A. OPENING OF REGULAR MEETING

1. Call to Order

A regular meeting of the Randolph Township Council was called to order at 7:00 p.m. by Mayor Forstenhausler. This meeting is held pursuant to the New Jersey Open Public Meetings Act. Adequate notice of the meeting has been provided by posting written notice of the time, date, location and to the extent known, the agenda of the meeting in Randolph Township. This notice was posted on the Bulletin Board within Town Hall, it was filed with the Township Clerk, and it was provided to those persons or entities requesting notification. Notice was also provided to the Randolph Reporter and the Morris County Daily Record on November 17, 2017 by emailing them the annual resolution adopted by the Council on October 10, 2017. The annual resolution, which included this meeting date, was advertised in the Randolph Reporter, the official newspaper of the Township of Randolph on November 23, 2017, and in the Daily Record on November 21, 2017.

3. Pledge of Allegiance

Mayor Forstenhausler led the Pledge of Allegiance.

B. PRESENTATIONS/PROCLAMATIONS

1. Board of Education Presentation on Proposed School Referendum

Board of Education Vice President, Joe Faranetta, presented the following:

  • There was a $500,000 cut to the state aid; it impacted this year’s budget. They were told by the state & county that every year going forward there will be reductions to the state aid.
  • He reviewed the various expenses in the budget. The capital budget is typically about $3,000,000.
  • One of the big drivers for the referendum is by floating bonds, there is a state program where the school can get 40% of those bonds refunded back.
  • Fourteen science rooms, seven prep rooms, and two music rooms in the high school are from the original high school; they show their wear and tear.
  • The current field house has no bathroom facilities. During any of the events at Bauer Field, the high school must remain open for use of the locker rooms and bathrooms. With the new field house, the high school could remain locked during events, making it more secure. The facility will have two locker rooms, four team rooms, a weight room, a multipurpose space, and storage.
  • The 40% does not apply to the field house or the Shongum security vestibule; the reason is because it’s new construction. Maintenance and renovations qualify for the 40%. The security vestibules will be constructed whether or not the referendum passes.
  • The communication plan inside the school will be a video and Board of Ed presence at all of the back to school nights. There will be meetings with all of the PTOs and RACs.

Councilwoman Veech asked where the field house would be located. Mr. Faranetta replied that it would be in the same location as the current building.

Councilman Guadagno asked if they guaranteed that there would be no tax increase. Mr. Faranetta replied that there would be no tax increase driven by a yes vote on the referendum.

C. OPEN TO THE PUBLIC

Seeing no one from the public, the public portion was closed.

D. MANAGER’S REPORT

Manager Mountain reported the following:

  • Commuter Survey—the development of the survey was completed, with input from TransOptions and a couple of citizens. The link to the survey can be found on the township website and other township communications; it is also being distributed in key areas by the residents who helped develop the survey. The survey results will help to determine the interest of residents in a shuttle service as well as to demonstrate that interest to an outside agency that will be recruited for the transportation service. The survey will run through early October. He encouraged the Council and local media to disseminate information about the survey.
  • Mariam Sabri—he introduced the intern; she is a senior at Rutgers University, a Public Administration major, and will be working in the Manager’s Office for the fall. She will be working on the EDC website, and will be getting exposed to as much municipal government as possible.
  • Morris County Park Alliance Award program—the township submitted three nominations—Planning category: the trail master plan project, Facility category: Randolph Lake beach improvement project, and Program category: Arts in the Park event. The recognition meeting is scheduled for Thursday, October 11.
  • Country Fair—Greg Mohr is organizing the fair; it will be on Saturday, September 22, with a rain date of September 23. There was a planning meeting earlier in the week; the event is coming along well. The EDC Business Awards will be presented at 1 p.m. at the Country Fair.
  • Freedom Park Turf Field project—the project has been completed, with the exception of a few small punch-list items. He is very pleased with the outcome of the project. He commended the efforts of Paul Ferriero and the entire Engineering Department, as well as Dakota Construction who did the job. The project came in under the projected budget.
  • Brundage Park—the resurfacing and paving work on the parking lot was completed. The Parks & Recreation Department has been working on other aspects of the park as well.
  • Pre-construction meeting on Veterans Community Park—scheduled for September 7; he will have a better idea of the construction schedule and inform the Council. He will speak with the contractor to determine a date for the ground breaking ceremony.
  • The Combined Action Resolutions include a few resolutions related to a bond sale scheduled for the fall. It will establish a schedule for permanent financing of the debt associated with the Sussex Turnpike and Meadowbrook Road water projects, capital equipment purchases, and park projects in the last year.

Darren Maloney explained that on October 3, 2018 he will be taking bids for 8.85 million dollars in bonds; these are predominantly for park projects and water projects. The township must comply with the local bond law; it requires the Council approving certain combining resolutions as well as the form of the bonds and the form questions. Darren reviewed the combining resolutions, R-247-18 & R-248-18, as well as R-249-18. He also explained the process. The bids will be taken online by outside company, Parity.

E. APPROVAL OF MEETING MINUTES

1. Approving the Regular Meeting Minutes from June 12, 2018, June 28, 2018, July 10, 2018, and July 26, 2018

Councilwoman Veech made a motion to approve the regular meeting minutes from June 12, 2018, June 28, 2018, July 10, 2018, and July 26, 2018. Councilman Guadagno seconded the motion, and the following roll call vote was taken:

1. Refund Tree Bond for Block 27, Lot 18, 25 Berry Lane to Jennifer Little—$1,600.00

WHEREAS, the Planning and Zoning Department received a tree bond posted by Jennifer Little, 25 Berry Lane for Block 27, Lot 18 in the amount of $1,600.00; and

WHEREAS, the requirements have been met and completed.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Darren Carney, Planning and Zoning Administrator that the tree bond in the amount of $1,600.00 be refunded to Jennifer Little, 25 Berry Lane, Randolph, NJ 07869.

3. Refund Portion of $650.00 Ice Hockey Registration Fee Due to Being Registered in Incorrect League to Jennifer and Matt Frey—$325.00

WHEREAS, the child’s parents erroneously registered for the incorrect league.

4. Refund Registration for Children’s Art Class Due to Lack of Registrants and Class Being Cancelled to Debra Goldstein—$390.00

5. Release Cash Road Opening Bond for the Purpose of Repaving the Driveway at 46 Dogwood Trail, Block 56, Lot 47 to Theresa LaPenna—$500.00

WHEREAS, the Engineering Department has received a request from Theresa LaPenna for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at 46 Dogwood Trail, Randolph, NJ 07869 (B56/L47); and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on September 7, 2017; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the driveway at 46 Dogwood Trail, Randolph, NJ 07869, within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Theresa LaPenna at 46 Dogwood Trail, Randolph, NJ 07869.

6. Release Cash Road Opening Bond for the Purpose of Connecting to the Township Water Service at 3 Nuko Terrace, Block 103, Lot 18 to Michael Wilhalme—$500.00

WHEREAS, the Engineering Department has received a request from Michael Wilhalme at 3 Nuko Terrace for the release of a $500.00 cash road opening bond posted for the purpose of connecting to the Township water service at 3 Nuko Terrace, Randolph, NJ 07869 (B 103/L 18);

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on October 26, 2017; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the connecting to the Township water service at 3 Nuko Terrace, Randolph, NJ 07869, within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Michael Wilhalme at 3 Nuko Terrace, Randolph, NJ 07869.

7. Release Cash Road Opening Bond for the Purpose of Repaving the Driveway at 42 Ridge Road, Block 60, Lot 7 to Mark Johnson—$500.00

WHEREAS, the Engineering Department has received a request from Mark Johnson for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at 42 Ridge Road, Randolph, NJ 07869 (BL 60/L 7); and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on May 7, 2018; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the driveway at 42 Ridge Road, Randolph, NJ 07869, within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Mark Johnson at 42 Ridge Road, Randolph, NJ 07869.

8. Release Cash Road Opening Bond for the Purpose of Repaving the Driveway at 21 Marjaleen Drive, Block 33, Lot 38.01 to Daniel Holtzman—$500.00

WHEREAS, the Engineering Department has received a request from Daniel Holtzman for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at 21 Marjaleen Drive, Randolph, NJ 07869 (B 33/L 38.01); and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on May 1, 2018; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the driveway at 21 Marjaleen Drive, Randolph, NJ 07869 within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Daniel Holtzman at 21 Marjaleen Drive, Randolph, NJ 07869.

9. Authorizing Refund of MCCPC Membership Dues to the Newton Board of Education—$1,100.00

WHEREAS, the Finance Department for the Township of Randolph is responsible for sending invoices for annual membership dues to the members of the Morris County Cooperative Pricing Council (“MCCPC”); and

WHEREAS, invoices for membership were mailed out to the various board of education members on June 1, 2018; and

WHEREAS, the annual cost for membership in the MCCPC is $1,250.00, however if payment is made within 45 days there is a discount of $150.00, which brings the total to $1,100.00; and

WHEREAS, the Newton Board of Education received their invoice and submitted a payment of $1,100.00 on July 30, 2018; and

WHEREAS, on August 2, 2018, the School Business Administrator for the Newton Board of Education contacted the MCCPC and indicated that the former School Board Administrator recently retired and a new Administrator was in place; and

WHEREAS, upon review of the available contracts, the new Administrator determined that the Newton Board of Education would not be using any of the contracts and inquired about the possibility of a refund of the membership dues received by the Township of Randolph a few days prior; and

WHEREAS, it was determined by the MCCPC Administrator, the Randolph Township Chief Finance Officer, and the Randolph Township Manager that, due to the specific circumstances in this case, the request for a refund of the membership dues by the Newton Board of Education is reasonable and should be approved.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby approves and authorizes the refund of the membership dues in the amount of $1,100.00 to the Newton Board of Education.

10. Release of Police Detail Escrow to High Point Utilities $174.00

WHEREAS, the Detail work has been completed.

THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey that it is recommended by the Finance Department that the escrow funds for the following amounts be refunded:

11. Release of Police Detail Escrow to Road Safety Systems—$220.50

WHEREAS, the Detail work has been completed.

THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, Morris County, New Jersey that it is recommended by the Finance Department that the escrow funds for the following amounts be refunded:

Road Safety Systems $220.50

12. Release Remaining Escrow Funds for 1178 Route 10 West, Block 1, Lot 1 for Mr. Crabby’s LLC (Millbrook, LLC)—$1,381.54.00

WHEREAS, the Engineering Department has received a request from Paul C. Ruck for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at 49 Davis Avenue, Randolph, NJ 07869 BL 71/L 6; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on August 12, 2018; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the driveway at 49 Davis Avenue, Randolph, NJ 07869, within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Paul C. Ruck at 49 Davis Avenue, Randolph, NJ 07869.

18. Release Cash Road Opening Bond for the Purpose of Repaving the Driveway at 6 Winding Way, Block 151, Lot 11 to Joseph Korasadowicz—$500.00

WHEREAS, the Engineering Department has received a request from Joseph Korasadowicz for the release of a $500.00 cash road opening bond posted for the purpose of repaving the driveway at 6 Winding Way, Randolph, NJ 07869 BL 151/L 11; and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on March 26, 2018; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the repaving of the driveway at 6 Winding Way, Randolph, NJ 07869, within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Joseph Korasadowicz at 6 Winding Way, Randolph, NJ 07869.

19. Acknowledging and Confirming Redemption of Tax Sale Certificate for Block 46, Lot 2, 217 Dover Chester Road by Costal Title Agency, Inc—$3,203.31

WHEREAS, Tax Sale Certificate #2028 held by the Township of Randolph, and assessed to Giovanni Sr. and Emila Iachetta known as Block 46, Lot 2 and also known as 217 Dover-Chester Rd.; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed by Costal Title Agency, Inc. representing the sale of the property. The redemption includes all open principal and interest in the amount of $3,203.31.

NOW, THEREFORE, BE IT RESOLVED by the Township Council of the Township of Randolph that this Governing Body acknowledges and confirms the redemption of tax sale certificate #2028; and

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, confirms that the Certified Tax Collector is authorized to process all the necessary documents to redeem said lien, to bring the account current and cancel the certificate from record with the Morris County Clerk’s Office.

20. Refund a Payment Made in Error for Block 9999, Lot 173, 14 Small Brook Circle to Leonard Campbell—$289.00

WHEREAS, Mr. Leonard Campbell sent a payment in the amount of $289.00 on June 3, 2018 via his bank’s bill pay system and indicated it to be posted to Block 9999, Lot 173 also known as 14 Small Brook Circle; and

WHEREAS, Mr. Campbell is now requested a refund in the amount of $289.00 stating that this payment was made in error as he is no longer associated with this property.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the payment of $289.00 to Mr. Leonard Campbell, 66 Highview Terrace, Dover, NJ 07801.

21. Refund a Payment Made in Error for Block 119, Lot 91.27, 27 Buckingham Ct. to Aleksandr Smotkin—$7,150.75

WHEREAS, Mr. Aleksandr Smotkin sent a payment in the amount of $9,574.19 on August 6, 2018 and indicated it to be posted to block 119 lot 91.27 for the 3rd & 4th quarters of 2018 and the 1st and 2nd quarters of 2019; and

WHEREAS, Mr. Smotkin is now requested a refund in the amount of $7,150.75 stating that this payment was made in error and should have been in the amount of $2,423.44 to cover only the 3rd quarter of 2018.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, that the Treasurer be instructed to refund the payment of $7,150.75 to Mr. Aleksandr Smotkin, 27 Buckingham Ct., Randolph, NJ 07869 which represents a refund of the 4th quarter of 2018 and the 1st and 2nd quarters of 2019.

22. Acknowledging and Confirming Redemption of Tax Sale Certificate for Block 201, Lot 66, 43 Shongum Rd. to MTAG cust for Ebury Fund 1 NJ LLC—$35,058.29

WHEREAS, Tax Sale Certificate #2033 held by MTAG cust for Ebury Fund 1 NJ LLC, and currently assessed to Mona-Vito-Asafa Development Co., LLC. and known as Block 201, Lot 66 and also known as 43 Shongum Rd.; and

WHEREAS, the above mentioned Tax Sale Certificate has been redeemed by Mona-Vito-Asafa Development Co., LLC. The current owner of the said property. The redemption includes principal and interest in the amount of $23,058.29. There is also a premium in the amount of $12,000.00.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Township of Randolph, County of Morris, acknowledges that the Tax Collector redeemed and refunded the total amount of $35,058.29 to MTAG cust for Ebury Fund 1 NJ LLC, PO Box 37695, Baltimore, MD 21297 the lien holder of Tax Sale Certificate #2033.

23. Declaring a Vendor in Default of MCCPC Contract 28 (Traffic Sign Materials) and Rescinding Award of Contract

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #28 (Traffic Sign Materials); and

WHEREAS, bids had been advertised and received on October 5, 2017, in accordance with Local Public Contracts Law; and

WHEREAS, the Township Council authorized the award of Categories A, B, C, E, F, G, H and I in Contract #28 to Garden State Highway Products in Vineland, New Jersey, at a regular meeting held on November 2, 2017; and

WHEREAS, in a letter dated August 8, 2018, Garden State Highway Products requested to be excused as the vendor supplying items in Category A (Aluminum Sign Blanks) due to an increase in the price of aluminum passed on from their supplier; and

WHEREAS, the MCCPC Administrator replied in a letter and email dated August 14, 2018, that the MCCPC would not approve the request that Garden State Highway Products be excused from supplying the items in Category A of Contract #28; and

WHEREAS, in a subsequent email dated August 15, 2018, Garden State Highway Products confirmed their position that they will not honor their contract for Category A in Contract #28 due to the increase in aluminum prices and that they are willing to accept the consequence of being found in default; and

WHEREAS, Section Z (Default) in the General Conditions and Instructions to Bidders states that a vendor who is unwilling to perform the contract as awarded will be declared in default and the entire contract award will be rescinded.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes that Garden State Highway Products be found in default of Contract #28 (Traffic Sign Materials) due to their unwillingness to provide the items in Category A (Aluminum Sign Blanks) for the prices bid and that the award of Categories A, B, C, E, F, G, H and I be rescinded as noted in Section Z of the General Conditions and Instructions to Bidders.

24. Authorizing Award of MCCPC Contract #4—Snow Grits to Eastern Concrete Materials

WHEREAS, Eastern Concrete Materials in Saddle Brook, New Jersey, is the lowest responsive and responsible bidder for the items and prices shown on the attached Notification of Award for a one-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township on behalf of the MCCPC hereby authorizes the award of Contract #4 (Snow Grits) to Eastern Concrete Materials as noted above for the term October 15, 2018 - October 14, 2019.

25. Authorizing the Award and Rejection of MCCPC Contract #15-A—Police Pursuit Vehicles, 2019 Models to Various Bidders

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #15-A (Police Pursuit Vehicles, 2019 Models); and

WHEREAS, bids had been advertised and received on August 16, 2018, in accordance with Local Public Contracts Law; and

WHEREAS, eight (8) bids were received for Contract #15-A; and

WHEREAS, Larson Ford in Lakewood, New Jersey, was the apparent low bidder for Items #1, #2, #3, #4, #5 and #6 however the Acknowledgement of Revisions & Notices form did not identify that an addendum was issued for Contract #15-A which is a non-curable, non-waivable defect and their bid must be rejected; and

WHEREAS, Chapman Autogroup in Philadelphia, Pennsylvania, was the apparent second low bidder for Items #1, #2, #5 and #6 however the undercoating and rustproofing material provided did not comply with the undercoating and rustproofing requirements in the bid specifications, therefore their bid must be rejected; and

WHEREAS, there were no other bidders for Items #1, #2, #3 and #4 and therefore there will not be an award for those items; and

WHEREAS, Winner Ford in Cherry Hill, New Jersey, was the apparent third lowest bidder for Items #5 and #6 however they did not sign the Bid Proposal Page which is a non-curable, non-waivable defect and their bid must be rejected; and

WHEREAS, prior to the bid opening it was brought to the attention of the MCCPC that the 2019 model for Items #5 and #6 (Ford Interceptor Utility) would not be available for purchase after September 21, 2018, which precedes the start date of the contract; therefore an addendum was issued to all bidders of record stating that the 2020 model of the Ford Interceptor Utility would be an acceptable alternative; and

WHEREAS, Beyer Ford in Morristown, New Jersey, was the lowest responsive and responsible bidder for Item #7 and the fourth lowest bidder being responsive and responsible for the 2020 model of Items #5 and #6 for the prices shown on the attached Notification of Award for a one-year term; and

WHEREAS, Beyer of Morristown in Morristown, New Jersey, was the lowest responsive and responsible bidder for Items #8 and #9 for the prices shown on the attached Notification of Award for a one-year term; and

WHEREAS, Mall Chevrolet in Cherry Hill, New Jersey, was the lowest responsive and responsible bidder for Items #12 and #13 for the prices shown on the attached Notification of Award for a one-year term; and

WHEREAS, there were no bidders for Items #10 and #11.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection, and hereby rejects, the bids submitted for Contract #15-A (Police Pursuit Vehicles, 2019 Models) by Larson Ford, Chapman Autogroup and Winner Ford for the reasons stated above.

BE IT FURTHER RESOLVED that the Randolph Township Council hereby authorizes the award of Contract #15-A (Police Pursuit Vehicles, 2019 Models) to Beyer Ford, Beyer of Morristown and Mall Chevrolet as noted in the Notification of Award for the term November 1, 2018 - October 31, 2019.

26. Authorizing Award of MCCPC Contract #15-B—Administrative Passenger Vehicles, 2019 Models to Various Bidders

27. Authorizing Award and Rejection of MCCPC Contract #15-C—Utility Vehicle, 2019 Models to Route 23 Automall

WHEREAS, the Township of Randolph (“Township”) on behalf of the Morris County Cooperative Pricing Council (“MCCPC”) sought bids for Contract #15-C (Utility Vehicles, 2019 Models); and

WHEREAS, bids had been advertised and received on August 16, 2018, in accordance with Local Public Contracts Law; and

WHEREAS, six (6) bids were received for Contract #15-C; and

WHEREAS, Larson Ford in Lakewood, New Jersey, was the apparent low bidder for Item #1 and the apparent second low bidder for Item #13, however the undercoating and rustproofing information submitted with their bid does not comply with the bid specifications, and therefore their bids for those items must be rejected; and

WHEREAS, Mall Chevrolet in Cherry Hill, New Jersey, was the apparent low bidder for Items #7 and #13 however the extended powertrain warranty information they are offering does not comply with the required 7 year/84,000 mile extended powertrain warranty required in the bid specifications, and therefore their bid for those items must be rejected; and

WHEREAS, Route 23 Automall in Butler, New Jersey, and DFFLM in Flemington, New Jersey, are the lowest responsive and responsible bidders for the items and prices shown on the attached Notification of Award for a one-year term.

NOW, THEREFORE, BE IT RESOLVED by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that the Township Council on behalf of the MCCPC hereby authorizes the rejection, and hereby rejects, the bids submitted by Larson Ford and Mall Chevrolet for the reasons stated above.

31. Authorizing Contracts with Additional Approved Vendors Under the MCCPC Pursuant to N.J.S.A. 40A:11-11(5)

WHEREAS, the Township of Randolph pursuant to N.J.S.A. 40A:11-11(5) and N.J.A.C. 5:34-7.1 et seq. may, by resolution and without advertising for bids, purchase any goods or services under a Cooperative Pricing System of which the Township is a member; and

WHEREAS, the Township of Randolph on March 1, 2018 via R 76-18 authorized contracts with certain approved MCCPC Contract Vendors and on May 17, 2018 via R 119-18 and again on July 26, 2018 via R 208-18 authorized additional approved Vendors; and

WHEREAS, it’s been determined that contracts in excess of $17,500 will be entered into with additional MCCPC Contract Vendors; and

WHEREAS, the additional MCCPC Contract Vendors have been added to the attached list; and

WHEREAS, the Township of Randolph anticipates entering into contracts in excess of $17,500 with the attached referenced Contract Vendors through this resolution and properly executed purchase orders/contracts as needed, which shall be subject to all the conditions applicable to the current co-op contracts.

NOW, THEREFORE, BE IT RESOLVED that the Township of Randolph authorizes the Purchasing Agent to purchase certain goods and services from the additional approved MCCPC Contract Vendors on the attached list, pursuant to all conditions of the individual co-op contracts; and

BE IT FURTHER RESOLVED that the governing body of the Township of Randolph pursuant to N.J.A.C. 5:30-5.5(b) regarding the certification of available funds, shall either certify the full maximum amount against the budget at the time the contract is awarded, or no contract amount shall be chargeable or certified until such time as the goods or services are ordered or otherwise called for prior to placing the order, and a certification of availability of funds is made by the Chief Financial Officer via an authorized Purchase Order; and

BE IT FURTHER RESOLVED that the duration of the contracts between the Township of Randolph and the referenced MCCPC Contract Vendors shall be until December 31, 2018 or upon expiration of the vendor’s contract whichever is first.

32. Authorizing Contracts with Additional State Contract Vendors for Contracting Units Pursuant to N.J.S.A. 40A:11-12a

WHEREAS, the Township of Randolph pursuant to N.J.S.A. 40A:11-12a and N.J.A.C. 5:34-7.29(c), may, by resolution and without advertising for bids, purchase any goods or services under the State of New Jersey Cooperative Purchasing Program for any State contracts entered into on behalf of the State by the Division of Purchase and Property in the Department of the Treasury; and

WHEREAS, the Township of Randolph on March 1, 2018 via R 74-18 authorized contracts with certain approved State; and

WHEREAS, it’s been determined that contracts in excess of $17,500 will be entered into with additional State Contract Vendors; and

WHEREAS, the additional State Contract Vendors have been added to the attached list; and

WHEREAS, the Township of Randolph anticipates entering into contracts in excess of $17,500 with the attached referenced State Contract Vendors through this resolution and properly executed purchase orders/contracts as needed, which shall be subject to all the conditions applicable to the current State contracts.

NOW, THEREFORE, BE IT RESOLVED, that the Township of Randolph authorizes the Purchasing Agent to purchase certain goods and services from the additional approved New Jersey State Contract Vendors on the attached list, pursuant to all conditions of the individual State contracts; and

33. Awarding an Emergency Contract for the Repair of a Collapsed Retaining Wall at 307 Millbrook Avenue with Kulpeksa Land Improvement Corp.—$51,726.00

WHEREAS, on August 9, 2018 a retaining wall at 307 Millbrook Avenue collapsed; and

WHEREAS, the Engineering Administrator/W&S certified to the emergency, which required the immediate repair to prevent the right of way, wall, and driveway from collapsing into the roadway, causing a public safety hazard; and

WHEREAS, the need for the immediate repair due to the emergency affecting the public safety allows for the township to award a contract without public advertising for bids and bidding therefor, notwithstanding that the contract price will exceed the bid threshold; and

WHEREAS, Kulpeksa Land Improvement Corp. of Rockaway, NJ was contacted and performed the necessary repairs as required for the price of $51,726; and

WHEREAS, the Finance Officer has certified to the availability of funds for this emergency repair from 04-215-55-975-320 ($12,555.21) and 04-215-55-990-326 ($39,170.79).

NOW, THEREFORE BE IT RESOLVED, by the Township Council, Township of Randolph, County of Morris, State of New Jersey, that an emergency contract be awarded to Kulpeksa Land Improvement Corp. of Rockaway, NJ and payment be made for the emergency repair of the retaining wall at 307 Millbrook Avenue for the price of $51,726.

35. Release Cash Road Opening Bond for the Purpose of Widening the Driveway at 12 Georgian Road, Block 42.05, Lot 10 to Danilo Sta Ana—$500.00

WHEREAS, the Engineering Department has received a request from Danilo Sta Ana for the release of a $500.00 cash road opening bond posted for the purpose of widening the driveway at 12 Georgian Road, Randolph, NJ 07869 (BL 42.05/L 10); and

WHEREAS, the Road Opening Bond consisted of a $500.00 cash bond, which was received and deposited with the Finance Department on June 18, 2018; and

WHEREAS, the Applicant was required to post this cash bond to guarantee the widening of the driveway at 12 Georgian Road, Randolph, NJ 07869, within the Township Right of Way; and

WHEREAS, the Engineering Department has inspected the road opening work, and found it to be acceptable.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey that it is recommended by Raffaele Carchia, Engineering Administrator that the Cash Road Opening Bond in the amount of $500.00 be refunded to Danilo Sta Ana at 12 Georgian Road, Randolph NJ 07869.

36. Determining the Form and Other Details of $4,520,000 General Bonds of 2018 and $4,365,000 Open Space Bonds of 2018 of the Township of Randolph

BE IT RESOLVED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF RANDOLPH, IN THE COUNTY OF MORRIS, NEW JERSEY, AS FOLLOWS:

Terms of Bonds. The $4,520,000 General Bonds of 2018 (the “General Bonds”) of The Township of Randolph, in the County of Morris, New Jersey (the “Township”), referred to and described in the resolution adopted pursuant to the Local Bond Law of the State of New Jersey, by the Township Council of the Township on September 6, 2018, entitled “Resolution providing for the combination of certain issues of bonds of the Township of Randolph, in the County of Morris, New Jersey, into a single issue of General Bonds aggregating $4,520,000 in principal amount” and authorized by certain bond ordinances of the Township therein described, shall be dated the date of delivery thereof, shall bear interest payable semi-annually on April 15 and October 15 in each year, commencing April 15, 2019, expressed in a multiple of 1/100th of 1% or a multiple of 1/8 of 1%, shall mature in the principal amount of $160,000 on October 15, 2019, $265,000 on October 15, 2020, $290,000 on October 15, 2021, $320,000 on October 15 in each of the years 2022 to 2032, both inclusive, and $285,000 on October 15, 2033 and shall each bear a distinctive number to distinguish it from all other General Bonds of said issue. The $4,365,000 Open Space Bonds of 2018 (the “Open Space Bonds” and, together with the General Bonds, the “Bonds”) of the Township referred to and described in the resolution adopted pursuant to the Local Bond Law of the State of New Jersey, by the Township Council of the Township on September 6, 2018, entitled “Resolution providing for the combination of certain issues of bonds of the Township of Randolph, in the County of Morris, New Jersey, into a single issue of Open Space Bonds aggregating to $4,365,000 in principal amount” and authorized by certain bond ordinances the Township therein described, shall be dated the date of delivery thereof, shall bear interest payable semi-annually on April 15 and October 15 in each year, commencing April 15, 2019, expressed in a multiple of 1/100th of 1% or a multiple of 1/8 of 1%, shall mature in the principal amount of $235,000 October 15, 2019, $245,000 on October 15, 2020, $250,000 on October 15, 2021, $260,000 on October 15, 2022, $270,000 on October 15, 2023, $280,000 on October 15, 2024, $290,000 on October 15, 2025, $295,000 on October 15, 2026, $305,000 on October 15, 2027, $315,000 on October 15, 2028, $325,000 on October 15, 2029, $335,000 on October 15, 2030, $345,000 on October 15, 2031, $355,000 on October 15, 2032 and $260,000 on October 15, 2033, and shall each bear a distinctive number to distinguish it from all other Open Space Bonds of said issue.

Book-Entry-Only Bonds. The Bonds shall be issued by means of a book-entry system with no physical distribution of bond certificates made to the public. The Bonds shall be issued in registered form and bond certificates for each maturity of each series will be issued to The Depository Trust Company, New York, New York (“DTC”), registered in the name of its nominee Cede & Co., and immobilized in its custody. A book-entry system will be employed, evidencing ownership of the Bonds in principal amount of $5,000 or any $1,000 increment in excess thereof, with transfers of ownership affected on the records of DTC and its participants pursuant to rules and procedures adopted by DTC and its participants. The successful bidder, as a condition to the delivery of the Bonds, will be required to deposit the bond certificates with DTC, registered in the name of Cede & Co. So long as Cede & Co. is the registered owner of the Bonds, principal and redemption price, if any, of and interest on the Bonds will be payable by the Township or its agent to DTC or its nominee as registered owner of the Bonds. The Bonds shall be executed in the name of the Township by the manual or facsimile signatures of its Mayor and its Chief Financial Officer, under the seal of the Township affixed, imprinted or otherwise reproduced thereon and attested by the manual signature of its Township Clerk.

Redemption. (A) The Bonds of each series maturing prior to October 15, 2026 are not subject to redemption prior to maturity at the option of the Township. The Bonds of each series maturing on or after October 15, 2026 are subject to redemption prior to maturity at the option of the Township upon notice as described below in whole or in part, in any order of maturity and by lot within a maturity if less than all the Bonds of such maturity are to be redeemed, on any date on or after October 15, 2025, at a redemption price equal to 100% of the principal amount thereof, together with interest accrued, if any, to the date fixed for redemption.

Notice of redemption shall be given by first-class mail, postage prepaid, to the registered owners of the Bonds or portions thereof to be redeemed, not less than thirty (30) days nor more than sixty (60) days prior to the redemption date, but such mailing shall not be a condition precedent to such redemption and failure so to mail any such notice shall not affect the validity of any proceedings for the redemption of Bonds. If notice of redemption shall have been given as aforesaid, the Bonds or portions thereof specified in said notice shall become due and payable at the redemption price on the redemption date therein designated and if, on the redemption date, moneys for payment of the redemption price of all the Bonds to be redeemed, together with interest to the redemption date, shall be available for such payment on said date, then from and after the redemption date interest on such Bonds shall cease to accrue and become payable. Less than all of a Bond in a denomination in excess of $5,000 may be so redeemed, and in such case, upon the surrender of such Bond, there shall be issued to the registered owner thereof, without charge therefor, for the unredeemed balance of the principal amount of such Bond, Bonds of like series, designation, maturity and interest rate in any of the authorized denominations.

Section 4. The following additional matters are hereby determined, declared, recited and stated:

  1. None of the bonds of the several issues of bonds described in Section 2 hereof has been heretofore sold or issued and the several bond ordinances described in Section 2 hereof have not heretofore been rescinded and now remain in full force and effect as authorizations for the amount of bonds set forth opposite the title of the several bond ordinances described in said Section 2 hereof.
  2. No bonds are authorized by any of the bond ordinances described in Section 2 hereof, except bonds in the amount set opposite the title of said bond ordinances in Section 2 hereof and except $3,000 (#12-18).

39. Authorizing the Person-to-Person and Place-to-Place Transfer of Plenary Liquor License from Randolph Restaurants, LLC to Meadow Wood Catering, LLC

WHEREAS, Meadow Wood Catering LLC (“Applicant”), age twenty one (21) or greater, has submitted a properly completed Retail Liquor License Application (“Application”), as provided by the New Jersey Division of Alcoholic Beverage Control (“ABC”), to transfer liquor license No. 1432-33-011-009 (“Liquor License”) from Randolph Restaurants LLC (“Licensee”) to Applicant, including all appropriate supporting documents and affidavits of publication; and

WHEREAS, Notice of the Application was published in the Daily Record on August 20, 2018 and August 27, 2018; and

WHEREAS, a police background check has been completed on Applicant, including a fingerprint check, with a determination of no criminal history; and

WHEREAS, the Applicant has disclosed information as to the source of funds for acquiring the Liquor License from the current Licensee satisfactory to Randolph Township; and

WHEREAS, the Licensee has submitted a Consent to Transfer Liquor License; and

WHEREAS, the New Jersey Department of the Treasury, Division of Taxation has approved and issued an Alcoholic Beverage Retail Licensee Clearance Certificate (Transfer) and;

WHEREAS, the Township of Randolph has not received any objection to the transfer of the Liquor License to the Applicant; and

WHEREAS, all applicable requirements to transfer a liquor license per N.J.S.A. 33:1 et seq., N.J.A.C. 13:2-7.1 et seq., and the Township of Randolph Revised Ordinances 4-1 et seq. have been met, including the payment of all required fees.

NOW, THEREFORE BE IT RESOLVED by the Township Council of the Township of Randolph, County of Morris, State of New Jersey, as follows:

  1. The Person-to-Person and Place-to-Place (expansion) transfer of the Plenary liquor license No. 1432-33-011-009 from Randolph Restaurants LLC to Meadow Wood Catering LLC is hereby authorized and approved.

1. Ordinance No. 19-18: An Ordinance Authorizing the Vacation of the Entirety of Nester Avenue and Sidney Terrace within the Township of Randolph

Manager Mountain explained that Nester Avenue was taken off the tax map many years ago, but it was not officially vacated. Sidney Terrace was never filed. This ordinance vacates both of these roads.

Councilman Guadagno asked if when roads are vacated, they are first looked at to determine if an easement might be beneficial for trails or anything else. Manager Mountain replied that Darren Carney does do prior research.

Councilwoman Veech asked if there were any more paper streets in the township; Darren Carney replied that there are approximately 50-100 others. Councilwoman Veech asked what the plan was for them. Darren replied that the two in the ordinance were recently sold; the title company had issues with them. The Council has been re-vacating streets for the past 40 years due to issues that arise.

2. Ordinance No. 20-18: An Ordinance Reappropriating $44,000 from Ordinance #15-13 in Order to Provide for other Purposes in and by the Township of Randolph

Manager Mountain explained that this ordinance reappropriates $44,000 from an older ordinance that had been originally set aside funding for security needs at the DPW garage and other facilities. The Buildings and Grounds supervisor and Public Works Director felt that security was needed in other areas, and not the automated gates at the DPW garage.

K. COUNCIL COMMENTS

Councilman Guadagno reported there was no Trails Committee meeting.

There was a storm group sub-committee meeting with First Energy; he felt it was inappropriate for them to ask the township to endorse their rate request. Manager Mountain explained further that First Energy is proposing improvements in response to the March storms, which will also result in a rate increase. It will be a rider on the bill with the capital improvements listed. He explained that Councilman Guadagno was referring to First Energy wanting to attend a future Council meeting to have the Council endorse their rate request to the Board of Public Utilities. Manager Mountain will discuss with First Energy the feedback, and let them know they can attend and provide the information and it would be up to the Council to discuss. Councilman Guadagno felt that First Energy did not do a good job during the March storms, and are doing worse than the response to Superstorm Sandy due to fewer workers. Councilwoman Veech agreed with Councilman Guadagno, and stated that at the sub-committee meeting the woman from First Energy skirted many of the questions; she is now responsible for 41 towns. Mayor Forstenhausler commented that Betty Lou DeCroce, Assemblywoman from District 26, had a meeting at her office with several local Mayors, Assemblyman Anthony Bucco, and First Energy President Jim Fakult. The proposed improvements were discussed, as well as personnel issues such as not yet replacing Mike Obremski, resulting in the new person having such a large number of towns for which she’s responsible. First Energy’s plan is to increase spending over the next several years to make improvements. Mayor Forstenhausler reported some of the other recommendations and improvements discussed at the meeting.

Councilman Napoliello reported that the Board of Health did not meet over the summer.

Councilman Tkacs attended the Traffic Advisory Committee meeting; there has been an uptick in accidents on Route 10 eastbound, when motorists are turning left onto Center Grove Road near Weis Markets. The stacking area for the left turn is not very long, and the turning arrow signal is not long. Manager Mountain reiterated that there have been ongoing efforts from the township and Mayor to try to draw the attention of the Department of Transportation (DOT). While Councilwoman Carey was Mayor, the township was led to believe that the project was moving forward; however, it has since stalled. The Manager felt that elected representatives at the state level may need to intervene. Mayor Forstenhausler reported that he spoke to Governor Murphy about it, and has spoken with his liaison at the governor’s office many times. The last time he spoke to the person, he received the name, email, and phone number of someone at the DOT; the person at the DOT responded to an email. The Mayor and Manager will continue to work with the DOT to set up a meeting date.

Councilman Tkacs attended the Planning Board meeting; the Meadow Wood Manor plans to do an addition, and for the Gateways Apartments, the developer removed one of the buildings and agreed to some fencing. The Gateways Apartments application is not yet fully approved.

Councilwoman Veech attended the community garden meeting; 14 people attended. Parks & Recreation Director interviewed and hired Mike Dzomba as the garden coordinator. Soil testing will be completed by Rutgers University. There will be an information table at the Country Fair. The pre-construction meeting will be held on September 7, 2018. The committee was in the process of creating a survey to gather feedback on items such as the cost, registration, and number of garden plots. The next meeting will be held on October 1st at 6:30 p.m. in the Community Center; the group will meet at 6:00 p.m. at the site to walk through it.

Councilwoman Carey attended the Library Board Meeting; the summer concert series concluded for the year. It was very well attended. The gazebo behind the library is deteriorating and needs to be replaced. Due to the site being the swimming pool of the former hotel, there were issues with putting the new gazebo there due to the ground settling. The Library Board met with Manager Mountain and Township Engineer, Paul Ferriero, at the site to determine a solution.

Deputy Mayor Loveys attended the facilities work group; they reviewed each of the township-owned facilities. He attended the ribbon cutting for the school district’s transition house; this will be used for the developmentally disabled students, 18-21 years old, to learn life skills.

Deputy Mayor Loveys attended the MAC meeting in Councilwoman Carey’s absence. At the meeting it was discussed that the Stigma-Free logo on the township website should match the colors of the county-sponsored initiative. The Recreation Department held a movie night at Randolph Lake, which the MAC supported; about 100 people attended. They plan to work with the Recreation Department again in the future, with something for older children. Dr. Maryalice Thomas, liaison from the schools, is going to schedule a mental health first aid training in the fall for middle school and high school teachers. On October 10 at 7 p.m. in the Community Center, the MAC and the Randolph Health Department are sponsoring a community mental health program with Dr. Leibu from Summit Medical Group.

Mayor Forstenhausler reported that the Essex-Morris Senior Softball League held their picnic in August; he and several Council members attended.

Mayor Forstenhausler also reported that the VFW had their picnic at Freedom Park; he and several Council members attended.

Mayor Forstenhausler attended the Board of Education liaison meeting on August 14. Members from the township and the board discussed current topics and events.

The Mayor also attended the Peach Festival at the Randolph Museum.

Mayor Forstenhausler reported that he, Deputy Mayor Loveys, and Councilwomen Carey and Veech attended the demonstration of the new zipper machine for road repairs that is shared by the Randolph DPW, and two other towns.

Mayor Forstenhausler reported that the new floor in the VFW looks great, the members are very pleased, and he commended Donna Luciani for coordinating the project.

The Mayor also reported that the 300 year old Liberty Tree had to be cut down. Several of the Council members met at the tree prior to the removal for photos. Pieces of the tree were saved.

The Mayor and Deputy Mayor attended a pep rally at the high school; this was a new event. He also reported that the Council got to see the new fire truck prior to this Council meeting.

L. EXECUTIVE SESSION

WHEREAS, Section 8 of the Open Public Meetings Act, Chapter 231, P.L. 1975 (N.J.S.A. 10:4-12) permits the exclusion of the public from a meeting under certain circumstances; and

WHEREAS, this public body is of the opinion that such circumstances presently exist.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Township of Randolph, in the County of Morris, and State of New Jersey, as follows:

1. The public shall be excluded from the Executive portion of the meeting.

2. The general nature of the subject matter to be discussed is as follows:

3. As nearly as now can be ascertained, the matter or matters to be discussed at this time will be disclosed to the public at such time and under such circumstances as are prescribed by law.

4. At the conclusion of the Executive Session, the Council will reconvene in public session for the purpose of taking formal action.
