An Ordinance Amending the Peddlers and Solicitors Ordinance, Chapter 14, and the Fee Schedule at Appendix A of the Code of the Township of Randolph to Amend the Annual Fee, and to Establish a "No Solicitation List"

Whereas, pursuant to NJ.S.A. 40:48-1, et. seq., NJ.S.A. 40:52-1; and NJ.S. A. 45-24-1, et. seq. the governing body of a municipality may make, amend, repeal, and enforce ordinances to regulate the conduct of peddlers and solicitors; and

Whereas, the Township of Randolph desires to amend Subsection 14-95 ( c) of the Peddlers and Solicitors Ordinance to set an annual term for a license and to amend the permit fee schedule contained in Appendix A of the Code of the Township of Randolph; and

Whereas, the Township of Randolph desires to establish a "No Solicitation List" whereupon any interested resident may be listed, at the resident's discretion, which list shall be maintained by the Township Clerk and provided to all persons obtaining a Peddlers and Solicitors License.

Now, therefore, be it ordained by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:

Section 1. Section 14-95 shall be amended to add a new subsection ( c) as follows:

Sec. 14-95 Annual Permit

(c) A permit shall be valid for one calendar year which shall run from January 1 to December 31 of the calendar year in which it is issued. There shall be an annual fee, which shall be charged for the annual permit, or for any portion of the calendar year without proration. No more than one individual shall utilize any one license. Where an organization has several agents engaged in solicitation activities within the Township, each agent shall be separately licensed, and pay the annual permit fee.

Section 2. A new Section 14-99 shall be added as follows:

Sec. 14-99 No Solicitation List

No person subject to the terms of this chapter shall make any solicitation within the Township limits where solicitors are notified by sign posted by a Township resident on the door or premises that soliciting is prohibited. No person subject to this chapter shall make any solicitation to any address within the Township which is contained on a "No Solicitation" list maintained by the Township of residences not to be solicited. The Township Clerk shall provide each person securing a permit with the "No Solicitation" list and shall take suitable steps to inform the residents of the Township that they may be included on such list at their discretion

Section 3. The Calendar Year Fee Schedule as Contained within Appendix A of the Code of the Township of Randolph for "Peddlers and Solicitors" shall be amended to read as follows and Subsection 2 ("One day - $10") shall be deleted:

Peddlers and solicitors:

(1) Calendar year $350 per solicitor/peddler

Section 4. All ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.

Section 5. If any section, subsection clause or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portion of this Ordinance.

Section 6. This Ordinance shall take effect immediately upon final passage, approval and publication as provided by law.

Notice is hereby given that an Ordinance entitled "An Ordinance Amending the Peddlers and Solicitors Ordinance, Chapter 14, and the Fee Schedule at Appendix A of the Code of the Township of Randolph to Amend the Annual Fee, and to Establish a 'No Solicitation List'" was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on July 26, 2018 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on September 6, 2018 at 7 pm prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to amend the Township Ordinance to establish the term of a Peddlers and Solicitors license, to amend the fee for the license, and to establish a "No Solicitation List" to be maintained by the Township Clerk upon which any interested resident may list their name and address at the residents discretion. Said list shall be provided to all Peddlers and Solicitors licensees.

A copy of the full Ordinance is available to any member of the general public, without cost, at the Township of Randolph, Municipal Building, Millbrook Avenue, Randolph, New Jersey, at the Office of the Township Clerk, between the hours of 9 am and 4:30 pm.
