Please note: An Ordinance Amending Chapter 46, Taxicabs, and Appendix A, Fee Schedule, of the Revised Ordinances of the Township of Randolph
- WHEREAS, pursuant to N.J.S.A.40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and
- WHEREAS, the Township of Randolph (“Township”) adopted Chapter 46, Taxicabs, of the Revised Ordinances of the Township of Randolph regarding the licensing and regulation of taxicabs operating in the Township; and
- WHEREAS, it is necessary to amend Chapter 46, Taxicabs, of the Revised Ordinances of the Township of Randolph to be consistent with current statutory provisions governing taxicabs; and
- WHEREAS, pursuant to N.J.S.A. 40:48-1, the governing body of a municipality may make, amend, repeal, and enforce ordinances to manage, regulate, and control the finances and property of the municipality; and
- WHEREAS, the Township of Randolph desires to amend Appendix A, Fee Schedule, of the Revised Ordinances of the Township of Randolph to update the fees for Taxi/Autocab Owner’s Licenses and Taxi/Autocab Driver’s Licenses.
NOW, THEREFORE, BE IT ORDAINED by the Governing Body of the Township of Randolph, County of Morris, State of New Jersey as follows:
Chapter 46, Taxicabs, of the Revised Ordinances of the Township of Randolph is hereby deleted in its entirety and replaced by the following:
CHAPTER 46 – TAXI/AUTOCABS AND LIMOUSINES
ARTICLE I. – TAXI/AUTOCABS
Sec. 46-1. - Definitions.
The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this Section, except where the context clearly indicates a different meaning:
Township shall mean Township of Randolph.
Driver shall mean any person who drives a taxi/autocab within the Township.
Operation of a taxi/autocab shall consist of transporting in such taxi/autocab of one or more persons for hire.
A taxi/autocab which is operated or run, over any of the streets within the Township, to seek or accept passengers for transportation from points or places to points or places within or outside the Township shall be deemed to be operation of a taxi/autocab within the Township. A taxi/autocab parked or idling on a Township street or accepting a passenger for hire from a point of departure within the Township shall be deemed to be operation. Operation of a taxi/autocab by one other than the owner shall be deemed operation by the owner, as well as operation by the person actually driving the taxi/autocab.
Owner shall mean any person, business entity or association in whose name title to any taxi/autocab is registered with the New Jersey Motor Vehicle Commission, or who appears in any governmental records to be the conditional vendee or licensee thereof.
Person means and includes any individual, copartnership, association, corporation or joint stock company, their lessees, trustees or receivers appointed by any court whatsoever.
Taxi/Autocab shall mean and include any automobile or motor car, commonly called taxi, engaged in the business of carrying passengers for hire which is held out, announced or advertised to operate or run, or which is operated or run over any of the streets within the Township and which accepts or discharges passengers for transportation from points or places to points or places within or outside the Township. Taxi/Autocab shall not include a limousine as defined by N.J.S.A. 48:16-13.
Sec. 46-2. - Requirement of taxi/autocab owner’s or driver’s license
No person shall operate any taxi/autocab within the Township unless both the taxi/autocab and the driver thereof are licensed in the Township in accordance with this Article and said person conforms to all requirements of this Article and the statutes and regulations of the State of New Jersey governing taxis/autocabs.
Sec. 46-3. - Licenses
All taxi/autocab drivers and owners, operating within the Township shall be licensed in accordance with the provisions of this Article. There are hereby established two (2) classes of taxi/autocab licenses in the Township as follows:
a. "Taxi/Autocab Driver's License". This license shall entitle the individual named therein to operate within this Township any taxi/autocab duly licensed hereunder. Such license may only be issued in the name of an individual and not in the name of the business entity.
b. "Taxi/Autocab Owner's License". This license shall entitle the vehicle therein listed and described to be used as a taxi/autocab and operated in this Township by a driver duly licensed hereunder.
Sec. 46-4. - Applications for licenses
Application Form. Each applicant for the issuance or renewal of a license of either class shall supply, in full, the information requested on the application forms available from the Township Clerk and shall verify the correctness thereof by certification. The completed application must be filed with the Township Clerk, together with the fee(s) set forth in Appendix A, Fee Schedule.
a. Applications for Taxi/Autocab Owner's and Driver's Licenses can be filed with the Township Clerk at any time, but no taxi/autocab shall be operated in the Township until both the taxi/autocab and driver are licensed in accordance with this Article each year.
b. Requirements for Taxi/Autocab Owner's Licenses. Each applicant for a Taxi/Autocab Owner's License must meet the following requirements to be considered for issuance of a license:
- Be of the age of twenty-one (21) years, or over.
- Fully complete an application form provided by the Township Clerk, which shall be signed and sworn to or certified by the applicant and filed with the Township Clerk as a permanent record.
- Have each driver of the taxi/autocab for which the owner/applicant is seeking a license submit to the performance of a criminal history background check. The cost for the criminal history background check, including all costs of administering and processing the check, shall be borne by the applicant.
- Insurance.
(i) Each applicant for a Taxi/Autocab Owner's License shall, together with the application, submit the insurance policy required by N.J.S.A. 48:16-3 et seq. and any amendments or supplements thereto. Specifically, the owner shall file with the Township Clerk an insurance policy issued by an insurance company licensed to transact business in the State of New Jersey providing for not less than $1.5 million to satisfy all claims for damages, by reason of bodily injury to, or the death of, any person or persons, resulting from, or on account of, an accident, by reason of the ownership, operation, maintenance, or use of such taxi/autocab upon any Township street, and to satisfy any claim for damages to property of any person or persons, resulting from, or on account of, an accident, by reason of the ownership, operation, maintenance, or use of such taxi/autocab upon any Township street.
(ii) If an owner/applicant operates more than one taxi/autocab, the owner/applicant may file, in lieu of the insurance policy required by subsection (i) above and by N.J.S.A. 48:16-3, a bond or insurance policy of a company licensed to transact business in the State of New Jersey in the sum of $50,000 which shall be a blanket insurance covering all taxis/autocabs operated by such owner/applicant which shall provide for the payment of any final judgment recovered by any person on account of the ownership, maintenance and use of any such taxis/autocabs or any fault in respect thereto, and shall be for the benefit of every person suffering loss, damage or injury as aforesaid.
(iii) If an owner/applicant has his principal place of business in another municipality, the owner/applicant must file with the Township Clerk the certificate of compliance issued pursuant to N.J.S.A. 48:16-7 by the Clerk of the municipality where the owner/applicant has his principal place of business. - Power of Attorney.
(i) An owner/applicant must execute and deliver to the Township Clerk concurrently with the filing of the insurance policy or bond referred to subsection 4 above, a power of attorney wherein and whereby the owner/applicant shall appoint the Township Chief Financial Officer his true and lawful attorney for the purpose of acknowledging service of any process out of a court of competent jurisdiction to be served against the insured by virtue of the indemnity granted under the insurance policy or bond filed.
c. Requirements for Taxi/Autocab Driver's License. Each applicant for a Taxi/Autocab Driver's License must meet the following requirements:
1. Be of the age of twenty-one (21) years, or over.
2. Possess and submit a photograph of a valid, unexpired New Jersey driver's license.
3. Fully complete an application form provided by the Township Clerk, which shall be signed and sworn to or certified by the applicant and filed with the Township Clerk as a permanent record.
4. The applicant shall submit to the performance of a criminal history background check. The cost for the criminal history background check, including all costs of administering and processing the check, shall be borne by the applicant.
5. The applicant shall be required to apply to the New Jersey Motor Vehicle Commission for a certified driver history abstract which shall be forwarded to the Township Clerk at the cost and expense of the applicant.
Sec. 46-5. - Issuance of license
a. Upon notification by the Township Clerk of satisfactory fulfillment of the foregoing requirements, the Township Council shall either grant or deny the license application, unless the governing body returns or holds over the application for further investigation.
b. Any license issued pursuant to this Section shall expire at midnight of the thirty-first (31s1) day of December of the year in which it was issued.
c. Licenses may not be transferred without prior written approval of the Township after new drivers and owners have satisfied all requirements of this Article. If a license is issued to a copartnership, association, corporation or joint stock company, the sale or assignment of 10 percent or more of the interest in the copartnership, association, corporation or joint stock company is considered a license transfer.
Sec. 46-6. - Fees
The fees for Taxi/Autocab Owner’s License and Taxi/Autocab Driver’s License shall be in accordance with the Fee Schedule in Appendix A of these Revised Ordinances.
Sec. 46-7. - Denial, revocation or suspension of licenses
a. After written notice of the action to be taken and the opportunity to be heard at a hearing, the Township Council may, in their discretion, refuse to issue or renew, or to revoke or suspend, any Taxi/Autocab Driver's and/or Owner's License issued hereunder if the applicant or licensee:
- Has not complied fully with all of the requirements of this Ordinance.
- If the taxi/autocab licensed, or to be licensed, has unsafe or unsanitary conditions, or is otherwise dangerous to the safety or health of the occupants or others.
- If the policy of insurance or bond required by N.J.S.A. 48:16-3 and 48-16-4 and Section 46-4.b.4. of this Article lapses, or such coverage is not maintained at all times.
- If the power of attorney required by N.J.S.A. 48:16-5 is not maintained on file with the Township Clerk.
- Has in any degree contributed to any injury to any person, or damage to property, arising out of reckless operation of a motor vehicle pursuant to N.J.S.A. 39:4-96
b. In addition to the above, a person shall be disqualified from operating or driving a taxi/autocab if a criminal history background check as required by N.J.S.A. 48:16-3 and this Article reveals a record of conviction of any of the following crimes:
- In New Jersey or elsewhere any crime as follows: aggravated assault, arson, burglary, escape, extortion, homicide, kidnapping, robbery, aggravated sexual assault, sexual assault or endangering the welfare of a child pursuant to N.J.S.A. 2C:24-4, whether or not armed with or having in his possession any weapon enumerated in subsection r. of N.J.S.A. 2C:39-l, a crime pursuant to the provisions of N.J.S.A. 2C:39-3, N.J.S.A. 2C:39-4, or N.J.S.A. 2C:39-9, or other than a disorderly persons or petty disorderly persons offense for the unlawful use, possession or sale of a controlled dangerous substance as defined in N.J.S.A. 2C:35-2.
- In any other state, territory, commonwealth, or other jurisdiction of the United States, or any country in the world, as a result of a conviction in a court of competent jurisdiction, a crime which in that other jurisdiction or country is comparable to one of the crimes enumerated in Subsection 1 above.
- If a person who has been convicted of one of the crimes enumerated in paragraphs 1. and 2. of this subsection can produce a certificate of rehabilitation issued pursuant to N.J.S.A. 2A:168A-8 or, if the criminal offense occurred outside New Jersey, an equivalent certificate from the jurisdiction where the criminal offense occurred, the criminal offense shall not disqualify the applicant from operating or driving a taxi/autocab.
Sec. 46-8. - Display of license and certificate of compliance
a. No taxi/autocab shall be operated in the Township unless the Taxi/Autocab Driver's License (including photograph identification) of the person operating the taxi/autocab is prominently displayed and open to view of passengers within the taxi/autocab.
b. The Certificate of Compliance required by N.J.S.A. 48:16-6 shall be posted in a conspicuous place within the taxi/autocab.
Sec. 46-9. - Restrictions on operation of taxi/autocabs
a. No Cruising. No person shall cruise the streets of the Township in any vehicle, including but not limited to taxi/autocabs, at any time for the purpose of soliciting for one or more persons for transportation for a fee or fare.
1. Pre-arranged Pickup. Any taxi/autocab may pick up passengers if the taxi/autocab owner or the owner's agent has been specifically called by the person seeking transportation or someone acting on said persons behalf or such person has otherwise arranged in advance for pick up at a specific time and place.
b. All persons shall be picked up or discharged at the curb, or in off-street areas designated by business establishments for the use of their patrons, and the taxi/autocab shall at no time interfere with traffic on any roadway.
Nothing herein shall preclude commercial establishments from designating pick up areas in parking lots.
Sec. 46-10. - Fines and penalties
a. Any person who violates any of the provisions of this Article shall be subject to the penalties established by Sec. 1-7 of the Revised Ordinances of the Township of Randolph.
b. Nothing herein shall preclude the prosecution of any violation under Title 48 and or Title 2C of the New Jersey Statutes nor restrain or prohibit the Township Council from suspending or revoking any license issued hereunder in accordance with the provisions of this Ordinance.
The fees applicable to taxicabs and taxicab drivers set forth in the Licenses Section of Appendix A, Fee Schedule, of Revised Ordinances of the Township of Randolph are hereby deleted in their entirety and replaced by the following:
Taxi/Autocab Owner's License $50.00 per vehicle
Taxi/Autocab Driver's License $50.00*
*If a person applies for both a Taxi/Autocab Owner’s License and a Taxi/Autocab Driver’s License, the additional $50.00 fee for the Taxi/Autocab Driver’s License shall be waived if the Taxi/Autocab Owner is also the designated driver of the particular licensed taxi/autocab.
All Ordinances of the Township of Randolph which are inconsistent with the provisions of this Ordinance are hereby repealed as to the extent of such inconsistency.
If any section, subsection, clause, or phrase of this Ordinance is for any reason held to be unconstitutional or invalid by any Court of competent jurisdiction, such decision shall not affect the remaining portions of this Ordinance.
This Ordinance shall take effect as provided by law.

Ordinance No. 31-25
Notice is hereby given that an Ordinance entitled "An Ordinance Amending Chapter 46, Taxicabs, and Appendix A, Fee Schedule, of the Revised Ordinances of the Township of Randolph" was submitted in writing at a regular meeting of the Mayor and Council of the Township of Randolph, County of Morris, State of New Jersey, held on November 25, 2025 and was introduced, read by title and passed on first reading. A Statement of Purpose of the Ordinance is contained below. The Governing Body of the Township of Randolph will further consider the Ordinance for second reading and final passage thereof at their regular meeting to be held on December 18, 2025 at 6 p.m. prevailing time, at the Municipal Building, 502 Millbrook Avenue, Randolph, New Jersey 07869, at which time and place a public hearing will be heard thereon by the Governing Body and all parties in interest and citizens shall have an opportunity to be heard concerning said Ordinance.
Statement of Purpose of Ordinance
The purpose of the above Ordinance is to amend Chapter 46, Taxicabs, of the Revised Ordinances of the Township of Randolph to be consistent with current statutory provisions governing taxicabs. In addition, the purpose of the above Ordinance is to amend Appendix A, Fee Schedule, of the Revised Ordinances of the Township of Randolph, to update the fees for Taxi/Autocab Owner’s Licenses and Taxi/Autocab Driver’s Licenses.
