Please note: An Ordinance Authorizing the Vacation and Release of the Utility Easement Located on Lots 29, 30 and 39, Block 120 Within the Township of Randolph

  • WHEREAS, N.J.S.A 40A:12-13 authorizes a municipality to release and extinguish the public right arising from the dedication of easements upon real property; and
  • WHEREAS, a Utility Easement was dedicated to the Randolph Township Municipal Utilities Authority on Lots 29, 30 and 39, Block 120, in the Township of Randolph (formerly Lots 6 and 7, Block 120) by Grant of Easement between Mabel A. McDermott and the Randolph Township Utilities Authority dated August 9, 1993 and recorded in the Office of the Morris County Clerk on August 26, 1993 at Book 3828, Page 178 (“Utility Easement”); and
  • WHEREAS, there are no utilities located within the Utility Easement and the Township of Randolph (“Township”), as successor to the Randolph Township Municipal Utilities Authority, has determined that said Utility Easement is no longer desirable, necessary, or required for public purposes; and
  • WHEREAS, the Township desires to release and vacate said Utility Easement.

NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, and State of New Jersey as follows:

Ordinance No. 30-25

Notice is hereby given that an Ordinance entitled "An Ordinance Authorizing the Vacation and Release of the Utility Easement Located on Lots 29, 30 and 39, Block 120 Within the Township of Randolph" was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on November 25, 2025 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on December 18, 2025 at 6 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.

Statement of Purpose of Ordinance

The purpose of the above Ordinance is to vacate and release the Township of Randolph’s interest in the Utility Easement located upon Lots 29, 30 and 39, Block 120, as same is described on the Grant of Easement between Mabel A. McDermott and the Randolph Township Utilities Authority (predecessor in interest to the Township of Randolph) dated August 9, 1993 and recorded in the Office of the Morris County Clerk on August 26, 1993 at Book 3828, Page 178, which is not needed or required for public purposes.
