A. OPENING OF REGULAR MEETING
1. Call to Order
A regular meeting of the Randolph Township Council was called to order at 6:00 p.m. by Mayor Veech. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 19, 2014, by emailing them the annual resolution adopted by the Council on December 4, 2014. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph, and the Daily Record on December 24, 2014. The time change for this meeting was emailed to the Daily Record on August 27, 2015 and advertised on August 31, 2015.

B. EXECUTIVE SESSION
WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and
WHEREAS, this public body is of the opinion that such circumstances presently exist.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:
1. The public shall be excluded from the executive portion of the meeting.
2. The general nature of the subject matter to be discussed is as follows:

C. PRESENTATIONS/PROCLAMATIONS
1. Recognition—Fire Department Grant Award—Steven Cohrs
Mayor Veech introduced Chief Cohrs.
Chief Cohrs introduced Dan Cohn, and explained that he is a Junior Firefighter with Company #4 who joined the department in October 2014. The Chief explained that Dan was in the summer program, and completed the Junior Firefighter program at the Academy; he is also a senior at Randolph High School. Chief Cohrs congratulated Dan on his accomplishment.
Chief Cohrs explained that the department received a series of grants from the Fireman’s Fund and CRC Insurance Services. The three grants, totaling $37,699, will fund life-saving ice and hydraulic rescue equipment, and new thermal imaging cameras. Mayor Veech thanked Chief Cohrs on behalf of the Council on his efforts to secure the grants.
D. OPEN TO THE PUBLIC
Seeing no one from the public, the public portion was closed.
E. MANAGER’S REPORT
The Manager reported the following:
- Road Resurfacing Program—the resurfacing of all of the streets and roads included in the 2015 capital plan has been completed. Public Works will be completing work on the roads scheduled for in-house maintenance by the end of September. This year’s program proved more challenging as a result of conditions created by the harsh winter weather the past two years; additional resources needed to be expended on base repairs for several roads, most notably Quaker Church Road. The supplemental funding ordinance on for first reading later in the meeting will cover these costs.
- Bond Sale—the bond sale was conducted on August 27 for securing long term financing for an issuance of $15,380,000. The low bid received from Bank of America - Merrill Lynch provides for an average interest rate of 2.97%. By locking in on this rate the township is now insulated from rising interest rates. He felt the timing of the sale and the township’s AAA bond rating were the primary factors contributing to this result.
- Emergency Towing Services—for a second time, the bids for emergency towing services are being rejected. The contract provides for a sole provider to be available 24-7 for emergency towing services. The current provider has advised that he is no longer in a position to bid on the contract, and there does not appear to be viable vendor who is able to meet the terms of the contract. He and Chief Stokoe have reviewed this with Tiena Cofoni and Liz Crescibene, and it is felt that the best means to address this service going forward would be to institute rotating arrangement in which multiple towing companies perform the service. This approach has been instituted in most of the neighboring municipalities, and it seems to be working very well. This requires the Council to adopt a towing services ordinance with specific details; the Manager will present an ordinance at a future meeting. The current contractor has agreed to extend his contract which will cover the township until the change is made.
- Sussex Turnpike—the Sussex Turnpike Water Line project will begin on or about the third week of September. The project runs from Calais Road to West Hanover Avenue and should be complete by the end of November. Morris County has provided an initial schedule for the Sussex Turnpike Improvement Project; the schedule and information will be distributed to the Council shortly, and information on the project will be posted on the township website. The County expects to begin the project at the Dover Chester Road intersection on or about September 22nd; they are planning to complete improvements this fall to that intersection and the Calais Road intersection.
- County College Water Line Extension/Meter Installation—township crews are nearing completion of the County Water Line Extension/Meter Installation corresponding with the County’s construction of a new Route 10 entrance to the college. The extension of the line into the campus has been completed, and the additional fire hydrant has been installed. The cost of the project being done in-house is approximately $40,000; a private contractor would have likely been two to three times this cost. The Manager commended Ralph Carchia for his oversight on this project and the water and sewer employees for their fine work in completing this important project.
Councilman Loveys asked some questions about the specific details of the Sussex Turnpike Water Line project and the County College Water Line Extension/Meter Installation project, Manager Mountain and Ralph Carchia responded.
Councilman Guadagno asked for clarification on the towing services bid regarding the number of bidders and how they would determine the limit as well as how the rotation would work. Manager Mountain explained that the ordinance would specify the parameters under which the services are to be provided, including the rotation schedule. Attorney Buzak stated that the ordinance is somewhat complicated, but the concept is that everyone gets an equal chance for the rotation, and how that is structured will be part of the ordinance.
Councilman Forstenhausler asked when the retaining wall project is expected to be completed for the three properties on Everdale Road. Manager Mountain stated that it should be completed by the end of September.
F. APPROVAL OF MEETING MINUTES

G. COMBINED ACTION RESOLUTIONS
Item #25, Water Master Plan—Councilman Guadagno commented that this plan is the first time that older parts of Randolph are included, and wanted to be sure that the state and the MUA know that this water is allocated for them and not to use them on new developments, etc. He is in full support of the Water Master Plan.
Item #26, Additional funds for the Road Overlay program—Councilman Forstenhausler commented that the road overlay program went over $1,000,000 for 2015. Councilman Loveys asked for clarification that the Resolution is just amending the Capital Budget, and that the ordinance will appropriate the funding. Manager Mountain explained that he was correct, that the format to follow is to amend the amount in the original budget to allow for the higher amount, and then the ordinance appropriates the money. They discussed where the funding amounts were coming from.

1. Release of Cash Lawn Stabilization Bond for Seeding and Grading on New Construction at 26 Carrell Rd., Block 86, Lot 7.02 to Gloria Catania—$1,500.00

WHEREAS, the Engineering Department has received a request from Gloria Catania for the release of a $1500.00 cash lawn stabilization bond posted for the purpose of seeding and grading for a new home construction at 26 Carrell Rd., Bl. 86/Lot 7.02, Randolph; and
WHEREAS, the Lawn stabilization Bond consisted of a $1500.00 cash bond, which was received and deposited with the Finance Department on Dec. 19, 2014; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the seeding and grading at 26 Carrell Rd., Block 86/Lot 7.02 within the Township Right of way; and
WHEREAS, the Engineering Department has inspected the seeding and grading work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $1,500.00 be refunded to Gloria Catania, 26 Carrell Rd., Randolph, NJ 07869.
2. Release of Cash Driveway Bond for Grading and Paving at New Construction at 26 Carrell Rd., Block 86, Lot 7.02 to Gloria Catania—$1,000.00

WHEREAS, the Engineering Department has received a request from Gloria Catania for the release of a $1000 cash driveway bond posted for the purpose of driveway grading and paving for a new home construction at 26 Carrell Rd. Block 86/Lot 7.02, Randolph; and
WHEREAS, the Driveway Bond consisted of a $1000.00 cash bond, which was received and deposited with the Finance Department on Dec. 19, 2014; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the grading and paving of the driveway at 26 Carrell Rd., Block 86/Lot 7.02 within the Township Right of way; and
WHEREAS, the Engineering Department has inspected the work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Driveway Bond in the amount of $1000.00 be refunded to Gloria Catania, 26 Carrell Rd., Randolph, NJ 07869.

WHEREAS, the Engineering Department has received a request from Gloria Catania, for the release of a $500.00 cash road opening bond posted for purpose of connecting to the water line at 26 Carrell Rd., Block 86/Lot 7.02, Randolph; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on Oct. 14, 2014; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the connection of the water line at 26 Carrell Rd., Block 86/Lot 7.02 within the Township right of way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Gloria Catania, 26 Carrell Rd., Randolph, NJ 07869.
4. Refund Overpayment of 2015 Taxes for Block 47, Lot 34 at 95A Calais Road to Calais Road Farms—$658.90

WHEREAS, Calais Road Farms has overpaid 2015 taxes in the amount of $658.90 on Block 47, Lot 34, 95A Calais Road; and
WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $658.90 to Calais Road Farms.
5. Refund Overpayment of Taxes for Block 82, Lot 40.1 at 651 Millbrook Avenue to Resurrection Parish—$539.34

WHEREAS, Resurrection Parish has overpaid 2015 taxes in the amount of $539.34 on Block 82, Lot 40.1, 651 Millbrook Ave; and
WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $539.34 to Resurrection Parish.
6. Refund Overpayment of 2015 Taxes at Block 81, Lot 65 at 129 Dover Chester Road to Jackson/Shirley Dickerson—$2,509.30

WHEREAS, George Jackson/Shirley Dickerson overpaid 2015 taxes in the amount of $2,509.30 on Block 81 Lot 65, 129 Dover-Chester Road; and
WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $2,509.30 to George Jackson/Shirley Dickerson.
7. Refund Overpayment of 2015 Taxes for Block 40, Lot 4 for 52 Warren Road to Anuf/Shawnta Dut $2,249.10

WHEREAS, Anuf/Shawnta Dut has overpaid 2015 taxes in the amount of $2,249.10, on Block 140, Lot 4, known as 52 Warren Road; and
WHEREAS, it is recommended by the Tax Collector that this payment be refunded at this time.
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the payment of $2,249.10 to Anuf/Shawnta Dut.
8. Refund Portion of $1,200 Registration for Recreation Ice Hockey as Child Will be in Travel Ice Hockey Instead to Kathryn/James Lord—$550.00

WHEREAS, Kathryn/James Lord registered their child for Randolph Township Recreation Ice Hockey program and paid the fee of $1,200.00; and
WHEREAS, their son will be playing in the Randolph Township Ice Hockey TRAVEL program instead.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Russ Newman, Director of Parks, Recreation and Community Services that $550.00 be refunded to Kathryn/James Lord, 16 Orchard Drive, Randolph, NJ 07869.
9. Authorizing Contracts with an Additional Approved State Contract Vendors for Contracting Units Pursuant to N.J.S.A. 40:A:11-12a

WHEREAS, the Township of Randolph on March 10, 2015 via R 73-15 and on July 9, 2015 via R 187-15 authorized contracts with certain approved State Contract Vendors pursuant to N.J.S.A. 40A:11-12a and N.J.A.C. 5:34-7.29(c); and
WHEREAS, it’s been determined that contracts in excess of $17,500 will be entered into with an additional State Contract Vendor; and
WHEREAS, the additional State Contract Vendor has been added to the attached list; and
WHEREAS, the State of NJ has rebid contract T2108, issuing new vendor contract numbers; and
WHEREAS, those numbers have been updated on the attached list.
NOW, THEREFORE, BE IT RESOLVED, that the Township of Randolph authorizes the Purchasing Agent to purchase certain goods and services from the additional approved New Jersey State Contract Vendor on the attached list, pursuant to all conditions of the individual State contracts; and
BE IT FURTHER RESOLVED that the governing body of the Township of Randolph pursuant to N.J.A.C. 5:30-5.5(b) regarding the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Financial Officer via an authorized Purchase Order; and
BE IT FURTHER RESOLVED that the duration of the contracts between the Township of Randolph and the Referenced State Contract Vendors shall be until December 31, 2015 or upon expiration of the vendor’s contract whichever is first.

WHEREAS, the bid from Napoli Transportation Inc dba C&L Towing Service did not include the mandatory references, list of potential drivers’ names, addresses and drivers’ license numbers, and detailed vehicle listing; and
WHEREAS, the bid from Sameis Holdings LLC dba Tow New Jersey did not include the mandatory Consent of Surety, a list of potential drivers’ names, addresses and drivers’ license numbers, detailed vehicle listing, and storage facility information and took exceptions to how they would perform the services, in conflict with Township specifications; and
WHEREAS, the bid from Ajaco Towing Inc. did not include the mandatory Consent of Surety, references, a list of potential drivers’ names, addresses and drivers’ license numbers, detailed vehicle listing and the address of the storage facility; and
WHEREAS, all three bids had major deficiencies which affect the Township’s ability to determine if the contract can be completed.
NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that all bids for the Towing Services - REBID #2 bid be rejected for the reasons stated above.
11. Authorizing the Increase of an Award of Professional Services Agreement to Apruzzese McDermott Mastro & Murphy for Police General Legal, Hearings and Police Contract Negotiations Services for the 2015 Calendar Year—Not to Exceed $22,500

WHEREAS, the Township of Randolph (“Township”) requires Police General Legal, Hearings and Police Contract Negotiations services for the 2015 calendar year; and
WHEREAS, a professional services agreement was awarded on January 1, 2015 via R 11-15 to Apruzzese McDermott Mastro & Murphy located at PO Box 112, 25 Independence Blvd #112, Liberty Corner, NJ 07938 to provide the necessary Police General Legal, Hearings and Police Contract Negotiations services for a total amount not to exceed $15,000 ($155 per hour); and
WHEREAS, additional legal services in the amount of $7,500 are anticipated to be needed for the remainder of the year; and
WHEREAS, Elizabeth Crescibene, Purchasing Agent, has determined and certified in writing that the value of these additional services will make the entire contract amount exceed $17,500; and
WHEREAS, the anticipated term of this contract is for the 2015 calendar year; and
WHEREAS, Apruzzese McDermott Mastro & Murphy has already submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification should the dollar amount of their contract be amended during the 2015 calendar year and exceed $17,500 and the requirements of the Anti Pay-to-Play Legislation would then apply; and
WHEREAS, there are funds available for the retention of such additional professional services; and
WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:
- The Township hereby increases the awarded amount of the professional services agreement to Apruzzese McDermott Mastro & Murphy by $7,500 from $15,000 to $22,500 for Police General Legal, Hearings and Police Contract Negotiations services for the remainder of the 2015 calendar year.
- Apruzzese McDermott Mastro & Murphy shall be compensated for a total contract amount not to exceed $22,500 ($155 per hour).
- The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
- The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.
- The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
- It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.
- This Resolution shall take effect immediately.
CERTIFICATION OF AVAILABILITY OF FUNDS
Dated: September 3, 2015
As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Darren Maloney, Director of Finance for the Township of Randolph, have ascertained that funds will be available in the 2015 General Budget, Legal Services, O&E, to amend a contract with Apruzzese McDermott Mastro and Murphy for police matters, per its proposal to the township.

12. Authorizing a Professional Services Agreement to EcolSciences, Inc. for Additional Environmental Consulting, NJDEP Reporting and LSRP Services for the EA Porter Site—Not to Exceed $474,000

WHEREAS, the Township of Randolph (“Township”) requires additional environmental consulting, NJDEP reporting and LSRP services for the EA Porter site; and
WHEREAS, Elizabeth Crescibene, Purchasing Agent, has determined and certified in writing that the value of these services will exceed $17,500; and
WHEREAS, the Township has agreed to retain EcolSciences, Inc. located at 75 Fleetwood Dr, Ste 250, Rockaway, NJ 07866 to provide the necessary additional environmental consulting, NJDEP reporting and LSRP services for the EA Porter site for a total amount not to exceed $474,000 per their attached proposal; and
WHEREAS, the anticipated term of this contract is until this project is fully completed; and
WHEREAS, the contract with EcolSciences, Inc. is for a total amount not to exceed $474,000 and was not solicited through receipt of sealed bids or competitive contracting, therefore the requirements of N.J.S.A. 19:44A-20.5 (Anti Pay-to-Play Legislation) apply; and
WHEREAS, in accordance with the Anti Pay-to-Play Legislation, EcolSciences, Inc. has submitted to the Township the Political Contribution Disclosure Form, Stockholder Disclosure Certification and Business Entity Disclosure Certification as required; and
WHEREAS, EcolSciences, Inc. has also submitted to the Township a New Jersey Business Registration Certificate, as required; and
WHEREAS, there are funds available for the retention of such professional services; and
WHEREAS, said professional services may be retained without competitive bidding pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:
- The Township hereby hires, employs and retains EcolSciences, Inc. having an office at 75 Fleetwood Dr, Ste 250, Rockaway, NJ 07866 to provide additional environmental consulting, NJDEP reporting and LSRP services for the EA Porter site until the project is fully completed.
- EcolSciences, Inc. shall be compensated for a total contract amount not to exceed $474,000 per the attached proposal.
- The contract with said firm is for professional services and exempt from the bidding requirements under the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.
- The award is also subject to compliance with the Equal Employment Opportunity Requirements pursuant to N.J.S.A. 10:5-31 et seq. and N.J.A.C. 17:27.
- The Mayor and Township Clerk, together with all appropriate officers, employees, professionals and staff of the Township are hereby authorized and directed to take all steps necessary to effectuate the purposes of this Resolution.
- It is hereby directed that Notice of Award of this Contract shall be published once in the official designated newspaper of the Township within ten (10) days of the date hereof.
- This Resolution shall take effect immediately.

WHEREAS, certain General Capital Improvement Authorization balances in Ordinance #7-12 and #11-13 remain dedicated to the repair of Radtke Road, which is now complete; and
WHEREAS, it is necessary to formally cancel these balances.

21. Authorizing Participation by Randolph Township in North Jersey Health Insurance Fund Employee Wellness Program

WHEREAS, the Randolph Township is a member of the North Jersey Health Insurance Fund; and
WHEREAS, the North Jersey Health Insurance Fund is establishing an employee wellness program for its member municipalities, known as the North Jersey Health Insurance Fund Employee Wellness Program; and
WHEREAS, the purpose of the employee wellness program is to encourage healthier lifestyle choices for employees, improve employees’ knowledge regarding health, and improve the overall health of employees of the member municipalities; and
WHEREAS, the employee wellness program will proceed in Phase I for 2015 and Phase II for 2016 as detailed in the Wellness Program Announcement Letter and Employee Wellness Agreement, appended hereto; and
WHEREAS, Randolph supports the purposes of the employee wellness program and seeks to participate in the program to support the good health of its employees; and
NOW THEREFORE, BE IT RESOLVED by the Mayor and Township Council of the Township of Randolph, in the County of Morris and State of New Jersey, as follows:
- Randolph Township is hereby authorized to participate in the North Jersey Health Insurance Fund Employee Wellness Program.
- The Randolph Administration is hereby authorized to take any necessary actions to facilitate participation in the Employee Wellness Program, including, but not limited to, requiring participating employees to review and execute the Wellness Program Announcement Letter and Employee Wellness Agreement. The Randolph Township Administration shall take all necessary actions immediately to implement the Employee Wellness Program.
- A copy of the Wellness Program Announcement Letter and Employee Wellness Agreement is attached and incorporated hereto.
- Randolph acknowledges and agrees that in Phase I, ending December 31, 2015, that there will be no cost to Randolph Township, but that beginning January 1, 2016, Phase II will implement and that this Phase II will require Randolph Township to commit to and provide a $250 incentive for each participating employee. This $250 incentive will be at the sole cost and responsibility of Randolph Township.
- A copy of this Resolution shall be forwarded to the North Jersey Health Insurance Fund.
22. Appointing Glen Sherman as Tax Assessor for the Township of Randolph for a (4) Four Year Term

WHEREAS, upon receiving notice of the July 31, 2015 retirement of Barbara Gothie, Tax Assessor, of the Township of Randolph (“Township”), the Township began the process of selecting a new Tax Assessor; and
WHEREAS, after careful review of all credentials and qualifications, the Township has determined that it is in the best interests of the Township to appoint Glen Sherman as Tax Assessor of the Township, effective August 17, 2015, in accordance with provisions of N.J.S.A. 40A:9-148 and 40A:9-149 and in accordance with certain terms and conditions listed within his employment letter, dated July 16, 2015.
NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey as follows:
- The Township hereby appoints Glen Sherman as the Tax Assessor of the Township of Randolph (“Township”), effective August 17, 2015, for a (4) year term in accordance with the provisions of N.J.S.A. 40A:9-148 and 40A:9-149, and in accordance with certain terms and conditions listed within his employment letter, dated July 16, 2015, by and between the Township and the Tax Assessor.

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $7,378.11, and premium in the amount of $800.00.

24. Release of Road Opening Cash Bond for the Purpose of Widening a Driveway at 6 Prince Henry Drive at Block 42.04, Lot 7 to Melchor Constantino—$500.00

WHEREAS, the Engineering Department has received a request from Melchor Constantino, for the release of a $500.00 cash road opening bond posted for the purpose of widening a driveway at 6 Prince Henry Dr., Block 42.04/Lot 7, Randolph; and
WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on July 23, 2015; and
WHEREAS, the Applicant was required to post this cash bond to guarantee the widening of the driveway at 6 Prince Henry Dr., Block 42.04/Lot 7, within the Township Right of way; and
WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Melchor Constantino, 6 Prince Henry Dr., Randolph, NJ 07869.
25. Adopting the Water Master Plan Update Prepared by Hatch Mott MacDonald

WHEREAS, in 2014 the Township of Randolph entered into a professional services agreement with the Engineering firm of Hatch Mott MacDonald to provide a Water System Master Plan; and
WHEREAS, Hatch Mott MacDonald has prepared a draft Master Plan that has been reviewed by the following Township agencies:

WHEREAS, the Master Plan was presented to the Township Council on July 30, 2015, by Carol Walczyk, P.E. of Hatch Mott MacDonald; and

1. Ordinance #19-15: An Ordinance Amending Ordinance No. 05-15 and to Provide and Determine the Range of Compensation in Accordance with the Teamsters Collective Bargaining Agreement Effective January 1, 2015 in the Township of Randolph
Manager Mountain explained that this ordinance amends the prior salary ordinance from earlier in the year to bring the salary ordinance in accordance with the recently concluded Teamsters collective bargaining agreement. It also adds the maximum in conjunction with the appointment of the new Tax Assessor.
BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING ORDINANCE NO. 05-15 AND TO PROVIDE AND DETERMINE THE RANGE OF COMPENSATION IN ACCORDANCE WITH THE TEAMSTERS COLLECTIVE BARGAINING AGREEMENT EFFECTIVE JANUARY 1, 2015 IN THE TOWNSHIP OF RANDOLPH” be introduced, read by title by the Township Clerk and passed on first reading.

Manager Mountain explained this ordinance is for the Road Overlay Program, supplementing the Capital Budget with $65,000. The bulk of the money will go toward Quaker Church Road.

K. OPEN TO THE PUBLIC
Judith Stewart of 114 Everdale Road expressed her concern about the traffic light turn arrow and people turning right on red at Millbrook Avenue and Sussex Turnpike. She suggested that someone call the county and ask that they change the light so motorists cannot turn right on red while the oncoming traffic has the green turning arrow.
Mrs. Stewart also expressed her concern about people smoking right outside the doors of business establishments. She suggested the Manager and Council explore with the township attorney the idea of creating a law to prohibit smoking right outside business establishments, and its legality in New Jersey.
Phil Sheehy of 9 Birchwood Road asked what the process is for the Water Master Plan. His neighborhood has 49 houses, all of which have wells; there is a water line running down Carrell Road. Mr. Sheehy asked if the Water Master Plan included running a water line to his neighborhood. He asked how the process worked, and if he and his wife could participate in the process. Councilman Guadagno stated that Birchwood Road is included in the Water Master Plan.
Seeing no one further from the public, the public portion was closed.
L. COUNCIL COMMENTS
Councilman Guadagno asked Attorney Buzak if the State considers the amount of traffic on roads such as Route 10 when they’re requiring municipalities to conform to COAH regulations; Attorney Buzak felt that the State does not.
Councilman Guadagno also asked when the hotbox and the paver for the DPW were expected to be delivered. Manager Mountain stated the hotbox has been ordered, and he would find out the expected delivery date prior to the next Council meeting.
Councilwoman Carey reported that on Friday, September 18th the library will have a delayed opening due to a mock disaster/active shooter drill for the staff.
Councilman Loveys reported that the TAC met and there was discussion about the next couple of weeks having the potential to have a lot of traffic on the roads due to the various road resurfacing projects. Officer Biase informed the TAC that the Police Department will have five officers assigned to Dover Chester Road, and something similar for Millbrook Avenue. In addition, October is the Put the Brakes on Fatalities campaign; federally it is just one day, but the Police Department considers it a campaign for the entire month. However, five specific dates have been designated, 10/1, 10/9, 10/13, 10/21, and 10/29. They will also have some focus on the Move Over Law. Officer Biase also reported at the TAC meeting that one of the pole-mounted traffic calming devices was stolen off of Radtke Road last month. It should’ve been traceable, however, the battery was dead. Councilman Loveys also reported that the Share the Keys program will be held on September 21, October 19, March 28, and May 2. One of the TAC members is following up on a grant application submitted to Kean University for a grant to purchase more booklets for the Share the Keys program.
Deputy Mayor Hirniak stated that as more residents become aware of the Wildlife Management Committee, as the Council liaison, he hears from them about what the committee should or should not be doing and how they should do it. There is also interest from Council members, the Parks Committee members, and the Rotary Club as to what is happening with the Wildlife Management Committee and issues or questions they would like to add or ask. There was a discussion at the July Wildlife Management Committee meeting that culminated at the August 26th meeting to appoint one member of the Wildlife Management Committee to liaise to five existing township committees on a bi-annual basis; Greg Mohr was appointed as the liaison. The existing township committees are the Board of Health, Environmental Commission, Recreation, Parks, and Traffic Advisory.
Mayor Veech reported that the Economic Development Committee had a guest speaker, the Executive Director of the Morris County Economic Development Corporation, Meghan Hunscher. Ms. Hunscher explained that Randolph Township’s EDC is the most senior of the groups in Morris County, and it is a model for the rest of the county. An EDC newsletter went out with the tax bills. It included information on the business environment of the township, and the health of the properties. Ms. Hunscher offered some suggestions on projects in which she would work with the township. Mayor Veech stated that John Ragan and Manager Mountain will be meeting with Ms. Hunscher to accelerate the program that the township has already committed to.
