A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 5:00 p.m. by Mayor Potter. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 19, 2021, by emailing them the annual resolution adopted by the Council on November 18, 2021. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph and the Daily Record on November 24, 2021. The time change for this meeting was provided to the Morris County Daily Record on November 2, 2022 via email and advertised on November 4, 2022. It was also emailed to TapInto Randolph on November 2, 2022 and posted on the Township website.

B. PRESENTATION/PROCLAMATION

1. Proclamation: Diwali - The Festival of Lights: to be Presented by Mayor Potter on November 6, 2022, during Diwali Celebration at Aashirwad Palace of Randolph

2. Proclamation for Fire Chief Anthony Moschella - to be Presented by Mayor and Council at 65th Annual Fire Department Inspection Dinner, November 12, 2022

The council unanimously approved the two proclamations.

C. OPEN TO THE PUBLIC

Joseph Amaral of 14 Holly Drive asked if the council could share information about the second item designated for the Executive Session, titled, Attorney-Client Privilege-Restrictive Covenant, 1275 Sussex Turnpike. Manager Poff clarified that the discussion item is described on the agenda and has nothing to do with the application that is currently pending before the Board of Adjustment.

Seeing and hearing no one further, the public session was closed.

D. MANAGER'S REPORT

Manager Poff reported the following:

2023 Budget Preparation - Capital budget meetings have concluded and the statutorily required department budget hearings will be completed tomorrow. There are real economic pressures on the budget including medical benefits and pension increases. He will continue working with CFO Debbie Bonanno over the next several weeks to develop a draft budget document.

NJNG Update - Installation of a plastic gas main and residential gas services along Everdale Road and Mountainside Drive have begun. Construction will require full road closures of Everdale Road and Mountainside Drive as the gas installation progresses with detours in place. The motoring public can expect delays or plan alternate routes.

Traffic Advisory Committee Update - Township Engineer Paul Ferriero has been directed to contact the Morris County Department of Engineering and Transportation to request any traffic studies on the Sussex Turnpike corridor. This information may be of use to both County and Township Land Use Boards. The request emphasized that these updates are to be made in a timely manner.

E. APPROVAL OF MEETING MINUTES

1. Approving the Regular Council Meeting Minutes for September 22, 2022 and October 6, 2022

Councilmember Veech made a motion to approve the Regular Council Meeting Minutes for September 22, 2022 and October 6, 2022. Councilmember Carey seconded the motion, and the following roll call vote was taken:

F. COMBINED ACTION RESOLUTIONS

Manager Poff shared that there were many resolutions under the Combined Action items that authorize the award of contracts through the Morris County Cooperative Pricing Council.

He referred to items, R-265-22, R-266-22, and R-267-22, and shared that they pertain to treatment work approval for the Village Square development, and the endorsement of applications for water extension and utilities.

He referred to items, R-274-22, R-275-22, and R-276-22, and shared that the CFO recommended the cancellation of certain unused balances.

Item #6, R-242-22, Awarding a Contract for CCTV Inspection of Sanitary Sewer Collection Line (Jackson Brook Interceptor) - Councilmember Loveys inquired about the rate for the repair and CCTV. Manager Poff explained that the council is being asked to consider an award not to exceed $30,000 for the videoing and an amount not to exceed $7,050 for any sewer jetting if necessary. He stated that half of the total cost would be reimbursed by Mine Hill Township.

Item #28, R-264-22 Endorsing an Application for a Treatment Works Approval (TWA) for Village Square, a multi-family development at 931 Route 10, Block 44, Lot 4 - Mayor Potter shared that the Block/Lot for Village Square had four names for the lot in the Affordable Housing Plan. She wanted the Village Square name to be added to the Affordable Housing Status Map for consistency. Manager Poff explained that the Planning Department has already been advised to do so.

H. ORDINANCES: INTRODUCTION

1. Ordinance No. 32-22 An Ordinance of the Township of Randolph Appropriating $60,000 from the General Capital Improvement Fund - Recreation/Open Space for Various Improvements to Municipal Properties

Manager Poff explained that the purpose of this ordinance is to provide funding for Capital Improvements to various municipally-owned Recreation/Open Space properties. He briefly explained how the funds would be applied toward the improvement of existing Recreation/Open Space structures and the installation of accessory structures and the Brundage Park Lighting project.

BE IT RESOLVED, that an Ordinance entitled, "An Ordinance of the Township of Randolph Appropriating $60,000 from the General Capital Improvement Fund - Recreation/Open Space for Various Improvements to Municipal Properties," be introduced, read by title by the Township Clerk and passed on first reading.

BE IT RESOLVED, that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 8th, of December, 2022 at 6 o'clock in the evening, prevailing time, at the Town Hall in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said ordinance.

Councilmember Veech asked what the timeframe was for the Brundage Park lighting project. Manager Poff explained that the township is proceeding quickly with the project; they are waiting on word from the bonding company and the contractor. He stated that this ordinance was the first step in the process. He hoped to have the funding and change order in place in time for the Second Hearing of the ordinance on December 8, 2022. He anticipated that the project would be completed quickly.

Councilmember Hathaway asked if there were specific improvements lined up for Veterans Community Park. Manager Poff explained that the improvements were for the sheds at Veterans Park and the roof of the maintenance building at Brundage Park.

2. Ordinance No. 33-22 Bond Ordinance Making a Supplemental Appropriation of $150,000 for the Acquisition of a Fire Truck by the Township Heretofore Authorized to be Undertaken by the Township of Randolph Authorizing the Issuance of $142,800 Bonds or Notes of the Township for Financing Such Supplemental Appropriation

Manager Poff explained that the purpose of this ordinance is to purchase new and additional firefighting equipment for the preservation of life and property in the township and use by the Randolph Township Volunteer Fire Department, including one (1) fire truck, together with all equipment, attachments, and accessories. He noted that the public hearing date has been amended from the draft that was originally posted. The public hearing date for this ordinance is December 8, 2022.

I. DISCUSSION

1. 2022 Municipal Best Practices Inventory

Manager Poff explained that according to the State Fiscal Year 2023 Appropriations Act, the township is required to authorize the Best Practices Inventory. He provided a background on the purpose of the inventory and shared that the data allows the DLGS to obtain a variety of information about the status of municipal government practices throughout New Jersey.

He explained that the township has an obligation to complete the survey, have it reviewed by the council at a public meeting, and submit the inventory to the DLGS. He stated that the inventory scores impact municipal eligibility to receive state aid awards. He reported that the township far exceeded the number of points needed to receive 100% of its state aid. Councilmember Veech referred to the practice inventory. She inquired about the timeline for items identified as prospective. Manager Poff explained that those items would be considered for implementation in 2023.

Councilmember Veech asked about the inventory's questions relating to the implementation of particular ordinances; she specifically referred to an anti-nepotism ordinance. Manager Poff explained that some of the questions the state asks suburban municipalities do not consider if the organizations are set up to facilitate those particular ordinances or programs. He stated that they indicated no to the inventory question about an anti-nepotism ordinance because the township enforces anti-nepotism through its personnel policy which is adopted by resolution. He stated that the policy is enforced and complies with state requirements.

2. Proposed Zoning Amendments to the PO/R and B-1 Zones Allowing for Cooperative Sober Living Residences (CSLR)

Manager Poff explained that the township has been considering amending zoning for the purpose of identifying areas that are appropriate for Cooperative Sober Living Residences (CSLR). He stated that there has been discussion of establishing CSLR facilities as conditional uses in two identified zones; PO/R and B-1 Zones. He explained that since that time, the township has identified other mechanisms within the Municipal Land Use Law for possible consideration. He recommended that the discussion item be listed for Executive Session to allow the Township Attorney to discuss the various provisions for the council to hear.

Councilmember Forstenhausler made a motion to move this discussion item into the Executive Session. Councilmember Hathaway seconded the motion, and the following roll call vote was taken:

3. Affordable Housing Trust Fund Request

Manager Poff explained that his office received a request from Co-Home Inclusive Co-Living to ascertain speculative interest in providing up to four units of supportive housing for adults with disabilities. The Executive Director of the organization asked if the township would entertain providing financial assistance from the township's Affordable Housing Trust Fund in support of the development. Manager Poff reached out to obtain additional information, but the amount was not specified; he estimated that it would likely be $240k for the total project. Mr. Carney reported that the unencumbered balance in the Affordable Housing Trust Fund is $283,872. He added that there are certain categories within the spending plan that the township is obligated to fund. He did not have a specific recommendation. He wanted to advise the council of the request. He stated that he would follow up with more information.

J. OPEN TO THE PUBLIC

John Torres of 22 Prince Henry Drive asked if the four-unit development would count towards the township's Affordable Housing obligation. He asked if bonus credits were applicable for such a project. Attorney Buzak explained that supportive units are usually counted per bedroom. Manager Poff shared that it was one unit with four bedrooms and would count as four credits.

Mr. Torres referred to resolutions R-274-22, R-275-22, and R-276-22; he asked where the unused funds would go. Manager Poff explained that the funds would return to where they originally came from. He stated that once balances are canceled, they can be reappropriated by ordinance for items that qualify under Local Finance Law for capital purposes.

Mr. Torres asked if it would be possible to use those funds to offset the costs of building inclusive playgrounds in the community. Manager Poff stated that it was in the purview of the council.

Tim Potter of 11 Highview Terrace asked if the township has moved forward with publishing notice of the zone changes. Manager Poff informed Mr. Potter that the ordinance for the amendments required an introduction. He stated that the council would be considering further mechanisms relating to land use during the Executive Session. He stated that the ordinance would be drafted. Mr. Potter asked if there was a timeline for moving forward. Manager Poff stated that the objective was to address the change as quickly as the law would allow.

Joseph Amaral of 14 Holly Drive asked how he was to believe that the issue had nothing to do with the Board of Adjustment. Manager Poff explained that the law precludes the Township Council from discussing any matter before the Planning Board or Board of Adjustment.

Mr. Amaral stated that he wanted to get involved with Economic Development Committee. He found it hard to believe that someone with a case before the township was on a committee.

Deepak Das of 8 Devonshire Drive shared his concerns about the intersection of Hanover Avenue and Sussex Turnpike. He learned that there was a movement towards creating a multi-soccer field facility which would result in an increase in traffic. He stated that the council elects and places individuals on committees who have an obligation to look after the interest of the community and communicate with other committees and the Police Department when it comes to traffic concerns. He was worried that he would not be able to commute and stressed that the neighborhood should not be packed in. He referred to the 200ft List and suggested that the rule for notification be changed to accommodate a larger radius.

He asked why the township meetings were not broadcasted or streamed. He shared that he frequently travels and would like to participate. He stated that he had to submit an OPRA request to obtain meeting minutes. He expressed that he envisioned Randolph's downtown area to resemble Chester Township or Denville Township. He asked the council to consider the traffic and construction disruptions.

Mayor Potter referred to Mr. Deepak's comment on his frequent travel and inability to attend meetings. She stated that it was possible to visit the Municipal Building to discuss and share his concerns. Mr. Deepak stated that he could get much of the information from the minutes. Clerk Luciani informed Mr. Deepak of his remaining time. Mr. Deepak stated that the council had an obligation to foresee those developments and ensure that there would be a downtown area. Manager Poff shared that he and Mr. Carney have spoken with Mr. Deepak previously. Mr. Deepak asked the council to challenge themselves and work with the boards and committees.

Tim Potter of 11 Highview Terrace asked if there was any thought into developing a town center somewhere else. Mayor Potter explained that the developments would not affect the location of the town center. Mr. Potter suggested that the Greco property could build to accommodate a town center.

K. COUNCIL COMMENTS

Councilmember Forstenhausler, Councilmember Loveys, Councilmember Carey, Councilmember Hathaway, and Deputy Mayor Nisivoccia had nothing to report for this meeting.

Councilmember Veech reported that the Planning Board approved an application for a three-unit townhome development on Old Brookside Road next to the Pulte Development. The board also reviewed the 72-point checklist it uses for the application review purposes. They discussed additional changes and edits to the checklist.

Mayor Potter reported that she attended an Economic Development Committee meeting. She stated that the committee was focused on improving its social media presence. They were continuing with their 2022 initiatives and cultivating their 2023 initiatives.

She reported that the Environmental Action Plan Committee met with representatives of the project's consulting firm to discuss areas of possible action. She stated that input was taken from all members of the committee to add or delete action items. The list of considerations included air quality, community engagement, climate, energy, food, housing, economic development, natural resources, conservation, open space, transportation, waste management, and water. She explained that the consultant would prepare details for each of the action items and provide information regarding costs and available funding resources. She stated that the report would act like a tool for tracking.

She reported that the Diversity Workgroup met with the Randolph PEACE Group and the Interfaith Group. All three groups agreed to meet quarterly to problem solve, celebrate diversity initiatives, denounce hate rhetoric, and market initiatives. The next meeting is scheduled to be held in February 2023.

She attended the Morris County Chamber of Commerce Government Affairs Forum. The difficulties of red tape for New Jersey businesses were discussed. She shared information from the forum about communication with the EDC. She suggested that any local business struggling with red tap reach out and share their concerns so the township can work with state elected officials who will advocate on behalf of the businesses.

She informed the public that the Affordable Housing Map has been updated on the website and has been broadcasted on the township's social media channels.

L. EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

1. The public shall be excluded from the Executive portion of the meeting.

2. The general nature of the subject matter to be discussed is as follows:

a. Agreement Negotiation: Attorney-Client Privilege - Shongum Lake POA
b. Attorney-Client Privilege - Restrictive Covenant, 1275 Sussex Turnpike
c. Proposed Zoning Amendments to the PO/R and B-1 Zones Allowing for Cooperative Sober Living Residences (CSLR)

3. As nearly as now can be ascertained, the matter or matters to be discussed at this time will be disclosed to the public at such time and under such circumstances as are prescribed by law.

4. At the conclusion of the Executive Session, the Council may or may not reconvene in public session for the purpose of taking formal action.
