Please note: An Ordinance Amending Section 10-1, 10-91, 10-112, 10-222 and 10-341 of Chapter 10, Boards, Commissions, Committees and Agencies of the Revised Ordinances of the Township of Randolph.
- WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and
- WHEREAS, the Township of Randolph (“Township”) desires to amend Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph to provide for the appointment to any and all agencies, boards, commissions and committees, except as otherwise provided by law or in the Revised Ordinances of the Township of Randolph, of up to four student members each for a term of one year.
- NOW, THEREFORE, BE IT ORDAINED, by the governing body of the Township of Randolph, County of Morris, State of New Jersey, as follows:
Section 10-1, Organization; election of officer; student members, of Article I, In General, of Chapter 10, Boards, Commissions, Committees and Agencies, of Revised Ordinances of the Township of Randolph is hereby deleted in its entirety and replaced with the following:
Sec. 10-1. - Organization; election of officers; student members.
(a) All agencies, boards and committees, except as otherwise provided by law or these Revised Ordinances, shall organize and elect one of the members as presiding head and such other members to such offices as are necessary for the conduct of business.
(b) The council may appoint to any and all agencies, boards, commissions and committees, except as otherwise provided by law or these Revised Ordinances, up to four additional high school student member representative per agency, board, commission or committee for a term of one year. Each such additional student member shall not have any voting power, but shall be subject to the same conditions as provided by law or these Revised Ordinances for each such agency, board, commission or committee.
(c) Each additional high school student member representative of an agency, board, commission or committee appointed by the township council shall serve for a term to coincide with the academic calendar. The term for each high school student member representative shall run from June of each year, for a one-year period.
Section 10-91, Membership; term of office, of Article V, Advisory Recreation Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of Revised Ordinances of the Township of Randolph is hereby deleted in its entirety and replaced with the following:
Sec. 10-91. - Membership; term of office.
(a) There shall be an advisory recreation committee consisting of 11 members appointed by the council.
(b) The initial terms of seven such members shall be as follows: two members for a term of three years each, two members for a term of two years each, and three members for a term of one year each. The terms of the successors to these seven members shall be for three years each.
(c) The terms of the remaining four members shall be for one year each.
(d) After the initial appointments, all future membership appointments shall be made at the annual reorganization meeting. (e) There shall be two alternate members of the advisory recreation committee which shall be appointed by the council.
Section 10-112, Appointment and term, of Article VI, Advisory Parks Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of Revised Ordinances of the Township of Randolph is hereby deleted in its entirety and replaced with the following:
Sec. 10-112. - Appointment and term.
(a) The committee shall consist of eight general members, plus one member from the recreation committee, all of which are to be appointed by the council. All members of the committee shall reside in the township. Student members shall not take part in voting.
(b) The members first appointed, as designated by the council shall serve terms as follows: (1) Four general members for three years; (2) Four general members for two years; (3) The member from the recreation committee for one year.
(c) The general members' successors shall be appointed for terms of three years. The successor of the recreation committee member shall be appointed for one year. After the initial appointments, all future appointments shall be made on January 1 of each year.
Section 10-222, Appointment; term; officers; vacancies, of Article XI, Community Services Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of Revised Ordinances of the Township of Randolph is hereby deleted in its entirety and replaced with the following:
Sec. 10-222. – Appointment; term; officers; vacancies.
(a) The committee shall consist of nine general members and one alternate member. A meeting quorum shall be achieved with any combination of general members and alternate member as long as a total of five or more general/alternate members are in attendance. All members shall reside in Randolph. Student members shall not take part in voting.
(b) The members first appointed, by the council, shall serve terms as follows:
- Three general members for three years with terms expiring December 31, 2009. After the initial appointment; all future appointments shall be for three years.
- Three general members for two years with terms expiring December 31, 2008. After the initial appointment; all future appointments shall be for three years.
- Three general members for one year with terms expiring December 31, 2007. After the initial appointment; all future appointments shall be for three years.
- One alternate member for three years, with the first term expiring December 31, 2009. After the initial appointment; all future appointments shall be for three years.
(c) The chairperson of the committee shall be a general member who shall be appointed by a vote of a majority of a quorum during a duly convened meeting of the committee, at its annual reorganization meeting to be held within the first 30 days of each calendar year. (d) If a vacancy shall occur, it shall be filled by appointment, as provided above, for the unexpired term.
Section 10-341, Appointment and term, of Article XVII, Wildlife Management Advisory Committee, of Chapter 10, Boards, Commissions, Committees and Agencies, of Revised Ordinances of the Township of Randolph is hereby deleted in its entirety and replaced with the following:
Sec. 10-341. - Appointment and term.
(a) The committee shall consist of:
- Five general members and one alternate member, all of which are to be appointed by the township council;
- One member from the advisory parks committee, which shall be appointed by the advisory parks committee;
- One member from the township council, who shall serve as liaison to the township council; and
- The township manager or his/her designee. The alternate member shall participate in the absence of any of the general members.
(b) The initial appointment of all committee members shall occur on January 1, 2013. The committee members shall serve according to the following terms:
- Three general members serving for two-year terms;
- Two general members serving for one-year terms;
- The members from the advisory parks committee, the township council and the township manager serving one-year terms; and
- The alternate member serving for a one-year term.
(c) The successors to the general members shall be appointed for three-year terms at the township council annual reorganization meeting.
(d) The successors to the advisory parks committee member shall be appointed for one-year terms at the advisory parks committee annual reorganization meeting.
(e) The successors to the township council member shall be appointed by the mayor for one-year terms at the township council annual reorganization meeting.
(f) The successors to the alternate member shall be appointed for two-year terms at the township council annual reorganization meeting.
(g) If a vacancy shall occur, it shall be filled by appointment, as provided above, for the unexpired term.
All Ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.
If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.
This Ordinance shall take effect as provided by law.

Notice is hereby given that an Ordinance entitled "An Ordinance Amending Sections 101, 10-91, 10-112, 10-222 and 10-341 of Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinance of the Township of Randolph, Morris County, New Jersey, regarding the Appointment of Student Members" was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on September 21, 2023 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on October 19, 2023 at 6 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of the above Ordinance is to amend Chapter 10, Boards, Commissions, Committees and Agencies, of the Revised Ordinances of the Township of Randolph to provide for the appointment to any and all agencies, boards, commissions and committees, except as otherwise provided by law or in the Revised Ordinances of the Township of Randolph, of up to four student members each for a term of one year.
