, be refunded to SJC Builders, LLC, 1360 Sussex Turnpike Suite B, Randolph, NJ 07869.

15. Refund Escrow Fees for Heritage Project XVI to SJC Builders—$937.25

WHEREAS, the Planning and Zoning Department received escrow funds from SJC Builders, LLC, 1360 Sussex Turnpike, Suite B, Randolph, NJ, for the Heritage XVI Project, Account No. B60028687; and

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $937.25, plus accrued interest, be refunded to SJC Builders, LLC, 1360 Sussex Turnpike Suite B, Randolph, NJ 07869.

16. Refund Escrow Funds for the Golf Course Concept Account to SJC Builders—$2,693.50

WHEREAS, the Planning and Zoning Department received escrow funds from SJC Builders, LLC, 1360 Sussex Turnpike, Suite B, Randolph, NJ, for the Golf Course Concept, Account No. P50023236 ; and

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $2,693.50 be refunded to SJC Builders, LLC, 1360 Sussex Turnpike Suite B, Randolph, NJ 07869.

17. Refund Outside Tax Sale for Block 137, Lot 30 to US Bank Cust for BV001 Trust—$41,440.60

WHEREAS, Outside Tax Sale Certificate #1995 held by US Bank Cust for BV001 Trust, assessed to Dabal Enterprises, LLC, Block 137, Lot 30, 246 Route 10; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $440.60, and premium in the amount of $41,000.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $41,440.60 to US Bank Cust for BV001 Trust holder of Tax Sale Certificate #1995.

18. Cancellation of Accounts Payable to Tempo System Company for the Public Works Time Clock—$164.50

WHEREAS, an accounts payable to Tempo Systems Company in the amount of $164.50 for the Public Works time clock exist on the books of the Randolph General Fund; and

WHEREAS, the purchase order and contract creating the accounts payable to Tempo Systems Company has been investigated and it is determined that they be cancelled.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Finance Director be instructed to cancel the accounts payable to Tempo System Company in the amount of $164.50.

19. Refund Escrow for 12 Birch Street to Nicola Gangemi—$1,013.75

WHEREAS, the Planning and Zoning Department received escrow funds from Nicola Gangemi, 12 Birch Street, Randolph, NJ, Block 56, Lot 12.01, and in the amount of $4,900.00; and

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $1,013.75 be refunded to Nicola Gangemi, 12 Birch Street, Randolph, NJ 07869.

20. Awarding MCCPC Contract #9 Crushed Stone, Gravel & Sand

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #9 (Crushed Stone, Gravel and Sand); and

WHEREAS, bids had been advertised and received on October 1, 2013, on behalf of the MCCPC in accordance with Local Public Contracts Law; and

WHEREAS, three bids were received for Contract #9 (Crushed Stone, Gravel and Sand); and

WHEREAS, Stone Industries, Inc. is the lowest responsive and responsible bidder for the following categories contained in Contract #9 (Crushed Stone, Gravel and Sand) as shown on the attached Notification of Award for a one-year contract:

Manager Lovell explained that Randolph anticipated combining forces with Roxbury this year for the services of a Construction Official. Frank Howard postponed his retirement & will be retiring on March 1. Therefore, the Construction Official position needs to be reinserted. There was also discussion about changing the Zoning Officer’s responsibilities and making it a full time position. The Zoning Officer will remain part-time and the new Manager and the new Construction Official can determine the direction of the township.

1. Ordinance #23-13: Amend Open Space Bond Ordinance

Manager Lovell explained that at the last Council meeting an Open Space Bond Ordinance amendment was introduced that would allow staff to charge incidental costs against the bond ordinance. The township maintains a lot of property and occasionally professional projects need to be done. This allows the flexibility for projects to be turned around quickly. Previously there wasn’t a complete list of block and lot numbers. Because of that, Manager Lovell instructed Donna Luciani not to advertise the last ordinance that was introduced. The ordinance is being reintroduced with a complete list of block and lots for open space.

BE IT RESOLVED that an Ordinance entitled “BOND ORDINANCE AMENDING THE DESCRIPTION OF THE IMPROVEMENT REFERRED TO IN SECTION ONE OF BOND ORDINANCE NO. 7-08 FINALLY ADOPTED ON APRIL 3, 2008 IN AND BY THE TOWNSHIP OF RANDOLPH, NEW JERSEY” be introduced, read by title by the Township Clerk and passed on first reading.

There was discussion about the need for the Council to authorize these expenditures. 3. Ordinance #27-13: Cushing Court Temporary Easement Ordinance

Manager Lovell explained that a drainage system was installed on private property in Randolph many years ago. The drain line has a clog in it and the 3 property owners were contacted. The township received temporary easements from the 3 property owners to examine the line; however, only 2 of the property owners signed easements for repair of the line. Once the property owners signed off on the easements, a camera test was done on the line and the clog was found. The clog was located on one of the properties whose owner had signed off on the easement for both examination and repair.

J. DISCUSSION ITEMS

1. Township Manager Recruitment

Mayor MacArthur reported:

  • Twenty-three resumes have been received to date. Of those, 3 candidates have been identified to be interviewed.
  • After discussion amongst the committee members as well as with the consultant, Dan Mason, it was decided that the residency requirement was limiting the applications. The committee feels that their primary job is to get the best manager, and although residency should be considered, it is not a defining quality. The committee unanimously concluded that the position should be re-advertised without residency as a limitation provided the entire Council agreed.

Councilman Guadagno asked to discuss parameters for contract negotiations in the Executive Session.

Keli Gallo stated that the discussion regarding parameters for contract negotiations can be done in the Executive Session; however, all other discussion regarding recruitment would be heard in Open Session.

2. Naming of Park Facilities

Councilman Hirniak reported that the committee was asked to create a vision and suggest a name for each of the 3 parcels. The suggested name for the 1 acre parcel on South Salem Street is Old Tye Park. When appropriate, a monument would be placed there identifying the name and describing the namesake.

Councilman Hirniak reported that the 10 acre parcel on Park Avenue will maintain its role in the community as a recreation facility. The township maintains the ball fields and any improvements to the park are the responsibility of the owner of the Tamarack Day Camp. The ball fields are available to the township recreation programs, and assignment is done through the Recreation Department. The proposed name is Tamarack Fields. When appropriate, the municipality will erect a sign identifying the park as Tamarack Fields.

Councilman Hirniak reported that for now the 90 acre parcel on Calais Road will be referred to as “the 90 acres.” The committee decided that the naming of the parcel should wait to see what the Parks & Open Space Master Plan review unveils.

Mayor MacArthur asked Manager Lovell to have the township website reflect the new names.

3. Township Clerk Performance Review Process

Mayor MacArthur reported that the committee chaired by Councilman Hirniak, after completing the Township Clerk’s performance review, recommended creating a new format for the review. The Mayor asked Councilman Hirniak if he would chair the committee again to revise the performance review.

Councilman Hirniak stated that he would chair the committee and that he envisioned circulating the format from the previous review to the Council for their comments. Councilman Napoliello and Councilwoman Carey will also be on the committee.

4. Community Garden Update

Manager Lovell reported:

  • Councilwoman Veech & her group have been working on developing the concept of a community garden.
  • There are several expenditures needed:
    • The group has been working with a landscape architect who has provided a proposal for design work.
    • Two types of soil testing need to be performed, a pollutant scan and soil condition testing. For the pollutant scan four corings and a scan are done to check for toxins in the soil. The testing for soil conditions is sent to Rutgers Extension Agricultural School.
    • John McAndrew is willing to till the soil and will provide Manager Lovell with the cost. It is about a 1 acre plot that will be plowed.
    • These projects would be undertaken over the next 3 months and PO’s would be signed for them.
    • To get the projects underway, $6,000 would need to be authorized.
  • The proposed garden plot is going to be in the corner of the property closest to Calais Road and Dover Chester Road.
  • Once the design is provided, as part of the budget process the cost of hiring people to install the fence will be priced out. The Department of Public Works can install the water system.
  • There are two grants pending for the 90 acre parcel, one with DOT and one with DEP to develop a trail through the property. A trail head will be necessary, and that includes parking and a kiosk with information on the trail system.
  • Gardens can be built in a wetlands buffer. The concept is to build the garden in the wetlands buffer and put the lot to the side of the garden outside that buffer.

Councilwoman Veech reported:

  • The design consultant will provide information on size, cost to gardeners, etc., but it is expected that each plot will be 15 x 15. The money collected each year will go toward the water.
  • The money that is being invested now should eventually be recouped.
  • There are approximately 12 members who come to meetings every two weeks. Councilwoman Veech also invited Jim Marasca from the Parks Committee to join the group and John McAndrew wants to become an active member.
  • There were 49 people at the Country Fair who signed up that they were interested in getting a plot.
  • The group is thinking there will be between 60 and 70 plots initially. The electronic message signs will post the registration period. When the group decides that there is a long enough waiting list, an additional 30 plots could possibly open.
  • The reason the garden is proposed near the road is because there are water lines nearby.
  • The proposed trail and garden will share the same parking lot which will be gravel.
  • Sign up for the garden would be through the Recreation Department. There would be an initial educational meeting.
  • The initial year would include September through December. People may do winter gardening or prepare for the spring.
  • The garden would have a set of rules and regulations which would be signed off on when the plot is leased. There would be a volunteer coordinator to run the daily activities. This person would be part of a subcommittee of the Parks Committee. As part of the daily activities, he/she would hear complaints and take appropriate action on behalf of the subcommittee.
  • The fencing would have a lock and each member would have a key. There will be community rakes provided.
  • There are four Eagle Scouts interested in building a potting bench or shed.
  • The community, schools, and library are going to get involved. The library is going to host programs on gardening and the food pantry is going to have a plot to grow food for the pantry.

Mayor MacArthur explained that the Council had authorized an exploration of the community garden concept. He reported that two other sites had been considered, the land next to the Municipal Building and the Combs land. The Mayor clarified that the committee determined that the 90 acre parcel is the site in which they want to concentrate. They are also requesting authorization to spend $6,000 to determine if that site is feasible. They will then provide the Council with a more formal proposal.

Councilwoman Veech made a motion to authorize a maximum of $6,000 to move forward with the soil testing on the northwest corner of the 90 acre site, the consultant for the design, and the harrowing for the community garden. Councilman Guadagno seconded the motion, and the following roll call vote was taken:

5. Select Policy Renewal Limits

Mayor MacArthur reported:

  • The policy limits were reviewed at the last meeting. A Council decision was made over the objection of Councilman Guadagno to raise the General Liability limit to $15,000,000 and the Public Officials limit to $6,000,000.
  • After the meeting, Councilman Guadagno contacted the Mayor and asked if the discussion could be revisited.
  • Asked if the Council would consider reducing the General Liability limit from the previously agreed to $15,000,000 to $10,000,000 with a savings of $4,800 per year.

There was discussion about the limits and the savings. It was decided that more research should be done before determining the General Liability limit. Manager Lovell will contact the MEL to find out the recent verdicts against public entities and if there are a number of them that are getting close to 10 million dollars.

6. Tax Map Update in Advance of the Revaluation

Manager Lovell reported that one proposal was received to update the tax maps and to digitized them. The proposal was from Adams, Rehmann & Heggan of Hammonton, NJ; it was $170,000. The Manager will get a couple of more proposals and will report back to the Council in December or January with a recommendation. He expects the revaluation to be approximately $650,000 plus the $170,000. The tax maps will be done in 2014 and will need to be certified by the end of 2014 by the State of New Jersey. The revaluation will begin in 2015, it will use numbers from 2015 and 2016, and it will be on the books January 1, 2017.

K. OPEN TO THE PUBLIC

Judith Stewart of 114 Everdale Road again requested a consolidated budget for garbage and recycling so the residents could see that recycling saves the township money. She also expressed her concern that there is only a short time to find a replacement for the Township Manager position.

Jim McConnell of 45 Carroll Road reported that the Rescue Squad is sponsoring a blood drive at the RRS building from 9 a.m. to 2 p.m. on Sunday the 10th of November. He inquired how to get Rescue Squad information onto the electronic message signs in the future.

Chris Renda introduced himself as a writer for a new online publication called thealternativepress.com. He will be covering the Council meetings. Mayor MacArthur explained that Council members are appointed to different positions on January 1, but communications is always appointed to the Mayor. He said that Chris should first contact the Mayor, but if the subject deals with a town hall issue, then he should contact the Manager.

Seeing no one further from the public, the public portion was closed.

L. COUNCIL COMMENTS

Councilman Guadagno stated that some of the other agencies he is involved with give reports each month of budget spending and remaining budget. He asked if the other Council members would like to see a copy as an example. He also asked if new recycling trucks were going to be in the 2014 budget.

Manager Lovell replied that recycling trucks are not in the 2014 capital improvement program. The committee that was established, Councilman Napoliello, Councilman Guadagno, and Councilwoman Carey, are currently obtaining information from the private sector as well as the MCMUA for curbside recycling.

Mayor MacArthur asked if a finance committee had been created at the last meeting. Manager Lovell reported that the Council had directed that a resolution be drafted. Keli Gallo has drafted the resolution, but he needs to review it.

Mayor MacArthur replied that Councilman Guadagno could bring in the report for the future finance committee’s Council liaison.

Councilman Hirniak explained that he had been asked as the Council liaison to the Traffic Advisory Committee to find out if the members were interested in turning Dover Chester Road, from a point just south of the college in the direction of Morris Turnpike, into a Complete Street. The TAC met on November 5, and they were unanimously against the concept; they felt that there was no purpose.

Councilwoman Carey attended the Morris County Department of Human Services Public Forum. They highlighted the services that are available through the county including the Morris View Nursing Home, Employment Training Services, the Juvenile Detention Center, Youth Shelter, Aging, Disabilities and Veterans Services, Meals on Wheels, Office of Temporary Assistance, and Community and Behavioral Health Services. They went into a lot of detail about the people in Morris County receiving services. Councilwoman Carey stated that Freeholder Hank Lyon attended to give an award for the MCMATCH Food Drive which is the Morris County Municipal Action To Curb Hunger. It was a big food drive in September since the food banks get so low in the summer that they do a big drive in September. As part of the food drive discussion, they talked about every community, and they mentioned that there are 95 families in Randolph receiving services through the Interfaith Food Pantry. Freeholder Lyon gave awards to the communities that had brought in the most food: “less than 6,000 people” was Mendham Township; “6,000 to 15,000 population” was Rockaway Boro; and “over 15,000” was Mount Olive.

M. EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

1. The public shall be excluded from the following portion of the meeting.
