A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Forstenhausler. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 17, 2017 by emailing them the annual resolution adopted by the Council on October 10, 2017. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph on November 23, 2017, and in the Daily Record on November 21, 2017.

3. Pledge of Allegiance

Mayor Forstenhausler led the Pledge of Allegiance.

B. OPEN TO THE PUBLIC

Peter Grzesiowski of 4 Cypress Place spoke about Ordinance 31-91 prohibiting overnight parking between 2 am and 6 am. He felt that the enforcement should be considered on a case by case basis; he does not have enough room in his driveway for the number of cars in his family. Occasionally they have left a car on the street, and have gotten a ticket. He explained the last ticket was not left on the car, but it was mailed. Mr. Grzesiowski asked if there was a way to have the police give a warning first instead of initially issuing a ticket. Manager Mountain replied that the Council could decide if they want to review the ordinance and the policy behind it; if so, it would be placed on a future meeting agenda. He explained that enforcement discretion is more difficult; however, the Police Chief does not have the authority to tell an officer to give warnings unless the ordinance is written that way. Issuance of a warning or ticket is at the officer’s discretion. Mayor Forstenhausler thought the Council could discuss it at a future meeting. Councilwoman Veech suggested this be presented to the Traffic Advisory Committee (TAC), and have them make a recommendation to the Council. Councilman Guadagno stated that he did not like that idea. He explained that some streets are narrow, and if two cars are on opposite sides of the roads, two cars could not drive past each other; he felt the ordinance was written correctly. Councilwoman Veech still felt it appropriate for the TAC to review and provide input. Councilman Tkacs stated that he would present it to the TAC. Mr. Grzesiowski added that cars are permitted to park on the streets during the day since the ordinance pertains to overnight parking. Therefore, the width of a street is not really the basis for the ordinance.

Judith Stewart of 114 Everdale Road commented on two upcoming events that were not on the agenda the day prior; the pancake breakfast at the Ironia fire house and the Council candidates’ forum.

Seeing no one further from the public, the public portion was closed.

C. MANAGER’S REPORT

Manager Mountain reported the following:

  • JCP&L meeting regarding tree trimming—he, Mayor Forstenhausler and township staff met with Rob Walton, the new JCP&L forester, to review the tree trimming taking place by the contractors. They will be removing trees and tree limbs in the right of way that impact power lines near the Mt. Fern substation; this substation serves 6,500 properties. In addition to the targeted areas, the forester was asked to review some locations outside of the targeted area; he agreed to review and add them to the list for trimming. Jackie Espinosa, the JCP&L area manager for Randolph, is scheduled to attend the November 29th Council meeting; she will review the company’s plan for investing in infrastructure as well as responses to storms from last March.

    Councilman Tkacs asked if the Manager had gotten any comments on the tree trimming. Manager Mountain replied that there have been a few comments, mostly positive, but there were a couple negative. In response to the negative comments, the township has reinforced that they are targeting ash trees in addition to other species that are growing in the lines; this right of way clearing is a necessity to help with safety based upon the recent storms. Councilwoman Veech added that they were trimming trees along Route 10 East during the morning rush hour which caused a traffic backup. She suggested the Manager talk to them about considering the flow of rush hour traffic when they decide where they will be working. There was some discussion about the right of way, the trees located under the power lines, and the trimming of tree limbs versus tree removal. Mayor Forstenhausler added that the lines lower on the poles are the telecommunication and cable lines; JCP&L does not trim the trees from those lines, only the power lines.
  • Trail marking/way-finding project—he, Russ Newman, and Darren Carney met with the consultant, Greener by Design to review the status. The signs and posts have been determined, and the consultant is working on purchasing them. The implementation plan was reviewed; it will be a combination of township staff, volunteer groups, and Greener by Design staff. The first set of installs will take place in November; he will let the Council know once the dates are selected.
  • Fords Road retaining wall project—the contractor has made great progress; the old walls have been removed, the trees have been cleared, and most required only grading, although a couple required small walls. The residents are pleased with the project.
  • Butterworth III sewer project—it is nearing completion; the contractor has finished the installation of the sanitary sewer lines. The project includes Jason Lane, Nucco Terrace, Old Shunpike Road, and Carellen Place. The power company is working to complete the electrical service needed for the pump station. The anticipated completion date is early to mid-January; this will allow the aforementioned properties as well as the businesses and residential properties on Sussex Turnpike between Calais Road and Millbrook Avenue to connect into the sewer system.

D. COMBINED ACTION RESOLUTIONS

1. Authorizing the Manager to Endorse the Treatment Works Approval (TWA) Application to NJDEP for the Construction of a Sewer Main Extension for the County College of Morris in the Township of Randolph

WHEREAS, the County College of Morris, (the “Applicant”) has planned the construction of an advanced engineering and technology building and a future classroom building; and

WHEREAS, the permit is to convey the effluent from the two buildings with a total design flow of 24,000 gallons per day through the Randolph Township system to the RVRSA treatment facility; and

WHEREAS, the application must be submitted to the New Jersey Department of Environmental Protection to obtain a TWA approval for the construction of the gravity sewer main for this project; and

WHEREAS in order for the New Jersey Department of Environmental Protection to consider the application, the same must be endorsed by the Township among others; and

WHEREAS the Township desires to authorize the execution of the endorsement of the said application,

NOW, THEREFORE, BE IT RESOLVED, by the Township Council of the Township of Randolph, County of Morris, State of New Jersey;

  1. The Township Manager is herby authorized and directed to execute the appropriate endorsements for the Treatment Works Approval, together with other appropriate officers and employees of the Township of Randolph, and hereby authorized to take all actions necessary to effectuate the purpose.
  2. This resolution shall take effect immediately.

WHEREAS, the permit is to convey the effluent from 11 single family residences with a total design flow of 3,300 gallons per day through the Randolph Township system to the RVRSA treatment facility; and

WHEREAS, the application must be submitted to the New Jersey Department of Environmental Protection to obtain a TWA approval for the construction of the gravity sewer main for this project; and

WHEREAS in order for the New Jersey Department of Environmental Protection to consider the application, the same must be endorsed by the Township among others; and

WHEREAS the Township desires to authorize the execution of the endorsement of the said application,

3. Awarding a Contract for Preventive Maintenance/Repair of HVAC Equipment of Township Buildings/Complexes for the Period of January 1, 2019 through December 31, 2019, with the Option to Extend for One Two-Year Period or Two One-Year Periods

WHEREAS, the Township of Randolph advertised for the Preventive Maintenance/Repair of HVAC Equipment of Township Buildings/Complexes in accordance with Local Public Contracts Law and received bids on October 10, 2018; and

WHEREAS, 2 bids were received; and

WHEREAS, bids were received from the following in the order listed and for the bid prices shown:

Air Systems Maintenance, Inc., Kenilworth, NJ: $49,655;
Echelon Services, LLC, Hamburg, NJ: $100,000; and

WHEREAS, the Buildings & Grounds Supervisor and the Purchasing Agent recommend the award of the contract to Air Systems Maintenance, Inc. as the lowest responsive, responsible bidder; and

WHEREAS, the Township of Randolph desires to award a contract for the Preventive Maintenance/Repair of HVAC Equipment of Township Buildings/Complexes to Air Systems Maintenance, Inc. of Kenilworth, NJ in the amount of $49,655 for the period of January 1, 2019 through December 31, 2019 with the option to extend for one (1) two-year period or two (2) one-year periods at the same price; and

WHEREAS, the Finance Officer has certified to the availability of funds for this project from 01-201-26-310-305 pending budget adoption in 2019.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Air Systems Maintenance, Inc. of Kenilworth, NJ for the Preventive Maintenance/Repair of HVAC Equipment of Township Buildings/Complexes for the price of $49,655 per their bid proposal for the period of January 1, 2019 through December 31, 2019 with the option to extend for one (1) two-year period or two (2) one-year periods at the same price.

CERTIFICATION OF AVAILABILITY OF FUNDS

As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Darren Maloney, Director of Finance for the Township of Randolph, have ascertained that funds will be available in the 2019 Budget (pending adoption), Building and Grounds, O&E to award a contract to Air Systems Maintenance to maintain/repair HVAC equipment, per its response to a township bid solicitation.

4. Refunding Tax Sale Certificate #17-08 for Block 42.03, Lot 14, 7 Prince Henry Drive to US Bank Customer BV002 Trst & Crdtr—$6,650.56

WHEREAS, Tax Sale Certificate #17-08 held by US Bank cust BV002 Trst & Credtr, and currently assessed to Federal National Mortgage known as, Block 42.03, Lot 14 and also known as 7 Prince Henry Drive, and;

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed by Phoenix Asset Management who represents the property owner. The redemption includes principal and interest in the amount of $3,650.56 and the return of the premium in the amount of $3,000.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the total amount of $6,650.56 to US Bank cust BV002 Trst & Crdtr, 50 South 16th Street—Suite 2050, Philadelphia, PA 19102-2513 the lien holder of Tax Sale Certificate #17-08.

5. Refund Overpayment of Taxes due to a Reduction in Assessed Valuation for Tax Year 2015 for Block 27.01, Lot 22.02 for 340 Dover Chester Rd. to Jacobus & Associates, LLC—$2,664.99

WHEREAS, Gordon Demario has been granted a reduction in assessed valuation for the tax year 2015 by the Tax Court of New Jersey on Block 27.01, Lot 22.02, known as 340 Dover-Chester Road; and

WHEREAS, the Tax Office received the documentation issued by the Tax Court of New Jersey for a correction to the tax assessment for the tax year 2015, this order has resulted in an overpayment in the amount of $2,664.99 for the tax year 2015.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $2,664.99 to Jacobus & Associates, LLC Trustee for Demario, Gordon, Jacobus & Associates, LLC, 201 Littleton Road, 1st Floor, Morris Plains, NJ 07950.

6. Awarding a Contract for Dumpster Garbage (Solid Waste) Collection Services for a 5 Year Period Beginning January 1, 2019 through December 31, 2023 to Waste Management of NJ for a Total of $1,680,264.00

WHEREAS, the Township of Randolph advertised for Dumpster Garbage (Solid Waste) Collection Services in accordance with Local Public Contracts Law and received bids on September 21, 2018; and

WHEREAS, 3 bids were received; and

WHEREAS, bids were received from the following in the order listed and for the bid prices shown:

Waste Management of New Jersey, Inc., Ewing, NJ:
One Year Contract Total (2019): $316,488.00;
Three Year Contract Total (2019-2021): $978,228.00;
Five Year Contract Total: (2019-2023): $1,680,264.00; and

WHEREAS, the Township of Randolph desires to award a five (5) year contract for the period of January 1, 2019 - December 31, 2023 for Dumpster Garbage (Solid Waste) Collection Services to Waste Management of New Jersey, Inc. of Ewing, NJ in the amount of $1,680,264.00 (2019: $316,488.00, 2020: $325,980.00, 2021: $335,760.00, 2022: $345,828.00, 2023: $356,208.00).

WHEREAS, the Finance Officer has certified to the availability of funds for this project from 01-201-26-305-301 pending budget adoption in the awarded budget years.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Waste Management of New Jersey, Inc. of Ewing, NJ for Dumpster Garbage (Solid Waste) Collection Services for the price of $1,680,264.00 per their bid proposal.

7. Authorizing Contracts with Additional Approved Vendors under the MCCPC

WHEREAS, the Township of Randolph pursuant to N.J.S.A. 40A:11-11(5) and N.J.A.C. 5:34-7.1 et seq. may, by resolution and without advertising for bids, purchase any goods or services under a Cooperative Pricing System of which the Township is a member; and

WHEREAS, the Township of Randolph on March 1, 2018 via R 76-18 authorized contracts with certain approved MCCPC Contract Vendors and on May 17, 2018 via R 119-18, on July 26, 2018 via R 208-18, on September 16, 2018 via R 242-18 and on October 2, 2018 via R 287-18 authorized additional approved Vendors; and

WHEREAS, it’s been determined that contracts in excess of $17,500 will be entered into with additional MCCPC Contract Vendors; and

WHEREAS, the additional MCCPC Contract Vendors have been added to the attached list; and

WHEREAS, the Township of Randolph anticipates entering into contracts in excess of $17,500 with the attached referenced Contract Vendors through this resolution and properly executed purchase orders/contracts as needed, which shall be subject to all the conditions applicable to the current co-op contracts.

NOW, THEREFORE, BE IT RESOLVED that the Township of Randolph authorizes the Purchasing Agent to purchase certain goods and services from the additional approved MCCPC Contract Vendors on the attached list, pursuant to all conditions of the individual co-op contracts; and

BE IT FURTHER RESOLVED that the governing body of the Township of Randolph pursuant to N.J.A.C. 5:30-5.5(b) regarding the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Financial Officer via an authorized Purchase Order; and

BE IT FURTHER RESOLVED that the duration of the contracts between the Township of Randolph and the referenced MCCPC Contract Vendors shall be until December 31, 2018 or upon expiration of the vendor’s contract whichever is first.

8. Refund Tree Bond for Block 77, Lot 13, 7 Ashwood Avenue to Ray Valle—$1,800.00

WHEREAS, the Planning and Zoning Department received a tree bond posted by Ray Valle, 7 Ashwood Avenue for Block 77, Lot 13 in the amount of $1,800.00; and

WHEREAS, the requirements have been met and completed.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator that the tree bond in the amount of $1,800.00 be refunded to Ray Valle, 7 Ashwood Avenue, Randolph, NJ 07869.

F. ORDINANCES: SECOND READING/PUBLIC HEARING

1. Ordinance No. 21-18: An Ordinance Amending and Supplementing Sections 15.2.2, and 15-92 of the Code of the Township of Randolph Regarding Performance, Maintenance, and Stabilization Guarantees—Carry to November 29, 2018

BE IT RESOLVED, that an Ordinance entitled “AN ORDINANCE AMENDING AND SUPPLEMENTING SECTIONS 15.2.2, AND 15-92 OF THE CODE OF THE TOWNSHIP OF RANDOLPH REGARDING PERFORMANCE, MAINTENANCE, AND STABILIZATION GUARANTEES” be read by title on second reading and a hearing held thereon.

Manager Mountain explained that this ordinance will need to be carried to the November 29, 2018 meeting. The ordinance was properly provided to the newspaper for advertisement, and the affidavit was received that it was posted; however, it never was actually printed in the newspaper. Therefore, the Council cannot proceed with the public hearing. Keli Gallo explained the Council can make a motion to carry the ordinance to the November 29, 2018 meeting, and Donna Luciani will need to re-advertise.

Councilwoman Veech made a motion to carry Ordinance 21-18 to the November 29, 2018 Council meeting. Deputy Mayor Loveys seconded the motion, and the following roll call vote was taken:

2. Ordinance No. 22-18: An Ordinance Authorizing the Vacation of a 50 Foot Right-of-Way within the Township of Randolph

BE IT RESOLVED, that an Ordinance entitled “AN ORDINANCE AUTHORIZING THE VACATION OF A 50 FOOT RIGHT-OF-WAY WITHIN THE TOWNSHIP OF RANDOLPH” be read by title on second reading and a hearing held thereon.

Manager Mountain explained that this ordinance vacates a small, 50 foot right of way that is no longer needed for municipal purposes; this right of way ran into James Andrews Park off of Shongum Road. This vacation was old; however, it was never memorialized at the county level.

Seeing no one from the public, the public portion was closed.

BE IT RESOLVED, that an Ordinance entitled, “AN ORDINANCE AUTHORIZING THE VACATION OF A 50 FOOT RIGHT-OF-WAY WITHIN THE TOWNSHIP OF RANDOLPH” be passed on final reading and that a Notice of Final Passage of said Ordinance be published in the official designated newspaper according to law.

G. ORDINANCES: INTRODUCTION

1. Ordinance No. 23-18: An Ordinance Amending Sections 15-2.2, 15-50.2, 15-43.9, 15-43.21 and 15.81.2 of the Land Development Ordinance of the Township of Randolph, Morris County, New Jersey

Manager Mountain explained that in the spring Darren Carney presented to the Council a set of recommendations from the annual report that the Board of Adjustment compiles each year. In that report, there were recommendations for adjustments to the definition of how houses of worship are handled in the ordinances, as well as how parking is defined where there is no seating involved. There were also recommendations about LED signs related to gas station operations. Darren explained that the board has heard a number of applications from gas stations changing their signage to LED, and it was felt that the township should move to make the conditions under which they have been approving those LED signs part of the Land Use Ordinance. This would avoid those operators having to come in for a variance request for something that has been approved in the past. There was also a recommendation related to the site plan exemptions pertaining to cellular communication towers in locations where the commercial equipment is being added in an existing location. The federal laws have changed such that the local zoning powers can no longer regulate this; the ordinance memorializes it so the restriction is no longer applied on a local level.

BE IT RESOLVED, that an Ordinance entitled “AN ORDINANCE AMENDING SECTIONS 15-2.2, 15-50.2, 15-43.9, 15-43.21 AND 15.81.2 OF THE LAND DEVELOPMENT ORDINANCE OF THE TOWNSHIP OF RANDOLPH, MORRIS COUNTY, NEW JERSEY” be introduced, read by title by the Township Clerk and passed on first reading.

BE IT RESOLVED, that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 29th of November 2018 at 7 o’clock in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said ordinance.

BE IT FURTHER RESOLVED, that the Township Clerk be authorized and directed to advertise said Ordinance in full or by summary with the notice of introduction thereof, in the official designated newspaper according to law.

Deputy Mayor Loveys noted that one recommendation that was not addressed was regarding the self storage facility; he asked if it was felt that nothing needed to be changed. Manager Mountain replied that the recommendation was that it needed to be looked at further; it was suggested that when the master plan subcommittee goes back to work, it should be added to their agenda so they can make a recommendation. Keli Gallo added that Deputy Mayor Loveys noted that there was a typographical error on page 3, section five, “LED Gas station price designation,” number 2; the word “blinking” should be “blink,” and should read, “the LED signage is not permitted to move, revolve, blink, flash, vibrate, or flicker.”

Councilman Guadagno made a motion to introduce the ordinance, with the typographical error corrected. Councilwoman Veech seconded the motion, and the following roll call vote was taken:

I. COUNCIL COMMENTS

Councilman Guadagno attended the Trails Committee meeting; however, the Manager presented the information in his report.

Councilman Napoliello attended the Board of Health meeting; there will be a female cancer screening on October 25th, a blood pressure screening on November 7th, and a few flu clinics are also scheduled.

Councilman Tkacs attended the Park Alliance Awards meeting on October 11th.

Councilwoman Veech attended the Parks Committee meeting; the Greener by Design proposal was reviewed. They are looking for people to volunteer. There was also a discussion about the number of intersections and colors, and everything the Trails Committee went through including bar codes at the intersections. There are four new areas for the deer hunters this year.

Councilwoman Veech distributed an invitation to Frank Druetzler’s retirement party; he was the long-time mayor of Morris Plains.

Councilwoman Veech also reported that there were two bench dedications, one for the Brembs, and one for Mr. Knothe.

Mayor Forstenhausler reported that he was invited to speak at the installation of a new Rabbi at Temple Shalom in Succasunna; it was a nice event, with many Randolph residents in attendance.

Mayor Forstenhausler attended the Safety Committee meeting; they reviewed incidents and accidents during the past quarter.

Mayor Forstenhausler also reported that he and several other Council members attended the Casino Night fundraiser at the Shongum Fire Company.

Deputy Mayor Loveys asked for more information on the way-finding project. Manager Mountain replied that the dates for the install are still being discussed; they will be implementing the signage in phases.

Deputy Mayor Loveys took a moment to acknowledge the young woman who lost her life on Route 10, and her family, and what they must be going through.

J. EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

1. The public shall be excluded from the Executive portion of the meeting.

2. The general nature of the subject matter to be discussed is as follows:

3. As nearly as now can be ascertained, the matter or matters to be discussed at this time will be disclosed to the public at such time and under such circumstances as are prescribed by law.
