A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Loveys. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location, and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the bulletin board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on December 5, 2013 by e-mailing them the annual resolution adopted by the Council on December 5, 2013. The annual resolution, including this meeting date, was advertised in the Randolph Reporter, the official paper of the Township of Randolph, and the Daily Record on December 12, 2013.

3. Mayor Loveys led the Pledge of Allegiance.

B. OPEN TO THE PUBLIC

Judith Stewart of 114 Everdale Road gave copies of the flyer for the used book sale at the library to the Council, Township Clerk, and the public.

Adam Edgar of 4 Pine Tree Lane, Chester explained that he had received notices stating that his driveway was illegal and that he could no longer use it. There is a dispute as to whether a small portion of the property is in Randolph or Chester. He then received a notice about an easement from 50 years ago, from the construction of Park Avenue and that he would have to pay taxes on it. Mr. Edgar has been trying to resolve this and, to date, has been unable. Manager Mountain suggested that he and Mr. Edgar meet as well as with other appropriate staff members to review the facts and come to a resolution.

Seeing no one further from the public, the public portion was closed.

C. MANAGER’S REPORT

Manager Mountain reported the following:

  • Road overlay program—the township overlay program has been completed successfully. There are a couple of projects that are outside of the definition of overlay, they are scheduled in the next 4-6 weeks. Pierson Hill Road and Middlebury Boulevard are scheduled for reclamation. The township has received state grant funding for Quaker Church Road between Millbrook Ave. and South Morris Ave., and the northern portion of Millbrook Ave. to be paved. Both projects are in the process of being bid and should be completed this fall. Morris County recently completed overlay on Sussex Turnpike between Dover Chester Road and Calais Road and they have scheduled the overlay of the section of Millbrook Avenue in the next couple of weeks.
  • The Revaluation Work Group met. They have approved the final draft of the RFP for the selection of a revaluation firm to complete the township wide revaluation. Proposals are expected to be received by mid-October. A recommendation to the Council is expected at the end of November or early December.
  • The Parks Master Plan is moving forward; the work group completed its review of the RFP. It is expected that the timing should be about the same as the revaluation schedule mentioned above.
  • A Council tour/work session of the Mt. Freedom area is scheduled for the September 18th meeting at 4 p.m. Darren Carney will take a lead role with the tour and the work session which will include a review of the planning issues.

F. COMBINED ACTION RESOLUTIONS

Item #23: Clothing Bins—it was asked how the pickup will work when the bin is full. Darren Carney explained that they are to be emptied regularly and if they are not, the township will remind them. There was some discussion on the location of the bins.

Item #20: Road Closing for RHS—there was discussion on the timing being rush hour. Deputy Mayor Veech suggested that a Reverse 911 be utilized to inform residents of this closing. It was also suggested that the information be included on the electronic signs.

Councilman Guadagno made a motion to accept the Combined Action Resolutions. Councilwoman Carey seconded the motion, and the following roll call vote was taken:

1. Refund Road Opening Cash Bond for Water Line Connection at 145 Park Avenue to Melissa Johansson—$500.00

WHEREAS, the Engineering Department has received a request from Melissa Johansson, for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the water line at 145 Park Ave., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on Dec. 30 ,2013; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the connection of the water line at 145 Park Ave. within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Melissa Johansson, 21 Wood Duck Court, Hackettstown, NJ 07840.

2. Release Driveway Cash Bond for Grading and Paving at 109 Morris Tpke to DeSalvatore Homes & Design—$1,000.00

WHEREAS, the Engineering Department has received a request from DeSalvatore Homes & Design, LLC. for the release of a $1000 cash driveway bond posted for the purpose of driveway grading and paving for a new home construction at 109 Morris Tpke., Randolph; and

WHEREAS, the Driveway Bond consisted of a $1000.00 cash bond, which was received and deposited with the Finance Department on March 24, 2014; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the grading and paving of the driveway at 109 Morris Tpke. within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Driveway Bond in the amount of $1,000.00 be refunded to DeSalvatore Homes & Design, LLC., 160 Goff Ave., Staten Island, N.Y. 10309.

3. Release Cash Road Opening Bond for Repaving an Existing Driveway and Rebuilding Retaining Wall at 24 Drake Ct. to Ricky Gilk Harddrives, LLC—$500.00

WHEREAS, the Engineering Department has received a request from Ricky Gilk Harddrives, LLC, for the release of a $500.00 cash road opening bond posted for the purpose of repaving an existing driveway and rebuilding retaining wall at 24 Drake Ct., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on July 18, 2014; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the existing driveway and rebuilding retaining at 24 Drake Ct. within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Ricky Gilk Harddrives, LLC, 22 Finns Drive, Wayne, NJ 07470.

4. Release Cash Road Opening Bond for Connecting to Water Line at 36 Carrell Rd. to Susan Arthurs—$500.00

WHEREAS, the Engineering Department has received a request from Susan Arthurs, for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the water line at 36 Carrell Rd., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on May 27,2014; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the connection of the water line at 36 Carrell Rd. within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Susan Arthurs, 36 Carrell Rd., Randolph, NJ 07869.

5. Refund Escrow for Block 42, Lot 99 & 100 to G&L Pagano, Realty LLC—$1,347.37

WHEREAS, the Planning and Zoning Department received escrow funds from G & L Pagano Realty, LLC 746 Route 10 West, Randolph, NJ, Block 42, Lot 99 & 100, and in the amount of $4,500.00; and

WHEREAS, the project has been completed and closed out and there are no outstanding payments due.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator the remaining escrow funds in the amount of $1,347.37 be refunded to G & L Pagano, Realty LLC, 747 Route 10 West, Randolph, NJ 07869.

6. Refund Outside Tax Sale for Block 140, Lot 1 to FWDSL & Associates—$3,193.58

WHEREAS, Outside Tax Sale Certificate #1962 held FWDSL & Associates, assessed to Margaret/Carl Brignola, Block140, Lot 1, 36 Warren Road; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $2,793.58, and premium in the amount of $400.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $3,193.58 to FWDSL & Associates LP holder of Tax Sale Certificate #1962.

7. Refund Outside Tax Sale for Block 77, Lot 13 to Jonathan Katz—$22,072.61

WHEREAS, Outside Tax Sale Certificate #1930 held by Jonathan Katz, assessed to Ramom/Jackeline Valle, Block 77, Lot 13, 7 Ashwood Lane; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $22,072.61.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund $22,072.61 to Jonathan Katz holder of Tax Sale Certificate #1930.

8. Authorizing Contracts with an Additional Vendor under the Somerset County Cooperative Pricing Council “SOCCP”

WHEREAS, the Township of Randolph pursuant to N.J.S.A. 40A:11-11(5) and N.J.A.C. 5:34-7.1 et seq. may, by resolution and without advertising for bids, purchase any goods or services under a Cooperative Pricing System of which the Township is a member; and

WHEREAS, the Township of Randolph on April 24, 2014 via R 115-14 and May 22, 2014 via R 150-14 authorized contracts with certain approved SOCCP Contract vendors; and

WHEREAS, it’s been determined that contracts in excess of $17,500 will be entered into with one additional SOCCP Contract Vendor; and

WHEREAS, the additional SOCCP Contract Vendor has been added to the attached list; and

WHEREAS, the Township of Randolph anticipates entering into contracts in excess of $17,500 with the attached Referenced Contract Vendors through this resolution and properly executed purchase orders/contracts as needed, which shall be subject to all the conditions applicable to the current co-op contracts.

NOW, THEREFORE, BE IT RESOLVED that the Township of Randolph authorizes the Purchasing Agent to purchase certain goods and services from the additional approved SOCCP Contract Vendors on the attached list, pursuant to all conditions of the individual co-op contracts; and

BE IT FURTHER RESOLVED that the governing body of the Township of Randolph pursuant to N.J.A.C. 5:30-5.5(b) regarding the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Financial Officer via an authorized Purchase Order; and

BE IT FURTHER RESOLVED that the duration of the contracts between the Township of Randolph and the referenced SOCCP Contract Vendors shall be until December 31, 2014 or upon expiration of the vendor’s contract whichever is first.

9. Authorizing Award of Contract for Pavement Reclamation to Reclamation LLC—$71,312.50

WHEREAS, the Township of Randolph advertised for the Pavement Reclamation project in accordance with Local Public Contracts Law and received bids on August 12, 2014; and

WHEREAS, 1 bid was received; and

WHEREAS, bids were received from the following and for the bid prices listed:

Reclamation LLC, West Hurley, NY—Base Bid: $71,312.50; and

WHEREAS, the Engineer, Public Works Director and Purchasing Agent recommend the award of the contract to Reclamation LLC as the lowest responsive, responsible bidder; and

WHEREAS, the Township of Randolph desires to award a contract for Pavement Reclamation to Reclamation LLC of West Hurley, NY.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that a contract be awarded to Reclamation LLC of West Hurley, NY for the Pavement Reclamation project for the price of $71,312.50 per their bid proposal.

CERTIFICATION OF AVAILABILITY OF FUNDS

As required by N.J.S.A. 40A:4-57, N.J.A.C. 5:30-14.5, and any other applicable requirement, I, Darren Maloney, Director of Finance of the Township of Randolph, has ascertained that funds will be available in the General Capital Fund, Ordinance (14-14), 2014 Road Overlay Program account, to award a contract to Reclamation LLC for a pavement reclamation project, per its response to a township bid request.

10. Requesting the Approval of Items of Revenue and Appropriation in the 2014 Budget Representing the Municipal Alliance Grant for $19,125 and $4,781.25 Representing the Municipality’s Share

WHEREAS, NJSA 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item has been made available by law and the amount was not determined at the time of the adoption of the budget; and

WHEREAS, the Director may also approve the insertion an item of appropriation for an equal amount;

NOW, THEREFORE, BE IT RESOLVED, that the Council of the Township of Randolph, in the County of Morris, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2014 in the sum of $19,125, which is now available from the FY 2014 Municipal Alliance Grant in the amount of $19,125; and

BE IT FURTHER RESOLVED, that the like sum of $19,125 is hereby appropriated under the caption Municipal Alliance Grant - 2014; and

BE IT FURTHUR RESOLVED, that the sum of $4,781.25 representing the amount required for the municipality’s share of the aforementioned undertaking or improvement, appears in the budget of the year 2014 under the caption Municipal Alliance - Salary and Wages and Municipal Alliance - Other Expense and is hereby appropriated under Municipal Alliance - Town Match; and

BE IT FURTHER RESOLVED, that the above is the result of a State grant of $19,125 from the Governor’s Council on Alcoholism and Drug Abuse Fiscal Grant - Cycle July-2014 to June 2015.

11. Requesting the Approval of Items of Revenue and Appropriation in the 2014 Budget from the Municipal Alliance Grant Fund Supplemental in the Amount of $2,000 and $1,000 Representing the Municipality’s Share

WHEREAS, the Director may also approve the insertion an item of appropriation for an equal amount.

NOW, THEREFORE, BE IT RESOLVED, that the Council of the Township of Randolph, in the County of Morris, New Jersey, hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2014 in the sum of $2,000 which is now available from the FY 2014 Municipal Alliance Grant Fund -Supplemental in the amount of $2,000; and

BE IT FURTHER RESOLVED, that the like sum of $2,000 is hereby appropriated under the caption Municipal Alliance Grant - 2014 - Supplemental; and

BE IT FURTHUR RESOLVED, that the sum of $1,000 representing the amount required for the municipality’s share of the aforementioned undertaking or improvement, appears in the budget of the year 2014 under the caption Municipal Alliance - Salary and Wages and Municipal Alliance - Other Expense and is hereby appropriated under Municipal Alliance - Town Match - Supplemental; and

BE IT FURTHER RESOLVED, that the above is the result of a State grant of $2,000 from the Governor’s Council on Alcoholism and Drug Abuse Fiscal Grant - Cycle July-2014 to June 2015.

12. Authorizing the Cancellation of Check #20154 to Amir Allen in the Amount of $19.05 and Check #20563 to Madeline Frankel in the Amount of $18.36

WHEREAS, the following checks from the Randolph Payroll Account are currently outstanding

Check 20154 dated 8/29/2013 to Amir Allen in the amount of $19.05
Check 20563 dated 12/5/2013 to Madeline Frankel in the amount of $18.36

WHEREAS, the Finance Department has sent letters to with no response and

WHEREAS, it is recommended by the Finance Department that Checks 20154 and 20563 be cancelled.

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Finance Director be instructed to cancel Payroll Checks 20154 issued to Amir Allen in the amount of $19.05 and 20563 issued to Madeline Frankel in the amount of $18.36 and transfer the money to the Randolph Township General Account.

13. Authorizing the Tax Collector to Cancel Tax Sale Certificate #1975 for Block 48, Lot 2, 2Q—$70,243.61

WHEREAS, Tax Sale Certificate #1975, held by Township of Randolph, assessed to Calais Road Farms, Block 48, Lot 2, 2Q , 141 Calais Road; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $70,243.61.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Tax Collector be instructed to cancel Tax Sale Certificate #1975.

14. Authorizing the Tax Collector to Cancel Tax Sale Certificate #1974 for Block 47, Lot 24, 2Q—$70,047.76

WHEREAS, Tax Sale Certificate #1974, held by Township of Randolph, assessed to Calais Road Farms, Block 47, Lot 34/34.Q , 95A Calais Road; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed through the Tax Collector, including principal and interest in the amount of $70,047.76.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Tax Collector be instructed to cancel Tax Sale Certificate #1974.

15. Authorizing MCCPC Award and Rejection of Portions of Contract #3 Rock Salt & Calcium Chloride Liquid

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #3 (Rock Salt & Calcium Chloride Liquid); and

WHEREAS, bids had been advertised and received on August 21, 2014, in accordance with Local Public Contracts Law; and

WHEREAS, five bids were received for Contract #3 (Rock Salt & Calcium Chloride Liquid); and

WHEREAS, Contract #3 (Rock Salt & Calcium Chloride Liquid) is awarded on a “per county” basis (Essex, Hunterdon, Morris, Passaic, Somerset, Sussex, Union, and Warren); and

WHEREAS, Morton Salt, the low bidder for all counties except Morris County for Category I, the low bidder for all counties for Category II, and the sole bidder for Categories VI and VII, submitted an incorrect Bid Bond and did not provide the mandatory Consent of Surety and is therefore non-responsive and must be rejected; and

WHEREAS, the bidders submitting the lowest responsive and responsible bids for a one-year contract as shown on the attached Notification of Award are as follows:

Category I (Bulk Rock Salt Delivered): Atlantic Salt (Morris County Only)
Category II (Bulk Rock Salt Picked Up): Atlantic Salt (Morris County Only)
Category III (Calcium Chloride Liquid Delivered): Peckham Materials (All Counties)

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby rejects the bid submitted by Morton Salt as non-responsive to the bid specifications.

BE IT FURTHER RESOLVED that the Township Council hereby authorizes the award of Contract #3 (Rock Salt & Calcium Chloride Liquid) as noted above for the term October 15, 2014 - October 14, 2015.

16. Refund Overpayment of Taxes for Block 199, Lot 46.12 to Chase—$6,445.03

WHEREAS, Chase has overpaid 2014 taxes in the amount of $6,445.03 on Block 199, Lot 46.12, 6 Red Oak Lane, assessed to Peter/Mariella Rizzolo; and

WHEREAS, it is recommended by the Tax Collector that this overpayment be refunded at this time.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the overpayment of $6,445.03 to Chase.

17. Release Cash Road Opening Bond for 36 Lake Shore Dr. S. to Judy Frost—$500.00

WHEREAS, the Engineering Department has received a request from Judy Frost, for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the public sewer at 36 Lake Shore Dr. So., Randolph; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on July 1, 2014; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the connection of the sewer line at 36 Lake Shore Dr. So. within the Township Right of way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Judy Frost, 7575 Gosling Rd., Apt. 820,The Woodlands, TX 77382.

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #4 (Snow Grits); and

WHEREAS, bids had been advertised and received on August 21, 2014, in accordance with Local Public Contracts Law; and

WHEREAS, two bids were received for Contract #4 (Snow Grits); and

WHEREAS, Eastern Concrete Materials in Elmwood Park, New Jersey, was the lowest responsive and responsible bidder for Contract #4 (Snow Grits) for the categories shown below for a one-year contract:

Category A (Picked Up by Members, Loaded by Bidder): $11.73 per ton
Category B (Delivered to Member Locations): $17.73 per ton

20. Authorizing Road Closures for Randolph High School 50th Anniversary Parade on October 17, 2014

WHEREAS, Randolph High School will be celebrating its 50th year anniversary; and

WHEREAS, Randolph High School would like to celebrate this event by having a parade on Friday, October 17, 2014 beginning at 4 p.m. at Freedom Park and traveling up Millbrook Avenue ending at the High School at approximately 5:30 p.m.; and

WHEREAS, Michael Sorge, Vice Principal of the Randolph High School has requested approval for road closures from the Town Council, Randolph Police, and the Morris County Engineering Department.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council, Township of Randolph, County of Morris, State of New Jersey that the Township Council approves of the road closures requested.

21. Authorizing Road Closures for Randolph Rotary and Research Down Syndrome Foundation 5K Run/Walk on November 15

WHEREAS, the Morris County Board of Chosen Freeholders received a letter from the Randolph Rotary Club in partnership with the Research Down Syndrome Foundation requesting permission to close certain roads in Randolph for a 5K Run/Walk in Randolph Township; and

WHEREAS, the event will be held on Saturday, November 15 from 9:45 a.m. to 11:30 am and will require closing apportion of Millbrook Avenue from Schoolhouse Road to Carrell Road; and

WHEREAS, the Morris County Board of Chosen Freeholders gave their approval conditioned upon approval from the police department and Council.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council, Township of Randolph, County of Morris, State of New Jersey that the Township Council approves of the road closures requested.

22. Authorizing Clothing Bins at Randolph Chemical Co. #3—670 Millbrook Avenue

WHEREAS, Randolph Chemical Engine Co. #3 has submitted an application for a Donation Clothing Bin to be placed at 670 Millbrook Avenue, Randolph, New Jersey by Millennium International Textile; and

WHEREAS, the fee of $150.00 (per month, per bin) will be utilized by the Volunteer Fire Company to pay building expenses.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that the placement of this clothing bin is approved.

1. Ordinance No. 21-14: An Ordinance Amending and Supplementing Sections 8-1 and 8-10 of Chapter 8, Animals, of the Revised Ordinances of the Township of Randolph to Ban the Retail Sale of Dogs and Cats

BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE AMENDING AND SUPPLEMENTING SECTIONS 8-1 AND 8-10 OF CHAPTER 8, ANIMALS, OF THE REVISED ORDINANCES OF THE TOWNSHIP OF RANDOLPH TO BAN THE RETAIL SALE OF DOGS AND CATS” be read by title on second reading and a hearing held thereon.

Manager Mountain explained that this Ordinance is based on a previous discussion by the Council as well as the Board of Health and The Friends of the Randolph Pound regarding the fact that many retail stores that sell dogs and cats use puppy mills as a source. The Ordinance sends the message to the community that the township is sensitive to the inhumane treatment of such animals as well as prohibiting it from happening within the community.

OPEN TO THE PUBLIC

Leslie Moran of 42 Oak Lane added that local people have posted on social media several stories about puppies purchased at retail stores that died soon after, and she read the posts to the Council. Ms. Moran also read a quote by a USDA breeder.

Mayor Loveys reiterated that the Council did not want to hurt the reputable businesses and with this Ordinance he felt they were successful. He commended Keli Gallo for her work on the Ordinance. There was some discussion on the use of the words kennel and kennel operators; however, if deemed necessary, the Ordinance can be revised in the future.

BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE GRANTING A CONSERVATION RESTRICTION/EASEMENT OVER A PORTION OF BLOCK 222, LOT 11.01 ON THE OFFICIAL TAX MAP OF THE TOWNSHIP OF RANDOLPH TO THE NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION” be read by title on second reading and a hearing held thereon.

Manager Mountain explained that the purpose of this Ordinance is to grant a conservation easement/restriction over a portion of the property that was acquired for the purposes of constructing a pump station in association with the Butterworth improvement project. The request for the conservation easement is a condition of the flood hazard area permit the township received from the State of New Jersey. The state is looking to protect the area that is not being constructed upon from further development that could potentially impact the property.

I. ORDINANCES: INTRODUCTIONS

1. Ordinance No. 23-14: Ordinance Funding Museum Improvements

Manager Mountain explained that the museum is an old house and its age is becoming evident. There was an agreement with the people from the museum that a number of issues would be addressed this fall. In preparing for the work, a number of other areas of concern were identified which are more structural. If those are not addressed before winter, they will lead to bigger improvements in the spring. The Manager described the improvements needed.

There was some discussion on whether the property had been looked at by Council members, what discussions took place in prior years, the specific improvements, and the possibility of installing cameras at the house or entrance to Freedom Park.

BE IT RESOLVED that an Ordinance entitled “AN ORDINANCE OF THE TOWNSHIP OF RANDOLPH APPROPRIATING $50,000 FOR CAPITAL IMPROVEMENTS AND REPAIRS TO THE RANDOLPH MUSEUM FUNDED BY $50,000 FROM THE TOWNSHIP’S OPEN SPACE TRUST FUND” be introduced, read by title by the Township Clerk and passed on first reading.

BE IT RESOLVED that said Ordinance shall be further considered for final passage at the meeting of the Township Council of the Township of Randolph on the 2nd of October 2014 at 7:00 o’clock in the evening, prevailing time, at the Municipal Building in said Township, at which time and place all persons interested shall be given an opportunity to be heard concerning said Ordinance.

BE IT FURTHER RESOLVED that the Township Clerk be authorized and directed to advertise said Ordinance in full or by summary with the Notice of Introduction thereof in the official designated newspaper according to law.

L. COUNCIL COMMENTS

Deputy Mayor Veech asked Manager Mountain if there could be an Executive Session in the future to review the outstanding legal cases.

Councilman Guadagno discussed an issue with Atlantic Ambulance charging a resident on Medicaid over the amount covered. Per the contract with Atlantic Ambulance, any person in Randolph that is on Medicaid or Medicare cannot be charged over the amount covered. He felt that Atlantic Ambulance should be contacted to remind them of the details of the contract. Manager Mountain will follow up.

M. EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.
